Complaint: Rushmore Loan Management Services LLC, a debt collector and servicer of the mortgage, on several occasions have authorized XXXX XXXX XXXX, to change the locks on my property. XXXX XXXX has illegally locked me out of my home, by breaking the lock, entering the home, removing valuable items, clothing, jewelry, removing food from the cabinets, etc. and replacing the lock on several occasions, leaving me unable to enter the property upon return which is late at night. I 've had to sleep in my car because of the illegal lock out. I 've replaced the lock at least three times in the past four months, at a total cost {$75.00}. I 've called and spoke, to both XXXX XXXX XXXX, the party who does the lockout and Rushmore to the manager on the account. The first lockout, I changed the lock and entered my property, which was then removed. On the second occasion, I called XXXX XXXX XXXX to inform them that the property is not vacant or abandoned. I was referred to Rushmore. After speaking with the manager on the account, he advised that I meet with their representative at the home and provide identification prior to be given the keys from the lock box to enter my home. I could not meet with them since I would have to leave my job to do so, and to be on their time frame. So upon return to my property, I again changed the lock and entered my home. This was again replaced by XXXX XXXX on XXXX XXXX, 2015. I have since replaced the lock and have placed trespassing signs on the property. Furthermore, on XXXX/XXXX/15 I have written a Cease and Desist letter to both Rushmore and Field Asset Services. The home is in foreclosure, but the debt collector has not proven that it is the proper party in the case, thus, the case has stalled and there is n't any activity on the case as of to date, and there is no judgment. This is very stressful and uncomfortable, because when you leave work and decide to drive 2 hours to get home and find the door lock changed, and you have to sleep in the car, as I 've had to do, this illegal activity must be ceased. I am hoping that Rushmore and XXXX XXXX XXXX comply with the Cease and Desist letter. I hope this agency can be of assistance in this matter.

Complaint: I have been victimized, XXXX by a toxic mortgage loan and now by a toxic foreclosure process in which the courts seem complicit. I feel like a poster child for XXXX XXXX XXXX A FIGHTING CHANCE. XXXX XXXX confiscated the remainder of an insurance payout after stonewalling my requests for payments for work done in accordance with the insurance adjusters estimates. Not only did they compromise my contractor, an independent adjuster whose funds were released only after he threatened to place a lien on my property, but they also precluded me from the right to appeal for funds to complete work on my property by demanding repetitive forms, letters, notarizations and an endless bureaucracy of paper work. They chose to release only the amount sufficient to pay the adjuster 's fee so that he would not place a lien, then they confiscated the remaining funds. My understanding was that they would apply them to my mortgage for approximately XXXX payments. Instead the chose to apply the money to the back-end principal, foreclosing on my property immediately upon a thirty-day default in XXXX before I even realized I was in arrears. I had no way of making my property whole out of personal funds and realized I was a victim of " foreclosuregate. '' I sought Legal Aid when Debt Collector/Foreclosure XXXX law firm XXXX XXXX filed the foreclosure in the name of XXXX XXXX Bank XXXX I was told that because of Sequester no funds were available. I was advised as to how to fight the foreclosure by filing an Answer. I followed the Agency 's instructions meticulously, and filed the Answer. When my foreclosure was scheduled for a hearing I again applied to Legal Aid for help, only to be told that they then could not help because I had already filed arguments on my own and that neither Legal Aid nor any other lawyer would want to follow on the foundation I had laid -- '' catch XXXX! '' Foreclosure XXXX, Debt Collection firm, XXXX XXXX XXXX pursued the foreclosure on behalf of XXXX XXXX until XX/XX/XXXX, when XXXX XXXX sold my mortgage to XXXX Bank XXXX as of. At the hearing of XX/XX/XXXX, before XXXX Courthouse, XXXX County PA, Debt Collector XXXX XXXX XXXX XXXX XXXX continued their representation, but then listing the Plaintiff as XXXX Bank XXXX XXXX Bank XXXX. as Trustee for XXXX XXXX. The judge rejected my request for an XXXX XXXX ) because they did not want to inconvenience their " roving robo-testifier '' who had already booked a flight from XXXX, TX, XXXX XXXX XXXX, Vice President of Legal Documentation for Rushmore Loan Management Services. It is understandable that XXXX XXXX was a bit confused as to documentation, after all his complany had owned my loan for barely six months at the time of his testimony. He answered Foreclosure Mill 's lawyer XXXX XXXX by attesting to how he travels all over the country in his VP of Legal Documentation to testify. The judge expressed sympathy for his schedule. I challenged XXXX XXXX testimony that Rushmore had placed my Homeowner 's Insurance, for instance. I pointed out that Rushmore had phoned my XXXX XXXX agent to make sure that Rushmore was on my policy, XXXX that I have been maintaining and continue to do so for more than thirty years. In a later filing of a motion to reassess arears, the XXXX of XXXX in their foreclosure action, the Debt Collectors alleged that they in fact held and paid for the insurance on my property and listed it on my obligations to them -- forced, " double '' placement? During the continued hearing on XX/XX/XXXX, I was allowed to present " my side '' according to XXXX XXXX. Complaint: I started my loan modification with Rushmore Loan Management Services in XX/XX/XXXX, We had come to an agreement just before the sale date of the house. The only problem was that I had never consulted with a Attorney, and I was afraid to sign any paper. I went and saw a Attorney and they suggested bankruptcy to stop the sale. Now Rushmmore will not agree to the original terms in XX/XX/XXXX, which was {$7500.00} and {$1500.00} per month for 3 month at that time a final modification if I was current. One week ago I gave them {$20.00} down and they raised my monthy payment {$2500.00} per month, setting me up for failure again. This is the payment I had before and was not able to keep up with it. I do n't understand this is no modification. My father use to help with the mortgage payment, since XX/XX/XXXX he XXXX at the age of XXXX, now he is XXXXyears old and all his social security goes to XXXX expenses..

Complaint: I need my mortgage modified. I have tried effortlessly to provide Rushmore Loan Services with the documents that were requested only to continue to be told that a complete package was not submitted. I would ask them what documents they needed and I faxed them accordingly. Whenever I would call to follow-up with my Account Manager, XXXX XXXX, it would take her XXXX days for her to return my phone calls. This has been my entire experience with her. On XXXX XXXX, 2015 I received a letter from a Foreclosure Attorney indicating that my home was scheduled to be sold on XXXX XXXX, 2015. I was so confused, because I was under the assumption that all of the documents that I faxed had been received only to find out once again that the same document that they requested previously was not received and this caused my loan modification case to be closed and they had moved forward with a sale date. I explain to XXXX XXXX that the last letter that I received from her indicated that I had XXXX days from the date of the letter to submit the document and that 's when she told me that I needed to have the information in XXXX days prior to the sale date. I feel that this decision was very harsh considering the time and the continued effort that I put in to make sure that I stayed in compliance and following all of the instructions that were given to me to be considered for a loan modification.

Complaint: Rushmore Loan Services called me on XXXX/XXXX/XX/XX/XXXX at XXXX XXXX ET to demand my XXXX payment, which I had made the day before -- the due date -- via electronic fund transfer. Just a month ago, Rushmore sent me a letter stating my account was delinquent, and I filed a complaint with this agency. The XXXX time they made a bogus collection call was XXXX XXXX XX/XX/XXXX. I had sent a check one week earlier, and the caller stated I was delinquent. I pointed out to the caller that according to Rushmore 's payment coupon there was a ten ( 10 ) day grace period! When I returned to work, I checked my bank account online and saw that my check had actually cleared MY BANK on XXXX XXXX XX/XX/XXXX! Rushmore is abusive and bullying. I recommend that they be severely penalized -- even shut down for this on-going pattern of abuse. How many victims do not know their rights, or have access to prove Rushmore 's abusive behavior?
