Complaint: I have been trying to obtain a modification from my old lender XXXX XXXX XXXX since XXXX XXXX when my loan defaulted because of past due property taxes. We believed that when he got our XXXX loan that the taxes was impounded. Once XXXX took over the loan and the 5 year statute passed for past due property taxes ; XXXX XXXX XXXX sent us a letter advising us that we was {$60000.00}. in debt for property taxes. Our payment went from {$3400.00} to {$10000.00}. We tried to ask XXXX to help us but they only tried to adjust the escrow which dropped the payments to about {$8500.00} which we still could not afford. We tried for three and a half years to get a modification with XXXX XXXX XXXX with no success. First they say we had too much income, then they said it was n't enough income. Lot 's of back and forth. Then in XXXX XXXX ; the sold the loan to US Bank, serviced by XXXX loan servicing. We have now been trying with no luck or success with them. They have denied the XXXX modification packets that was submitted in XXXX and the XXXX that was sent by our representative. We do n't know what to do and were afraid they will foreclose on our home. We tried to explain that we were part of the predatory lending from XXXX, but it appears that they do n't want to help us. Our loan is now XXXX years past due with lots of fees and costs. They are refusing to entertain any offers. They offered us a modification after they denied our request four times. Then started foreclosure proceedings on XXXX XXXX, XXXX ; right after they denied our appeal. One week after we resubmitted an appeal it was again denied and then on XXXX XXXX, XXXX they offered us a modification. The agreement was that we would have to come up with {$220000.00} in past due fees and costs. We would have a mortgage payment of {$8200.00}. We ca n't afford that. I believe they just offered us this so that we could show our inability to pay this agreed modification. No principal reduction, balance put to back of loan, no consideration for our income and expenses. I want someone to get involved because XXXX XXXX XXXX washed their hands of us and this new servicer ; is unwilling to help us. They only want to sell our house. We just want a fair offer. We asked for them if we could pay back {$100000.00} towards the default, provide us principal forgiveness in the amount of {$280000.00} ; to put the balance of our property taxes in the amount of {$24000.00} to the back of the loan and keep our payments roughly about {$5100.00}. They refused as well. We may have to file a lawsuit to stop them from selling our home. They are not following none of the guidelines that was set up in the us settlement lawsuit against the major banks. They are not trying to work with us at all. Can someone please help us with USBank and XXXX loan servicing. Time is of the essence and we are afraid that they will try to foreclose on us this month.

Complaint: XX/XX/XXXX I was leaving the Army and looking to buy a house with my then fianc and our teenaged children. As first time home buyers we were qualified for a XXXX loan. We found a home in our price range and I carefully chose XXXX Bank because they were least likely to sell our mortgage. One year later, they sold our mortgage XXXX, which was taken over XXXX XX/XX/XXXX. This was the worst possible outcome. After carefully avoiding XXXX during the mortgage buying process, here we were. The first thing they did was raise our mortgage from {$1700.00} per month to {$2500.00} per month citing a deficiency in the escrow account. We struggled to keep up, sold family heirlooms, cashed out our annuities, anything to keep from losing the house. Four months later, they lowered the payments to {$2100.00} per month, but we were getting fewer hours due to the weather and it was still too much for us to pay. We were able to keep it up for a year, but XX/XX/XXXX we were laid-off. My husband and I are both XXXX. The financial crisis may have taken a bit longer to get to us than the rest of the workforce, but it hit us with a vengeance. Our friends were getting help with their loans from the government, and they recommended we try to do the same. We tried for a year to get a loan mod, but were told that we did not qualify because we were still making payments and in order to qualify we would have to be behind on payments by three months. What they did n't tell us is that penalties would continue to accrue. We stopped making payments and applied for the loan mod again. XXXX asked us to fax over XXXX pages costing us XXXX dollars, but at least we would have our application in and we would finally get help. A month passed, and XXXX contacted us to send the exact same paperwork again, they had allowed the paperwork to expire and if we wanted to mod we had no choice but to resend everything. This was to be a monthly theme where we would spend over XXXX dollars to send them paperwork and they would ignore it until it was expired. All we could do was continue to send the same paperwork to XXXX every month and hope that one day they would actually review it. Finally XX/XX/XXXX XXXX let us know that our mortgage would be reduced by only XXXX dollars a month. It turned out that all of the payments that we missed plus all of the interest and penalties, fees and so forth was added to the mortgage. They did n't even lower the interest rate. Six months later XXXX cashed out our P & I insurance and the loan went back XXXX who then sold it to Rushmore Loan Management XX/XX/XXXX. Once again I began negotiating to keep the house. Rushmore told us that we would have to come up with a down payment of at least {$8000.00} in order to get a loan modification. We started the paperwork all over again and this time we were successful. They gave us a six month trial payment of {$2100.00} per month. When the new paperwork came in, we were not able to hire a lawyer to look it over carefully, but we read it the best we could. It was n't until we had already signed it and sent it back that we realized that not only had they not reduced our loan payments, but they had tacked another ten years onto the mortgage. Our {$210000.00} home would end up costing us almost XXXX XXXX dollars by the time it was paid off, and we would never be able to pay it off during our lifetime, since we are almost XXXX. Then Rushmore raised our mortgage to {$2200.00} per month, citing a deficiency in the escrow account. They are likely to push us into foreclosure so they can also cash out on our P & I insurance.

Complaint: Rushmore tried to sell our home on XXXX XXXX, 2015 and we were forced to file a bankruptcy to stop the sale. We have been trying to get help from them since the loan was transferred from XXXX XXXX XXXX to Rushmore. However, they will not open a review for assistance because they claim that they have reviewed us for assistance XXXX times already and they wo n't do it any more, but they have NEVER reviewed our loan for assistance. Unless they did it on their own. We are now in a situation where they are going to take our home away, even though we qualify for assistance through government programs. Our bankruptcy will time out at some point and Rushmore is unfairly trying to take our home away. Even if we did go through the process years ago, our finances have changed and we are in dire need of getting our loan back on track. Rushmore is not even allowing us to send in a package for assistance review because they say that our loan has been reviewed three times. We do n't think so. I am XXXX and my wife works, but does not make that much money to keep us from assistance. Please help us get into a negotiation with them. Thank you.

Complaint: The servicer, Rushmore Loan Servicing is stating that the investor wants {$25000.00} down payment before they will modifiy the loan for a three month trial period. It was declined when we could n't come up with the payment we offered to spread out with the trial period payments. Initial down payment we could do was {$5000.00} that was declined. Then we offered {$15000.00} down payment to be spreadout in three month with the trial period payment. XXXX, who is the contact representative with Rushmore said she spoke to her supervisor's-supervisor and said that the investor said no that they need the entire {$25000.00}. My Home is currently in foreclosure and assigned to there Attorney. XXXX

Complaint: Rushmore Loan Management added unnecessary insurance to my mortgage, which led to a shortage in escrow, resulting in an increased mortgage payment. The company was made aware ( proof was provided ) that my home was from the requirement for flood insurance due to flood zone : AH. Rushmore failed to rectify the matter on a timely basis. They have failed to apply my payment appropriately, and they then started foreclosure proceedings and refused any of my payments as per their letter dated XXXX XXXX, 2015. They have ruined my good credit history under the affordable housing programs, for which I am to receive a yearly credit of {$1000.00} for making timely payments. They have also ruined my credit history, and have started foreclosure proceedings. My attempts to resolve this issue by contacting the company has failed miserably! Instead, I continue to receive dunning letters and phone calls. I 'm asking that Rushmore reinstate my payments under the agreed terms, allow me to make my payments, remove negative reports from my credit history from XXXX 2015 to XXXX 2015, and reinstate my good payment record so that I may receive the yearly incentive of $ XXXX you for you assistance in this matter.

Complaint: First of all, thank you for handling my Complaint. After reading the Consumer Financial Protection Bureau Rules to protect homeowners,I can briefly write my Complaint by saying that:"Rushmore Loan Management Services has violated each and every one of the Rules" I am trusting that you will base your final conclusions on facts and evidence and not words written in a piece of paper, that is why I am presenting each of my TRUE statements with documents attached. Please, know that the least I expect is the same from Rushmore. On XX/XX/XXXX 2014, Instead of Rushmore informing me that they were the NEW Servicer, I found out because I received an e-mail XXXX, saying that Rushmore was going to continue processing my Loan Modification request and Rushmore HAS NOT UNDERWRITTEN MY FILE! (Exhibit G). For fifteen months I have been calling and sending e-mails and ALL Rushmore's employee refused to talk to me. All of them refer me to Rushmore Attorney, XXXX who does not answer either! My Complaint has more characters that the ones remainning therefore I will be attaching my three pages Complaint for your review and consideration. Complaint: In XX/XX/XXXX Rushmore Loan Management of XXXX, Ca. purchased my FHA/HUD loan from XXXX XXXX XXXX. I was in active Bankruptcy Chapter XXXX at time of their purchase. I received notice from them they had bought the note. I began at that point paying mortgage payments to Rushmore beginning in XX/XX/XXXX as they requested. Little did I homeowner know, Rushmore lending intent was to show all payments made tothem under a " Property Preservation '' account which puts homeowner payments towards their regular mortgage in limbo, and creates an account summary favorable to foreclosurefor their purposes of acquisition and sale without current homeowner being made aware of this " Predatory Lending tactic ''. My home has no court order allowing XXXX XXXX XXXX any Foreclosure status in their sale of note to Rushmore Loan Management. Now all payments made to them by me are in a default status of mortgage loan payments I have been making since XX/XX/XXXX. This deceptive Predatory lending tactic should be exposed within the Mortgage lending community as a whole, and considered illegal business practice. Rushmore has no right to change my FHA/HUD home mortgage purchase toa Property Preservation account without court ordered foreclosure, property was never foreclosed on by Texas courts allowing such actions by Rushmore Loan Management.

Complaint: In short I had a mortgage with a coborrower in XXXX ... in XXXX that mortgage was modified into a mortgage with that coborrower by herself. In XXXX I filed a BKXXXX and in XXXX I received a discharge. Rushmore Loan Management took over servicing the mortgage in XXXX and has been reporting to the credit bureaus that the mortgage is mine, open, and delinquent. I faxed them the attached letter on XXXX/XXXX/XXXX and they are supposed to respond within 30 days and have not done so. I had an attorney send them a letter and again no response. All the while my credit is being ruined by them for an account that is not mine anymore.
