Complaint: This is a follow-up to a complaint I made yesterday, # XXXX . A company called RoundPoint ha s been contacting me asking for money, claiming to be my mortgage servicer. Meanwhile, XXXX ( my actual mortgage servicer ) has confirmed multiple times that XXXX is the servicer. I have been making my payments to XXXX . After I filed complaint # XXXX yesterday, RoundPoint called me to respond to the complaint, claiming that I am still being serviced by RoundPoint and that they will send me paperwork to prove it. However, XXXX has sent me paperwork showing that they purchased servicing rights fr om RoundPoint effective XXXX XXXX , XXXX . I am writing again to include this letter from XXXX .

Complaint: This complaint is in regards to RoundPoint Mortgage Servicing Corp. of XXXX NC. My mortgage was transferred t o RoundPoint ser vicing. This was in XXXX 2017. I had ( an d have always ha d ) an escrow account for taxes and insurance. Upon receiving notification that my servicing had been transferred I called RP 's customer service to ensure that I did n't need to do anything to make sure my insurance was being paid. They confirmed that they had my XXXX policy and everything was good. I called twice, and both times was assured that it was fine. I then received a check from Roundpoint in the amount of approximately {$800.00} for " overfunding of my escrow account ''. I called again because this number is very close to the cost of my insurance premium. They told me ( 3rd time now ) that my account had been over funded and my insurance was still good. They even confirmed the policy number. About a month later I got another letter from Roindpoint stating that I needed to call the insurance dept. I called, and they told me that a mistake had been made and that not only had they not contacted my insurance broker to update the loss payee when they took over my mortgage but they also did n't pay it so my insurance had been cancelled! I could not believe it. I called my insurance broker at XXXX XXXX and they confirmed that Roundpoint had never reached out to them to update themselves as the lender and they had never remitted payment. So, unbeknownst to me, my home had been uninsured for the previous 45 days or so. On top of that, because the policy had been lapsed for over 30 days it was not able to be reinstated and had to be rewritten. In the meantime, XXXX had increased their premiums, so for the same coverage my policy went from $ XXXX /year to $ XXXX /year. Also, because of the lapse, my wife 's engagement ring ( which had always been a part of the coverage ) would need to be re-appraised. So not only did I lose my grandfathered premium, I incurred a 33 % increase in my premium ( which will now be every year ), I had to take a day off of work and drive 2 hou rs to where I got the ring to have it re-appraised so it could be back to the policy. I spoke with the supervisor ( XXXX ) at RoundPoint 's in surance dept who has agreed several times that this was 100 % their error, and no steps have been made to make it right. I have spent hours and hours on the phone with my insurance company and RP, coordinating the insurance policy being re-written, making sure it got paid, getting the ring re-appraised, getting that info over to them, all so I could pay over $ 400+/year extra because they did n't bother to make the call and get the insurance paid. I Also lost days of work and had to pay for another appraisal. And this is n't a one time thing, I will now have to pay this increased premium every year AND my mortgage payment has now been increased because the escrow account is now underfunded, because my increase in insurance. XXXX a t RP h as told me that it will be reviewed by management but I have been getting the same response for weeks now with no resolution or offers to make this right. I do n't believe that it is fair for me to have to cover all of these expenses because of ( admittedly ) so meone else 's oversight. I thank god that nothing happened to my home during the time that ( again, unbeknownst to m e ) I was un insured. Had there been a fire, or someone got hurt, or my wife lost our wedding right?? I did n't want to have to submit a complaint but I have given them several chances to make this right and feel I have been more than patient but this just is n't right. XXXX XXXX

Complaint: This is in response to reply # XXXX of which was a response to # XXXX . Thank you for quick responses and timely information that help me understand and get to the bottom of this. Let me please ask these questions - 1 ) Has XXXX XXXX XXXX been contacted on this raised concern of mine regarding the reporting of this loan? 2 ) Where is XXXX XXXX as he was my constant point of contact and always knew what was going on and how to direct me through what RPM and XXXX 's legal team were trying to do to avoid the confusion of what I came to experience anyway? My response is this first off- Why did n't you just send me this signed agreement to begin with at the start of this inquiry? It could have saved some time. Secondly, Per page XXXX of the attached document ; I understand that it says I should call if I needed to get the extension or further help. I did. I did not call the number indicated but I did call XXXX XXXX and he was handling this. Why did nobody ever call me or check in with me to see what help or direction I needed to go? XXXX would be able to substantiate this and I have emails that prove the communications with him. Suddenly, he quit replying to my emails. Why and where is the communication to me that gives me choices and options beyond the XXXX XXXX expiration date? Please understand also that as previously mentioned, every time I called in to speak with someone at RPM, I got directed all over the place and nobody ever knew what was going on or why I was in the loss mitigation status that I was in. This is why XXXX XXXX was my point of contact. Is n't it easy to see why I never did and still ca n't trust anything RPM has ever told me or DID N'T TELL ME? Even when I was assigned to representatives as I recall, ie. XXXX XXXX , XXXX XXXX , etc., I never could get answers. I never got call backs. I left messages all the time. In fact, I had to call and hound RPM over the XXXX status for months. I just got this a month ago in XXXX XXXX . Also, It is important to note that I moved in XXXX XXXX and had to keep reminding RPM that my address changed as I kept getting mail that was sent to the old address of XXXX XXXX XXXX XXXX . Who knows what mail I never got? Hopefully, you all understand that my experience in all of this was that the right hand was not with the left hand and maybe, just maybe nobody ever thought enough to do the right thing and help me understand my options by reaching out to me and educating me. I think we can all understand that this was not an everyday situation and in your position, I do n't think it fair to expect the average consumer or home owner to understand without communication, what to do or what options are available. I still contest that in keeping with reporting me as delinquent is NOT CORRECT reporting due to the circumstances. I 'm sorry but this is not because I refused to pay or could not pay. It is because the builder built a bad home. I was not the only victim thus, the joint litigation with XXXX . You have to know that if I understood you were to start reporting me for delinquency, why did someone not get with me and suggest a short sale on the home WAY BEFORE I SUGGESTED IT? I would like answers to these questions please and of course I still truly feel that I am not being reported correctly on this loan.

Complaint: Roundpoint paid my homeowners insurance IN ERROR. Only my principal/interest and taxes were getting escrowed. I tried calling many times and got different reps that all had different solutions. I paid the {$2500.00} back. They are now sending me a refund because I paid more than their INCORRECT escrow analysis statement and are raising my note {$150.00} a month. I can not get a direct line to any supervisor to get this problem corrected. I have been on hold for over 45 minutes waiting for a supervisor as I am writing this.

Complaint: I am having problems with my escrow account. The county overcharged for property taxes at the beginning of the year and Roundpoint paid the overage. As soon as I found out about the error in XX/XX/XXXX, I got a refund from the county and sent it to the mortgage company, which they added to the escrow account. The amount was the difference from which they would normally pay for my yearly taxes. Roundpoint then increased my payment by approx {$700.00} beginning in XX/XX/XXXX. I filed all the supporting documents and received email confirmation from them on XX/XX/XXXX. I was informed that it would take 30 days to investigate and correct the error. I called on XX/XX/XXXX to find out what the resolution was, and I was told that it was not done and to call back on the XX/XX/XXXX. I called back on the XX/XX/XXXX and was told they were not done and I was to call back the following day. I have called 4 times since then receiving assurances that emails were sent to escalate the case and I was even told that on XX/XX/XXXX that I would be receiving a call back from the supervisor, that never happened. I am constantly told by customer service that there is not a supervisor to talk to and that I have to wait for them to contact me.

Complaint: This is in rebuttal to previous complaint XXXX against RoundPoint Mortgage.
First off regarding the response I get back- There are six indiscretions already and two more if you count the ( not once but twice ) incorrect addresses by which you sent the certified letter. Is n't it easy to see why I have to raise the complaint to another level.
The one issue that raises the biggest concern is this- You service the loan for XXXX and in light of the unusual circumstances and legal issues surrounding this case, do n't you think it is deserving of this situation to inquire instead of blindly assume that XXXX would not want you to reflect accurate reporting of this loan. I quote - '' The investor of the loan did not request we stop reporting the account to the credit bureaus. As such, we reported the account to the credit bureaus. '' Hello? Someone pick up the phone or send an email to legal department, i.e.. XXXX XXXX and ask the question ... ..
If accurate reporting is the ultimate goal here, can you see why it is wrong to report me as delinquent for 180 days or more when 1 ) there seems to be no indication that XXXX was in the know on this and 2 ) I was n't in the know on this? Did I receive or can you show where I acknowledged by signature or any other legal means of proof that I was informed of this loan being reported as delinquent because I came out of a forbearance status? In fact, it was not a forbearance status at all. It seems this was just a category to drop this loan into when XXXX agreed to partner with me in litigation against the builder. Again, if accurate reporting is the goal here, BLOCK all months and accurately report what it truly was! This is not because I could not pay or would not pay! So ask yourself, does it reflect accurate reporting?
Lastly, why does it take 4-6 weeks to change what you have already admitted has been erroneous reporting?

Complaint: Dear RoundPoint Vice President XXXX, You stated in your previous letter that my deed in lieu of foreclosure was completed effective XX/XX/XXXX, and that the account " was due for all subsequent payments at that time ''. You go on to claim that you reported the correct information to the credit reporting agencies on XX/XX/XXXX, indicating the deed in lieu of foreclosure was effective XX/XX/XXXX. However, you further state that you did not update the changes to reflect the completed deed in lieu of foreclosure until XX/XX/XXXX. It is now XX/XX/XXXX and the changes do not reflect on my credit to indicate a " zero and/or settled '' balance. I want scanned documentation showing exactly what you reported to the credit reporting agencies, as well as the cited date of submission.
XXXX is the owner of the property ; they are the lienholder of the one and only loan on the property in question : XXXX, TN XXXX. They hired several companies to handle the loss mitigation process. XXXX transferred the process over to you with all documentation. XXXX, acting on behalf of XXXX, filed a XXXX " Cancellation of Debt '' where they cancelled and forgave all debt associated with the property. I filed this document on my XXXX IRS XXXX. I have the letter signed and dated by you, XXXX, Vice President of RoundPoint, indicating that the Deed in Lieu of Foreclosure filed with XXXX was completed and finalized.
First, I am not an attorney nor am I practicing law. However, I would direct your attention to XXXX ( XXXX ). The court, in their holding, said that the issuance of a XXXX reflects a creditors cancellation and forgiveness of debt. Thus, the creditor can not sue a debtor in an attempt to seek economic losses. Restated, XXXX filed my XXXX, at the behest of XXXX, prior to being submitted to RoundPoint, again, at XXXX 's direction. Moreover, your previous letter in response to my last complaint further reflects the outcome of the cancellation and forgiveness of the debt, along with my fourth signed Deed in Lieu of Foreclosure agreement with XXXX.
XXXX, Deputy Property Clerk of XXXX, and I called RoundPoint and we spoke with XXXX on XX/XX/XXXX. XXXX stated that XXXX is handling the case ; sent documentation to XXXX ( manager ), who will follow up w/ the " closing department. '' The issue in XXXX is that RoundPoint never filed a document showing that XXXX actually owns the property. The last document they show was filed XX/XX/XXXX ; filed by XXXX. ; this document, for some unknown reason, conveys the property back into my name, which at this point is beyond impossible.

Complaint: On multiple different occasions, Round Point Mortgage has been unable to handle my escrow account accordingly. First, once they obtained the loan, I was charged the same amount of money for city taxes as I was for my county taxes causing an additional $ XXXX yearly addition. After providing documentation multiple times over a matter of three months, it was finally rectified. During those three months, all of my emails and secured messages went unanswered. It took upward of ten calls to finally have someone look at it and give me a guarantee that it would be adjusted. Now, I have submitted new tax documentation from the county and the Veteran 's Affair 's Office showing that I am a XXXX veteran. My initial contact was at the end of XX/XX/XXXX and did not receive a response for ten days. Following that, I responded with the same said documents via email. I never heard anything back which prompted me to call them mid-XX/XX/XXXX. After speaking to a representative, he assured me my escrow analysis was be performed by XX/XX/2017. In addition to that, he made sure all of my documents were in order. XX/XX/XXXX comes and goes and there was still no update to my escrow payment nor an escrow analysis performed. I called in again since they never responded to my emails nor my secure messages through their website. I was told the documents I sent in were a blank check and a homestead exemption form. I sent neither of those documents in. Plus, the blank check was for a bank that I am not a member of. I, again, emailed the same documents to the email address provided. There has not been any sort of contact attempts to me to let me know that I either sent in right or wrong documents. My escrow account still has not had an analysis performed, but I was told it would be taken care of by XX/XX/2017.

Complaint: RoundPoint Mortgage/ loan # XXXX Acct # XXXX I am filing this complaint because I believe that RoundPoint Mortgage is reporting me incorrectly to the XXXX credit bureaus as being over 120 days delinquent for over XXXX years. This is very incorrect! I have been over this and over this with XXXX, XXXX, XXXX, XXXX ( attorney in legal department ), XXXX and XXXX while this was all going on. Once I learned they were reporting me for being delinquent in XX/XX/XXXX, I called and spoke with XXXX and XXXX so many times I ca n't remember. The answer was always the same, " let me report this to my legal department and supervisors and get it taken care of ''.
This account was bought from the original creditor XXXX where I had a good standing in the early part of the loan. The mortgage company was XXXX. RoundPoint serviced the loan for them after the aquisition. From the beginning, I had nothing but problems as the right hand was not with the left hand between XXXX and RoundPoint. Here is my story- Shortly after I moved into this new home that I built in XX/XX/XXXX, I started having problems with the foundation. Within a year, I had to move out because the movement of the foundation was so great, that it became unlivable. The builder and warranty company were not taking responsibility. They were sued by me. When I had to move out, the lender ( XXXX ) agree to put me in a loss mitigation status and actually pay for legal costs to sue the builder. XXXX put me in a forebearance/loss mitigation status while this was going on and they were paying the loan. I can tell you that the many times I called in to get information or update them with information, they could not find my file, or, it was in the hands of a new loan officer and they could not find information, or, I had to go over the information all over again, etc, etc. Finally, in XX/XX/XXXX, I decided to short sell the home and move on so that I could deal with the legal aspects on my own. This is when I learned that they had been reporting me negatively to the bureaus. I honestly do n't think they know what they are doing or if they do, they still do n't know what they are doing! This needs to be removed or corrected in the reporting procedures. I think it would be best to remove everything since I do n't think they know how to report it any other way. They sure did n't ever seem to know what was going on when it was right in front of them.

Complaint: Round Point Mortgage failed to calculate the appropriate escrow amount for last year 's tax bill, as a result I have stated they need to recalculate the amount I am charged on a monthly basis. This overestimation resulted in an approximate {$3500.00} refund from last year 's property taxes, which would be about {$290.00} reduction in escrow on a monthly basis. I have attempted to resolve the issue on 5 different phone calls ( all of which were unable to confirm the discussion through email to have a record of these conversations ), and over 3 secure messages. Their poor customer service has added no assurance that this matter is being taken seriously, and has me wishing that my XXXX mortgages that are currently with the organization had been sold to a more customer friendly and responsible mortgage service provider.

Complaint: Assignment of Mortgage From FHA to Conventional, MIP insurance was being paid the entire time, based on loan statements, the loan was in default, however the MIP insurance was being paid. Complaint: I purchased my home in XX/XX/XXXX. I refinanced my home in XX/XX/XXXX. At that time it was a streamline refinance. I had no closing cost. My home was sold to a lender which was round point mortgage in XX/XX/XXXX. In XX/XX/XXXX I received an escrow letter stating I owed around {$1600.00} in escrow because of my county and city taxes. I understood this because the total taxes were not refinanced into the mortgage because, the taxes were based on an empty lot. I sent a full amount and the mortgage was adjusted to include the amount. Now I receiving an escrow letter stating they want {$1000.00} for cushion in escrow or they will raise my mortgage again to reflect a cushion amount. Everything is being paid. And the escrow account is left to a {$0.00} balance. I feel since everything is paid there is no need for a cushion amount of {$1000.00}. And if they needed a cushion amount this should have been explain on the front end of the refinance or the year the escrow was short for the taxes owed and they adjusted the mortgage. Now I am looking at another {$100.00} in mortgage adjustment I can not afford or a full payment of {$1000.00} of cushion I can not afford. This almost feel like an adjustable mortgage rate. My mortgage is going up {$100.00} every year. I can not afford this. And I should not be forced to do either if everything is being paid. Cushions of escrow along and adjusting monthly payments is not acceptable if there is no shortages at all. Or they can simple ask for the shortage amount to be paid. But how can you ask for a cushion two years later?

Complaint: My loan was sold to the Roundpoint Mortgage Servicing Corporation last year. I received the letter from the city stating that I did n't pay the taxes for the last year and and I am charged {$200.00} penalty fee. My account is set up as an impound account ( have escrow and money is deducted automatically each month ). The Roundpoint told me that they payed the taxes in XX/XX/XXXX they will research this and will get back to me by XX/XX/XXXX. Second issue is my mortgage increased in the amount of {$210.00}.
The Roundpint told me that my home value went up. Looking at the public records the last time property value changed was in XX/XX/2011 when I purchased my home. I asked them to send me a detailed report so I can understand how did they get to the amount of {$210.00} increase and the proof of tax payment. They told me that this conversation is recorded and they can not send me anything in writing. I feel that this amount of {$210.00} is wrong and they are lying to me about taxes being paid. The customer service representative XXXX did not let me to talk to the supervisor.

All of the sudden Round point mortgage company want to add around {$8000.00} to my escrow knowing that my home insurance, my house tax, and my PMI is not changing. I called the Bank and No body is able to explain to me. They just read the letter again to me and do nothing as they are not professional bankers!! its like someone in XXXX is answering my questions. This bank has no local office or no one who can speak with no accent to help me around. Complaint: I have been having issues with our mortgage company over the past two years. This started out with our home not being assessed properly, thus raising my monthly mortgage bill about {$700.00} dollars. This was obviously not their fault because of how my house was valued. So, they allowed me to spread my payments out over 5 years, which was a good thing. So, my mortgage went from {$3300.00} to XXXX, to XXXX. I then asked the locality in our area to re-assess our home so that we could lower our mortgage payments. Once that was done, I received a refund for our school , county, and township taxes. I then asked our mortgage company if we sent them a check to go directly to our esscro for our taxes, would they be able to reduce our monthly mortgage payment. The response was that it would go down to around XXXX a month, which i was pleased with. That payment happened in XX/XX/XXXX. When I received my bill for XX/XX/XXXX, it was over XXXX! I called to ask why this was the case, and the response was that they use a formula that specifies what the monthly payment would be based on how much is owed vs. extending the payments, which did n't make sense to me. If someone would have told me that the XXXX payment for our mortgage would have raised my monthly bill, then I would have never made that payment, and I would have been happy to just deal with the XXXX a month payment! And to add insult to injury, I lost my job XX/XX/XXXX. So, I still owe a XX/XX/XXXX and XX/XX/XXXX payment. I 've applied for borrowers assistance from the mortgage company, but I am not confident that they will give me the assistance that I require to get my life for me and my family back on track. I am obviously frantically looking for a job so I can get back to supporting my wife and XXXX kids. Anything that you can do to assist is greatly appreciated!

Complaint: Initiated refi with Roundpoint Mortgage XX/XX/XXXX, called a week prior to loan transfer to inform County Taxes ( 6 months ) and Hazard Insurance ( year ) was paid last month.
XX/XX/XXXX Roundpoint paid County Taxes and Hazard insurance causing a " shortage '' in our account, i informed them of their mistake they said they would take care of it and request refund and place fund back into escrow balance.
XX/XX/XXXX, Roundpoint sent us a notice that our mortgage was going up due to a " shortage '' in our escrow account. I had to call and inform them of their mistake and that our account had been refunded our County Taxes and Hazard insurance ( {$4300.00} ). They informed they would run a new escrow analysis since fund had been returned but not accounted.
XX/XX/XXXX, escrow analysis was never completed. Called again, Roundpoint informed they would run one asap.
XX/XX/XXXX, Roundpoint has an overage in our escrow account ( over $ 2K ), taxes have not gone up and hazard insurance has not increased, yet Roundpoint withdrew an extra amount to cover for a " fictions escrow shortage ''. Contacted Roundpoint, they never apologized and still initiated the extra amount for XX/XX/XXXX to cover for a non-existent shortage.
XX/XX/XXXX, Roundpoint sent us a check with excess amount owed back to us causing a real shortage in our escrow account and causing our mortgage to go up!
These people are totally incompetent when it comes to numbers and escrow accounts! They have illegally raised my mortgage when my fixed rate can not change and my County taxes and Hazard insurance has not increased.
I have only had their " service '' four months and they have not got ANYTHING right, i have had to call every other week to request promised excreted analysis be done and demand my payment return back to what it was locked in at.
AVOID this company.
