Dealing with your lender or servicer

Student loan: Private student loan

Received bad information about your loan
Complaint: In XXXX of 2018 Navient agreed to a rate reduction program. Come to find out it was " processed incorrectly '' Went thru the footwork again in XXXX of 2018 for the rate reduction program. Have since received numerous notices about delinquencies while they were automatically withdrawing payments from the checking account. Each time customer service was called, no one knew anything about the rate reduction program. Part of the rate reduction program says it would take effect after 3 consecutive payments. Because the program wasn't processed correctly originally, the first payment didn't count. They did an automatic withdrawal for XXXX and XX/XX/2018. They did not automatically withdraw XXXX 's payment and then came looking for payment as if to purposely force a default on the loan, so they wouldn't have to keep up their end of the deal. They have also put thru a forbearance, that was never asked for or applied for, and have not reduced the rates as promised. Every phone correspondence I have gotten the runaround and harrassed about paying more money. Every agent I have spoken with says " Well I don't know what the last person said or did, so I can't help you. '' The loan has continued to accrue late fees eve though I have kept up with my end of the agreement. I believe I have been misled, lied to, and taken advantage of.

Don't agree with the fees charged
Complaint: On XX/XX/XXXX XXXX was debited from my checking by Navient through an electronic check ; the check noted " Verbally Authorized by Your Depositor ''. While Navient has my permission to obtain electronic monthly payments from me on the last day of every month, for a calculated payment, mine for the past six since months ( since XX/XX/XXXX ) has been XXXX. I never received any correspondence informing me my payment was going to increase. I went through this same dilemma back in XX/XX/XXXX when they charged me {$700.00} without informing me of the changes. While they did refund me for that incorrect amount at the time, it was painstaking. While I have confidence they will also refund me this time around, I am so angered that anyone should have to go through this in the first place. They continually fail to inform borrowers that their payments will be changing and for how much ; it has to stop. I am taking this action today as it is really the only action I can take on a Saturday. This transaction was posted to my account on a Friday evening and I have been unable to resolve any issues with Navient as they're closed over the weekend. I attempted to make headway with my personal financial institution but their dispute department is also closed for the weekend. I am requesting three things : First, to be refunded in the total of {$590.00} immediately. I never received any correspondence for monthly payments increasing to the deducted amount. My permission, verbal or otherwise, to be charged for {$590.00} was never obtained by the company. If, after the fact, Navient tries to inform me that an IBR plan expired and I did not complete the required paperwork, I will note that I never received correspondence about an IBR plan expiring, nor about what my new monthly payment would look like. My second request is to be sent correspondence at least 60 days prior to a plan expiring that contains detailed information on how to renew and/or extend your plan. Finally, Navient should never be allowed to charge a borrower anything other than what is reflected in their monthly billing statements. If Navient has intent to the aforementioned, then I am requesting for notification at least 30 days in advance to when a fee will increase, explaining why, and listing in detail what actions the borrower can take if they are unable to afford to make those payments.

Struggling to repay your loan

Student loan: Private student loan

Can't temporarily delay making payments
Complaint: I called Navient to see about getting a deferment or forbearance for my student loan with them, as I lost my job due to layoff in XXXX and my unemployment has run out. I initially called on XX/XX/XXXX but was told they won't even speak to me about this until a payment is due, with my last payment having been made on the due date of XX/XX/XXXX. I called back on XX/XX/XXXX as I now had a payment due and was told that I could not get a forbearance without first paying a fee of {$50.00} per 3 month period of forbearance. I explained I can not afford this as I have no income and they ultimately suggested I speak to someone about payment options and I was transferred. After reaching someone in collections, I was asked a series of questions to determine eligibility. When we reached how much can I afford to pay a month, I answered that I can't afford a payment as this time as I have no income and I also have other obligations, such as my rent, car payment, and phone payment, all of which are necessary for me to obtain a job. I was told at that time that, since I can't afford a payment, they can do nothing for me. I requested to speak to a supervisor ( XXXX ) and explained I have no income, I can not predict the future and determine when I will be able to make a payment ( they specifically asked when I could pay ), and that I have other financial matters which take a priority. He stated that the {$50.00} for a forbearance serves as a " good faith payment '', to which I asked what about my years of making payments on time every month, to which he replied that past payment history has no bearing on these matters. They further stated that there was nothing they would do for me. I pointed out that my other loan providers were able to assist me when I explained my situation to which he replied " Well, we're not you're other loan providers ''. I informed them they could disconnect the call so I could take their survey at which point he replied " this is the collections department. There is no survey. '' I specifically stated that this was a matter of a financial hardship, that I have other financial obligations, and that I am working to resolve this hardship by actively seeking employment, and still they would not do anything to help with the matter.

Struggling to repay your loan

Student loan: Federal student loan servicing

Can't get other flexible options for repaying your loan
Complaint: Student Loans are through Navient. In XX/XX/2018 I renewed my IDR through Student Loans.gov. In XX/XX/XXXX I called Navient and a girl couldn't locate it, so I called back and spoke to a guy who said he did locate it, but it was not processed. He said he would put a rush on it and in the mean time do a forbearance to bring account current through XX/XX/XXXX. I did that, and in XX/XX/XXXX I began getting mail, emails and phone calls about payments. I called them in XX/XX/XXXX and the girl said it was still being processed. Now we are at end of XX/XX/XXXX and I'm still getting phone calls, statements and emails that I'm behind in payments and that I should do a forbearance again. I sent them an email stating that I would not do that and that they need to do their job and process my IDR. I even check on the website and it was never processed.

Trouble with how payments are being handled
Complaint: I've been dealing with navient for several years now. When I've called to get any kind of help with my loan payments to either try and lower when they were close to 500.00 per month to just making a simple payment they stick to script and will not budge. They always incite by laws in the agreement that gives them complete control over the loans and leaves me with few options. Based on the current lawsuits against Navient I can not help but feel me and many others have been taken advantage of. Just one of the five loans I have began at XXXX and I am at XXXX after several years of paying.

Took or threatened to take negative or legal action

Debt collection: Federal student loan debt

Threatened or suggested your credit would be damaged
Complaint: I am a co-signer on a loan that my deceased grandson originated with Sallie Mae and later transferred to Navient. I asked my daughter in law to contact them on my behalf to request a copy of the loan documents, payment history and proof that he opted out of an insurance that would have covered the debt ( according to Navient ) which I have requested in the past and never received. She sent that request XX/XX/2018. We did not receive any further correspondence from Navient until XXXX when the transferred it to collections and filed negative reporting on my credit history. They also said they mailed a letter on XX/XX/2018 stating they had to have authorization to release information to a third party. My daughter in law did not try to obtain anything until XX/XX/XXXX so I don't know why they would send a letter the day before. As of today I still have not received any of the information that has been requested. Up until XXXX I made all monthly payments timely because they told me it was owed although I have been requesting documentation to show how much was owed for how long and now I have started to question everything that has been paid because to date I haven't received any paperwork other than monthly statements.

Struggling to repay your loan

Problem lowering your monthly payments
Complaint: Starting on XX/XX/XXXX, I called to lower my loan payment. After being on hold for 20 minutes, I was able to speak with a representative. She was fairly rude and short with me when I asked to lower my payment plan based on my income. She garenteed me that they will send me papers in the mail, after I had asked for via email documents instead. She said she could only send it on paper through the mail because it was about 20 papers for me to sign and read. I said to myself this is rediculous and illegal. All I wanted was the paperwork sent through via email so I could quickly fill them out and turn them back in before my next assigned payment due date on XX/XX/XXXX. Still to this day ( XXXX ) I have not received any papers from navient in the mail. Monday XXXX I called Navient, and got ahold of an representative and directly asked to speak to a supervisor during this call. The news she gave me was false and once again illegal. She told me that my account number and all my information I had given her indicated that I was not in Navients system. She asked to transfer me over to the Department of Education and speak with one of their representatives. I complied and when I was transferred I was on hold for 35 minutes and decided to hang up. When my sister calls about her loan the same day ( her loan is also with navient ) they seem to answer her hold call right away and she is able to speak with a representative within 5 minutes of being on hold. How is this possible. I thought to myself something shadey is going on with Navient and realized they are putting me on hold on purpose in order to avoid contact with me. The 2nd time I called the same exact thing happened again, telling me that my information is not showing up in there system and keep transferring me to Dep. Of Education while on hold for 40 minutes again I decided to hang up and call back. After this incident happened over and over again I had my sister call and put in her account number just to speak to a representative and once again they said Im not in the system and transfered me to department of education for the 4th time and left me on hold for 45 minutes this time. At this point I had spent half of my day trying to get ahold of a representative to figure out what was going on with my account. I almost lost it that day from frustration so I decided to call again the next morning. Tuesday the XXXX I called about XXXX and had the same exact experience from the previous day. This time when I called it was a 40 minute wait time the automated recording said. It gave me an option to either press 1-to make a call back appointment or press 2-do not make appointment and if you didnt press 1 it would disconnect your call. I pressed 1 and make a call back appointment for XXXX the same day. Well guess what? They never called me back. In fact when XXXX came around I decided to call again. When I called the same thing happened. The automated voice told me it was high wait time at 40 minutes. After that I pretty much gave up calling and this is when I decided to write this complaint towards the loan company Navient! I hope who ever reads this understands how frustrating this experience has been and when I am able to financially afford a lawyer I will sue them with all I have. Thanks for your time and support. Have a great day. Sincerely, Your Victim of Navient

Student loan: Federal student loan servicing

Received bad information about your loan
Complaint: I am a XXXX XXXX with some student loans serviced by Navient. Over a year ago I filed for a XXXX discharge and was granted a permanent discharge by XXXX. They apparently sent the proper notices to Navient and about half of my loans got discharged and I recieved a refund of what I had paid. But, the remaining half, now amounting to almost {$20000.00} still has not been discharged. It has been about a year since the discharge decision and notice from XXXX. I am in forbearance that is about to end and my balance is growing daily due to interest instead of being discharged. I have called Navient several times during the year and was told that verification processes were taking longer for these " consolidation '' loans. Last XX/XX/XXXX a rep told me my discharge was scheduled for XX/XX/XXXX of this year. That date has come and gone and no discharge still. Now, when I call Navient, they say they know nothing of my discharge and tell me to call XXXX. XXXX confirms what I already know, that my student loans are to be discharged. Navient does nothing and my balance keeps growing ...

Incorrect information on your report

Credit reporting, credit repair services, or other personal consumer reports: Credit reporting

Account status incorrect
Complaint: Navient reported me as 60 days delinquent to the CRAs in XX/XX/XXXX ; however, if you look at my credit report you will see that they reported me as current for XX/XX/XXXX. One can not go from being current in one month to being 60 days past due the following month. Either Navient incorrectly reported me as current in XX/XX/XXXX OR Navient incorrectly reported me as 60 days late in XX/XX/XXXX. It is not possible that the company 's records substantiated both records at the time they were furnished. This illogical reporting calls into question the integrity of Navient 's reporting and whether it accurately reflects the terms of liability for the credit account as well as my performance and conduct with respect to the account. I question the status of my loan that Navient reported to its Board of Directors in those months where they designated me " current '' on my credit report but charged me late fees, which I just learned they have done 30 times in the past two years despite me having made payments on time.

Communication tactics

Debt collection: I do not know

Frequent or repeated calls
Complaint: Receiving MULTIPLE calls a day from Navient about my 'debt. ' I have no account with them. They are clearly looking for someone -else-, however they leave no reference to the name or account number in question. When I called to try and deal with the situation ( twice ), they tell me they can't stop calling because I only have my phone number as a reference ; they required a name or account number. I tell them they aren't LEAVING a name or account number in their twice ( or more ) daily calls, and ... silence. I asked for a manager ; they say one will call me back ( which didn't happen ). They call multiple times a day from different numbers ; I am a professor and I have to open these voice mails over and over to see who is calling me and ensure it isn't a student who needs my attention. This is harassment at this point. I even tried writing a Cease and Desist letter to their corporate headquarters, which was then returned as undeliverable.

Struggling to repay your loan

Student loan: Federal student loan servicing

Can't get other flexible options for repaying your loan
Complaint: Hello, My name is XXXX. I initially had a student loan with Sallie Mae, and now it is transferred to Navient. The loans were disbursed in 2006 for a total amount of XXXX. And a total of 8 different loans. Some of the loans were deferred without my knowledge for 4 years. So basically after 13 years my loans are still owed XXXX. So I have only paid off XXXX dollars. I have calculated that I have actually paid XXXX in total payments to Navient. I will attach the file I pulled from Navients website as proof. All eight loans have different percentage rates, and it is all very confusing. I feel as though Navient, and Sallie Mae have taken advantage of me, and that I have lost a good amount of money because of their negligence.

Problem lowering your monthly payments
Complaint: This school is no longer in existence after countless promises of job placement and top tier support. It's now 10 years later and I haven't made a dent in my loans. I am a graduate with honors and have made on time payments since the end of my 6 month grace period. Sallie Mae has not offered any help but extensions and forbearances that will only help them in the long run. Regretfully, I have chose some of those options in times of need over the last decade. I am looking for information on how to proceed with elimination of payment to unrendered services.

Struggling to repay your loan

Student loan: Private student loan

Problem lowering your monthly payments
Complaint: Navient acknowledges that I am completely and XXXX XXXX and I have received a federal student loan discharge based on that ( the discharge monitoring period for that ended XXXX of XXXX ). I have no income and no assets and am in the process re-applying for SSI. When I applied for TPD relief with Navient for my private students loans, they " restructured '' some of my loans, but the payments are still completely unmanageable ( over {$200.00} per month ). I've repeatedly asked them about at least lowering my payments and am told this is impossible. Being completely unable to pay them, at this point I am going into default and my credit is trashed. I filed for bankruptcy in XXXX, but the legal aid company I used does not do adversary proceedings and so could not address the student loans. I currently owe Navient {$27000.00}, with about {$1500.00} of it being past-due. I have 4 loans : 2 were dispersed in XXXX at XXXX University, one in XXXX at University XXXX XXXX, and one in XXXX at University XXXX XXXX XXXX. Navient says I became legally XXXX in XXXX, before taking out the final loan, so they don't consider that to be included under TPD restructuring options.
