Complaint: I used to own a property with my ex-girlfriend. When we split, I quit claim deeded off the property so she could refinance the loan out of my name and solely into hers. Instead of refinancing, she modified the loan without my knowledge. The lender acknowledges that I was and am not an owner of the property and never signed loan documents for the modification but refuses to remove the modification from my credit report. This is severely negatively impacting my credit and I had no knowledge that the loan was modified in my name. I was able to obtain a copy of the deed and it even states that the borrower ( my ex-girlfriend ) claims that there was no change in ownership of the property since the original loan, but there was a change, as I was removed from being an owner. Also, it is my understanding that it is illegal to place a loan in someone 's name or modify a loan without the knowledge and consent of the person whose credit is being affected by the event.

I have requested the assistance of an attorney office to help investigate some issues with my mortgage, I do not believe I have signed some of the documents they claim to have due to the dates they are claiming, since I have never received a copy of my closing documents at time of closing I had mad a formal request of all documents in order to make sure my loan is correct.
since XX/XX/XXXX the original bank " XXXX XXXX '' refuse to give me my copies of my mortgage, my X husband has been in charge of making the payments and controlling the flow of information coming from the bank, since the change of lenders I had found out because people came to the house and told me the loan was behind, but no one has been able to help us at the bank.
the attorney was the only person able to get the account number from the SPS but has still not sent in our proof of documents.

Complaint: We are currently going through a short sale on our home with a company called XXXX XXXX XXXX XXXX XXXX, we have been going through this with them for well over 8 months. They represent a company called Midland mortgage and they have been delaying the process over and over, we have a buyer for the home willing and ready to purchase and XXXX just keeps delaying the process. They have asked for the same information on numerous occasions ( which I have kept all documentation ), but when we call them we can never get the contact person they have assigned us so therefore we are thrown into a pool of people in which we never get the same person so they read through the notes only to tell us, we have all the information we need it is sitting with the under writer. Then it ends up needing a new appraisal because XXXX has caused it to be out dated. We have had numerous appraisals as well. I can not explain the frustration and anxiety that this has caused but would like to see a resolution.

Complaint: My loan to value % is under 78 %. I have called my mortgage servicer several times about the automatic termination of PMI. They refuse to remove it, and only reference the 80 % threshold which is a different issue, and request for me to pay for an appraisal and use those values. After several phone calls I submitted a letter on XX/XX/2017 with us codes attached. I received an email stating they were received, and I have all that information.
I called them again and spoke to a representative, they still would only discuss the 80 % threshold and acted as if the 78 % law did not exist.
Homeowners Protection act states in code 4901 ( 18 ) The term " termination date '' means -- ( A ) with respect to a fixed rate mortgage, the date on which the principal balance of the mortgage, based solely on the initial amortization schedule for that mortgage, and irrespective of the outstanding balance for that mortgage on that date, is first scheduled to reach 78 percent of the original value of the property securing the loan.
So an appraisal is not needed.

Complaint: My complaint is that, I have been working with SPS for over a year on a short sale, as of XX/XX/2017 the first lien holder has agreed to an amount of XXXX to move forward with the short sale, the second lien holder is asking for XXXX this is a XXXX approved loan and should be accepted by SPS, both institutions have give me dates to have the short sale closed on, I have been waiting for a approval since XXXX XXXX.
with out having a negotiator to follow thru with this request, when i call i just get a person in the ombudsman Dept. updating me with no answer yet!! this need someones attention, for this matter is time sensitive.

Complaint: I have filed bankruptcy that was discharged in XX/XX/XXXX. I am behind on my mortgage, and trying to catch up with payments. I called them on XX/XX/XXXX to make a phone payment, and was told that the mortgage was referred to a lawyer for foreclosure. According to customer service, it was referred on XX/XX/XXXX. Almost a month later, and i have received nothing from them indicating it was referred to a lawyer for foreclosure. Since filing bankruptcy, I am not legally financially responsible to pay the mortgage. I called to make a payment because I am still living in the house. They would n't let me make a payment because of the lawyer referral. They said that they could only let me make a payment if it is for the entire amount due. I asked the man on the phone what that amount is. He said around {$13000.00}. He was n't sure of the amount. If I would n't have called them, I would not even know that the house is soon going into foreclosure. My complaint is that they did n't notify me that the referral was made. I would have called sooner to make a payment. When I called last week, I was going to make three payments. They wo n't let me. There is no way that I can make a {$13000.00} payment at one time. I am assuming that since they ca n't legally make me pay the mortgage, that is why I have n't gotten anything from any lawyers, or courts, but I still should have gotten notified by the mortgage company. They have also raised my mortgage payment to over {$1900.00} per month. They are trying to force me out of the house. I have lived here for XXXX, and am now divorced. I have no where else to go at this time, as my ex-husband ruined my credit, and due to issues with my marriage, I had to file bankruptcy. I guess I 'll have to live in my car. This mortgage company continues to claim to help people, but they have n't done anything for me. It is not fair if this house goes to sheriff sale, and I was n't even aware of what was happening. Contrary to what they will say, I DID NOT receive any letter from them about going into foreclosure.
