Complaint: IN XXXX my husband and I got a secured loan through XXXX XXXX XXXX that had four properties as collateral for this loan ( XXXX ). This mortgage was bought by Ocwen who we continued to pay for until XX/XX/XXXX when we paid off the loan in full. We never missed a payment, always paid on time, and paid all owed taxes in escrow as they asked. We PAID OFF this 16 % loan in FULL on XX/XX/XXXX. Recently, we are selling three of these properties ( XXXX XXXX XXXX XXXX, PA, XXXX XXXX XXXX XXXX, PA and XXXX XXXX XXXX ( XXXX XXXX, PA ). We have found that OCWEN FAILED to file satisfaction for any of these properties. We have a closing scheduled for within a week ; only to find that we can not close because Ocwen ( even though they have had a YEAR to file these MANDATED PAPERS ) has FAILED to CLOSE PROPERLY by not filling these satisfaction papers in either XXXX XXXX, PA ( where XXXX and XXXX are located ) or in XXXX XXXX, PA ( where XXXX XXXX XXXX is located ). My husband is having XXXX XXXX XXXX that we need these monies for and can not complete the closing because Ocwen ( even with NUMEROUS calls ) refuses to do. Infact even after getting TWO attorneies involved OCWEN refuses ( even though I granted permission for them to talk to these attorneies ) to return numerous attempts at resolving this issue. My understanding is that these satisfaction fomrs should have been filed in the appropriate county office within 90 days. It has been a YEAR ( 365 days ) and they are still not filed. In addition, Ocwen is asking ME and my Attorney for information on my account ( claiming they can not find my loan information ). We have faxed, called, and tried to get this information to them ; with no response and no immediate action. We may very well lose these sales due to their not doing what is MANDATED for them to do.

Complaint: My mortgage company conducted an escrow analysis on my account due to my taxes decreasing there is a surplus due back to me and they are refusing to send me I spoke to representative XXXX agent # XXXX on XX/XX/18 he advised me that the escrow surplus will not issue until 30 days. I advised him I never heard of that before the escrow surplus should be issued when the escrow analysis is completed if the account is not 30 days past due and my account is current. He advised that is our policy I advised the rep that is not Respa policy he stated that is Ocwen policy. I advised the rep I would like to speak with a supervisor he transfer me over to supervisor XXXX agent # XXXX. I asked XXXX to please have my escrow surplus rush XXXX said no it will take up to 30 days for me to receive the escrow surplus I asked her why it can not be rushed she stated it is Ocwen policy and they can not rush it I have to wait the 30 days. I then asked her the name of her CEO she did not know and hesitate to provide the information. I asked to speak with her manager and she told me no non was available to speak with me. This is just crazy. All I am asking Ocwen to rush my escrow surplus and I have to go through all of this mess and have to treated my reps like this I pay my mortgage every month and do not feel like I should be treated like this.

Complaint: Ocwen Loan Servicing failed to resolve unfair deceptive issues before they transferred or sold my mortgage to XXXX XXXX XXXX. I requested loan remodification under the Harp Program when I took very ill and missed 2 payments. Instead Ocwen inaccurately adjusted my mortgage to a higher amount ( initially XXXX XXXX-payment {$300.00} for 240 months at 9.90 % interest rate ; in XX/XX/XXXX-balance of {$36000.00} was modified by Ocwen ), did their own modification, and did not apply my previous payments of over 10 years prior. After months of inquiries and unresolved complaints, Ocwen transferred my mortgage. My mortgage suppose to be {$0.00} this year. After I inquired to my current mortgager, XXXX XXXX XXXX of final payment, I was informed they had to investigate and review file as mortgage info was confusing and not accurate in file. Now again, XXXX is transferring mortgage to another company also. I never missed but 2 payments which was in XX/XX/XXXXwhen I became ill ( was on XXXX ) and those payments were brought current in XX/XX/XXXX.

Complaint: RE : Loan # XXXX XXXX XXXX On XX/XX/XXXX I received a answer back from your Ocwen s account anaylist XXXX XXXX when i pointed out all the fraud that the company that he works with and represent. He defence was such : " we can not comment on actions taken by " that '' servicing company. '' So my question to the gentleman is : Before you foreclosure me. If you want to do things right don't you think you should check every paper that, that prior company placed in court so you don't commit the same fraud? Since your company said the investor is the one who does not want to modify my loan so after just 2 weeks ago I requested from your company the XXXX from my loan. Because I thought : _Oh ... well, you must have it already in hand if you are denying my loan on bases of the investor been the one who does not want it. As of today they send me a letter saying that they had send me what I requested but. guess what? I never got it. this is the letter that I have sent to you. " Last week a received a call from your company. The represent told me that you guys where working on a in house loan modification and by last week you would give the the final figure and that every thing was ok and you just needed to give me final numbers.which i though it was very wise from you. Since my loan has so many fraud. You can not deny it.because again attorney general, etc, has send checks after checks apologizing for frauds you committed against me. Me and my family were happy with you decision that finally we would get our peace of mind back. we even went out to celebrate with our kids that blessing. But it is known the cruelty your company does with home owner! Sad to say today I got again some of your cruelty again because again today your representative came up with another story. They told me today that you can not modify my loan because there is too much interesse to pay. And also " the investor '' does not want that. Right now I'm challenging you to prove to me in court the investor has a say on it. First you dont even know who is the owner of my note after so many selling of it on XXXX XXXX. Even the representative of investors in the XXXX XXXX says only the servicer can decide when to modify loans. you are The SERVICER. Also XXXX XXXX XXXX XXXX XXXX spokesman XXXX XXXX says its misinformation to say that investors make these decisions.it is very rare for the language iven to exist on the XXXX So you are the ones who does not think you are going to gain as much as if you sell my loan.Again the house is in rehab. Every thing is on hold right now referent to that. I was fixing Walls has damaged through the years. ( 11 year ) Kitchen i'm putting new cabinet, fixing floor etc. Im experrient on that. I will be suppressed for it condition if you can make XXXX on that. Therefore you will loose more money if you sell it.apart of putting more name of fraud under your companies name, because I'm reporting every thing you are doing in my loan .also more money to loose because I'm about to go back in court to fight again. I m not taking vantage of the situation and asking for a free house. I just want a fair modification. I know you are doing the math and thinking you better off to selling it then work with me. But please don't test my intelligence. I know there is not investor in this. It is you who don't want to modify. You can say you were not taking care of my loan when all this happened but you can not close your eyes to some thing that is under y our authority at this present time. Complaint: Paid reinstatement amount stated by Ocwen in XX/XX/XXXX for {$25000.00}. Loan was reinstated Next payment was due XX/XX/XXXX. Ocwen applied funds to account and state I owed another {$6500.00} in XXXX. I contested this and was stonewalled when I tried to call on numerous times with the person on the phone who promised that this would be resolved. My account was frozen in XXXX stating I owed {$1000.00}, but they refused to use money in a suspense account totally {$1000.00}. No resolution was ever offered to apply funds properly. Account went into foreclosure Property sold to Ocwen ( XXXX XXXX, XXXX ) on XX/XX/XXXX. Have been trying to speak to someone about purchasing the home, but have not been allowed to speak to anyone who can make this decision. I have retained a lawyer who has tried, unsuccessfully, to speak to someone at Ocwen, they have continually referred us to a company called XXXX. This would have never gone to foreclosure if Ocwen honored the reinstatement in XX/XX/XXXX. Through their accounting, application of the {$25000.00} payment, and refusal to allow me to speak to anyone higher than customer service when I call in, have taken my home and given me nothing in the way of any recognition or resolution to the XX/XX/XXXX payment or suspense account money that was never applied.

Complaint: I have been paying ahead on my loan sending in additional money writing on the money order and sending a letter with each additional payment that these were principle only additional payments. I called on XX/XX/18 for a pay off and to inform them that they other money I sent in was for principle only. They informed me it would take 3-4 days to fix the payments and then another 3-4 days to give me a pay off. I informed them that this was unacceptable. I would be paying interest for almost 2 more weeks because they can not figure a pay off. I want a pay off so the interest is stopped. Please help! Complaint: I refinanced my loan back on XXXX ending with a conventional ARM loan, currently with an interest rate of 7.75 %. I was able to maintain my payment on time until I was forced to retire back on XX/XX/XXXX due to serious medical condition. I am now depending on my social security benefits and a small pension from XXXX. Due to the income reduction I was also forced to file for bankruptcy in the beginning of XXXX, finally discharged on XX/XX/XXXX. I contacted a Housing Counseling Agency since XX/XX/XXXX after getting a steep increase in my payment. My housing counselor has submitted the workout package along with my financial documentation for a couple of times and I have been following up closely since then. I am know 60 days behind and the lender keeps arguing the bankruptcy case must be " dominated '' to process my application. I have gone back and forth to the bankruptcy court and their staff had clearly stated the bankruptcy is done, shouldn't be an impediment any more. My counselor recommended to report my case to you agency, hoping to get an answer from my lender.
