Complaint: rushmore loan management services is not applying my payments sent by XXXX on time in order to allegedly generate late fees and retaliation for me complaining to the uscfpb for not applying m y payments on time. it is all over the internet they do this and they refused to allow my bank and bill payer service to send my payments electronically by federal reserve ach money transfer that would end all of these games they play. so I sent the following message to rushmore and my bank 's bill payer service told me they mailed the payment from XXXX, California to rushmore in XXXX California and XXXX XXXX, 2015 and received by them and as of XXXX XXXX rushmore still has not answered my previous complaint to uscfpb not given me my amortization schedule for this predatory loan that I never applied for and complained to the XXXX credit bureaus that it is not my loan and never applied for it and have no settlement documents for. so here is the message i sent t o rushmore loan management services. my bill payer service sent me a notice that the payment for XXXX 2015 was mailed to you from XXXX California on XXXX XXXX, 2015 and you received it on XXXX XXXX, XXXX it has not been submitted by you for payment. it seems you did this last month and credited my payment after the grace period on XXXX XXXX, XXXX allegedly holding the payment for crediting for 8 days before applying to my account. this time you still have n't applied the payment. the payment was mailed to you and the money is in the bank to pay it. why not stop playing games in order to generate late fees. it is all over the internet you do this illegal practice. please apply my payment immediately. I have contacted my bank and their bill payer service to find out why you have n't applied my payment for XXXX 2015 per your letter to me to that effect that I received on Saturday XXXX, XXXX, 2015. as I said they still have not answered my previous complaint and when I called them in XXXX they solicited me to do a loan modification when I have never been late or behind they are doing this to manufacture a default by not applying the payments. and coordinating with XXXX bank that also manufactures defaults by not applying payments.

Complaint: I had my mortgage loan with XXXX for past 10 years. Suddenly, I received a letter on XXXX and indicated XXXX would stop servcie our loan from XXXX XX/XX/XXXX and Rushmore, and the new loan company who bought our loan would start servicing our loan. Also, XXXX told us that we should receive the payment coupon from the new mortgage company. That was why we did n't given our morgage payment in XXXX becasue XXXX did n't mail the payment statement and coupon to us. At the same time, we were wariting for the Rushmore 's payment starting on XXXX XX/XX/XXXX. But we could n't recieve it, so inteand sending our XXXX XX/XX/XXXX payment to Rushmore, we sent it to XXXX. XXXX the XXXX received it, they sent us a letter that indicated our XXXX XX/XX/XXXX payment would be transferred to XXXX but XXXX told us this would be the XXXX time for the XXXX. On XXXX XX/XX/XXXX, we still could n't receive any payment coupon from Rushmore, but we decided to mail out payment to Rushmore anyway. We did it and Rushmore cashed it. Since we have never and ever received the payment coupon from Rushmore, the new loan company, we started to feel it must be something wrong. We did n't send our mortgage payment on XXXX XX/XX/XXXX. In XXXX XXXX we started to hear their complaints and recevied a complaint from the court and they asked the court to collect our past ten month mortgage missing payments. They indicated that we broken the contract, etc ... We sent my XXXX XXXX, XX/XX/XXXX mortgage payment to XXXX, they returned it to me. We got all our mortgage payments history and sent to them for the dispute on XXXX XXXX, XX/XX/XXXX, but they still sent us Notice Of Intent To Foreclose and said that if we do n't pay them total of {$62000.00}, the missing payment from XXXX XXXX, XX/XX/XXXX to XXXX XXXX, XX/XX/XXXX before XXXX XXXXXX/XX/XXXX, they will initiate foreclosure proceedings ... etc.. We do have the missing payment money for total of {$24000.00}, the current XXXX payments we owe to them but they do n't want it and they are demading on {$62000.00}, that we do n't have it. I will hire a attorney to send a lawsuit against the XXXX and this may be the only chice we have at this time becuase there is no way the Rushmore can do what they want and take our home as granted. Complaint: This complaint is being submitted by XXXX XXXX XXXX ( XXXX ) on behalf of XXXX and XXXX XXXX. This complaint pertains to Rushmore 's violation of the CFPB 's loss mitigation procedures. On XXXX XXXX, 2015, XXXX faxed a complete Request for Mortgage Assistance ( RMA ) to Rushmore 's Home Retention Department on behalf of XXXX and XXXX XXXX. ( Exhibit A ). Pursuant to Regulation X of the Real Estate Settlement Procedures Act ( RESPA ), a servicer must " Notify the borrower in writing within 5 days ( excluding legal public holidays, Saturdays, and Sundays ) after receiving the loss mitigation application that the servicer acknowledges receipt of the loss mitigation application and that the servicer has determined that the loss mitigation application is either complete or incomplete. '' XXXX ( B ). To this date, XXXX XXXX, 2015, Rushmore has not acknowledged receipt of the XXXX ' application. It has been nine days since XXXX sent Rushmore the package ; thus, Rushmore is in violation of Regulation X.

Complaint: Hello, My mortgage loan was handled by XXXX XXXX XXXX before it was assign to Rushmore servicing Company a few months ago ), we have requested XXXX XXXX XXXX to send us payoff figures in order to payoff the loan in full, we have borrowed the money from a private source, paid the entire amount to XXXX XXXX XXXX ( this was back in XXXX XX/XX/2011 ), and instead of getting a satisfaction letter, we received a few months later a letter from the bank stating that the total payment was returned since it was {$800.00} short ( legal fees ) which by the way never appeared on the payoff statement. In the meantime, the total amount was higher because of an interest and other fees added to the principle amount, we have experienced a terrible family crisis ( XXXX of my daughters deceased in my family ) and loss of income which prevented us from making the mortgage payments, the amount owed, has become higher and left us no choice but falling behind with the mortgage payments. The property is no longer livable since we did not have the funds to maintain it and as of today it is vacant. As said before, a few months ago we have received a letter stating that the mortgage loan is no longer with XXXX XXXX XXXX and it was transferred to Rushmore servicing Company, when we called and asked for help, we have been told that they ( Rushmore ) ca n't help since all of this happened with XXXX XXXX XXXX and they will have to start a foreclosure procedure against our property. The only payments we were able to maintain since this happened about 3 years ago were for property taxes. It is sad to think that just because of {$800.00} we, a widow that have lost XXXX daughters in less then a year is facing foreclosure and a possibility of losing her home. We feel that neither XXXX XXXX XXXX or Rushmore servicing simply do not want to listen to us and try resolve this big problem we are facing and possibly lose our home. We have attached a detailed letter written by me to Rushmore servicing which is currently handling my mortgage loan and started a foreclosure procedure about a month ago. Thank you for your help

Complaint: We have been mistreated and misled by the representatives at Rushmore. We can not understand the poor treatment we have received during the servicing of our mortgage loan. Let me give a little background : I 'm a XXXX years. I XXXX in XX/XX/XXXX and we have lived in this community for 26 years. I had an accident at work, badly injuring my XXXX in XX/XX/XXXX. I rely on my XXXX for work ... this accident caused me to fall behind due to the recovery time and the job loss. Plus, my XXXX never completely healed, forcing me to work only in a XXXX. I am trying to go to school to learn a new profession to add to my existing job and maybe replace it. Once our construction loan converted to a home loan it was held by XXXX XXXX. When I got hurt and fell behind, we tried to catch up but then the loan was transferred to Rushmore. When that happened, it seems the fixed rate loan I signed up for became an interest-only adjustable rate loan. Our payment shot up from $ XXXX to $ XXXX within XXXX months!! Is that even legal? Once we reached out to Rushmore to try and get some help to get back on track with the mortgage, we were constantly being treated unfairly. In fact, a supervisor named XXXX XXXX had the nerve to say to me as I was trying to get a completed modification application submitted that I should " start saving money '' since he had to respond to his investors who were business men and I was just another file. I had n't even officially applied and he was indicating that my application would be denied and that I should start saving for what was coming. It was very negative and the exact opposite of helpful to someone looking to save their home and fix the problem that we could n't avoid. I was constantly submitting documents trying to complete the application for a modification of my loan, many of them submitted multiple times due to the complete incompetence of the Rushmore staff. I was never given a single person to deal with. I just repeatedly submitted documents to a department. And of course, my application was eventually denied as the supervisor had predicted. Rushmore 's entire operation acts like a group of bullies and thugs, not businessmen. I want Rushmore to take a hard look at the servicing history of our loan and give us some reasonable options to save our home and get back on track with our mortgage. I believe our loan qualifies for help and Rushmore should provide us with a loan review for a loan modification or restructure. Rushmore had turned our life upside down with deceptive, unethical and probably illegal activities and have proven that their organization is nothing other than a greedy company interested in profits without care for the wellbeing of Rushmore clients. I am very kind, but also tough and resourceful. Rushmore has left me no choice but to engage elected officials and regulatory agencies to help me against their tactics. Again, I built this home with my XXXX hands, so it is very important to me not to lose this home due to an unavoidable and unfortunate accident. I will do whatever I need to do to save my home. I am not asking for a handout, just to be given a fair chance with reasonable options to save my home. Thank you for any assistance you can provide.

Complaint: Mortgage company failed to provide me with sufficient notice prior to foreclosure. Only notice received was notice of foreclosure which was less than 37 days prior to foreclosure. I did not have time to submit loan modification documents in time nor dispute said debt. Once I was notified of foreclosure date I immediately sent in a complete loan modification package and was told it had to be submitted 37 days prior to foreclosure. Under the fair credit practice act Rushmore should had notified me at least a month prior to foreclosure action to dispute said debt.
