Complaint: This payday loan was opened back in 2012. I joined a payday loan support group shortly thereafter. To my understanding, the support group sent out validation letters to all the payday loan companies that I had done business with. No letters came back proving that these loans were valid in Florida. Since then I have been contacted by phone calls at home and at work. And now this has shown up on my credit report in collections. I tried contacting the payday loan support group that I joined but they are no longer in business.

I demand this item to be removed from my credit report since they violated the FCRP by not notifying me of this debt nor proof of validation, and completely be removed. Complaint: Midwest Recovery Systems, LLC, XXXX XXXX XXXX, XXXX XXXX, XXXX XXXX, Missouri XXXX, owned by a one XXXX XXXX XXXX, recently made an untruthful collection entry onto my XXXX credit report ( XXXX XXXX ). In the entry, Midwest alleges I owe a {$510.00} debt to payday lender XXXX XXXX XXXX XXXX supposedly due in XXXX XXXX. This claim is blatantly untrue. I never applied for, nor have I ever received a payday loan or funds from XXXX XXXX XXXX XXXX, nor any other person or entity. Midwest 's negative collection entry upon my credit report with XXXX is an attempt at identity theft, identity fraud or identity impersonation ; one or all being a fabrication tantamount to extortion ( ruining my credit rating ) to coerce me into paying Midwest and/or XXXX monies that I do not owe. My research has uncovered that Midwest Recovery Systems, L.L.C. is not a licensed collection agency in Florida where I live. In addition, XXXX XXXX XXXX XXXX XXXX, and its numerous affiliates, have never been incorporated in Florida, nor have they ever been licensed in XXXX as a money transmitter, a payday lender, a deferred presentment provider, or a money service business. Moreover, I have discovered that XX/XX/XXXX, the CFPB sued XXXX XXXX, XXXX, and his multitude of companies, including XXXX XXXX XXXX XXXX XXXX XXXX al ( Case XXXX ) for using " information bought from online lead generators to access consumers ' checking accounts to illegally deposit payday loans and withdraw fees without consent, '' collecting XXXX from consumers over a 15-month period. The United States District Court for the XXXX District of Missouri granted the CFPB 's request for a temporary restraining order, freezing the defendants ' assets, and installing a receiver to oversee the business. In addition, I have further learned that, following an extensive investigation, on Wed., XXXX XXXX, XXXX, Manhattan U.S. Attorney XXXX XXXX announced criminal charges had been filed against the owner of XXXX and its affiliates, to wit : a one XXXX XXXX, XXXX of operating a XXXX fraudulent internet payday lending enterprise whereas the defendant extended predatory loans to more than XXXX financially struggling Americans, including victims who never sought them. '' As per the XXXX XXXX, XXXX announcement, " XXXX XXXX XXXX, the United States Attorney for the XXXX District of XXXX ; XXXX XXXX XXXX, the Assistant Director-in-Charge of the XXXX Office of the Federal Bureau of Investigation ( " FBI '' ), and XXXX XXXX XXXX, Inspector General for the Board of Governors of the Federal Reserve System ( " Federal Reserve '' ), announced today ( XXXX XXXX, XXXX ) the unsealing of an indictment charging XXXX XXXX, XXXX with wire fraud and violating the Racketeer Influenced and Corrupt Organizations Act ( " RICO '' ) and the Truth in Lending Act ( " TILA '' ) for operating a payday lending enterprise that systematically evaded state usury laws in order to charge illegally high interest rates, and for issuing payday loans to consumers who never even sought them. I have submitted multiple investigations to the bureaus because it just suddenly appeared on my credit report. After submitting first investigation, they added it to another bureau and after disputing that one, they added to the third bureau. I am at a loss here for how they could report something on my credit and not be able to send me any validation of this debt? The company is Midwest Recovery Systems. Also they are reporting an opening date for the account as last month and that is not possible. I have a clean and clear good credit report. No defaults or delinquencies.

Complaint: This is being submitted with help by the XXXX. I took out a loan in XXXX with XXXX. It was XXXX XXXX when I took the loan out according to my records. I borrowed {$710.00} and repaid, I believe every two weeks, in the amount of {$210.00}, through XXXX of XXXX. While I do n't remember everything from that far back, I do have an email from XXXX in XXXX XXXX saying I had to call them to complete a new loan request, however, I never received any subsequent notifications that I actually obtained a new loan with a new loan amount and new payment amount, as I had for the XXXX loan. At the time, I was advised by my bank to close my account and open another one because they thought it could be possibly be illegitimate, which I did, as my records show. I received XXXX email from XXXX after the account change, but I never heard from them again. I have later realized that the loan I had was considered void in my state of Virginia. I received a some crazy debt collection calls several months ago, but the debt buyer just kept saying I owed money, but never provided any proof, even when asked. On XXXX XXXX, I received another set of calls. I returned the missed calls, to a woman, XXXX XXXX, who told me I owed them, for an XXXX. She was actually with Midwest Recovery Systems. I asked her to provide proof for the debt, because I had received calls several months earlier from a different company. She emailed me a debt collection letter as the proof I had asked for, but there was no actual proof or any documentation from XXXX, as to what was borrowerd, how much was paid, or how much was left on the loan before and after going to collections with them. The letter they sent as proof of the debt also disclosed that the owner of the debt was XXXX XXXX XXXX, XXXX, a company I had never heard of or heard from. I did n't receive any other contact or proof documentation that I had asked for, but I had received notifications from my credit monitering service on XXXX different occasions that Midwest Recovery Services had negatively reported on all XXXX credit bureaus. I was still waiting for the proof I requested, but it never came, so today I called back the initial number from XXXX XXXX, and talked to a XXXX XXXX, with Midwest Recovery Services. He said they are not the ones that have to provide proof, that I was the one who need to prove to them that I did n't still own on the XXXX account. I was shocked by that statement. I really did n't want to deal with this without any documentation, but I asked if I was to try to pay, how much would hey be willing to take. XXXX said that the owner of the debt, XXXX XXXX XXXX would n't be willing to take anything less than 50 % of the {$1500.00} they say I owed. I asked if I paid that amount ( 50 % ) would that take it off my credit. XXXX said no, the only way they would take it off my credit is if I paid the full amount of {$1500.00}, in essence he was extorting me out of the other 50 % for themselves to take it off of my credit reports. Also when I look at XXXX XXXX, it shows the open date of the loan as being XXXX XXXX of XXXX. The loan was clearly from XXXX, and until I received documentation from the original loan, with proof of exactly what was owed, an accounting, and proof that the loan is n't void in Virginia, I do not think they should be putting it on anyone 's credit. I am also puzzled why no proof is necessary on the part of the debt collector to show why so much was owed, and where any fees were added along the way. By my own records and calculations, I paid at least {$1500.00}, likely more on the loan before XXXX of XXXX, more than would XXXX required, as the loan is void in Virginia. The most troubling thing to me is the lack of proof on what was owed.

How can a business do that without contacting the person they claim are owing the debt? Complaint: While checking my credit report I noticed a collection account from a Midwest Recovery Systems stating that I owe {$500.00} from an XXXX XXXX XXXX. I have had dealings with them in the past after I had received several spam/fraud emails from another collection agency XXXX that was threatening to " take me to the courthouse if I do not pay '' I asked for proof of the debt being that I am a victim of identity theft in past. The never sent me any proof of the debt. I filed a complaint with my states attorney General, and they stated that the emails I was receiving were fraudulent. I also filed a complaint with the CFPB. After this, and not receiving any feedback from any XXXX, I thought the matter was closed. Now this collection agency Midwest Recovery Systems has placed this account on my credit report which has caused my credit score to drop nearly XXXX points! I am in the process of looking for a home to rent and this has severely affected my chances of getting approved by potential agents/ landlords. I have sent letters to all " collection agencies '' that are claiming to represent XXXX with no response.
