Complaint: In the past Ive been allowed to make partial payments on my mortgage. Today I attempted to pay XXXX of my mortgage XXXX {$1000.00} XXXX. I was advised I could n't, I asked to speak to a manager and was told by the man " it does not matter, I will not allow my manager to accept the partial payment ''. A young lady got on and said she was a senior rep, that a manager was not available. She had then told me she would not except a partial payment either. Then proceeded to tell me per my finances there is no reason I should be making partial payments. I then again asked to speak to a supervisor, she would not put XXXX on. When I mentioned the CFPB, she hung up on me. It be different if they never accepted a partial payment before but they have, on more then XXXX occasion. There was also no reason for here to tell me about my finances.

Complaint: I submitted a file to Rushmore Loan Management for a loan modification through XXXX. I also filed Chapter XXXX Bankruptcy to get rid of the arrears of the loan. Rushmore is trying to recoop the arrears which I do not have by paying upfront funds of {$8000.00}. They have also given me a sale date and a modification which is duress. I can afford the {$1200.00}, but the upfront funds of {$8000.00} I do n't have that is why I filed bankruptcy. The sale date is scheduled for XXXX XXXX, 2015.

Complaint: My house was illegally foreclosed on XXXX/XXXX/2015. The bank did not generate documentation that they legally hold the original deed and the title nor they showed any interest in numerous modification attempts that I tried. Please help me resolve this situation and get my house back to me. I know for a fact they have fraudulently foreclosed on me and the mortgage audit has shown that they have committed a securitization fraud at least.

Complaint: The Rushmore Loan Company purchased my mothers loan from XXXX XXXX XXXX in XX/XX/XXXX with monthly payments of {$830.00} due. In XX/XX/XXXX, my mother passed away and I assumed responsibility as co-signor for the remaining debt of approximately {$24000.00} in which payments of {$900.00} to {$1000.00} have been made consistently on a monthly basis. In XX/XX/XXXX, I received notice from Bankruptcy Court that Rushmore wanted to request a motion of relief for delinquency. I contacted Rushmore immediately and was told that XXXX payments were missing during the XXXX time frame. I explained that I had no knowledge of delinquent payments and could I work out a payment plan to include adding any missed payments to end of loan. XXXX XXXX Rushmore Relationship Manager gave me XXXX options to pay the delinquency plus fees. Option XXXX is payment in full. Option XXXX is Repayment Plan for a short period of time. Option XXXX was for a loan modification. I was told that I would also have to pay for the additional fees associated with this loan. The fees were for a Lender placed Fire Insurance Policy ( not in a fire zone according to FEMA ) and {$1100.00} for the monthly home inspections and analysis of property. I have not received any contact from Rushmore until today XX/XX/XXXX regarding any delinquencies. I also feel the adding of the Fire Insurance Policy is not in standing with FEMA for Georgia. This property is not in a flood or fire zone and is covered completely by Homeowner 's Insurance Policy. There has not been any contact with the owners concerning the monthly home inspection and/or analysis. The charges for corporate fees and insurance would fall into the Predatory Lending Practices for inadequate disclosure along with inflated fees and charges.

Complaint: I have owned my home for several years and fell behind on my mortgage due to a reduction in my monthly income. My home is underwater as many people 's homes are in this market, the only option I have to save my home is through the making home affordable program. I have applied for several modifications with my mortgage servicer and have received several denials. The denials are based off a negative NPV, which is a very vague decision. I make monthly income and could very much afford a payment for my home. The investor on my loan seems to fluctuate my value based off of the internet, they have never seen the inside of my home but value it at the top of the market, like a remodeled home instead of the true value. This fluctuation in my homes ' value is the major reason why the decision on my modification is always no. My loan was also recently acquired by an investor and was service released to Rushmore to foreclose. My only option left today to avoid foreclosure is to short sale. I was told by my servicer that if I would find them a good offer that they would work with me and not foreclose. I listed my home with a realtor and have received several offers for my home, an as-is offer at fair market value was accepted by me to submit for short sale approval. This offer was denied by my investor and the buyers increase was also later denied- we are within XXXX of the investors net today and they refuse to do an interior appraisal which would help close this gap in value. The buyers have decided to conduct an inspection of my home with their contractor and termite company, these reports will be submitted to Rushmore for consideration of a value dispute- the only problem is this investor does not entertain value disputes per my servicer. My home needs repair and this is why the offer is at this amount. This is not a low ball offer as it is within XXXX of the remodeled home that sold directly across the street. How can they not entertain pertinent information like this?! Given the situation that I find myself in I would be in a better place if I can have Rushmore work with me on a short sale, they promised they would and I have spent the last month preparing and helping with selling my home when Rushmore would rather foreclose. I fear that I will be kicked out on the street by my servicer, all of my attempts to work with them are futile and to make matters worse I often feel antagonized by the person assigned to my file. I am going through a rough patch in my life, I would appreciate being treated like a human being, I have held my end of the agreement to short sale, part of working with someone is to have the information I send in considered not hastily disregarded as insufficient-within 5 minutes of sending it.
