Complaint: The current mortgage company has been giving us trouble since they took over the loan last year. The previous mortgage company did a loan modification with us, the new deal was they gave us a balloon payment of {$15000.00}, to be paid at the end of the loan, so we signed the agreement. The current mortgage company demanded that we pay the balloon payment the XXXX month they had the loan, it took us almost 1 year to straighten this out, every time we called there was someone new assigned to our loan. I believe they charged us interest on the balloon payment during the dispute period. Every time we ask for paperwork they say we have to submit the request in writing and when we call back after a month they say they already mailed it and we must resubmit the request again. We made a payment on the principle last year but they still show the same payoff date on our statements, and the interest payments are n't going down in size by very much. We made another payment this year on the principle and we asked them the same questions and they say we must request information in writing, so again we requested the payment schedule from them and we called them back after a month and they said they had already mailed it XXXX XXXX and today is the XXXX and they said on the XXXX they would mail it again and we still have n't received anything from them.

Complaint: I am in a chapter XXXX Bankruptcy and am working with a HUD approved Housing Counseling Office Named XXXX XXXX XXXX XXXX Who was given approval from my attorney to help me get a modification. The paperwork was faxes on XXXX XXXX, 2016. My counselor has been Calling two to Three days a week for the last 2 weeks and they Keep telling her that a fax was received but it is not loaded yet. My mortgage company is Rushmore Loan Management. I think they are trying not to help me. I know that it does n't take that long to upload paperwork into a system. Please help me!

Complaint: I have been trying to get a loan modification from XXXX XXXX XXXX since XX/XX/XXXX which the loan has now been bought out by Rushmore Loan Management Services. While it was with XXXX XXXX XXXX, after asking for help I was told I would have to skip XXXX payments which I did and then they would talk to me about helping me. They then sent me a letter telling me what I needed to send them which I did and to start making my payments again which I did. They said I would here back from them within 45 days. Before the 45 days were up they put us in foreclosure and never let us pay again even though we could make the payments and made us accrue over {$100000.00} in interest since XX/XX/XXXX. I have an attorney working on this with me. The last correspondence we have had from them was in XXXX XX/XX/XXXX which is well beyond the 45 days that they should have responded to us from the offer they gave us and our lawyer wrote back to them. This has been a continuing problem with this bank and has gone on way to long. This bank ignores our attorneys phone calls and we feel it is time the bank responds to us and our attorney. They have destroyed my credit letting this go on for so long. It is the banks responsibility to get back to us in a reasonable time frame and they are not doing that. I just want to hopefully receive this modification and finally move on with my life. I do n't feel the bank should have the right to keep this up in the air without any correspondence at all. I just want them to do what they should do in the correct amount of time allowed.

Complaint: In XXXX my husband was laid off after 33 years. in order to collect a pension he was precluded from getting a job per the company 's contract.I paid a lawyer for a loan mod because my income alone would not cover our mtg. We were given a mod.by the servicer XXXX The modification payment was more than {$3000.00} that was XXXX. I was doing fine with my self employment business and paying our mtg. up until XXXX. I fell behind on the mtg. because I lost my business due to the crisis. The landlord filed a judgement for failure to pay rent for my defunct business. during my modification XXXX had bought the servicing rights. XXXX, the mortgagor at the time agreed to allow us to sale our family home in writing. XXXX decided not to work with us any longer because there was a XXXX and an IRS lien on the property in which was being worked out but they would n't wait. XXXX XXXX XXXX filed a NOD. We hired an attorney to help with this NOD and the attorney advised us to file a bankruptcy. The attorney that helped us was a scam he took {$400000.00} from us and he ended up loosing his license and no longer can practice law thus putting us in jeopardy. while all this was going on the servicing rights were sold to Rushmore. Rushmore has given us written approval to sell the property our bankruptcy is now discharged, However, today XXXX XXXX XXXX My agent received an email saying the have decided to foreclose. According to SB XXXX no bank that took TARP money can duel track.Rushmore 's email to my agents states that they are going to start the foreclosure process while we are in an approved short sale. Rushmore has changed the amount they want 2 times in 4 mo. The buyer has agreed to pay what they want and instead of giving us a 30 day approval based on the new purchase price, which is a change of circumstance, they gave an 11 day approval. We are almost ready to close but because we asked for a normal approval for 30 days based on Rushmore changing the purchase price they refused to give us XXXX. we are currently approved by Rushmore until the XXXX of XXXX XXXX, however, XXXX of the liens still need to be cleared. We are asking you to step in and stop the duel tracking from Rushmore and allow us a normal 30 days to close. Rushmore has been given a conditional approval by the buyer 's lender which proves the buyer is approved to purchase. with the price increase Rushmore has imposed, the buyer must be given ample time to get the new approval from their lender. we need ample time to get that. 5 days should be enough time. The hud is attached that shows the XXXX purchase price. Rushmore increased the price so much in that they forced out the relocation money they were to pay the sellers from the TARP money they have received. They 're crooks. Please help us

Complaint: My mortgage note was sold by B of A, who I was working on a modification with coming out of bankruptcy, to Rushmore Loan Management. My mortgage servicer is dual tracking me I have sent in at least XXXX modification applications and numerous support documents. While under the guise of assisting me secure a modification of my loan they proceeded the entire time to push the foreclosure through as evidenced by filing dates on various documents. I need assistance because I want to keep my house. I fell behind because I am unable to work. I have secured a steady income stream and can afford modified payments now for at least two or more years. It has been more than thirty days since I was notified of my complete modification application and required documents being received and I still do not know the status of my request for assistance.

Complaint: this is my second communication. I filed initial complaint last week. please see the record for case number. I have filed appeals paperwork with my lender for HAMP Denial. My servicer has not acknowledged receipt of the paperwork nor have contacted me. I have left several messages for my account manager and they have all been ignored. The decline letter I received was dated XXXX XXXX, 2016 in which I was given 30 days to file an appeal. That 30 days is over on XXXX XXXX, 2016. the time is approaching fast. although I have sent all the paperwork to them within the timeframe allowed, they have not started any process from their side. I am afraid that they will claim that they never received my paperwork for an appeal and, will close my case. I really need your help in resolving this. a copy of his appeal was also sent to you last week. Thank you

Complaint: Received mortgage modification packet from Rushmore Loan Management Services XXXX/XXXX/XXXX due to possible foreclosure. Returned packet XXXX/XXXX/XXXX. Was told at that time all proceedings would stop until further notice. Received a denial letter on the modification XXXX/XXXX/XXXX but to contact them for options. Contacted Rushmore XXXX/XXXX/XXXX to discuss options. Contacted a relator XXXX/XXXX/XXXX to place property up for sale. Recieved first payoff from XXXX dated XXXX/XXXX/XXXX good until XXXX/XXXX/XXXX or a daily per diem, house officially listed XXXX/XXXX/XXXX, received offer XXXX/XXXX/XXXX. Contacted Rushmore XXXX/XXXX/XXXX that property was sold. Was told at that time to stay in touch every 10 days on process and not to worry about anything. Closing was to be approx. XXXX XXXX or XXXX. Contacted Rushmore again, received second payoff dated XXXX XXXX, XXXX good through XXXX XXXX. Loan signed XXXX XXXX, XXXX, funds disbursed XXXX/XXXX/XXXX. On XXXX/XXXX/XXXX Rushmore contacted my relator my email that amount sent was incorrect and to send more money. XXXX/XXXX/XXXX, I contacted Rushmore and at that time they stated the payoff statement sent was not correct, was n't caught by them nor the title company. Explained funds received had been disbursed, was told to bad, gave me an amount needed to be wired. Rushmore stated they would send the wire back and cancel the sale. Also on XXXX/XXXX/XXXX Rushmore contact XXXX XXXX wanted more funds, gave them a different amount to be wired. I tried to negotiate an amount with Rushmore stating the funds received had been used and Rushmore could n't of cared less, they stated to me I was the victim but they were not willing to negotiate for any amount. Emails began between Rushmore and XXXX, XXXX/XXXX/XXXX with different amounts being requested each time. At this point Rushmore was not returning any calls nor willing to take responsibility for there error. They then added additional costs that were not represented on any payoff statements. Forced placed insurance for {$500.00} which the property had insurance on it and they had copy on file and a foreclosure fee {$420.00} to which was never disclosed. XXXX sent an additional {$8800.00} to Rushmore XXXX/XXXX/XXXX by wire, then asking for confirmation of loan closed and lien released and to date have not received such confirmation. As for the force place insurance, contacted that department XXXX/XXXX/XXXX, was told error made, would refund {$500.00} directly to me and would call me with confirmation. Again nothing, call Rushmore XXXX/XXXX/XXXX was told refund sent to the loan which at this time was told : oh, sorry loan closed, we will send it to you in the mail in about a week. I now owe XXXX money due to Rushmore 's errors and bait and switch of amounts to be paid. I 've lost wages at my employment. I do n't have the funds to pay the title company as I had other obligations that were paid from proceeds. At this point, I know Rushmore needs to accept responsibility and refund myself or the title company or both.
