Complaint: Roundpoint erroneously increeased mortgage payment, then created a suspense account to make payments seem late and charged late fees. Tho Roundpoint has admitted in writing that it had no basis for increasing monthly payment and that its action was an error, it refused to correct the payment history despite numerous oral and written requests to do so. Instead it erroneously applied two payments in excess of the amount due to one month. Then they erroneously applied all subsequent payments, which actually were received prior to the due date, as if they were paid in arrears, created a " suspense account '' charged late fees, and continue to demand money in excess of what they are owed under the promissory note.

Complaint: Roundpoint Mortgage servicing changed my monthly mortgage payment amount based on an escrow analysis they said they performed but never sent. Although they have my email address and notified me of a late payment via this email address they did not send notice of the change in monthly mortgage payment. The payment I made was {$54.00} short of the new amount so they " held '' the monthly payment without notice and did not apply to my account. This seems to be done in an underhanded and secretive manner to incur late fees

Complaint: In XX/XX/XXXX my brother in law began the process of building his house directly to the south of our house. In the land deed of ours, XXXX feet of land was deeded and mortgaged to us was actually my brother in-laws land. This happened back in XX/XX/XXXX. My brother in law called the abstract company and lawyers to get everything corrected so that he could get his home loan approved. Everything was settled. We accepted a different part of the land so that we got XXXX feet back to our property. We signed everything. Now my brother in law can not close on his building loan because my mortgage company, XXXX, will not get back with my brother in laws bank or lawyers to take off the XXXX feet of mortgage on our land so that they can add to his. They have tried for 6 months to contact XXXX. In XX/XX/XXXX, I went to pay our mortgage. XXXX now will not let my husband and I pay our mortgage or escrow because my brother in law is now in litigation with them. We are not suing XXXX. We have nothing to do with the litigation. We signed over the XXXX feet last year. We are now currently doing a cashier 's check and sending certified mail to XXXX because we want to pay our mortgage. We have tried several times to contact them. We have even talked to them over the phone with our banker. They said they would call back in a week. That has been a month ago and we have heard nothing. Please help us in this matter. We do not want our credit or our home insurance to suffer because of this. This is our last option to get help. Our banker said that we should contact you to get help. Thank you. XXXX and XXXX XXXX

Complaint: RoundPoint Mortgage is my servicer. As with most homeowners, I pay escrow every month as part of my mortgage payment. However, RoundPoint paid one of my insurance premiums a week and a half late ( due XXXX/XXXX/2016 ) causing the insurance provider to cancel my policy. Four months later my account gets assessed with a forced-place insurance policy that is conveniently offered by an affiliate of RoundPoint. This made me angry for multiple reasons. One, I was unknowingly without insurance for several months due to an error which RoundPoint has admitted to, but still not corrected. Had something tragic happened to my property, I have no idea how RoundPoint would have addressed. Thankfully nothing happened to my home, but the concern is still valid. Additionally, my total annual premium is {$770.00}. The policy RoundPoint offered was approximately 6 times the cost of that. RoundPoint also forced a retroactive placement of the policy, so by the time I realized anything was wrong, I already had 4 months of charges against an absurdly overpriced policy. Additionally, one of their customer service reps notified me that the insurance vendor is an affiliate of RoundPoint. They profited from their own mistake! Despite 5-10 phone calls, and 20+ emails over the past 6 months, I am always left waiting for one of their " managers '' to return my messages after they promise to do so. I consistently get a few responses and then the trail goes dry. It 's like they 're purposefully waiting for me to give up.

Complaint: Here is a letter I have sent to the office of the president of Roundpoint as a response to again another issue with our mortgage. Hello XXXX, I would like to additionally illuminate how ungodly this entire transfer of servicing to your company has been. I have ZERO faith in your company having the ability to properly service our loan. You have demonstrated nothing to prove your capabilities to do so since the moment you have been given the opportunity. Blunder after blunder, insurance department, flood escrow DEPT and servicing NEVER properly communicating with each other via a system to make it a seamless transaction for us the consumer. The never ending letters from the escrow department telling us we were in default for flood coverage, then the lettters about escrow amounts being too high too low and changes to monthly payments ... all this still happening as of TODAY 8 months after you became our servicer. The COUNTLESS HOURS WE HAVE SPENT ON THE PHONE WAITING ON HOLD only to speak to the countless twits who know nothing or little or ca n't help us because they ca n't see what the other system has confirmed and the different departments dont speak to the other ... meanwhile us, the CUSTOMER IS LEFT WITH NO satisfaction week after week month after month because of poor actions by YOUR company .... wrong escrows calculated time and time again. Poor processs and procedures for your company ... .possibly poor management as well .... it took emails to the CFPB for us to get ANYONE to look into this for us at ROUNDPOINT with any seriousness! AND even though the OFFICE OF THE PRESIDENT is involved it is STILL NOT BEING HANDLED CORECTLY! As XXXX XXXX and myself received a letter Saturday from Roundpoint telling us our Flood insurance coverage policy for 2017 was inadequate and only having XXXX of coverage where as the requirement was XXXX ... well thanks for the newsflash! .... BUT YOUR PEOPLE were READING IT WRONG ... .. it was for full Amount of XXXX coverage as required by The guidelines. SO AGAIN ANOTHER BLUNDER BY ROUNDPOINT .... XXXX XXXX sent you the policy and so did the insurance agent ... .. Again today ... XXXX XXXX the time, energy and most of all ... XXXX having XXXX do YOUR companies job and make sure things are being handled properly, we should be paid for it. The apologies and wrongdoing over and over again which Roundpoint admitted to is frankly embarrassing. I truly believe we deserve to be compensated for this incredibly horrible torture we are still enduring. I want to be compensated. Figure it out, I know you can do it, it is only fair. I have been in the mortgage industry for 25 years and have seen it all, but this is so continuous and never ending even at this high level. We are doing your job from Day XXXX .... when the loan was transferred to you, YOUR company should have recieved the ENTIRE PKG from the old lender and and IF the Flood or other REQUIREMENTS WERE MISSING YOUR COMPANY SHOUKD HAVE REQUESTED THEM FROM THE PREVIOUS COMPANY AS THEY WOUKD HAVE NEVER CLOSED WITHOUT HAVING THEM IN THE FIRST PLACE ... .. Again This was the first of your mistakes that we are still enduring. Sincerely XXXX XXXX. ( I 'm in the system as an approved person to deal with on this, assuming that paperwork was processed and saved correctly )

Complaint: RoundPoint Mortgage Servicing has repeated " lost '' my home owners insurance policy each year. Each year I resolve this only to have it happen again. This has gone on for 3 years. They are employed by XXXX whom is known for taking on " high risk loans. '' RoundPoint is renown for missing payments, losing payments, losing escrow or insurance payments etc. It seems this would be an excellent way of XXXX companies working together to make predatory investments. By missing payments, losing payments, etc the homeowner would be forced into penalties and payments that they may not be able to make. In my case they clearly laid out their intentions by threatening to move my insurance to a company of their choosing at whatever rate it happened to be after RoundPoint deliberately lost my insurance policy for a 3rd year in a row. A policy that has been with the same company for 6 years and was able to be renewed for the 3 years with the prior loan servicer without any issues or intervention on my part.

Complaint: I submitted loss mitigation paperwork to my mortgage company in XX/XX/XXXX. I have n't been able to get a response to this paperwork and it is now XX/XX/XXXX. I am told my single point of contact is XXXX XXXX. I have n't heard from him at all via email which I have sent numerous emails or my calls. I was told a manager sent an email to the processors on XX/XX/XXXX and still no response. I followed up again today and was told thy were sending yet another follow up email and should call back on XX/XX/XXXX. Why is it t taking so long to get a decision. This is the second time Roundpoint has sat on paperwork for my home. I just need a decision made to finalize my loan terms or determine if I can stay in the home. The longer they sit on the paperwork the longer I fall behind. Loan Number XXXX

Complaint: I was offered a loan modification in XXXX XXXX and signed it and it was recorded onto my property. The agreement also removed my ex wife from the mortgage. I am attaching a recorded copy of the agreement to this complaint. I have also removed my ex wife 's name from the title of my home. My servicer, Roundpoint, after violating RESPA Regulation X by evading review for almost six months, improperly reporting and collecting on a loan that was modified in XXXX, ruining my credit and costing me thousands of dollars in legal fees, is still showing me in arrears and they state to my attorney that they can not recognize the loan modification that I signed because it somehow does n't meet their system requirements for default. They then after stalling for 6 months stating they did n't have a complete file, finally issued a new loan modification agreement and they are trying to add my ex wife 's name back onto my mortgage. They also asked for a large down payment. I have done nothing wrong here. My attorney asked Roundpoint to contact the investor/owner of the loan to get this problem ( which is on their side ) resolved so my loan can finally be out of limbo. I feel I have been victimized by both my servicer and the investor of this loan " XXXX XXXX XXXX XXXX XXXX ''. Roundpoint purposely avoids discussing this account. Every time my attorney contacts them to try and resolve THEIR error, they put him into voice mail and never return the call. The VP of the servicer wrote some fraudulent letter stating they did nothing wrong, but it is very easy to understand. They are servicing a loan that was modified and they refuse to recognize it. Ruining my credit, costing me thousands of dollars in legal fees and stress that is easily fixable if they would just contact the investor and stop avoiding the problem. My loan was modified in XXXX. As of today they still show me due for XXXX XXXX, XXXX. This can not be legal. Roundpoint is a crooked servicer who thinks they do n't have to follow Respa law regarding servicing and servicing loss mitigation situations.
