Threatened to sue on too old debt
Complaint: In XXXX 2011, I was involved in a car accident. The car was financed by Nissan Motor Acceptance. During that time, I never received any documents that the car was being sold for scrap. The car debt was sold to a collection agency. it is now with a new collection agency and the agency is threatening to sue. However, I have informed the agency that I did not receive any information from NMAC about the debt or car being sold. The agency has also refused payments.
Recently, the debt was removed from my credit report and added back on multiple times. I have provided proof of this.

Complaint: Purchased new Nissan in 2013 setup due date thru dealership for mid month. 1st and only statement every mailed to me showed due XXXX of each month.made monthly pymts per this statement on bank auto pay, setting up online acct this morning and finding out for 1st time that I have been charged ) ate fees for 2yrs for paying late, but did not report because acct still considered current, Never called or contacted in anyway to advise me of this, even when I called for help setting up acct online Rep. Did not even say anything about this only found out once I could log into acct. Was told just pay at end of contract. After some time on phone did get XXXX dollars waived but feel should not have to pay any of these fees because I was Never told about this or sent statement. Nissan first said statement mailed to bank because on auto pay? Not sure why because my bank would have mailed them a ck in my name never requested paperless did n't even know acct # this is why I called when setting up acct, if I had not been setting up online in 3 more yrs loan would never pay off because I would continue being charge fees for late pymt.

Complaint: I am XXXX and Nissan motors acceptance cooperation has been accusing me of not making payments even though I have been paying above the minimum amount since I got the car. On top of that, they keep adding on these " late '' fees even though I 'm paying them on time. They have been blowing my phone up every single day for months now. At least 2-4 times a day. It does n't matter if I answer or do n't because they say the same thing. I keep blocking their number but they just keep calling me from different numbers. I told them many times that they are wrong about me owing them money. I told them they are harassing me and to remove me from their calling list but they just became more disrespectful towards me, making more threats, and calling me more everyday for no reason but just to harass me. These guys are crooks and I 'm tired of them treating people like this. It 's like they think I 'm rolling around in money but really I 'm barely making it by paycheck to paycheck. On top of all that these guys are ruining my credit. I went from having great credit to very poor credit because of these people accusing me of something that 's completely false. They 're are ruining my life.

Complaint: I obtained a copy of my credit file around XXXX 2016 and filed a dispute through the credit bureaus against XXXX XXXX XXXX and Nissan Motor Acceptance. Once bureaus investigation was completed it came back the information disputed with XXXX XXXX XXXX was verified, no change and Nissan Motor Acceptance as new information. In receipt of this information I sent XXXX and XXXX a letter of stating : This is NOT a request for " verification '' or proof of my mailing address, but a request for VALIDATION made pursuant to the Fair Debt Collection Practices Act, 15 USC 1692g Sec. 809 ( b ) that your claim is disputed and validation is requested.
XXXX XXXX XXXX than replied with a letter saying they received my dispute for verification and to be advised that XXXX XXXX XXXX confirmed the name and address listed on the account as well as the amount due. Nissan Motor Acceptance has not responded to my request.

Complaint: From XXXX XXXX to XXXX XXXX, my husband was XXXX ill in the hospital and then eventually XXXX ( XXXX ). At one point, he had XXXX, almost died, and was put into XXXX for 8 days. I did nothing but live at the hospital and go home once a day to shower. A friend even came and kept my dog for about XXXX weeks during this timeframe. I was not looking at a computer or a calendar. Once things began to improve and my dog came home, I was walking her one afternoon ( XXXX/XXXX/XXXX ) and noticed that I had a voice mail. It was Infiniti Financial Services and I had missed the payment. This is my XXXX vehicle lease with Infiniti Financial Services, back-to-back. I had never previously missed a payment or paid late on either lease. I did not get anything by mail or email to warn me of this, just a voice mail on my cell phone from a random number that I could n't identify, thus no rush to check the voice mail. By this time, I 'm about to be late on a 2nd payment, so I was 30 days over on the first one. While on the phone that afternoon with Infiniti Financial Services, XXXX/XXXX/XXXX, I paid the amount owed in full for XX/XX/XXXX and XX/XX/XXXX ( 2 payments plus a late fee ), {$1200.00}. They seemed shocked that I could pay it in full. Eventually, they still submitted it to hit my credit report in XX/XX/XXXX or XX/XX/XXXX ( ca n't remember ) and I contacted Infiniti/Nissan Finance and told them the horrible family situation I had been in, it was n't that I could not pay, I was just extremely focused on another matter and had no reminder at all to pay it and it never crossed my mind. I asked could they please review it. They said they would pass it to the appropriate department and that I would get a phone call for discussion or an email notifying me of the decision that had been made. I never received anything and it is still on my report, so I called them in XX/XX/XXXX and they just said they reviewed it and the circumstance did not warrant the removal. So ... ..10 months before my second lease will expire where I 've made all previous payments on time ( and all payments after this occurrence ) ( almost 6 years ) AND when I found out I had missed this one I immediately paid in full, in a situation where my husband was so XXXX ill he almost died, they sent no reminders either via email or regular mail and left one voice mail from a number I could not recognize, they will not assist me in getting my impeccable credit rating back. As we all know, a 30-day late will drag my score down for a VERY long time, and we know they can fix whatever they are willing to.

Complaint: Automatic payments for my car loan were discontinued by NMAC. I was not informed that this was happening so the bill was not paid for over 30 days. Complaint: I leased a vehicle with XXXX XXXX Nissan in XXXX, NC. It was a three-year lease ending XX/XX/2016. In the lease contract, under the heading " Purchase Option, '' it states : " You have the option to purchase this Vehicle 'AS IS ' from the originating dealer ... in cash for the Purchase Option Price, plus any official fees and taxes, vehicle inspection costs required in connection with the purchase, and a Purchase Option Fee of {$300.00}, which fees, taxes, and costs are not included in the Purchase Option Price agreed to in Section 6. '' The Purchase Option Price under the lease was {$16000.00}. The lease also contains a section defining official fees and taxes as including only " registration, title and license fees, and personal property taxes. '' When I went to the dealership to exercise my purchase option under the lease ( the same dealership I leased the vehicle from ) it tried to charge me an additional " Administrative Fee '' of {$690.00} and an " Electronic Filing Fee '' of {$120.00} in addition to the other official fees and taxes and vehicle inspection costs. When I complained, the sales manager XXXX XXXX, admitted that these administrative fees were not disclosed in the lease contract, but refused to remove them. He said that if I did n't want to pay them, then I would not be able to exercise my repurchase option and would have to return to the vehicle.
