Complaint: I have been in review with Rushmore for over 1 year trying to get my mortgage modified. We are currently assigned to XXXX XXXX, who has been nothing but combative and rude throughout the entire process. I am asking for our representative to be changed immediately, as she is nothing but degrading and very snide to my advisors as well. She has done nothing to help us but only harm the process. As I have stated, we have been in review for almost 1 year. We even told Rushmore that we have {$10000.00} to put toward a down payment on a modification, still they drag their feet. We have sent the same documents over and over. I think it 's because they just do n't like us and are trying to stall to sell our house. What happened most recently was that they put a sale date on our house for XXXX/XXXX/XXXX even though we are still in a Chapter XXXX bankruptcy that is not discharged. Not knowing the laws and not knowing we are still protected. My huband filed a Chapter XXXX in his own name on XXXX, a day before the sale, which was upheld by the Bankruptcy court as valid. Just last week, XXXX, Rushmore 's attorney, XXXX, tried to file something to overturn our bankruptcy based on a document he filed in XXXX. The bankruptcy judge overturned his filing ( attached ) and said there will be a hearing on XXXX/XXXX/XXXX to give us time to respond. I am currently talking to my atttorney to file a response to let the court know how hard we have been fighting Rushmore to keep our house. We have been assigned to people who refuse to help us. The letter from the bankruptcy judge who overturned XXXX 's filing has been on file and emailed to all involved ( Rushmore and XXXX ) on XXXX. It is now XXXX and Rushmore states that there are no new developments and they have to wait for instruction from XXXX 's office. Every day they wait is a day closer to me losing my home. They have this letter in their possession and they are still not trying to move forward. My advocate XXXX has called XXXX, who now conveniently does n't answer the phone, as well as her supervisor XXXX, who has not called him or us back for now another 2 days. I have been on the line as XXXX has left messages. I need help moving this forward, nobody at Rushmore has helped in the slightest, all they have done is talk down to us, ignore us, and ask for the same documents over and over. I further give my permission to talk to XXXX XXXX and/or XXXX XXXX at XXXX XXXX, they are working hard on my behalf but have also just been disregarded by Rushmore. I am also putting my authorization in writing ( attached ).

Complaint: Case number : XXXX Filed XXXX/XXXX/XXXX I filled bankruptcy, including my mortgage with Rushmore Loan Management in XXXX and it was discharged XXXX XXXX, XXXX Creditors are supposed to cease reporting negative items after the notice of bankruptcy being filed and creditors discharging items. I am protected through the bankruptcy against any further consequences for this loan. After several credit disputes, Rushmore continues to report derogatory information on my credit reports. They will not remove the comments " settled for less than the amount owed ''. This comment along is not allowing me to get a mortgage to purchase a new home. ( XXXX was the lender at the time of the Bankruptcy ) Rushmore response XXXX/XXXX/XXXX We have conducted an investigation and corrected the error asserted within the received correspondence. Rushmore has confirmed that the Chapter XXXX Bankruptcy case you filed was discharged on XX/XX/XXXX. Please note that Rushmore submitted an update on XXXX XXXX, XXXX, to the main credit repository agencies to reflect the Loan as Closed, Discharged Chapter XXXX Bankruptcy. Please allow 30 days for the credit bureaus to update your account with them. We apologize for any confusion or inconvenience this matter may have caused My current complaint that still needs resolution. XXXX/XXXX/XXXX The words " settled for less than owed '' are the words that still need to be removed. This is the statement that is not allowing me to get a new home loan. I filed the BK over 6 years ago and this does not affect my ability to get a home loan. What I need the letter to say is " to remove all working related to settled for less than owed. '' What it should say is just Ch XXXX BK and give directions to the XXXX to remove all other verbiage more specifically to remove the " settled '' verbiage. I discuss the last letter you sent with the Bureau 's and unless it tells them to remove the " settled '' working, they will not remove it. Again, this is the working that is not allowing me to get a new home loan and as I file BK against the loan XX/XX/2009, I am no longer responsible for the loan and it can not go against my credit after the BK. Please address this issue immediately so I do not lose the home that I have an offer on.

Complaint: My mortgage servicer, Rushmore Loan Management Services, did not pay my property taxes. I sent them the bill multiple times, contacted them by phone and mail. They promised to investigate but the taxes are still overdue. There is more than enough money in the escrow to pay the taxes but they have not done anything. I do n't know how to handle this. The tax bill is already overdue with assessed penalties and could go to collection.

Complaint: I modified my loan and any thing I owed was put on the back of my loan my sevicer states I owe XXXX in fees. I have never missed one payment since I modified my loan XXXX/XXXX/XXXX I 've showed proof on my original modification agreement with XXXX ( XXXX ) then it states my loan is up in XXXX/XXXX/XXXX which my modification clearly shows my loan is up XXXX/XXXX/XXXX. My loan servicer literally gave me a new ending date for my loan over 40 years more. When I clearly took out a 30year fixed rate. An after I modified my loan and was approved my ending date is now XXXX/XXXX/XXXX. Plus I 'm im owed for the forced insurance that was put on my house when I already had insurance it took three weeks to get this straight and I was told/writting that it is being credited to my account yet I 'm being told I owe late fees which if I ever pay my loan pass the XXXX of the month I always add first it was XXXX $ then I was told it was XXXX $ In late fee charge ( I always put the fee in as I am obligated to ). I believe this servicer ( s ) are doing illegal practices to rob unsuspecting consumers. I 've ask in writting at least 2 time to show me in writting how I owe these funds because my bank records clearly show I have never missed a payment since I modified my loan and ever thing I did owe was put on the back end of my loan. So I 've come to the conclusion that this is not my loan!
