Complaint: We feel like we are being scammed out of our home. Rushmore Loan Management Services and law firm XXXX XXXX XXXX, XXXX. are trying to foreclose on our home. We completed a chapter XXXX discharge in XX/XX/XXXX. Neither of them had nothing to do with the bankcruptcy process. After the discharge was complete we started getting contact from Rushmore Loan Management. We told them that we owed them nothing and reported this information to our attorney. They tried to bully us into a modification. We said no. They sent us paperwork anyway saying we had a modification ( attached ) .XXXX again, we informed our attorney. Later we got a letter from XXXX XXXX XXXX saying they would foreclose and kept getting information saying we owe money from Rushmore Loan Management ( attached ). We received a lettter from XXXX XXXX XXXX saying that our house would be sold on the courthouse steps on XX/XX/XXXX ( attached ). On Monday XX/XX/XXXX someone from XXXX Foreclosures left a notice on our door. ( attached ). We did not get any legal documentation saying that they had went through the court system. Since they were not part of the bankruptcy process, we can not understand how they got the right to foreclose or modify our home previous home loan. We want it handled properly. We do not want to owe them or any one else any money when this is all over. We think this is a scam or they would have went through the court system for a proper foreclosure. Original home loan was with XXXX mortgage and then transferred to XXXX Mortgage ( attached ). Something is not right about the way this entire process is being handled.We want the federal and local law involved if a foreclosure is going to occur

They demanded that I pay all past due amounts -- there are none -- and sign up for their automatic withdrawal. ( I send the payment via XXXX every month on the due date, and it is received by Rushmore that day. )

Complaint: misrepresenatation and changing of XXXX trust loan terms after loan was laundered by XXXX and nationstar. this XXXX trust predatory loan violates multiple us federal consumer protection laws and including respa and tila. rushomore created along with XXXX a new loan for the XXXX trust to piggbank the creation of anew XXXX trust loan by XXXX that I have been complaining about to us cfpb since it happened it XXXX. I received notice about this from Transunion credit bureau about both loans being created by XXXX and rushmore loan mgt services in XXXX XXXX and their offices in XXXX. the point here is that on their website the maturity date was changed from XXXX to XXXX and it is impossible that this loan will amortize to XXXX by XXXX which the rushmore rep told me it would after refusing to give me my amortization statement that would show it was full amortized and there was no balloon payment. both these companies have defrauded me for years. the text below is the complaint I sent to them demanding documents and I contacted their v.p as well in writing about this in the past since they cut me off their online mortgage servicing site so I could not get any information while they were coordinating an alleged foreclosure strategy manufactured default in XXXX today XXXX/XXXX/XXXX I received notice from rushomre I did not make my XXXX payment but on their website they did and I have the cancelled check they XXXX both sides. below is my complaint to them. this inquiry about the maturity date for this loI am writing an. I was told by your representative several years ago that this loan was fully amortized to zero and would be fully paid off since it was a 25 year loan with no balloon payment. maturity date of XXXX not XXXX as it states on your website. by my calculations, this loan can not be paid off by XXXX at a payment rate of XXXX per nonth for seven more years through XXXX. I requested an amortization statement that would document his statement to me about this but he refused and told me I HAD TO WRITE A LETTER. SO THIS TIME I AM WRITING THIS INQUIRY IN ORDER TO REQUEST A FULL AMORTIZATION SCHEDULE SHOWING WHAT THE MORTGAGE BALANCE WILL BE AT THE XX/XX/XXXX. YOUR REPRESENTATIVE TOLD ME THAT THERE WAS NO BALLOON PAYMENT ON THIS FULLY AMORTIZED TO XXXX BALANCE LOAN BUT THE MATURITY DATE WAS XXXX. XXXX PLUS XXXX EQUALS XXXX. IN ADDITION, XXXX CREDIT BUREAU SENT ME A NOTICE THAT NOT ONLY XXXX XXXX BUT ALSO RUSHMORE REPORTED TO TRANSUNION THAT IT HAD CREATED A NEW XXXX TRUST LOAN ON MY HOME WITHOUT MY PERMISSION TO DO SO WITH NO TILA or RESPA notices as requird by the recent us supreme court in XXXX, XXXX legal decision that Truth in LENDING LAWS MUST BE COMPLIED WITH. SO THIS REQUEST IS FOR ALL LOAN DOCS FOR THIS NEW XXXX MATURITY XXXX MORTGAGE LOAN THAT I NEVER APPLIED FOR NOR APPROVED AND THAT RUSHOMRE SENT A NOTICE OF IT TO XXXX CREDIT BUREAU AND I HAVE THAT NOTICE AND THAT XXXX DIGIT ACCOUNT NUMBER WAS ASSIGNED BY RUSHOMRE TO THIS NEW XXXX TRUST 15 YEAR LOAN. PLEASE ADVISE. SO UNDER THE PROVISIONS OF THE USCFPB AND THE US SUPREME COURT I AM GOING TO HAVE TO SEE ALL LOAN DOCS FOR THIS 15 YEAR LOAN INCLUDING ALL SETTLEMENT DOCUEMNTS ALL PROMISSORY NOTES AND ALL MODIFICATION DOCUEMENTS ON THIS LOAN THAT YOU RECEIVED FROM YOUR PREDECESSOR NATIONSTAR. IN EFFECT, THERE IS A BALLOON PAYMENT ON THIS LOAN SINCE THE MATURITY DATE SEEMS TO HAVE BEEN CHANGED FROM XXXX TO XXXX BY SOMEONE. MY HOUSE IS UNDERWATER FROM THE CRASH OF XXXX AND IT MAY BE VERY DIFFICULT TO REFINANCE ANY REMAINING BALANCE ON THIS MORTGAGE. Complaint: I had an FHA mortgage from XXXX XXXX XXXX. I was divorced and my husband gave me the house in the divorce settlement. I tried to get a modification from XXXX XXXX XXXX, but it was denied. Then, my mortgage was somehow sold to Rushmore Loan Management Services. It 's no longer an FHA mortgage, and they WILL NOT work with me to complete a short sale. They are demanding that I find a buyer willing to pay MORE THAN the original outstanding principal balance, and MORE than the current appraisal value. This will go to foreclosure auction on XXXX/XXXX/2015, and I will be forced to declare bankruptcy if they come after me for the deficiency, which I can not afford. How was XXXX XXXX XXXX allowed to sell my FHA loan and convert it to a conventional loan, and why was a non-HAFA participant allowed to acquire my mortgage? Rushmore has been totally uncooperative and expects this house ( with non-insurable aluminum wiring and in need of a new roof ) to sell for MORE than it 's worth and far more than I ever owed.

Complaint: XXXX was submitted XX/XX/XXXX. At the time I submitted this complaint, I had dealt with Rushmore Mortgage directly endeavoring to get them to stop the continuous daily calls I was receiving trying to collect on a mortgage for which I was not responsible due to bankruptcy. They denied having knowledge of the bankruptcy, even though I had spoken with them about it repeatedly and had written them repeatedly referencing the bankruptcy requesting them to cease the pursuit, they continued to do so. When they were unable to trick me into paying, force me into paying in retaliation they placed reported to my credit bureaus a past due mortgage amount that had been discharged in Federal Court. On XX/XX/XXXX Rushmore responded the referenced complaint indicating that they would remove the reporting from my bureau, yet it is still there now in XX/XX/XXXX. I would like them to remove it immediately and send me a letter indicating that it should not have been there in the first place and they are going to remove it from all my bureaus. Rushmore, when speaking to me, represented themselves as the new note holder, but when CFPB was involved, they identified themselves as the servicing agency for XXXX XXXX XXXX. This credit bullying and racial discrimination practices is damaging to anyone who is exposed to these tactics and this needs to stop. Them denying their intent and then walking away with no penalties of any kind is one of the reasons it continues. Please assist me in procuring the resolution once and for all.
