Complaint: Upon checking my credit report, I saw that Midwest Recovery Systems had placed XXXX separate accounts, which I have no knowledge of, on my credit as a negative collection. I have had no contact from this creditor at all. I have sent a letter of complaint to Midwest Recovery Systems. I am a XXXX, and it is possible that this debt is my father 's. But I am leery of that also.

Threatened to sue on too old debt
Complaint: At around XXXX on XX/XX/XXXX, I received a call that was a recorded voice. At no time was a company named. The recorded voice offered no identity. The gist of the message was, " I received an order for you. I 'm calling from the processing division. It looks like XXXX charges pending against you. If I do n't hear from, you, I will actively pursue you at your place of employment and your residence. You have the right to contact the client directly to resolve this voluntarily. Understand that once you are located, you forfeit that right. If you have any questions call ( another recorded voice, a mechanical-sounding one, says the number : ) XXXX. '' I did n't call back. I have XXXX new entries by a company called Midwest Recovery Systems on my Transunion credit report, for $ {$980.00} each, all three of them are actually XXXX very old debt that is past the statute of limitations, with XXXX XXXX, a payday loan company from XX/XX/XXXX. I filed a dispute with Transunion. I called XXXX XXXX, they say they sold the debt in XX/XX/XXXX, and it was for {$98.00}. I am assuming that these recent messages are about the {$98.00} debt that is way past the statute of limitations. So, not only did this company ding my credit three times for XXXX debt, they dinged it about a debt that is past the statute of limitations, they jacked up the debt amount by XXXX %, they threatened to sue me about a debt that is way past the statute of limitations, they did not identify the company or the individual calling when they called my cellphone number unsolicited with an illegal collection that is on the Do Not Call Registry, and they made the message sound like I am going to be charged with a crime that I might be arrested for at my home or at my job, and they misinformed me that I have no rights once they locate me.

Cont'd attempts collect debt not owed

Debt collection: Payday loan

Debt was paid
Complaint: I do not dispute that I took out a payday loan with XXXX but I repaid the loan years ago. I had to get a mortgage in 2014 and ensured my credit report was squared away well in advance of the home purchase. It seems documentation of the repayment has become lost in the shuffle as the debt was bought and resold ( who knows how many times ) and a new random debt collector has reported the debt back to all XXXX major credit bureaus. I 've disputed with all XXXX, XXXX came back as deleted, the other XXXX show 'remain ', I called this debt collector ( Midwest Recovery Systems ) and XXXX woman told me they were updating it all to 'delete ', and today 's call with a gentleman said they had plans to rereport it to all XXXX bureaus. This is very upsetting. I paid this money back in full years ago. It 's not my fault the documentation on the debt collector was lost or not retained. My wife lost her job last year and I need to refinance my mortgage. With this on my credit report, I 'll get a less favorable interest rate when I refi. I also need to buy a new car next year and this will impact me there, too. I do n't know who else to engage on this, but the burden of documentation should be on the debt collectors if they 're so easily able to buy and resell debt this way. How on earth can a consumer ever know when this is happening, especially in error, until it slams their credit score?

Cont'd attempts collect debt not owed

Debt collection: Other (i.e. phone, health club, etc.)

Debt was paid
Complaint: This complaint is written in reference to a Midwest recovery system LLC acct # XXXX listed on my XXXX major credit reports illegally, in regards to a collecting a debt I do not owe. I have sent request for validation via USPS certified mail/ return receipt requested at the beginning of XXXX XXXX. I have not receive any response! According to the Fair Debt Collection Practices Act, a debt must be 100 % true and accurate. This company has place their name Midwest Recovery Systems acct # XXXX on my XXXX, XXXX, and XXXX reports without validation. The original creditor XXXX whom this company is attempting to collect false funds, have misapplied any payments I may owe. To my understanding I had a checking account with XXXX back in XXXX and I close the account in XXXX, due to limited supply of branches. I wanted to join a bank that was bigger, However, I did not leave the company XXXX with any outstanding balance. Neither was I ever inform of having a balance with them. It has been 6 years since I banked with XXXX whom this company Midwest Recovery System LLC is attempting to collect funds. I have been trying to resolve this matter amicably with this company. Failure to comply to FTC regulations regarding debt collecting and credit reporting will result in a small claims legal action against this company Midwest Recovery Systems at my local venue. I will be seeking a minimum of {$5000.00} in damages for : Defamation, Negligent Enablement of Identity Fraud, and Violation of the Fair Debt Collection Practices Act ( including but not limited to Section 807-8 ). This company will be required to appear in a court venue local to me, in order to formally defend themselves. This notice is an attempt to correct this company records, any information received from this company will be collected as evidence should any further action be necessary. This is a request that this company Midwest Recovery System cease there illegal collection attempt and request removal of there company name from my XXXX, XXXX, and XXXX credit reports immediately. I had a similar case against a collection agency and XXXX whom the collection agency was trying to collect illegal funds. I took them to small claims court and was awarded {$5000.00} from each company. This matter is urgent and should require your immediate attention. I am now prepared to file a small claims judgement against your company. I have been maintaining a careful record of my communication with you for legal purposes only. Dependent upon this company response, I may be detailing any potential issues with this company via an online public press release, including documentation of any potential small claims action. Further more, if this debt was valid, the statue of limitation ( SOL ) expires 6 years in my state. Which is another violation I can file charges against this company Midwest Recovery System. I close this account in XXXX!
