Struggling to repay your loan

Student loan: Federal student loan servicing

Problem lowering your monthly payments
Complaint: I consolidated my loans through Navient, after being told I could apply for PSLF through them. During several financial hardships during the mid XX/XX/XXXX and again during my divorce during XX/XX/XXXX-XX/XX/XXXX, I was advised by Navient to defer and/or place my loans in forebearance. The original principal was {$55000.00} ( Consolidated XX/XX/XXXX ) and {$7900.00} ( Consolidated XX/XX/XXXX ). In XX/XX/XXXX I was told my Navient that I could not apply for student loan foregiveness thru them. At that time, I consolidated my Navient Loans with XXXX XXXX XXXX. My total balance is now in excess of {$110000.00}. I will never be able to pay these off.

Struggling to repay your loan

Student loan: Federal student loan servicing

Can't get other flexible options for repaying your loan
Complaint: Up until 2 years ago I was never shown an option for IDR. My loans were always in deferment, which was the only option aside from forbearance that was ever offered. So for 8 years I was continually being charged interest. I researched on my own and found the IDR. I applied and obviously was approved. I didn't start working until 3 years ago. So the first 7 years my income was {$0.00}. Now I owe around $ 2k MORE THAN my original loan, 10+years ago.

Received bad information about your loan
Complaint: I went to XXXX XXXX in XXXX. I received a loan from sallie mae and now it's Navient. I was in XXXX XXXX for 7 years XXXX to XXXX. I seen several informational articles that being i was in XXXX XXXX, I should have qualified for a public service forgiveness repayment program. Sallie Mae and Navient both denied me and told me I did not qualify because i was a XXXX XXXX. I was still considered as XXXX XXXX. I also have seen a school closure article that I as never told about either. When i asked navient about the school closure loan dismissal they did not give me direction on how to apply. My personal bank is the one that helped me with this information. Now that I am not in XXXX XXXX anymore, I do not qualify for that program. I feel I was misled and missed out on an opportunity to help me with my loans.

Student loan: Federal student loan servicing

Received bad information about your loan
Complaint: I have been unfairly directed into forbearance and deferment for years while I could have qualified for income driven repayment. Navient knowingly and intentionally steered me toward forbearance and deferment instead of making me aware of more suited methods of repayment. I have over 7 years of foreberance and deferments during which time I would have qualified for IDR and during which I have been negatively effected by negative credit reporting and delinquencies. My loans were predatorily directed in the most profitable manner while neglecting my best interests. Please inform me of the best course of action.

Student loan: Private student loan

Received bad information about your loan
Complaint: Was coerced into taking a large private loan over and above tuition costs for " living expenses '' I paid my loan on time for over a decade following graduation and none of my principal debts went down. All of it was applied to interest - all of which is detailed in the current class action lawsuits pending against Navient. I called them and asked for a more favorable interest rate or a different plan to help me to manage my bills and was told there were no options.

Dealing with your lender or servicer

Student loan: Private student loan

Received bad information about your loan
Complaint: This is my second complaint with CFPB about Navient. My previous complaint received a copy and pasted generic response from Navient. I am fed up with dealing with this lender. I was never properly educated on how the interest would capitalize during my time in school and after. I was only given options for repayment that paid toward interest and in very small increments which has increased my balance over 150 % in the last 10 years. I owe 2.5 times what I borrowed and have my made payments since graduation I XX/XX/XXXX. The original lender, Sallie Mae, could not keep their end of the bargain and were conveniently allowed to just change their name and continue business as usual XXXX borrowers that were defrauded by their schools. When students realized they attended predatory and for-profit schools, the lender should have made attempts to work with the students for relief. It is absolutely unfair that I attended a school that lied about accreditation, did not educate me on cost and taking out loans, and eventually closed their doors ; making my degree a useless piece of paper. I am expected to pay back loans until XX/XX/XXXX, which will equate to over {$600000.00}!!!!!! GIVE RELIEF TO STUDENTS FRAUDED BY SCHOOLS THAT ARE NO LONGER OPEN THAT HAVE CREDITS THAT DO NOT TRANSFER!!!!! 1. unclear on capitalization of interest over time of loan 2. loan sale and resale without permission 3. loan capitalization that was over 3x borrowed amount 4. horrible customer service, only offer repayment options that make money for navient and never pay toward the principal 5. late fees before payment due date or when payment was applied twice in one month 6. unfair practices for borrowers, policies do not favor the borrower and lender makes enormous profit 7. estimate of my loan payoff is XX/XX/XXXX with a total payment of over {$600000.00} when I only borrowed {$68000.00}. HOW IS THIS FAIR OR LEGAL???? 8. can not say enough about the customer service. reps are unkind and I have been told things like if you can afford a mortgage or a car payment then you don't have your priorities straight and you can afford 25 % of your income to your student loans.

Trouble with how payments are being handled
Complaint: I have twice made large payments. I called and made payments over phone to tell them specifically how to pay the loan once i verified payment amounts. Both times after i paid off loans there was overpayments that were redirected in a way beneficial only to the loan company. First there should have been no overpayment because i called and verified the amount i needed to pay. Second I was not asked how to direct any overpayment. The response from Navient was that there was a way ( well hidden on the website ) where you could select the options for overpayment. The links for this area to select options are impossible to find.

Dealing with your lender or servicer

Student loan: Private student loan

Received bad information about your loan
Complaint: This company violated not only my trust but the law multiple times but the most recent event occurred on or around XX/XX/2019. On this date I received one of the many calls from Navient in regards to my private student loan. I spoke to a female representative in total around 30-40 min. I asked very specific questions in regards to bringing my loan current, and because of the the representatives response to those questions I decided to enter a payment plan. I paid a total of {$230.00} though the phone that day. A few days later ( After payment ) I realized responses to those questions were incorrect, misleading, and flat out lies. To name a few, 1. One I paid my account would automatically be brought current, and would be reported to credit bureaus. ( turned out to just be misleading information given in order to collect payment ) In reality it would only be brought current after 3 payments 2. The payment I was making would cover all my loans ( minus Federal ones ) including the ones connected to a co signer. ( Again Lies ) I was initially outraged by the blatant misrepresentation. I contacted Navients ' consumer advocate department as well as sent a letter outlying misleading acts to XXXX XXXX ( XXXX ). No response from XXXX ( as expected ) but the consumer advocate department reviewed the call and agreed that I had been given false information in order to collect the debt. But told me there was nothing they would do. I am very familiar with the FDCPA. I know that Navient is clearly in violation. I have gone through them to correct their mistake and they refuse. My problem is that I am concerned that they could be doing this to thousands of other loan holders.

Student loan: Federal student loan servicing

Received bad information about your loan
Complaint: I really have 2 problems with the way Navient has handled my account. First, I received a SMART Loan Consolidation on XX/XX/XXXX of which I have been regularly paying to Sallie Mae and then Navient. I have been a XXXX XXXX XXXX since XX/XX/XXXX and learned of the Public Service Loan Forgiveness ( PSLF ) program. I applied for PSLF on XX/XX/XXXX. I subsequently received correspondence from Navient that I do not have the type of loans to qualify for PSLF. The Navient representative advised me to consolidate my loans to " under the right type of loans and make 120 more payments to qualify ''! Prior to applying for PSLF, I applied for XXXX Loan Forgiveness and was also denied. After receiving the denial for the PSLF, I decided to apply again for the XXXX Loan Forgiveness program on XX/XX/XXXX with the required documentation and Navient sent me yet another letter stating again that I was not eligible for XXXX Loan Forgiveness as I " did not meet the criteria ''. I contacted the Federal Department of Education and spoke with a representative who stated that I did in fact qualify for XXXX Loan Forgiveness. To this date, my loans have not been forgiven or cancelled. In addition to this, I have asked Navient repeatedly why there is such a variance as to how much is paid toward principal from month to month. Payments are not consistently applied. Please see attached payment history from Navient. The response I received was that " it depends on what day of the month I made the payment ''. I do not believe any of my payments were applied correctly. Finally, it is interesting to note that I have been contacted by Navient in both email and postal mail form asking me to apply for a Navi Refi. Well, it's very enticing in that the NaviRefi would substantially lower my interest rate ; however, I would lose Federal benefits such as XXXX Loan Forgiveness and Public Service Loan Forgiveness. I did apply for a NaviRefi and found eligible for 3.70 % interest rate compared to my current 7.625 % interest rate. However, I did not sign the paperwork because I did not want to give up the federal benefits and I still think my loan should be cancelled anyway through either XXXX Loan Forgiveness or Public Service Loan Forgiveness. My sense is that Navient is determined to not cancel student loans for any reason.

Struggling to repay your loan

Student loan: Federal student loan servicing

Can't get other flexible options for repaying your loan
Complaint: I have tried over 6 times to get my loan re certified for the income based repayment plan. When I finally did get my loans into the repayment plan I have a monthly bill of {$120.00}. I've told Navient numerous times that I cant afford a monthly bill. My income is the only income available to pay bills. I'm paying rent, car insurance, water bill, electric bill and oil heat bill. On top of the bills I also have to pay for groceries. I'm struggling and I need proper assistance. Navient isnt answering my phone calls, returning my phone calls or responding to my emails. What navient does do is send me harassing emails. I'm sick and tired of Navient playing around with my livelihood. I cant afford for my paycheck to get garnished. I need help and I'm not getting any.

Dealing with your lender or servicer

Student loan: Federal student loan servicing

Received bad information about your loan
Complaint: My loan is a parent plus loan with Navient. Loan # XXXX. The loan was originally consolodated for 30 years. I asked Navient to refinance for a shorter period of time and they told me I couldn't. Additionally I've noticed throughout the loan that they keep adding a thing called " capitalized '' interest. Nobody has been able to explain to me what that means. They are adding interest to my loan on a daily basis and periodically adding lump sum interest amounts to the loan. I've been paying on the loan for 2.5 years and my loan amount has gone up instead of down. I applied through student loan.gov to refinance the loan and change service companies. Navient blocked by ability to go with another service company. I had chosen XXXX. Instead they changed my loan to a 12 year payback. I had requested a 10 year payback with XXXX. I'm attaching the document so you can see how my loan terms have changed in just the last 30 days. Additionally on XXXX XXXX it showed my unpaid interest was {$480.00}. I made a payment of {$490.00} thinking they would finally apply a partial payment to the principle. The next day they added {$3800.00} in " capitalized '' interest therefore negating any money being applied to the principle. As of now I have not had {$1.00} applied to principle in 2.5 years. I called Navient and asked for an audit of my account with a printout of my accumulated interest for 2 years. I told them I did not want a generic letter. I did not get the audit and instead got a generic letter advising how they calculate interest on a loan.

Incorrect information on your report

Credit reporting, credit repair services, or other personal consumer reports: Credit reporting

Account information incorrect
Complaint: Navient is continuing to stick by the lie that they attempted to notify me about my deferment and forbearance periods ending. They never did, until my loan was almost in default. Then of course I responded immediately, as I would have if they actually would have attempted to contact me in any way, shape, or form. I believe they deliberately denied me information and avoided contacting me as long as possible to maximize the amount of interest on my loans.I had the same loans previously with Sallie Mae, XXXX, XXXX XXXX XXXX XXXX, and XXXX/ XXXX XXXX XXXX and never once had a problem with a late payment or communication issue. It is only when my loan was transferred to Navient that I began to have problems. Not a single phone call, automated or not, to me until I was almost 180 days past due, when I know I should have been in forbearance or had a XXXX payment due to my income based repayment plan. Seriously if Navient the only option available to you, it is best to flip burgers. You'll likely come out ahead in the end, read any other complaint listed here or just search for news articles about them on the internet. They are not difficult to find.
