Complaint: My current mortgage holder, XXXX Mortgage, a Connecticut Company, sold my mortgage to Rushmore Loan Management Services, a Texas Company, on XX/XX/2015. The terms of the mortgage were to remain unchanged. When Rushmore sent me written confirmation they had me owning the wrong home and the wrong mortgage terms. I called them and they corrected the records to reflect the correct home and mortgage terms in a letter to me dated XX/XX/2015. However when they sent a billing they had the incorrect amount. I should be paying a total of $ XXXX per month and they are billing me $XXXX. I have called them multiple times and all I get is promises that they will investigate. In the mean while I have sent them XXXX payments of $XXXX for XX/XX/XXXX and XX/XX/XXXX but they have not applied either payment to my mortgage. They are calling me every other day dunning me for payment of the incorrect amount and telling me that I am XXXX months behind in my mortgage payments. I have spoken with XXXX different people at Rushmore and it is like beating your head against the wall. Now they threatening to start foreclosure against me and to report me to the credit reporting agencies while I am current in my payments. I am fearful that their errors will cost me unnecessary legal fees and destroy my absolutely perfect credit rating. My wife and I are in our XXXX and do not need dealing with Rushmore. Your help will be greatly appreciated.

Complaint: This complaint is about the Loan Servicer RUSHMORE LOAN MANAGEMENT SERVICES, LLCOn XXXX/XXXX/XXXX, before the Tenant Protection Act expired on XXXX/XXXX/XXXX, we signed a residential lease with the owner of the property located at XXXX XXXX XXXX XXXX, # XXXX, XXXX XXXX, FL XXXX, for XXXX year which was exended until XXXX/XXXX/XXXX, because the XXXX association took longer to get us approved. The property sold and the purchaser was the plaintiff/bank who is NOT going to occupy the property. We believe we are covered under the TPA because the lease was singed before the act expired. However, the attorney IRA XXXX XXXX representing the Loan Servicer RUSHMORE, is completely ignoring this act and does not want to honor the terms of the lease to allows to stay in the property until XXXX/XXXX/XXXX. He wants us out by XXXX/XXXX/XXXX, in two weeks. My questions to you are : Are we covered under this act since we signed the lease before the expiration of the act? What can we do to force them to honor our lease? Complaint: Rushmore Loan Management Service is involved in unfair business practice. They continue to delay my loan modification application by saying they never received faxed documents that are needed to finish my application. We have enlisted the help of a third party organization called XXXX that specializes in helping homeowner such as myself save their homes from foreclosing. Again, Rushmore stated that they never received the required documentation from XXXX and even suggested that we stop using a third party organization. I have been trying to get a loan modification for the past year. Initially, the loan was with XXXX XXXX XXXX who also was using the delay process so that they could sell the loan. Then in XXXX of 2014 the loan was sold to Rushmore Loan Management Services and from that time until today my application is still incomplete. I strongly believe that Rushmore is intentionally delaying the loan modification process in hopes of foreclosing.

Complaint: I 've had a mortgage on a small summer home for about 20 months. In XXXX, they decided to change the loan servicer to what looks like an in-house servicer, Rushmore Loan Managment Services. I have sent in payments, and have reaquested that they change the autopay option I have set up with XXXX XXXX XXXX, from XXXX account to another. I have written them, faxed them, called at least XXXX times. They do not change the account the monthly mortgage is taken from, and as a consequence every month I have to keep the new and old accounts filled with cash, not knowing which they will draw from. I asked our loan broker, XXXX XXXX, to look into it and he has had no success either. Calling in takes a long time to ge through to a human, I have done this XXXX times, each time they say it will be taken care of. The last XXXX, XXXX, said there was a record of my letter and fax. They have been 100 % non-responsive and are not allowing me to process my payments as my household moneys permit.

Complaint: I have been paying monthly mortgage payments to Rushmore Loan Management S,ervices on a regular basis for years. Recently I have used XXXX online payment service for this purpose. Rushmore claims that they have not been getting the bank transfer funds and threaten me with numerous phone calls at all hours. My bank records show valid fund transfers. I am unable to talk to reliable Rushmore employees , usually their phone numbers do not answer. I do not want to jeopridise my mortgage, but do not know how to proceed. Please advise XXXX

Complaint: Rushmore Loan Management Services purchased my mortgage from XXXX XXXX, which typically should not impact me as a consumer, other than changing where and to whom I should send my money. However, that was not the case. Rushmore failed to acquire all the proper documentations from XXXX which would show that the property is insured, so they added a lender-placed insurance to my account resulting to an increased escrow, which increased my monthly payment from {$600.00} to {$1000.00}. I called Rushmore to advise them that I already have insurance through the homeowners association, provided them with name and phone number and advised Rushmore that I would send the regular payment of {$600.00} for XXXX 2015, which I did. Now Rushmore has labeled my account as delinquent for the difference. I 'm seeking protection as a consumer who should not be impacted by lenders practice of bouncing/selling mortgages to other lenders. Help!!

Complaint: The servicing of my loan was transferred back in XXXX of XXXX and I have been living a nightmare ever since the transfer of my mortgage to Rushmore Loan Management Services. On the initial paperwork/statements they reported the wrong interest rate. Initially I spoke to a young woman in XXXX XXXX and explained there is an error with the interest rate and that it was wrong. The correct interest rate should be 5 % NOT 5.75 %. She noted my file and would have to research this information. I asked her how I can confirm that it has been corrected. She recommended that I sign up for Internet access to my account. I explained I would try but I had recently started a new part time job and would try to find time to set up online access. In XXXX I received several notices from Rushmore XXXX Tax XXXX - Homeowners Insurance required Mortgagee Clause change. XXXX - A notice that my Note and Security Instrument were in default due to non payment of the installment and a new charge of {$320.00}. - Recoverable Corporate Advance. I have called Customer Service XXXX again and again with no responses. I explained in great detail about the mortgage payment assistance program that I was enrolled in, NJ XXXX Acct # XXXX and that the payments were being automatically sent directly to Rushmore from NJ XXXX. Also, with this program there should be no late fees being charged. Each time I provided my phone number and was told that they would have somebody call me after this was all researched but it would take some time. At that time I set up my internet/online access in hopes that I would see some sort of response and corrections to my account. I have documentation/emails to detail my situation that I can provide to document this case. I began recording phone conversations in XXXX XXXX when I got a letter of intention to foreclose on my home. I called on XXXX XXXX, XXXX and demanded to speak with a supervisor. I began speaking to the ONLY person that seemed to care or even began to help me, a mortgage servicing manager named XXXX XXXX. It has taken many hours of my time and aggravation in order to have them CORRECT THEIR MANY ERRORS. My biggest complaint is the way they keep records and do not report accurately true important information. I am in the mortgage business and I believe it is the ONLY reason that I was finally able to hopefully have this nightmare ended. I had to spend hours and hours on the phone, losing time from working XXXX jobs and paying to send certified letters and then experiencing mental anguish of receiving late notices and threats of foreclosure and letters from loss mitigation dept about my loan being in default when ALL of the errors and problems were created by Rushmore Loan Management Services. I had to make threats to them that I would make a complaint to CFPB! This should not happen. I got notices that my taxes were not paid and my home would be put up for tax sale even though Rushmore had the money to make the payment. Finally I have had a person taping a envelope to my front door for the past XXXX weeks. The letter is typed on plain white paper ( NO LETTERHHEAD ) from Rushmore and advising of solutions to avoid foreclosure of my loan that is in default. WHICH IT IS NOT!!! I have been suffering through a very difficult emotional period since XXXX of XXXX when my youngest sister died a sudden tragic death and caring for my father who is XXXX years old while working XXXX jobs. At this point, I believe that I am due some sort of reparation for the mental anguish/harm that I have endured due to being threatened for so many months with foreclosure and the personal losses of time and money that I lost from my life and my work to repair this mess and not have it affect my credit history. I appreciate your help in resolving this matter so that this never happens to someone else. Thanks you.

Complaint: Rushmore loan management services has been sending letters saying we are in default of our mortgage. The most recent letter is dated XX/XX/2015 and states that we are in default as of XX/XX/2015. Obviously, this makes no sense. Additionally, according to bank records the mortgage payments sent to Rushmore have been cleared every month since we've had this mortgage. This letter dated XX/XX/2015 is the XXXX letter we've received. After the XXXX letter I called the company & they said they would take care of it. Today I was told that they couldn't talk to me because I'm not my husband! I am concerned that this will affect our credit rating.
