Complaint: This is in regards to claim number # XXXX for your site would not let me enter my dispute. Per the attached letter dated XX/XX/XXXX, states the modification offered on XX/XX/XXXX w/payments in the amount of {$1100.00} to be honored. When in fact per the docs I uploaded previously, I was approved for a trial modification starting XX/XX/XXXX for {$1100.00}. SPS has the wrong date and amount which draws concern. In addition, they provide a XXXX tracking # along with stating that it was left by my front door. This draws even a greater concern that docs of such importance were sent with the instructions to be left at my front door, which could have been taken or blown away. Why is it acceptable for my final modification which is time sensitive. This goes right along with all the other additional mail SPS claims they sent, in which I never received. It is upon poor judgment that these docs were sent. Therefore, SPS clearly expressed that they have no knowledge or record of me receiving several documents from them, but received all documents that were required by me for I sent them via XXXX with signature being required for I knew I needed verification they received such. To send my final modification in such a manner only leaves me with the impression that SPS hopes I do n't receive it. Any and all formal documents should always be sent with a returned receipt. I can not be held responsible nor should I be penalized for not receiving something XXXX says they left at my front door. XXXX/XXXX have been notorious for logging deliveries in which were never delivered. In addition, I know that both offer a service that if no one is home to sign they leave a notification on your door to either come back or you can pick up from a sub station. I have expressed on numerous occasions with SPS that if documents are being mailed other than USPS than they should be sent to my work address so that I can obtain them or sign for them as needed : Once again the address for overnight, priority or certified mail should be sent to XXXX c/o XXXX, XXXX # XXXX, XXXX, NV XXXX. To continue with additional issues I have never stated that SPS is to cease verbal communication with me and I always request when I call in or agree to the conversation being recorded. Again, here is another act of SPS trying to deflect blame on the homeowner. Now because the final modification was n't signed/returned in a timely manner they are unable to honor the modification but yet will offer me a new trial modification for {$1.00}, XXXX or offer me an alternative option if I can not afford. This is a bait and switch. The modification program in which I went through loss mitigation and spoke with SPS attorney 's not once but twice and my approved amount was based on my monthly income in which as of today remains the same. Based on the all the records SPS determined I could afford the {$1.00}, XXXX therefore {$1700.00} is setting me up to fail. SPS needs to send the final modification to my work address so that I am guaranteed to receive it. Finally, if payments where to begin on my final modification XXXX/XXXX/XXXX, why is it that I continued to pay {$1100.00} which was not returned but the bank applied. It was n't until XX/XX/XXXX when I called in for a status of my final modification was I informed that I never returned the final modification which resulted in SPS returning the XXXX 's payment. Question, if I would have never called in for a status its likely that my payment would still be to this day being applied. These are malicious acts upon SPS and I have complied with all required of me so why would I have jumped through all these hoops and get to the final stage and ignore it? I would n't, and my continue payments are proof of that. I 'm sure SPS would not except if I said well I have a tracking # that XXXX delivered a payoff check.

Complaint: XXXX years I 've been in my house, always paid mortgage on time. Few yrs back got caught up in the remortgage scam and now I 'm under water ca n't get help anywhere. Back in XX/XX/XXXX I applied for a loan modification, the one currently in place was expiring in XX/XX/XXXX. It is now XX/XX/XXXX and they have been stringing me along all this time so that my mortgage payment can go back up to the higher amount. I have done everything they 've asked of me several times just for them to come back 3 weeks later and tell me they need some thing else. The something else is always the same thing I have been sending since XX/XX/XXXX. I have a XXXX % rate, a single person working XXXX jobs to try and stay in my home and they are giving me the business. The company that started this was XXXX financial co. They sold my mortgage to a new company called sps Select Portfolio Sevicing, inc. They bite the big one. I have sent them so much that whenever b I call it takes them forever to go threw it for them to tell me they have everything b they need. Then 2 to 3 b weeks later they send me a letter telling me they need something else. This has been going on since XX/XX/XXXX. Now the higher amount is in play, I refuse to pay it.

Complaint: I 'm XXXX ... .after 3 years of fight ... I am left full of XXXX and XXXX regarding my home I worked so hard for. In XX/XX/XXXX I was approved with XXXX for a loan mod. I was very pleased with this mod as it was affordable. I paid 3 trial payments to XXXX and I was on track to a promising future with my home. THEN THE TROUBLE SET IN. My file was sent to SPS servicing following me making my 3 trial offer payments. As soon as I found out my file transferred lenders I called SPS to make a payment and they said I was not approved for my mod and that I would have to start the process ALL OVER AGAIN! I was FLOORED!!! I tried to contact management, I called profusely everyday to see what I could do to preserve my fully approved mod with XXXX ... .and nothing ... I got the ultimate run around. I have been calling, faxing, emailing, mailing letters to SPS pleading my case and my pleas have all gone unanswered. I have spoke with Manager after Manager, customer service reps and non of them were able to assist, I finally was able to speak with a rep who forwarded me to Onbudsman department and they reviewed the case, but they do not want to honor the mod because they stated too much time has passed. In my mind it was only yesterday the mod was approved. After my investigation I found that SPS had sent the final mod documents to the wrong address. They failed to type the suite number and therefore I was not able to receive the modification documents on time. I never had the opportunity to sign my docs and my heart, my mind and my soul knows I was wronged. Had I been given the chance and the opportunity to sign I would have. I paid the 3 trial epayments happily and was so excited about the mod and my new life. You see, I was in the process of divorce. I was starting life over and on my own I could afford the XXXX payment. I was moving forward and not looking back. I had XXXX kids and could raise my family in this home and afford it. I can not explain to you the relief I had after receiving my approval. Since working with SPS I have been nothing but XXXX to the max. I have gained XXXX my life is full of XXXX and I feel XXXX. I have called upon resource after resource, I have written extensive letters to SPS I am at my wits end. ... I went through a Financial Literacy training at my church. We had a lady come in from the CFPB. She provided us a book that says TRAIN THE TRAINER. I took that course and in the book I found your information. Shortly after I took the course XXXX came for a visit to XXXX where he was called upon by XXXX and XXXX. XXXX stated that if we needed anything to call his office. We even took pictures with XXXX while he was here. I XXXX that my case reaches you in enough time. I have been wronged and I know it. I have been fighting for 3 years now and I did not know of the CFPB until you came to my church. I thank the XXXX for bringing your organization into our church and into my life. Please contact SPS and ask them for the records where I have been calling them for the past 3 years. I have gotten no where ... but I hope you can get the records from them. You will see I have been relentless in contacting them. Please help ....

Complaint: I am set up on Automatic Loan payments to be drafted each month from my checking account. My due date is the XXXX of every month. After asking why they charged a fee to make on-time payments on-line, I was told I could make the pmts for free if I sign up for XXXX online & can choose the option to have the funds deducted exactly 16 days after my due date, which is my grace period for no late charges. I chose this option because it best coincided with my pay dates. However, on XX/XX/XXXX and again on XX/XX/XXXX, the monthly pmt was taken early. In XXXX, it was deducted on the XXXX when it should have come out on the XXXX ( 16 days after my XXXX due date ). In XXXX, it should have been drafted on XX/XX/XXXX yet it came out on XX/XX/XXXX. After this happened the XXXX time in XXXX, I faxed over proof the funds were taken along with a faxed request for resolution and nobody called me back to explain why this occurred. On both occasions, I was left on hold several times, transferred to different depts., including their " Cashier dept. ", yet nobody could explain why it happened. After the XXXX time it happened in XXXX, the team member I spoke with ( XXXX ) at first tried to tell me this occurred because XXXX is a XXXX month, which seemed irrelevant & should not affect the XXXX calendar days from your due date. I was finally transferred to Supervisor XXXX XXXX ( ext XXXX ) on XX/XX/XXXX who opened a research request and promised to call me back. I rec 'd a vml from XXXX the following Monday XX/XX/XXXX, however, I could not get thru to her directly & was stuck explaining the situation AGAIN to someone else on the XXXX who also said they 'd research & get back to me. As of Wed XX/XX/XXXX, I still have not heard back.

I have been notified by a company called Select Portfolio Servicing in the state of Utah and their counsel XXXX at XXXX law firm in XXXX California that through XXXX in XXXX California the auction holder that they have the intention to conduct a trustee sale on XX/XX/XXXX. At the North front entrance County Courthouse at XXXX XXXX California. Although not identified on the notice of sale put on my door the the note was authored my XXXX XXXX conveyed to XXXX then conveyed to a private trust XXXX as trustee for the certificate holders of XXXX and select Portfolio servicing. # 1. The Federal Court in XXXX XXXX found this note of many infractions in Federal Law and illegal lending practices. Reference XXXX XXXX XXXX Lead case # XXXX and I have positive identification my note is included and foreclosure protection rights ordered. # 2. The Secretary of State of California and the Franchise Tax Board on the Department of corporations site XXXX and XXXX are in dissolved, surrender and forfeit status forbidden to do any business in California at any time and the latest most effective date is XX/XX/XXXX all deeds and contract rights voided as of that date forward. The note was authored and sold in California XX/XX/XXXX after later found out bait ans switch technique was operated I have both contracts and deeds # 3. I have pending litigation in the court and the parties all mentioned arranged the sale date previous to the courts attention to the matter and are knowingly perpetrating illegal practices. # 4. If you read and reference the Pooling and servicing agreement as posted on XXXX the Securities and Exchange site in the risks of the investment claim many consumer laws and State Laws are violated my the mortgages held under the trust. It in the risks outlines the stress test witch I know in my case lead to property theft also identity theft in the case of the first named servicer XXXX. Please assist I have written proof of all statements and aware I am under oath. XXXX State of California business : SPS has repeatedly by employees statements it 's not company policy, disavowed to any compliance to California consumer law namely civil code 336 a and the California Home Owners Bill of Rights and make no bones about no compliance with the Secretary of State office in California. In fact noncompliance with the Secretary of State has been repeat offender XXXX and XXXX and is still ongoing in the forfeit of rights of XXXX. This is the same group that senator XXXX brought to California Court and won a sizable settlement in XX/XX/XXXX 49 states settlement " never paid ''! as far as I know. XXXX, SPS Select Portfolio Servicing all hold California licencing and I have tried in modification over 20 times to resolve this problem it 's my home and very dear to me. The price asked for is {$560000.00} even though the loan in terms of California is illegal to operate in that fashion. Please be advised that the sale posting does not identify the trustees as usually done a disclaimer on final price and as far as seen the trustee is XXXX appointed on no secured interest. Please assist I do n't want to lose my home to people who have no rights in California.

Complaint: I applied for HAMP loan modification XX/XX/XXXX. As of XX/XX/XXXX, I still have no decision regarding the modification. In fact, my application is n't even considered complete, as they are once again requesting another new document. I have been very timely returning their requested info, but SPS keeps asking for new Docs. each of these new requests for documentation is to support other previously submitted documents which support the information I provided on my application. The different requests I believe are not informational, but rather a delaying tactic. More frustrating is the fact that I have been told half a dozen times that the underwriters have what they need to make a decision, only to have them request another more obscure document. Dealing with customer service reps has been troubling since it is a different representative every time, so I 've had to answer the same questions over again and again, months apart, and the information they often ask for was included on the initial application. I do not feel this company is operating honestly or competently.

Complaint: SPS servicing has been stalling my loan mod application since XXXX/16. They request documents they already have, they say there is an issue with them when they are 100 % accurate. In many cases I just resubmit the original document and that ends up being approved. The process repeats itself with all other requested documents and I have to wait 5 days for each XXXX to know if it 's been accepted. Once again, they received 100 % accurate information on XXXX/16 and all requests for updated info were not needed since they already had it all.

On XX/XX/XXXX, I received a letter from Select Portfolio Servicing notifying me of a loan servicing transfer to their company, Loan # XXXX, to be effective XX/XX/XXXX. I continued to work with Select Portfolio Servicing on the modification request and, today, XX/XX/XXXX, I called to check on the status and was asked to resubmit documents that I had submitted numerous times already. I simply can not believe that this process is intended to take a year to complete and I only hope that there is an outlet to investigate whether this is a fraudulent practice while my credit score continues to be demolished in the interim.

Complaint: Hi, I have received a approval on my short sale, after a year, there was a question on a line item on the Hud, on XX/XX/2017 i emailed the response and explained why the number was on the hud, the second lien holder did not no the loan was haffa approved, so knowing that they are asking for XXXX, I have a date given by SPS of XX/XX/XXXX to close, i was told 5to 7 days to get a answer, it is now XX/XX/XXXX, that was my first complaint, which brings me to this complaint, when i called on XX/XX/XXXX t, and spoke to XXXX he told me because I have sent a complaint to CFBP, that they have to answer that complaint it priority and they have 15 days to do so, i asked what happen to the 5 to 7 days after i sent the answer about the hud, that has been under review for 10 day already? he just kept repeating that the CFPB comes first and that is there priority to answer them, and the review dept i guess stops working, while the Ombusman Dept. answers the complaint. I was also told that in XXXX the {$12000.00} that could of been offered was cut in 1/2???? all I want to do is close on the property and all i need is confirmation, that they will pay the {$12000.00} to the 2nd lien holder.

Complaint: Dear Sir or madam : I received a permanent HAMP modification agreement for a residential mortgage from sps Select Portfolio Servicing inc., XXXX XXXX XXXX XXXX, XXXX XXXX XXXX, Utah, XXXX and completed my trial payments both timely and in full in XXXX. On XXXX/XXXX/XXXX I received the final modification agreement and on XXXX/XXXX/XXXX, I signed, dated, and notarized it, and I faxed and mailed it to SPS. I complied with the SPS requirement that SPS receive the modification as evidenced by the XXXX/XXXX/XXXX dated stamped copy of the first page of the modification. Since then I have continued to make my payments timely and in full. I also called SPS requently to check on the status of my modification approval, where I was told it was under review. At no time was I made aware that the modification agreement I submitted was in any way inadequate. I was shocked and dismayed to receive a XXXX/XXXX/XXXX Denial letter from SPS claiming that the modification was rejected for allegedly not returning the agreement by XXXX/XXXX/XXXX. There did seem to be an error made by the notary through no fault of my own and as soon as I was made aware of this, I immediately recent the agreement with the missing notary information. I have since been told by SPS on XXXX/XXXX/XXXX from speaking with XXXX XXXX of SPS that SPS now has the XXXX signed notarized and dated copies of the modification agreement that they require and that there was a good possibility that it would be approved. At no time prior to XXXX/XXXX/XXXX did SPS inform me that I needed to anything other than saying that the modification was under review. To be overly thorough, I have since faxed, overnight express mailed, and mailed postage pre-paid certified return receipt requested on XXXX/XXXX/XXXX yet another compliantly dated, signed, and notarized copy to SPS dated XXXX/XXXX/XXXX. In response to the SPS denial letter, I have a since written an appeal letter to SPS explaining and correcting any alleged deficiencies relative to this modication. At this time it is important to mention that SPS has accepted all of my forbearance payments of I believe {$2500.00} for the first XXXX trial period and now is accepting permanent loan modication payments in the amount of {$2500.00}. Also within the 30 day appeal time of the SPS XXXX/XXXX/XXXX denial of modification letter, I have even sent SPS yet another completely compliant signed, notarized, and XXXX/XXXX/XXXX dated copy of this modification agreement : faxed, express overnight mail XXXX sets of originals, and first class postage pre-paid, return receipt requested XXXX more sets of originals. In conclusion, this residential home mortgage modification account number ending in XXXX should be approved as the consumer has expended Herculean efforts to comply with the SPS requirements to meet approval. I have a son with special needs in the school district where we reside. I am a single Dad and both my son and I would be devasted if we were forced to move. Thank you XXXX XXXX
