Trouble during payment process

Mortgage: Conventional home mortgage

Complaint: Our mortage loan originated with XXXX in XX/XX/XXXX. It was two parcel 's in one purchase combined and escrowed conventionally as one loan for $ XXXX, deeded together as one. Currently, we 've been with XXXX XXXX for about 4-5 years and have had nothing but issues. We were previously with XXXX XXXX who sold us to XXXX XXXX. In the middle of the Ocwen/XXXX transfer we filed bankruptcy to save our house ( XX/XX/XXXX est ) due to the economy, which never went through because we found the money to pay our way out. In the middle of the transfer between mortgage companies Ocwen, foreclosed on us without our knowledge on the auction block due to back taxes that XXXX never paid. We got as far as the deed changed over to another person due to taxes not being paid on the parcel of land our house sits on. We have another parcel attached that our land only on that were purchased together in the original loan explained above. My husband fixed the deed with Ocwen by calling them every single day for roughly two months while threatening lawsuit and bad practice because we were foreclosed to the sum of $ XXXX estimate in taxes that XXXX XXXX never paid. After the " foreclosure '' we were forced to sign a refi agreement ( Obama plan- but the numbers were skewed and we could n't get an answer on why ) with Ocwen in order to keep the home and for them to " research '' the $ XXXX that XXXX never paid. We gave birth to our XXXX child in this time line and were terrified of being homeless with a new baby. To date Ocwen has still have not cleared up or given us documentation on this issue but only the explanate. It was considered " lost '' per their books, but the deed was corrected with the county by switching it back to our name and all was well in regards to the XXXX in back owed taxes ( we think )? We never have found where our money has gone in the past 12 years, but we still owe over $ 200k on our home when our original note was $ XXXX. The only money we know that was accounted for was the $ XXXX down payment we put on it as a down payment to XXXX. Fast forward to summer of XX/XX/XXXX and, we hit hard times with a medical issue with our youngest ( we now have XXXX children ages XXXX, XXXX and XXXX ) and were out of work 6 months while living in the hospital. We reached an agreement with Ocwen to go on a re-payment plan this fall to correct our back payment and signed off on a new amount for one year for double our payment to catch back up. We paid early, quickly and on time. We made two payments on this plan, one in XX/XX/XXXX and one in XX/XX/XXXX. We paid our XX/XX/XXXX payment, as agreed and everything seemed fine. We received a notice yesterday that our escrow is now more than double the amount of last year ( our taxes do not justify this ) and we owe $ XXXX as a payment. We called and they have no answer for us, everything is still offshored, and they returned our payment made on XX/XX/XXXX, a week or so ago without our knowledge or notifying us. There is no reason for them to return the payment as we now pay them out of a separate account because we are scarred from the nightmare we have had dealing with them and the money is still there. It now appears we are in default of our payment agreement and they have no explanation for the escrow amounts and now our land is showing a different address that is no longer escrowed with our house parcel which was all in the orginal note to begin with. We are supposed to pay the 10 acre land taxes out of pocket, which does n't make sense since we pay into an escrow per our original agreement 11 years ago. We ca n't get a clear answer, clarity or anything and know we are past the point of " fixing '' it. We feel a deep dive investigation in our case would find significant fraud, deceit, mistakes in accounting and monies owed on our account by various mortgage companies.

Debt collection: Mortgage debt

Attempted to collect wrong amount
Complaint: Because of the market crash and my home value decreasing so that I could n't sell it for what was owed and other personal harships, on XXXX XXXX 2013 My home was foreclosed. The 1st lienholder XXXX XXXX received release from the 2nd Lien holder GMAC to foreclose on the property. After foreclosure the 1st lien sold the home for the full mortgage amount. I called GMAC the 2nd lien holder to see what would happen at that point since they did not receive money from the sale. They said they filed bankruptcy and wrote it off. Within the next year I started receiving calls from a company called XXXX XXXX XXXX who said the debt was sold to them and they are collecting it. XXXX XXXX XXXX is showing this debt on my credit as an open mortgage with late payments every month. I did some research and I found that legally GMAC should n't have sold the debt if they filed bankruptcy and wrote it off but even if it is okay for them to do that, the Collection company since they were not the original lien holder can not show this on my credit as an open mortgage with late payments every month and continued interest etc ... I have filed a complaint with the 3 credit bureau companies and XXXX refuses to do anything about how it is being reported ; however the other two have updated it. My complaint is against XXXX XXXX XXXX and XXXX. Please help me in straightening this out. I understand the debt has to show on my credit report but at some point it will fall off but as long as it shows an open mortgage it will never come off and it looks like I am paying late mortgage payments every month and I am not.

Complaint: I got a Loan with GMAC 14 years ago for XXXX. After 7 years ocwen bought them out and I modified my loan. I am actually losing my house now to a short sale or worse foreclosure. We had a short sale set up and the 2nd, my equity line if XXXX decided to foreclose. The sale was set fir yesterday. However they cancelled the sale and now I think the short sale will take place. But ocwen has said my payoff after all these years of paying is {$610000.00}. The original amount of my loan. Please excuse my ignorance but I do n't know what to do. I 've called them at least 20 times and they always say I 'm right, this does n't make sense. Then they transfer me. I never get anywhere.

Problem with a credit reporting company's investigation into an existing problem

Credit reporting, credit repair services, or other personal consumer reports: Credit reporting

Their investigation did not fix an error on your report
Complaint: Ocwen recently started reporting Re-Aged Disputed Mortgages that had already been removed over a year ago due to the 7 year Limitation. The Accounts last reported delinquent payment was in 2009. It appears they simply removed the old Info and started re-reporting even with False information of a payment even though one was never sent and the Historical Information they provide clearly shows no payment has been received. The issue is compounded with trying to deal with XXXX. Even though XXXX has and was provided documents from themselves in the past they simply send back a letter saying Ocwen states they reported correctly ( Information is blank or conflicting ). The agents in the call centers have no ability to do anything but re-dispute. When I have been able to actually speak to a empowered person like a supervisor at XXXX XXXX for example they actually review the documents with me and clearly see the issue with a resolution. The XXXX agents appear to be not USA based and never allow you to even get to the Survey to complain. I have actually let my phone sit on mute for almost a half hour to be hung up on. This same issue has happened to my husband 2 times in the last few months again with OCWEN and XXXX. XXXX needs to fix its dispute system and OCWEN needs to be held liable for the abuse of its reporting

Complaint: Ocwen is claiming my property tax is {$4200.00}. I asked them were they came up with that amount and all they could tell me was " a web site ''. My taxes are {$2900.00} and I provided them with the actual tax bill from my town office. They " investigated '' it and two weeks later basically said I was wrong and they were right. This has caused my yearly escrow with taxes and insurance to go from {$4200.00} to {$6100.00}. They are collecting an additional {$1800.00} a year from me without any explanation as to where it is going. I have tried several times to work this out with them but they wont budge. They call me and when I answer the phone no one is there. Then the next day I get a email stating they called me but I wont respond. I have called them but only have been allowed to leave messages. Any help would be great, I 'm a single parent and cant afford the higher monthly payment that seems to go nowhere.

Struggling to pay mortgage

Mortgage: Conventional home mortgage

Complaint: In XXXX my grandmother filed for chapter XXXX bankruptcy. She did not put our home under the bankruptcy and was given a loan modification. This was due to an income change because she had a series of XXXX. She XXXX XXXX in XXXX. Right before she XXXX she was a couple of months behind on her mortgage payments. I contacted the company to resolve the issue and take over the loan. My sister and I applied for a loan modification and it was granted in XXXX of XXXX. When the XXXX payment was to be made the relationship manager assigned to my case do n't send in the payment until further notice because there was a mixup with the paperwork and someone would be in touch with me. The verbal reason I was given after many attempts was that I initiated the payments too early. They then said we skipped steps. I did everything that was asked of me. They then said the debt was discharged in a bankruptcy but the house was n't entered under the bankruptcy. I showed them proof from her lawyer that it was n't. I 've been fighting Ocwen Loan Servicing LLC for the last for years and the company has foreclosed on my home. We 've had this home for over 40 years and I feel there was a predatory scam ran on me to keep the home. We have been at this for years and I just want to retain the home. There was a company that did an initial look into the matter but wanted {$3000.00} with no guarantee of results. The loan amount has gone up to {$150000.00}. XXXX XXXX is the bank that held the loan. We 're raising an XXXX child and teenager and our home is security and stability for the children. When I went to the court to stop the sale the company adjourned the sale and pretended to want to work with me but I had to get in contact with their lawyers to find out that was n't happening. No one contacted me. Every contact was initiated by me.
