Billing problem
Complaint: I leased a XXXX XXXX XXXX in XXXX of XXXX from XXXX XXXX XXXX. This year I was unable to renew my registration because the year on the title of my vehicle is incorrect. The year of purchase on the car is listed as XXXX instead of XXXX. The California XXXX confirmed this and requested a title modification in order to renew our registration.
I've been calling Infiniti Financial Services ( IFS ) since XXXX and they said that they will get this problem resolved. We are in XXXX now and my car no longer is eligible for a temporary registration. I STILL have an error on my title and I am making payments for an XXXX that I can not drive.
I just spoke with an IFS agent for an update, and from my understanding the title has been reviewed and sent to the dealer for a modification. HOWEVER, the XXXX XXXX XXXX is PERMANENTLY CLOSED. They have not followed up with this issue nor have they checked their facts to realize that there is no one at XXXX XXXX XXXX dealership to accept their request.
I spoke to another local dealership and they advised me to get in contact with XXXX XXXX XXXX. However, all the numbers provided were dead ends.
I keep getting brushed off and ignored and neglected.

Nissan stated that I was not the only one to have ever fell into financial problems and had to give the car back. It was ok and they got the car back.

Complaint: I received a call from Nissan on or about Monday, XX/XX/2019, I spoke to the representative and advised that I would be making my payment before the end of the month online. The representative gave me a breakdown of all the charges including late fees, and personal property taxes the representative recapped the call several times and also asked when I would be paying next month 's payment. I advised when I pay it, I gave this response because I was frustrated and didn't want to continue the call and also asked why Nissan had not contacted me with regard to my mileage not being correct on my lease or offer an apology. The representative just blamed the dealership. I reminded the representative that the dealership would not be involved if I go over my mileage I would be paying Nissan Finance. At any rate, I promised to pay with a method, amount and date on that call. I then received two subsequent calls from Nissan attempting to collect a debt when I informed them that I would pay. I gave specific instructions and calling and harassing me is a clear violation of the FDCPA.

Problem with paying off the loan
Complaint: I had an accident that totaled my car. My insurance paid on the claim. I had gap insurance that I purchased at the time of the sale. Nissan mailed a package to the insurance the gap insurance company and myself. I assumed all was well as I did not hear anything. I assumed the claim was fully paid. It wasnt until months later that I found out through a phone call from Nissan that I was in collections. I explained to the lady on the phone this cant possibly be. She told me I did not make payments. I told her that simply was not true. She explained I owed {$1900.00} and that it was for missed car payments. She really wasnt receptive about hearing me so I called XXXX the gap insurance company. They explained to me that three letters were mailed out asking for a Bill of sale. I explained that I never got them. I told her I would work on getting the bill of sale to her immediately. I was so infuriated by the representative from Nissan who told me emphatically, that I was in collections due to nonpayment, that I just had to call back. I explained to XXXX I was not delinquent in my payments. That it was in fact because The gap insurance company needed a bill of sale. She continued her delightfulness with me and told me I was a liar because it was mailed with my packet of information sent to me and to the gap insurance company. I looked in my packet and my bill of sale was not in there either. It was not included in the packet of information that was sent to me nor the gap insurance company. ( First error ). I called the gap insurance company back and through conversation I learned why I didnt get those three letters they had mailed me requesting the bill of sale. On the day of purchasing my car at XXXX Nissan, the gentleman entering the information failed to put my apartment number on the gap insurance addendum. ( Error two ). I live in a huge complex in the city of XXXX. Without an apartment number there is no way I would receive these letters. I was at work at the time and I called XXXX Nissan. I explained the situation to the gentleman that answered the phone. He was very helpful. He was able to get me a bill of sale within a couple of hours from Ohio and faxed it to me and to XXXX insurance company. The reason why he was so helpful and really went above and beyond was because he felt badly about the critical error they made at his dealership. XXXX received the bill of sale. They released the money to Nissan about {$1900.00}. My final balance was {$21.00}. Which I paid immediately upon learning this. My credit took a major dive. My credit report states that I was in collections with Nissan and it was a charge off. I would have never been in collections with Nissan if they had the right address put on the Gap insurance Addendum. They failed. And the amount was certainly not not not a charge off. My gap insurance company and I paid the balance in full. When I saw my credit take a major blow, I called Nissan and asked what they were going to do about this. They said, dont worry it will go back up. Well, it hasnt. If it wasnt for XXXX Nissans error at the time of sale, I would not find myself in the situation that Nissan caused me.
I was assured by XXXX, the gap insurer, they were taking good notes. They were kind enough to fax me a copy of the final notice I never received. You can see my incomplete address there and in the original addendum from Nissan. I also included the portion of the bill of sale from Nissan with my complete address. Clearly an error by the man at XXXX Nissan.
Please help! Nissan will not address this even though it was their error. And they were paid in full in the end. What charge off Nissan? Btw, Ive had two Nissans since 2014 and never missed a payment. Thanks Nissan!!!

After receiving the XXXX settlement Nissan updated my credit report reflecting a missed payment for XX/XX/XXXX that is incorrect. My final payment was set up for XX/XX/XXXX and was drafted from my account on the XXXXThis FP ( failure to pay ) or CO ( charge off ), depending on what bureau is reviewed needs to be removed. It reflects a recent delinquency which is false and negatively impacting my credit further. My final payment was due in XXXX on the scheduled date and successfully processed. I want all my bureaus updated correctly and not to include false information. Nissan assured me that there would be no new negative activity, but only an update that account was settled.

Complaint: On Thursday XX/XX/2019 XXXX I call the XXXX XXXX to try to resolve this problem because they have been harassing my XXXX XXXX XXXX aunt calling he several times a day and using abusive language on how she need to resolve this matter. I was paying the amount out of my account until I made contact with the Nissan Motor Acceptance Corporation when they advised me that they wasn't receiving any money on this account because the account has been closed. The amount owed is the amount that the gap insurance didn't pay. On this day I advised XXXX XXXX XXXX that I will no longer allow them to take money out of my account. Complaint: Infiniti Financial did not take out the final auto-draft, after taking 59 other payments which I paid on-time each month. When I contacted them about it, I spoke with a manager who confirmed the system had an issue and said he would fix it but it is their policy to STOP TAKING AUTO-DRAFTS ON THE FINAL MONTH. They waived late fees and interest, I paid off the loan and thought it was closed despite this deceptive business practice.
This line on equifax report now says " not more than two payments past due '' which has dropped my credit score by more than 70 points. I requested they correct it to " pays as agreed '', but they said there is nothing they can do, the request was rejected.
I have an open dispute with equifax, but I also think Infiniti is acting in bad faith, possibly impacting others intentionally at the end of their loan terms in order to intentionally collect late fees and over due interest. Making it standard business practice to stop auto-drafting in the last month, after doing it for 5 years, does not pass the " reasonable standard '' in that it creates a negative mark when customers are more likely to be looking for another loan, therefore inflating possible APR for the next automobile purchse.

Complaint: Signed the loan paperwork for new vehicle at Nissan of XXXX on XX/XX/19, was approved for a loan and at 6.9 % APR. While finishing up paperwork employee called me a " breeder ''. On XX/XX/19 dealer asked me to come in a get my copies and plates for car. Got there and was told my original approval was denied and they had to finance me with Nissan. Said I would not leave with car if I didn't sign new loan agreement. I also asked to see the denial letter from the first bank and have yet to receive it. I also asked if I could simply return the vehicle and was told yes but it would be a voluntary repo and would severely effect my credit score. I have asked to speak with their General manager several times and owner with no response. Dealership has not paid off the trade in either after almost a month of the sale/trade in. The finance department has been rude, nasty, and terrible customer service the whole time.

Complaint: I experienced an issue with my car smelling of mold and mildew dating back to XX/XX/2019. It was determined that there was a water leak by the XXXX peddle, which cause water to come in the car. It cause mold and mildew to grow within the vehicle. My car has continued to have a horrible odor, which has caused me to have headaches and other medical issues. Nissan has still yet to correct the problem with the vehicle or allow me out of lease with the down payment back. They continue to lack communicate and fail to answer any communication. They still continue to drag the process out with no end in sight. I'm looking for assistance with my options due to a manufacture defect that the car had from when I leased the vehicle. There are three other cars at the baron Nissan Dealer with the same leak issue as my car. They are refusing to speed up the process or provide me with a permeant solution to the issue. They have attempted to fix the issue over four times. The vehicle is now having current electrical issue with the starter and doors. The vehicle wont unlock or start with the keyless entry. its not detecting the key fob.

Complaint: On XX/XX/XXXX I met with a sales person who had reached out to me about my lease coming to an end. I told him I was aware of the excessive miles and will be ready to purchase the vehicle unless he can offer me something else. Instead of looking at used vehicles with lesser miles at the same price I would buy my current lease for, I asked to hear about what he can offer me to get into a newer lease. I told him which lease I would be interested if we can work out a deal, he walks off and comes back with an other sales person who offers me a XXXX XXXX at {$570.00} for 39 months and the dealer will cut me a check to pay off the bill XXXX will send me for the remaining of my lease which he said was for {$2700.00}. We agreed on a lower monthly payment. I questioned if the only bill I will receive will be for {$2700.00} and he replied yes never mentioning any other charges or the miles so I agreed to the deal. The bill I received for my previous lease came in for {$10000.00} which included the excessive miles. I contacted the dealer right away to let them know this is not what I spoke about with the original sales person who I made clear what I was looking for. They told me the second person who made me the offer only deals with the car payments. He tells me the other sales man never mentioned anything to him about the miles. I know I was scammed. The first sales person who got the sale did what he had to do to get his sale for the month, I have reached out to him and he wont even reply back to my emails which is very unprofessional if he did nothing wrong. The dealer has done nothing at this point. I called the XXXX and he has not returned my message.

Problem with paying off the loan
Complaint: My brand new XXXX XXXX ended up a total loss XX/XX/2015. All payments were made on time during loan term. XXXX XXXX paid value of the vehicle XX/XX/2015. The final balance was {$2000.00}.
Gap insurance was not paid in a timely manner & now Nissan has marked all of these payments late on my credit report. After numerous hours over the phone, they refused to mark any of the payments on time.
I would never even consider walking into another Nissan dealership until this is fixed. The loan has been paid in full and I am left to hurt from this deal.

Problem with personal statement of dispute
Complaint: At the bottom is a copy of the certified letter I sent Nissan Motor Corporation. After multiple calls and letters, they refuse to work with me. I feel this is very unfair and does not reflect my excellent payment record. I am a cosigner on the total loss car and the new car. They sure didn't have a problem financing a new car for my daughter with me as a cosigner due to our repayment record. They did not even run a credit check because we were told there was no need due to our repayment record with the wrecked car, but they refuse to remove a late payment that I was unaware should have even been made. The car was a total loss. Insurance and gap should have covered the loan amount. We purchased another vehicle. Payment by insurance was still being negotiated along with canceled warranties. They applied those to the principal that left XX/XX/XXXX note unpaid. This was also the month we purchased the new car also through Nissan motor finance. I, the cosigner, was never notified of a balance or missed payment. Once I called to confirm gap payment, they informed me of XX/XX/XXXX missed payment. ( Again, I called them, they never called me. ) I immediately paid two installments which brought the car up to date and have continued to pay monthly while negotiating with insurance and gap. I have begged and pleaded due to circumstances for Nissan to remove the late payment remark they reported in XX/XX/XXXX, but they refuse. I do not understand. This will be on my record for seven years. That is not fair when before this, I had a 100 percent repayment record.

Problem with signing the paperwork
Complaint: Went in to purchase a vehicle. Spent several hours negotiating a price we discussed before hand. Settled it's with the dealer and went on to sign the deal. He switched the number around and added the same item back on to the document but spelled out differently we didnt catch it at the time but apparently it's a known scam. XXXX XXXX was falsifying items unbeknownst to us. He admitted to this in the office after confronted about items not matching up and not giving us all the forms after the purchase. After being pulled all the way to the other side of the lot for financing and being told our agreed upon payment method XXXX XXXX XXXX would not be accepted one of us left to rush home for a check book. This division added to the confusion they would use to not turn over any receipts or documents besides the e-signature thing mixed in with the swapped buy order. Once we returned back he had none of the items and made excuses and delayed handing them over until general service XXXX intervened. He then presented a document he said was for the vehicle a document he said was from the time of signing. The document listed a different vehicle but had same model number at a lower price.. XXXX XXXX XXXX said it didnt exist and was not on the list of vehicles in the system he had showed us. Upon further review we found that the XXXX VA XXXX XX/XX/14 was digitally signed for accepting a loan. We were in the office physically and were signing with a pen. The signature was so foreign to us that we initially thought it was forged. Mentioned to this to XXXX XXXX and he never mentioned it was an e signature. He only stated no one had forged it. However someone else signed a e signature on our behalf without discussing this with us. Further discussion revealed that the staff keep the sales documents in an EDITABLE document. XXXX demonstrated this by deleting the lines in a document, showing he could. He then tried to take it back by saying only that one page was editable. But it was in same pdf so the entire documents integrity is in in question. So happens the doc in question they had on file was empty while the one we signed was not ( we took a picture of it ). We were presented multiple buy orders with differing numbers signed as proof we agreed to one price. When questioned about this he blamed the computers. It didnt seem to matter that they had so many with different versions of the price of the vehicle. Salesman was engaged in fraudullent manipulating documents telling stories that didnt add up to any of the other employees not even the XXXX XXXX XXXX. We requested to return the vehicle as it was obvious they were not being genuine. They said no, as if counting on the doctored up contracts to protect them. While he expressed confusion as well the XXXX XXXX didnt really care about what had been done.

Their system was down for a full week during this week I traded in my XXXX XXXX XXXX. Because they had a system wide error. You were not able to gain access to your account via phone, website or app. Because the dealership was unable to verify payoff of my trade it delayed the payoff from being processed since then my account has reached 10 days past due, Ive received 4-5 calls per day since I hit 8 days past due. Theyre aware that a payoff is coming, Ive repeatedly requested no contact other than email from them. Today alone Ive received 4 calls after requesting a do not contact, Per CFBP max attempt is 3 times per day per number.

Termination fees or other problem when ending the lease early
Complaint: It all started with emails. XX/XX/XXXX I asked XXXX XXXX from XXXX Nissan south if there are ever incentives to turn in a lease to then buy a used car. I told him right off the bat that I need to get either my payments, gas, or insurance cheaper because our dog with XXXX has increased our bills significantly. I went into XXXX Nissan XXXX on XX/XX/XXXX to discuss in person with XXXX about my options. I still had 4 lease payments due for my XXXX XXXX XXXX lease. I asked him about purchasing a used XXXX and he informed me that if I did that, the remaining lease payments would not be paid for the XXXX and that my best option is to lease a new XXXX. We went back on forth on price quite a bit, me having to constantly remind him of the whole reason Im turning the XXXX in early ( too much dog debt ). We finally agreed on a price and eventually I signed for the new lease and I thought that was it. I clearly asked XXXX if my XXXX is now all set and remaining payments waived. He said yes, 2 are waived by Nissan itself and 2 are being covered bu XXXX Nissan XXXX. A week or so later I received my {$700.00} check for 2 payments on my XXXX. Paid that and assumed its over. Fast forward to XXXX and when I go online to check out my excise ( property ) tax bill for last year I see there are still 2 remaining payments due on my account! And even worse, after 2 months, the XXXX had not even been grounded, making me responsible for it still!!!! I would have owed over {$21000.00} for a car that is no longer in my possession. The lady I spoke with at corporate was very concerned and suggested I IMMEDIATELY get XXXX Nissan XXXX to ground the Pathfinder and release my liability. The next day after speaking with XXXX via text I then received a copy of the grounding statement from the finance guy. XXXX had also told me that the XXXX will be all set and i wont be held accountable. Well thats great its grounded but he never took off the remaining 2 payments!! I NEVER would have turned in my lease early if I still would have owed payments. Someone coming into a car dealership nearly crying that the bills are too high and I need to lower them would never agree to {$700.00} extra. I was absolutely take advantage of, and feel like XXXX Nissan XXXX is giving me the runaround for something that should never have been a problem and should not have been my burden to bear in the first place.
