( c ) Ceasing communication If a consumer notifies a debt collector in writing that the consumer refuses to pay a debt or that the consumer wishes the debt collector to cease further communication with the consumer, the debt collector shall not communicate further with the consumer with respect to such debt, except -- ( 1 ) to advise the consumer that the debt collector 's further efforts are being terminated ; ( 2 ) to notify the consumer that the debt collector or creditor may invoke specified remedies which are ordinarily invoked by such debt collector or creditor ; or ( 3 ) where applicable, to notify the consumer that the debt collector or creditor intends to invoke a specified remedy. Complaint: Actions taken by Receivables Performance violate the federal Fair Credit Reporting Act and have had negative impacts on my credit worthiness. I cancelled service with XXXX in XX/XX/2017, sent equipment back, but still received bills in large amounts with invalid billing. Issue has since been resolved with XXXX, invalid billing was credited by XXXX and I paid valid charges, attachment, proof of XXXX balance. I contacted Collection Agency, Receivables Performance, who were informed initially that this was not valid, but attempted to collect debt from me anyway and damaged my credit rating by adding to my credit report. I advised them of error, dispute and resolution with XXXX and I requested corrective actions be taken, in the form of zeroing out this balance in their systems and removing this invalid debt from all 3 of my credit reports. Receivables Performance indicated that I still owe {$700.00} and refused to remove from my credit report, despite resolution actions taken by XXXX.

Complaint: I have written in prior to complain about RPM that is listed on my credit and the original creditor is Direct TV that is shown in the amount of {$570.00}. I am writing this letter to inform the individual ( s ) again that Under the Fair Credit Reporting Act, 15 U.S.C. 1681g I have the right to demand that you disclose to me all of the documents that you have recorded and retained in your file at the time of this request concerning the accounts that you are reporting in my credit report. Please dont respond to my request by saying that these accounts have been verified. Send me copies of the documents that you have in your files that were used to verify them. If you do not have any documentation in your files to verify the accuracy of these disputed accounts then please delete them immediately as required under Section 611 ( a ) ( 5 ) ( A ) ( i ). Complaint: I switched carriers from XXXX to another carrier. XXXX was to furnish a final bill, which the new carrier agreed, within a 90 day period of time to pay, upon furnishing the final bill. XXXX would not furnish a final bill nor tell me why. Ultimatly, it was discovered that a range extender, provided to me at no cost because the XXXX phones did not work at my home as represented, was the issue. As the extender was not associated with the phone contract, they could not even tell me what was holding up the issuance of the final bill, until the 90 days had expired. I made many calll to resolve the issue, and was finally assured the bill would be canceled, then the next month got a credit notice. I was in the hospital ( can be confirmed - Im a XXXX ) much of XXXX, and could not respond to ( did not know about ) credit demand, so am now trying to get fair settlement and expunge record from my otherwise good credit. I believe that XXXX uses this tactic as an anticompetitive tactic to punish folks who switch from their service. Representatives from the credit service and XXXX regularly hun ip on me when I daughter to resolve this unfair and unreasonable debt. As an aside, we switched because XXXX does not have coverage where we moved 7months ago, which is why we switched services.

The mentioned company has placed a debt collection as a derogatory mark on my credit as a third party debt collector agency for XXXX XXXX. The amount shown to be owed is {$540.00}. It is against the law to collect on a debt that is not associated with the original collector and RPM has failed to provide documents that show I had a contract with them! and being that they are not able to provide the documents for the validity of this debt they have to remove the debt and I am requesting that it is removed immediately! I am not responsible for this debt and would like it to be removed from any credit bureau that it is shown. I have repeatedly received threatening correspondence related to this debt but no validity of the debt!! If the debt is not removed from all 3 Credit Bureaus as requested I will be seeking a lawyer as the debt is erroneous and not owed to RPM

When I answer, they say I owe a debt but won't tell me the debt before I tell them personal info like my addresses and phone numbers. Complaint: I discontinued service with XXXX back in XXXX of XXXX. I was advised over the phone that if I had a remaining balance, they would reach out to me via letter with the amount and how I could take care of it. I received a letter two months later from them in XXXX stating I had a balance of XXXX. I contacted XXXX and requested if I can make this balance in several payment increments and was advised that would be fine. I went online and made my first payment of XXXX in XXXX. However several weeks later, I received a call from their collections team stating that in order to prevent negative credit reporting that I need to make an arrangement directly with them because I would not be able to make payments anymore since my account is now officially cancelled with XXXX. I set up a payment plan with the representative over the phone to be automatically deducted bi-weekly in the amount of XXXX from my checking account ending in XXXX on XX/XX/XXXX. The first payment would start XX/XX/XXXX. I recently received an alert this past Saturday ( XX/XX/XXXX ) from my credit reporting profile that Receivables Performance Management on behalf of XXXX reported this account as derogatory, which I was told wouldnt happen since I set up a payment plan with them to take care of the balance. I called in and was informed this happened because 2 payments were returned due to NSF from this account. This was startling because I received no calls, emails, texts, or mail to state that they were unable to successful debit my account. Furthermore, I knew I had more than enough funds to cover this payment on XX/XX/XXXX and XX/XX/XXXX. I contacted my bank to see what happened and she confirmed that there were sufficient funds and that they never received an ACH Debit Authorization in the amount of XXXX from XXXX or Receivables Performance Management. I have spoken with 4 different people from this company that have given me the run-around, disconnected me, cold-transferred me, and placed me on countless holds. When you call this company, they answer by instantly placing you on hold. Very bad customer service. I directly contacted XXXX today on XX/XX/XXXX and escalated. The representative took a payment over the phone while I had my personal banker on the phone for a payment in the amount of XXXX and it cleared both ends. When I inquired about the negative reporting to XXXX, she stated Receivables Performance Management is a third party collection company that they use and I would have to dispute with them directly. The representative from XXXX said I can make payments directly to XXXX going forward because of my negative experience with Receivables Performance Management, however my credit report is still affected so I will need to dispute with them. Therefore, I contacted RPM and was informed to email them information of my bank statements to show there were no attempts to debit my account and to show that I had enough funds to cover the payment increments of XXXX in order to remove negative reporting. I am just trying to come to a resolution and remove this negative reporting from my credit profile. I sent them copies of my bank statements to show that there was enough money in the account before and after you authorized payment. It also shows no attempt from XXXX or Receivables Performance Management to collect a payment until today ( XX/XX/XXXX ) which was the payment I made over the phone. I was advised to email this company a copy of my bank statement to rectify the issue and someone would contact me within 48 hours. Nobody contacted me, so I contacted them in 72 hours to follow up and no one knew what was going on. I was advised that someone would call me back within 30 minutes and I have not received any call. XXXX should of never transferred my account when I was told that it was ok to make payments until balance is paid in full and Receivables Performance Management should of never reported this account negatively after ACH payment agreement was made, which I was told wouldnt affect my credit report negatively.
