Attempts to collect debt not owed

Debt collection: Auto debt

Debt was already discharged in bankruptcy and is no longer owed
Complaint: In XX/XX/XXXX an auto loan was charged off the Pentagon Federal Credit Union in the amount of {$7100.00}. In XX/XX/XXXX, I filed for ChapterXXXX bankruptcy and this amount should have been included. Not to mention, after filing for Chapter XXXX bankruptcy again in XX/XX/XXXX, this amount should again have been removed from my records at the PenFed Credit Union. It is evident this charge-off that has stayed on my credit has undoubtedly had a severe impact on the type of credit I receive and the interest rate charged for the past 21 years. I kept this account open despite of the charge-off. Each time I go into the bank to withdraw my own funds, the tellers have to obtain an override - this is embarrassing. To add insult to injury, I am a XXXX employee - I am limited with funds to pay debtors. I was unable to open a checking account, obtain a debit card, and the like due to this charge-off. The PenFed Credit Union is offering assistance for members who have been with the credit union for at least 12 months. I was told by PenFed that I could obtain Direct Deposit Assistance. Meaning, if I was an existing member with PenFed and have an existing direct deposit into a PenFed deposit account, I could qualify for their Direct Deposit Assistance program. This program allows me during the government shutdown to take advantage of a 0 % advance on an overdraft line of credit in the amount of your most recent direct deposit from a qualifying government agency, up to {$6000.00}. For qualifying members with an existing overdraft line of credit will be increased by the amount of the direct deposit to accommodate the advance. For members without an overdraft line of credit such as myself, who otherwise qualify, an overdraft line of credit would be opened for me to accommodate the advance, and NO CREDIT CHECK is required for qualifying members. I was told I didn't qualify because of the charge-off still on the account from XX/XX/XXXX. The representative on the line indicated that even though I filed for bankruptcy, they still have the right to keep the charge-off on the account until they are able to collect the {$7100.00}. This is clearly a violation of bankruptcy laws and discrimination. I was told to contact a XXXX XXXX at the Credit Union, which I believe is a bogus name. This is false advertisement and acts of insensitivity during my times of hardship. I have {$1000.00} going to the credit union monthly. I was beginning to save funds, but in late XX/XX/XXXX I had two family members : ( 1 ) one who is now deceased ; and ( 2 ) another who has experienced severe health issues where I had to assist with other family members in burial costs and other expenses. I called in to ask questions, the representative on the phone didn't even offer me the opportunity to apply per their process. This is wrong. I meet the criteria for a Direct Deposit Assistance, especially since no credit checks are involved.

Getting a loan or lease

Vehicle loan or lease: Loan

Fraudulent loan
Complaint: Prior to purchasing a new truck in XX/XX/2018, XXXX XXXX, did NOT borrow money from Pentagon Federal Credit Union ( PenFed ). Instead he took out a loan with a different credit union. On XX/XX/XXXX ( and again on XX/XX/XXXX ), PenFed requested evidence of insurance coverage for the vehicle. On XX/XX/XXXX, Mr. XXXX, an active member of the military, died suddenly. On XX/XX/XXXX, XX/XX/XXXX ( and again on XX/XX/XXXX ), PenFed demanded proof that it was lienholder, threatening that failure to provide this information would result in a loan recalculation. Mr. XXXX 's surviving spouse ( and daughter who had power of attorney for her mother ) telephoned PenFed but PenFed refused to speak with either of them as they were not the borrower on file. On XX/XX/XXXX, Mrs. XXXX sent a copy of the death certificate by mail with a letter requesting proof of a loan because her records showed that there was none. On XX/XX/XXXX ( and again on XX/XX/XXXX ) PenFed sent an empty message of sympathy accompanied by a demand for the balance of the loan in the amount of {$26000.00}. Only after asking her personal attorney to call, was PenFed willing talk about the barrage of demand letters on a non-existent loan. On XX/XX/XXXX XXXX XXXX at XXXX XXXX XXXX, said that the loan was canceled the day before onXXXX, because the loan was never negotiated. The substance of this phone conversation was confirmed in a XX/XX/XXXX letter by XXXX XXXX, Estate Accounts Assistant. In this letter, PenFed acknowledged receipt of the death certificate, stated that the loan check had never been negotiated and there was no longer any open loan on file. However, PenFed stated that Ms.XXXX needs to complete a membership application in order to receive the small balance of the savings account funds and get the credit card transferred into her name ( but she would owe payments on any outstanding balances. There was no information as to what if any balance was owed on the credit card ). But the icing on the cake was sent on XXXX XXXX XX/XX/XXXX. The letter was addressed to the deceased (! ) demanding copy of the title to establish that PenFed is the lienholder on this NON EXISTENT LOAN! In a light most favorable to PenFed, this is an administrative error of epic proportion and the lack of empathy is appalling. In a light least favorable to PenFed, this is an attempt to fraudulently extort money out of a grieving XXXX XXXX widow for money that was never borrowed from PenFed in the first place.

Problem with the interest rate
Complaint: To Whom it may concern, I received a letter from Penfed stating that they will be changing me interest rate from 3.99 % as agreed upon in the contract to 14 % which I don't see in the truth in lending disclosure document that was signed. There changing the payments from {$770.00} to {$980.00}. Which is an {$11000.00} increase in finance charges to the life of the remaining 5 year loan. Mind you none of this stated on the truth in lending disclosure statement. There claim to this abusive charge is that I failed provide a title for the collateral. In Florida the title is electronic as stated on the Application for Vehicle Certificate of Title. Which was included in the paper work sent to Penfed. Upon the purchase on the registration of the vehicle I had Penfed Credit Union as the Lean holder which is stated on the Application for Vehicle Certification. I don't feel this fair nor even legal. I have attached all the paperwork that has been referenced. You may also contact the State of Florida to verify what is on the title. Penfed is acting in bad faith by attempting to add {$11000.00} in financing charges for something that they do already have as collateral as stated by the State of Florida. I look forward in your help to this matter. Best Regards, XXXX XXXX

Improper use of your report

Credit reporting, credit repair services, or other personal consumer reports: Credit reporting

Credit inquiries on your report that you don't recognize
Complaint: I have an unauthorized hard credit inquiry from Pentagon FCU appearing on my XXXX credit report. Ive attached a copy of the pre-approval letter from my credit union, XXXX XXXX XXXX ( who currently finances my vehicle ), as well as a letter from XXXX XXXX XXXX admitting my credit was ran in error. There was no reason for Pentagon FCU to run my credit due to having already secured financing through my own credit union. I am requesting that Pentagon FCU remove the hard credit inquiry from my XXXX credit report. I will pursue legal action, if necessary, to request the inquiry be removed from my credit report.

Managing an account

Checking or savings account: Checking account

Deposits and withdrawals
Complaint: Complaint against XXXX XXXX XXXX, insured by NCUA. Offers products to Consumers, such as bank accounts, loans, mortgages, auto loans, interest bearing accounts, popular banking products. Checking accounts are opened and rated by.Credit Bureau worthiness and credit score values. Consumers who's.credit scores don't meet the threshold of credit values ; are offered an alternative account. " Checking Limited '' accounts are opened with restrictions, ultimately designed to entrap Consumer from benefits, fees, funds availability, normal convenience and ability to make final transactions ; which are normal to everyday commerce. A Checking Limited Accounts, are no different than " prepaid ATM/Debit cards '', no different than " cash only accounts '', designed to operate only with " teller services only ''. ATM Visa Debit is attached, but.does n't function necessarily as credit rather debit, depleting funds ; ..when funds may not be made available ; given a " hard 5 -- 7 day hold on all funds '' ... checks, and cash via ATM machine. Consumers operating with a Checking Limited Account are doomed to be able to access funds in a timely manner and access positive balances after deposit is made. ONLY CASH is available immediately and only cash ; ... is the only way to make deposit. This product should be able to mature or expiration dates should apply, after Consumer has established a short or long term banking history. At this point, the only way to upgrade to " Checking Unlimited '' ... .is by additional credit ratings and credit scores scanned periodically after period of time. This method of banking is below standards and is only causing hardships, additional fees and mismanagement of personal banking needs.
