Complaint: In XX/XX/2017, I applied for a loan modification with XXXX which was my lender, all required documentations was submitted, as well as the trial payment that they required were sent and collected by them, on XX/XX/2017 I received a phone call from XXXX saying " Congratulations! we have received the trial payments and all documentations is already completed, you should be receiving the modification agreement next week, do not sent any mortgage payments until you receive the modification agreement reflecting your new mortgage payment, you need to sign them and send them back '' ; at the same time of all this process I received a letter from XXXX saying that my loan was sold to a new lender Select Portfolio Services, and they will honored any previous modification agreement already approved. Until now I have n't received my modification agreement, I have been calling back and forward to both companies XXXX and SPS, and they just keep saying that I need to keep waiting. It is taking to long and I am calling every week with the same answer. I do not want to lose my house and I can afford the high payment. Please help.

Complaint: I applied for a loan modification on an adjustable rate mortgage in XX/XX/XXXX due to getting injured on my job and having a curtailment of income. I 've been compliant to the all of the request made by SPS and I 've received seven letters stating that all of the documents have been received and are perfected and that SPS will send the file to an underwriter for review. The underwriters are n't reviewing the documents that are being sent and requesting the same documents again. On XX/XX/XXXX SPS requested clarification on paycheck stubs to determine if I get paid every two weeks or twice a month ( Hence, 24x a year or 26x a year ). A letter explaining that the pay period is every two weeks was sent on XX/XX/XXXX. Upon calling SPS on XX/XX/XXXX, I was told that they received clarification and all the documents were in to continue the review. On XX/XX/XXXX I called SPS for a status update and they informed me that they needed a letter regarding clarification of the frequency of pay. I advised that I already sent that letter and they told me that they just wanted a verbal explanation. I verbally told them that the frequency of pay was every 2 weeks. On XX/XX/XXXX, I called SPS and they explained that all docs are in and nothing else is needed to continue the review. On XX/XX/XXXX I called SPS for a status update and they advised they needed clarification of the frequency of paystubs. I explained to them that we already verbally told them and wrote a letter. SPS said " O.K. '' and continued the review. On XX/XX/XXXX, they advised me that they just received internal clarification on XXXX that the frequency of paystubs is every 2 weeks. However, they needed more bank statements to verify the frequency of pay. This tactic has been going on since the inception of the loan modification process began. The single point of contact XXXX XXXX never answers or calls me back and I speak to different reps every time I call in that ask for the same documents that we sent in and verified that SPS received them. SPS single point of contact and underwriting team are not reviewing the documents that we send in.

Complaint: We completed a trial modification in XX/XX/XXXX that we were offered through XXXX. XXXX took 90 days to finalize the modification and then changed the terms of what we were offered in the trial. We were offered a Home Affordable modification. XXXX sent a letter stating that they offered that incorrectly and offered an in house modification. We submitted 2 more payments in addition to the 3 trial payments in XXXX and XXXX. XXXX sent us permanent modification documents and requested we return them by XX/XX/XXXX and the first payment would be made on XX/XX/XXXX. We returned the paperwork and made the XXXX payment. We are waiting for XXXX to finalize the modification. We requested principal forgiveness because the house is not worth the amount of money. Wells Fargo is the noteholder and is refusing to honor principal or interest forgiveness. XXXX did 3 different appraisals. In XX/XX/XXXX, the house was appraised at {$440000.00}. In XXXX they appraised the house at {$740000.00}. The house could not have gone up {$300000.00} in 6 months. We received a notice that there is a status hearing on XX/XX/XXXX at XXXX. We have submitted all this paperwork to the court. Now we may have to have the additional expense of hiring a lawyer.

Complaint: Dear Sir or Madam : After review of the financial information that SPS has provided to me it appears that SPS was dually tracking my residential mortgage loan while I was working on a loan modification and reviewing their offer for a repayment plan. Not only did they dual track me but they also harmed me financially as they charged the expenses of {$1100.00} to my account. This is a direct violation of the California Homeowner Bill of Rights, Consumer Financial Protection Bureau, RESPA and Truth in Lending statues and laws. On XXXX XXXX, XXXX, I submitted a home affordable loan modification application to SPS both via facsimile and email. I experienced a material change in financial circumstances and submitted that change to my " mortgage servicer ''. I never received an acknowledgment of that application nor did I receive any outcome. However, on XXXX XXXX, XXXX SPS charged {$760.00} to my account, paid to XXXX XXXX XXXX XXXX and noted my account with Foreclosure Attorney. On XXXX XXXX, XXXX SPS sent me a letter offering a repayment plan. I did not agree with that plan and filed an appeal. SPS gave me until XXXX XXXX, XXXX to respond to their offer. However, SPS ordered and charged to my account a Foreclosure Broker Price Opinion in the amount {$89.00} and on XXXX XXXX, XXXX they charged to my account {$280.00} paid to The XXXX and noted on my account Foreclosure Attorney. These were outright illegal lending practices as SPS positioned themselves to foreclose and take my property while in direct violation of the law. I am requesting that your office conduct an industry standard investigation into my allegations. Please apply all penalties and sanctions as applicable to State and Federal Law to discontinue this behavior as it clearly demonstrates a pattern and practice of non-compliance, as well as malicious intent. Complaint: I filed a chapter XXXX, XX/XX/2016, I applied for a Deed in lieu with Select Portfolio Servicing and was approved by them gather all my information and submit it via Fax, and Email, received confirmations that all information was received, 4months go by I heard nothing then out of blue the last two weeks of XX/XX/XXXX they stated that they do n't have copy of my satisfaction of mortgage, I submitted the information via email, email confirmation stated that received, then 30 days later I called back for up date, they stated that it was not recorded correct, I then called my county courthouse and spoke to the records department and they stated that it was recorded right and there is no lean on the property!! After I called SPS back the same day, now it 's a mistake and they need a copy of my divorce decree, I was mad because that was sent in the beginning, I purchased the home in XX/XX/2006, and got divorce in XX/XX/2008, it states on the decree that I am the owner of the property and other findings, as well. They keep giving me the run around and the sad part is I was the one calling and follow up!! I called the ombudsmen department and XXXX, from the department stated that the underwriting department has n't touched my account since XX/XX/2016. I called my relationship manager XXXX and asked her why she lied and told me that the underwriting department was still looking at it and that the ombudsmen department said it was not looked at since XX/XX/XXXX. She had no explanation for thRee and that it would be submitted urgent need!! I am so tired of this process and prolonged the process they are unprofessional and liars they deceive their customers!!! Complaint: Pursuant to the California Revenue and Taxation Code the California Franchise Tax Board on XX/XX/XXXX, forfeited all powers, rights and privileges from a mortgage banker known as XXXX. XXXX is identified as a Foreign Corporation with the California Secretary of State with a corporation file number XXXX whose address was XXXX, XXXX, CA XXXX with XXXX as Chief Executive Officer, Secretary, and Chief Financial Officer. The California Revenue and Taxation Code states that when a foreign corporation has its powers, rights and privileges forfeited that " any contracts entered into during the forfeiture are voidable at the request of any party to the contract other than the suspended or forfeited corporation. Such contracts will remain voidable and unenforceable unless the corporation applies for relief from contract voidability and the Franchise Tax Board grants relief. '' See Cal. Rev. & Tax. Code 23304.1. Additionally there are tax fines by the California Franchise Tax Board for entities that violate their forfeiture status. XXXX remains out of business today per the Secretary of State of California and no transfers or mergers have occurred. XXXX, entered into a contract with me in California AFTER the XX/XX/XXXX date for XXXX residential home loan contracts which consisted of Deeds of Trusts and promissory notes. All three residential home loan contracts which consist of Deeds of Trusts and promissory notes at my request as the law provides have been voided. No foreclosure sale can take place by XXXX because the contract ( Deed of Trusts ) are voidable and unenforceable as the California law states. The problem today is that Select Portfolio Servicing , Inc. and XXXX are debt collectors and both companies are conspiring and attempting aggressively and illegally foreclose on my home with a sale date of XX/XX/XXXX. Both claim that they have the right to do that from XXXX and they reference a voided and unenforceable Deed of Trust that was recorded with the XXXX County Recorder AFTER the XX/XX/XXXX date that XXXX as Mortgage Banker and Lender was not allowed to do business in California. Select Portfolio Servicing Corporation started harassing me in XX/XX/XXXX and XXXX in XX/XX/XXXX. XXXX has recorded a Substitution of Trustee document and a Notice of Default and Trustee Sale without my permission, without proper verification and validation of debt, and they are placing themselves into a voided and unenforceable contract that they have no standing or right to be in. I have written both debt collectors and told them in witing to Cease and Desist the foreclosure action and both companies ignore my written letters and documentation of the voided and unenforceable contract. I have also filed a Police Report for Identity Theft against both debt collectors because I did not provide these companies with any of my financial and personal information and they have created an account in my name and without my permission. Complaint: I was in the remodification process with my previous mortgage company, XXXX. My loan was sold to SPS. I was not aware of this until I recieved a letter nearly 6 weeks after the purchase. As soon as I was aware, I reached out to SPS to let them know I was in the remodification process with XXXX, and to see how I could proceed. They told me that they would continue to process, and that the could use the information and forms from XXXX. That was the case until late XX/XX/XXXX, when they told me that I would have to start the process all over, using their documents and paperwork. I got started on this in XX/XX/XXXX, knowing that there was a sale date for my property soon. It had been a long time since I started the remodifciaiton process. The original housing agency I was working with ended up closing, which forced me to do this on my own with XXXX. SPS said to get my packet in before the XX/XX/XXXX, and they could postpone/stop the sale until my remodification packet was reviewed. Even if it was n't correct or if they needed additional information, they could get that later, but that it was most important to get it in. I did, and spoke to someone at SPS on XX/XX/XXXX who told me that paperwork was sent to the attorneys to postpone the sale. Since XX/XX/XXXX I spoke to SPS on several occasions as they needed different paperwork and documents. On XX/XX/XXXX I received a letter via mail that my property had been sold on XX/XX/XXXX. This was baffling to me because I was told the sale had been postponed, and because I had spoke to SPS multiple times since then. On XX/XX/XXXX I spent the entire day talking to SPS, HUD, my Housing Agency ( Transitions ). On XX/XX/XXXX, my final call with SPS, I was told they were putting in an escalation to have the sale resended, as it should not have been sold, and because my remodification was still under review. Additionally I was informed that XXXX sold it, and bought it, so it was still with SPS. I was advised to call every few days to check for updates, which I did. I was originally told that it would take 10-14 days for and update or action. On XX/XX/XXXX I was told that it would actually take 4-6 weeks. When I called on XX/XX/XXXX it was as if the escalation never took place. SPS told me the escalation to resend could not move forward without HUD 's approval. HUD made clear this was an issue with SPS and they could and should resend it and allow the remodification to be reviewed. Both HUD and my Housing Agency suggested I contact you, the attorney general, and an attorney as they felt like SPS had n't gone through the correct process, and had not communicated with me, and sent me around in circle. Additionally, SPS has NEVER, EVER reached out to me. I have never, ever spoken with my assigned relationship manager. They only communication I have had with SPS is when I call them, even though I have made perfectly clear that my number is and independent, private number where they can leave a message. SPS has never reached out to me. And, I get conflicting information every time I called.
