Consumer Loan: Installment loan

Complaint: I contacted the lender ( One Main Financial ) to refinance my high interest rate loan ( 33 % ). I have never been late on this or any loan/debt in over 24 months. I told them my credit score had increased from the low XXXX 's since origination in 2014 to XXXX today. I was advised that would allow me to get a better rate but they would have to make a hard inquiry to verify. I told then hard inquiries negatively impact credit ratings and I did n't want to go forward if there was no opportunity for a rate reduction. I was advised that the rate reduction was possible due to my score but they had to see the report. Once the report was pulled I was told no rate reduction would be offered even with a score of nearly XXXX. I was only then when I was told decisions are not score based but other undisclosed factors determine the rate. I was told to get their lowest advertised rate of 14 % my score would have to be nearly XXXX. When I asked why my score of nearly XXXX did n't get me a lower rate I was then told by another associate that the main reason for not getting a lower rate was utilization on XXXX credit card was near the limit and over XXXX % on another, I was not a homeowner and I had XXXX inquiries listed. I was told my score had nothing to do with getting a lower rate. This is a deceptive practice and harms the consumer trying to refinance their loans. The lender caused me to negatively impact my credit rating with a hard inquiry when my credit score had no bearing on their decision even though I was lead to believe so prior to authorizing the inquiry.

Consumer Loan: Installment loan

Complaint: I closed on a personal loan from Springleaf on XXXX in the amount of {$2500.00}. Interest rate in the LOAN AGREEMENT AND DISCLOSURE STATEMENT dated XXXX, page XXXX, indicated a : CONTRACT RATE of 26.26 % per year. On page XXXX of the above statement is the following : GOVERNING LAW. The laws of the State of Colorado shall govern this Agreement, except as preempted by federal law.I read in the XXXX XXXX that on XXXX, Governor XXXX vetoed House Bill XXXX, pertaining to subprime loan interest rates, partial quote from said article below : " Gov. XXXX XXXX vetoed a bill Thursday that would have caused people who borrow from subprime lenders to pay up to 36 percent interest on the first {$3000.00}. Lenders can continue to ask for 36 percent on the first {$1000.00}, but from {$1000.00} to {$3000.00} the interest rate remains at 21 percent and 15 percent for all amounts over {$3000.00} " Key in those excerpts is in the second paragraph, which states that : '' Lenders can continue to ask for 36 percent on the first {$1000.00} ... '' '' ask '' being the operative word.Further research indicates that the original Colorado statute that deals with subprime loan rates is in Colorado Revised Statutes, the applicable section as described below : Colorado Revised Statutes, XXXX speaks of limits on interest rates for various loan amounts, too verbose to include here. Key in the XXXX passage is the phrase " may contract for '' 36 % on balances less than or equal to $ XXXX.I contacted Springleaf Customer Service on XXXX by phone in an attempt to get an explanation of why my loan 's interest rate was higher than 21 %, since the amount financed was {$2500.00}. They were unable to answer my question and transferred me to Springleaf 's Executive Customer Service representative XXXX. After my explanation of why I was questioning the 26.26 % interest rate, XXXX indicated that she 'd have to consult with their legal department and that she 'd contact me upon receiving Legal ' s opinion. On XXXX I received a call from XXXX informing me that the legal department was still looking into the matter and that she 'd contact me when they reached a conclusion. On XXXX, I received a call from XXXX in which she stated that, according to Springleaf Legal, the first {$1000.00} of the loan had its interest rate set at 35.99 %, and the remainder of the loan balance was under a 21 % interest rate, hence the " blended '' rate of 26.26 %. She stated that Legal felt they were not violating Colorado law since in this case a split or blended interest rate was applied to the loan.NOWHERE IN ANY OF THE SPRINGLEAF LOAN DOCUMENTS I READ, SIGNED OR WAS GIVEN AT CLOSING WAS ANY MENTION MADE OF A 35.99 % INTEREST RATE, NOR WAS ANY MENTION MADE OF A SPLIT OR BLENDED INTEREST RATE.It is my contention that this loan was offered under fraudulent and deceptive pretenses, since absolutely no mention was made of the usurious rate on the first {$1000.00} or of the split/blended rate to be applied to this loan 's balance. This was not a {$1000.00} loan, it was a {$2500.00} loan.I was also told that since this was a short term ( 3 years ) loan, the 35.99 % rate was applicable. I was n't aware that a 3 year loan was considered a short term loan. Had I been aware of the splitting up of the loan balance into the 35.99 % and 21 % rates, I WOULD NOT HAVE ENTERED INTO THIS CONTRACT and would have sought the needed funds elsewhere. I was never informed of a split 35.99 % interest rate until I questioned Customer Service about it. It is my opinion that the split interest rates I 've described above were applied in a disingenuous and deceitful manner and that this was executed by Springleaf as perhaps an attempted work-around to the recently vetoed XXXX to defeat the intent of XXXX XXXX. No attempt whatsoever was made to inform me of a tiered interest rate structure for my loan. The loan amount was for $ XXXX, not XXXX

Complaint: XX/XX/XXXX or XX/XX/2015, I referred my mother XXXX XXXX to apply for a personal loan at OneMain Financial in XXXX XXXX, MD. There telephone number is XXXX.My mom 's loan was approved. Also, I have been a customer with this company for approximately 3 years and have referred others to the company. My mother called to inform me that I can be rewarded for referring people and I would receive {$100.00}. When my mother informed me of this, in XX/XX/XXXX or XX/XX/XXXX, I contacted the company and spoke to XXXX XXXX. I asked XXXX XXXX if I could be reward for my mother 's referral. XXXX XXXX stated that normally it has to be done at the time the customer completes the receives the funds. However, XXXX XXXX said that she would contact her manager to see if they could give me the offer. XXXX XXXX called by back to say that she was going to do it this time but in the future I would have to give my clients a number ( she provided me a number ) so that I could receive the {$100.00} for referring them. On XX/XX/XXXX, I contacted XXXX XXXX asking the status of my {$100.00}. XXXX XXXX told that that since it was too late she could not do it. HOWEVER, IN XX/XX/XXXX SHE TOLD ME THAT SHE DID IT AND IT WILL TAKE 6 TO 8 WEEKS TO RECEIVE THE CHECK. THIS IS FALSE LIES TO A CUSTOMER AND POOR CUSTOMER SERVICE. WHY XXXX XXXX NEVER CALLED ME BACK TO SAY THAT THE DECISON HAD CHANGED. YOU MEAN TO TELL ME THAT {$100.00} WILL HURT THIS COMPANY MUCH AS I HAVE BEEN AN CUSTOMER AND MY FAMILY. I FEEL THAT ONEMAIN SHOULD AWARD ME THE {$100.00} SINCE XXXX XXXX STATED THAT SHE PROCESSED THE ACTION. IT IS UNPROFESSIONAL TO RUN A BUSINESS TELLING CUSTOMER FALSE INFORMATION. IT IS NOT GOOD CUSTOMER SERVICE FOR ME NOT RECEIVING A FOLLOW-UP CALL TO INFORM ME THAT THE ACTION WAS REVERSED.

Complaint: Good day XXXX, I want to say that I am XXXX XXXX veteran XXXX female. I am not sure if you are the right agency to contact about my personal concern with how I was questioned by a financial institution when I requested and applied for an online loan. I applied for a small home improvement loan through I can not remember if it was through XXXX or XXXX. OneMain Financial online lending institution was one of the potentially interested online lenders of my application request. It was about XXXX XXXX, XXXX, the agency wrote to me through email asking me to call. I called and was asked a bunch of questions about my monthly incurred living expenses. If I remember correctly he took down the information and said that he would get back to me. I received a call one morning when I was asleep I answered the telephone and it was OneMain Financial calling waking me to ask more questions when I thought that I had answered everything on the first call. If I can remember it correctly I was still sleepy not really focused for the day ahead of me and he asked me out of the clear day if I ever filed a bankruptcy. I struggled to understand what and why he was asking I am also moderately hearing impaired. So I repeated what I thought he said however I asked if he asked me if I filed for bankruptcy in the last seven years. He repeated had I ever filed for bankruptcy I remember thinking can he ask me that? I thought I was protected if it was more than seven years ago and that I did not have to answer. I was perfectly willing to be told no OneMain Financial would not loan to me. He insisted as I said I was waking up and I did not want to respond but found myself responding yes. He asked when my bankruptcy was filed. I told him in XXXX XXXX. That was more than 20 years ago and I was frightened into it by the creditor XXXX threatening that they would send XXXX truck to my living place to pick up the money that I owed them. I was scared and I filed rather than be subjected to intimidation I had also recently received a telephone death threat and we were talking by phone. I received another call by a female who asked me similar questions as the first XXXX people and instantly told me I could not be approved. My concern is did this online financial institution OneMain Financial have a legitimate right to ask me about my credit 20 years ago when I had lost a job, and was near homeless. That XXXX XXXX on my birthday I was evicted and spent 10 years homeless. I was reminded of that period of time in my life it caused me emotional distress. I hope if you are not the right agency that you XXXX will point me hopefully in the right direction of who I should direct my concern to. Thank you.

Complaint: I 've had a loan since XXXX XXXX with XXXX, now Springleaf.. Last month they failed to withdraw the regularly scheduled payment and sent me an e-mail saying I needed to contact them about an important matter regarding my account. The e-mail was sent on XXXX XXXX, XXXX. I called, not knowing what the problem could be. I was told by a customer service agent that I did not make my payment for the month of XXXX ( which is normally withdrawn by automatic payment on the XXXX of each month. ) I asked how and why this happened and was made to feel that I was at fault. I asked to speak to a manager. I spoke with XXXX XXXX XXXX and he proceeded to tell me the same thing as the customer service rep. They both indicated that payment had been sent to my bank, and the bank told them there was no account with the number they submitted. I asked what changed since the beginning of the loan, we have never had any such issues previously. He finally admitted that they had made an error on their end, but still proceeded to make me feel it was my fault. He asked for a number to call me back later that evening after he could do some investigating, but I never received a call from anyone & have not til this day. About two days later I received a letter ( dated XXXX XXXX ) addressing me as if I had failed to make payment. A couple of days later, I received a bill indicating I had a missed payment. When speaking with them on the phone I asked why I had n't been contacted by them prior to this conversation, I was asked why I called them. I told them because I received an e-mail. I told them if there was an issue, why did n't you contact me in XXXX, not a month later. My question is should n't they have to cover that payment since they made the error? I have n't changed anything on my end since the beginning of the loan. They are now saying that I owe a double payment. I 'm currently waiting to see if the XXXX payment comes out of my account. What could be the reason that they changed my information and evidently put the account number down incorrectly. He kept saying they are now doing " direct pay '' and if that means I need to be sure to get the payment to them, why did they not ask me to set that up? I hope you can provide some light on this issue, so I will know my rights. Thanks!
