Problem during payment process
Complaint: XXXX has been non-compliant with removing the unverified account LENDMARK FINANCIAL S which has been deleted by XXXX and XXXX. XXXX and XXXX have both completed their research and determined that LENDMARK FINANCIAL S was not established by myself but XXXX keeps verifying this accounts. Also, when I called the company they responded that XXXX did not send them all of the verifying evidence to confirm each account is unverified.

Unable to receive car title or other problem after the loan is paid off
Complaint: On XX/XX/2018, I purchased a car for my daughter who had recently XXXX from XXXX XXXX with the intention of selling it to her within a couple of months after she was able to get her finances in order. I discussed this scenario with the loan officer as we were going through the closing documents which included the option to purchase GAP insurance which I had initially agreed to as we were going through all the closing documents. As I continued to go through the stack of documents, the loan officer, my daughter and I chatted about me selling my car to my daughter within the next XXXX months. The loan XXXX then advised me that the GAP insurance would not be transferable to my daughter XXXX months later when I would sell the car to her. Upon hearing this news, I advised the loan officer that I no longer wanted GAP insurance. She went to speak to a supervisor to see how to handle the change since the paperwork had been processed that included GAP insurance. She came back and advised me that since the manager had to leave early that day, and had already approved the transaction, she would send me a refund for the GAP insurance. I had no reason to doubt that they would keep their word but wanted to make sure that it was notated in the closing documents. I drafted a statement advising that I no longer wanted GAP insurance and that document was included in the closing documents.
I waited patiently for the refund for a couple of weeks and did not receive it. I phoned the office and was advised that the manager would get back to me with the refund. I never received the refund. I continued to call the office and was later advised that those funds would be applied to the balance. I was fine with that since I would be selling the car to my daughter within the month. Upon receiving the final payoff, I noticed that there had not been an adjustment for the GAP insurance. I began calling the office again. Once again the manager was out but the supervisor remembered my conversation with the loan officer and the fact that we had made the notation during closing. He said the manager would handle it.
After a few weeks, I had the opportunity to speak with the manager and she advised me that even though I changed my mind during closing that GAP insurance was not refundable. When I inquired as to why the loan officer stated that I would get a refund, she simply said she didn't know why she would tell me that. I reminded the manager that my signed document declining GAP insurance was included in the closing documents. She said she was aware of that ; however, I couldn't change my mind even at closing.

Complaint: To whom this may concern, At the Consumer Financial department Good Afternoon, I have been dealing with XXXX XXXX XXXX XXXX for a more then 4 years now. I had two accounts and loans that I have paid off with them. I open another account which is my latest account and I have the worst experience and unprofessional staff that I have dealt with. Located at XXXX XXXX XXXX XXXX XXXX XXXX MD, XXXX. The branch Manger XXXX and his staff have been very rude, disrespectful, unprofessional, threatening and belittling towards me on my most recent loan. This branch and company have been harassing me at my work place and personal cell phone. I have been called multiple times on my work phone. With threats about garnishing my paycheck and threading me I will be sent to court by the associate XXXX. My Job asked me not to receive those types of phone calls and I explained to XXXX XXXX XXXX XXXX and branch manger XXXX, XXXX and XXXX to please stop. I fell behind payments and explained to them I will be making the payment to catch the account back up to good order. They explained that I would have to come in and make the payment. They said the document I was signing was just stating that I will make the payment of amount that was asked to catch the account up and current. They lied and told me to sign something that I did not agree with. I got with a lawyer and he explained they placed me in trap that I could not get out off and it wasnt right. Once speaking to XXXX I asked why didnt you explain to me what this agreement was and lied about. He explained that was not his problem and he did not want to speak to me. I continued to make the payments for the amount of {$120.00} a month from that point on. Lendmark Financial called me on XX/XX/2018 to make a payment I missed and I explained that I totally forgot and told her to go ahead and use my debit account I had on file. She explained she will put me on a brief hold and never came back. Somebody else answered and she was very rude and loud stating she needed my Last name. She didnt tell me her name or what was going on. I asked why didnt she have my information and last name before I could finish she just put the phone back on hold not saying give me one moment to put you on hold. She put me back on hold and never came back I waited on the phone for about 5-7 mins and hung up to call the branch back. I called back to the branch and asked to speak to XXXX. He explained that he was getting tired of dealing with me and the feedback of him and his staff. I explained as a customer or client I have the right to express my feedback of him and his staff. Which he did like and expressed to him that I will be in the branch to make payment by quarters and pennies. He explained that was fine do what I would like I also explained I would be there in the next 15 mins and he said fine. I come to the XXXX branch and XXXX is at the front and explained that she will check with XXXX if It was okay to accept the payment which is a LEGAL TENDER. He made me wait for 20 minutes before he would come out and talk to me to tell me he wouldnt accept the payment. I explained that I do not have a bank and this is what I have to pay my account and explained to him you told me it was okay on the phone now it is not. The employees said we not about to count that all loud and rude to me. I explained to him that the law requires you take any XXXX XXXX especially when I owe a payment. He told me and mom and cousin that we could all get out his branch and did not want to deal with us and still refused payment which is all on video. They all continued to look at us and would not accept after multiple times trying to pay for my account. Since I have signed this agreement with Lendmark that I would pay I have had nothing but issues to make my payment trying to make it impossible for me to make a payment to fall delinquent. With that said Lendmark did not keep their agreement with me. He also noted he did not care because he would garnish my paycheck and he would move my account to another Lendmark without my permission I explained to him I did not want that. He explained he did not care and I had no option to this. The branch has blocked my phone calls or ignored me I had to call from a friend number just to get in touch with them on XX/XX/2018. I called to get the number to their lawyers office that had the agreement with me. I have all the videos and prof that they refused the payment and the customer service has 0 Value at this branch. I also called the corporate office on XX/XX/2018 and spoke with XXXX, XXXX @ XXXX and explained what was happening at the branch she called and spoke with XXXX . He explained he would refuse the payment as well to XXXX. She got back on the line and explained the same thing and thought the issue was funny and laughing at me. I would like call review based on her as well because that is not professional in any way. She didnt take my concerns seriously and placed me on 7 min hold just for an confirmation claim number. You could hear her laughing and telling other call center associates about the problem and chuckling over the phone. I would like resolution to this issue because this company is Rude and I will not give up even if I Have to take the video and documents to the news.
FYI - My local news company XXXX XXXX is interested in this story. But I will wait until Lendmark gives me an answer. They are aware of the Class action law suit that is currently happening and would be an add-on on how your branch mangers act on video to customers and clients XXXX XXXX XXXX XXXX XXXX XXXX XXXX MD XXXX

Complaint: RE : Lendmark Financial Services Effective XX/XX/XXXX my account was transferred from XXXX XXXX to Lendmark Financial Services ( I-1 ).
Around XX/XX/XXXX I got notification from XXXX XXXX that negative information had been placed in my credit file.
Around XX/XX/XXXX I noticed that Lendmark Financial Services was posting to XXXX two ( 2 ) entries for my account that was transferred from XXXX XXXX. ( I-2 page 2 ).
I noticed that one reporting ( I-3 ) entered on XX/XX/XXXX showed that the account was closed with a XXXX balance and included in my Chapter XXXX bankruptcy.
The second report ( I-4 ) entered on XX/XX/XXXX showed that the account was open with a {$5000.00} balance and 90-119 day late payment status.
This entry caused a 101 point drop in my credit score with XXXX effective XX/XX/XXXX ( I-5, I-6 ).
However, the original account ( I-7 ) which was reported as closed in bankruptcy accurately shows that my account never had a 30/60/90 day late reporting ( see page 2 of I-7 ) Around XX/XX/XXXX I filed a dispute with XXXX and requested that the open account reported by Lendmark Financial be deleted because the account was closed and included in my bankruptcy and that Lendmark was doing duplicate credit reporting on the same account.
On XX/XX/XXXX Lendmark re-entered the open account into XXXX ( I-8 ) showing the account as open with an outstanding balance of {$5000.00} and 90-119 day late payment status. There is no reference to the account having been included with my bankruptcy in XX/XX/XXXX.
A current summary of my Credit file ( I-9 ) reflects that I have Total Open Balances of {$7800.00} of which {$5000.00} is listed as other loans ( Lendmark ).
On XX/XX/XXXX at XXXX XXXX I talked with XXXX XXXX of Lendmark Financial Credit Dispute Department ( XXXX ) or ( XXXX ) XXXX ) who stated to me it is the policy of Lendmark Financial to close the original account of a borrower when the account goes to their bankruptcy department and open a new account with a new loan number for the purpose of continuing to report the loan as open with the credit bureaus during the entire time of the bankruptcy. For this reason I have two accounts reflected with XXXX at this time. She acknowledged that I have no legal obligations for the loan nor do I need to make payments, but this is Lendmarks procedure for handling the accounts of customers who file bankruptcy.
I researched on XXXX encyclopedia and learned : ( Copied from their webpage ) In fact, creditors wont be able to report your debt in a variety of ways that could cause your credit to suffer, such as allowing the obligation to show as : currently owed or active late or delinquent or outstanding charged off having a balance due, or converted to a new type of debt ( re-aged or given new account numbers, for example ).
Thus the reason for my complaint against Lendmark. My credit file reflects that the account is being shown in XXXX as : currently owed ( See I-9 page 1 ) or active late or delinquent or outstanding ( See I-9 page 2 ) having a balance due ( See I-9 page 1 ), or converted to a new type of debt ( re-aged or given new account numbers, for example ). Complaint: In a recent review of my credit report, XX/XX/XXXX I noticed the addition of a company called XXXX XXXX. I received no form of communication such as a phone call, a letter, or the like. In my attempt to contact the company, the unnamed representative, curtly stated to me : 'We purchased the debt from Lendmark Financial in your name and social and they state you owe a balance of {$1100.00}. ' I quickly asked where was the communication to substantiate said debt? She alleged that a letter was sent to the address that Lendmark provided to them and by law that is all that ( we ) are required to do. She further stated that she had been a debt collector for more than ( 20 ) years and she knew the laws. If in fact a letter was sent, it would have been returned. From XX/XX/XXXX to XX/XX/XXXX, I was XXXX. I had no fixed address and was essentially living on the streets, in a car, or a hotel when funds were available. My decent into XXXX stemmed from a job loss. Presently, I am attempting to restore my credit ; but when companies such as this impede my rights to challenge any debt prior to reporting, it becomes extremely difficult.

Complaint: I am writing to file a complaint on Lendmark Financial Services. I opened a loan account with them on XX/XX/XXXX the loan was for XXXX with a monthly payment of {$190.00}. I started to make payments then I lose my job at the same time I was going through a divorce and was unable to continue to make the payments I spoke with the supervisor over there and informed him of the situation I was in he stated he would do his best to hold off. He asked if there was any kind of payment that could be made I said not really as things were really bad for me. In XX/XX/XXXX Lendmark Financial Services Charged off my account for non-payment as I was unable to make the payments.I was hit with a heavy penalty from the Credit bureaus. I was notified by a company about them being the new account holder. At the time I was unable to make any arrangements so I waiting til I was able to. I called the company their name is XXXX XXXX XXXX XXXX XXXX XXXX . I sent up a payment agreement with them of {$100.00} to be taken out of my account monthly on the XX/XX/XXXX of each month. My first payment was to be a little more it was {$250.00} and there after {$100.00}. I made my first payment in XX/XX/XXXX and have made a payment each month. Well on XX/XX/XXXX I get an alert that I was hit with a serious delinquency on my credit reports when I called to check on what it was it was Lendmark Finanical Services they had changed the status from charged off/ closed/ transferred to OPEN status. Now I haven't had any contact with them, only the XXXX XXXX XXXX XXXX. I was now hit with another huge credit score drop. If my signed agreement is with XXXX XXXX XXXX XXXX how can XXXX come back and change the status to OPEN with the credit bureaus?
I have now been hit twice by the bureaus and my score has dropped tremendously.

Complaint: I'm currently struggling on paying some bills so I went to XXXX XXXX company which helps out people with different creditors to settle on a certain amount so I don't have to pay all of it back. They are currently trying to settle with Lendmark and I understand why they are calling me constantly to make a payment because I haven't but I had already told them to not contact where I work and they continue to. I find it disrespectful and thank XXXX I haven't got fired because they call almost everyday. I had spoke with a lady at Lendmark telling her to not contact me at work and she has other people calling from Lendmark and she should of passed the message to them as well. Also, they contacted my mom the other day asking to verify my employment and I don't appreciate that. I'm waiting till they settle on a agreement but until then I don't want them to contact me at work.

Complaint: On XX/XX/XXXX I took out a loan from XXXX XXXX XXXX XXXX XXXX branch located at XXXX XXXX XXXX XXXX # XXXX XXXX, SC XXXX ( XXXX ) XXXXfor a very close friend ( XXXX XXXX ) at the time who asked me to help him by getting a loan to help him because his credit was not good enough to take out a loan in his name and that he would pay the loan payments on time and if I could do this for him it would releive some of his financial stress for the thing 's that required prompt attention. I was not able to loan XXXXXXXX XXXX the money because financial I just didn't have it drowning in my own finances. I finally said yes because of my compassion to help other in their time of need in any way that I could and put my trust and faith in XXXXXXXX XXXX to keep his word on our verbal agreement/contract to never be 30 days and don't have lendmark call my job and he verbally agreed and promised to do as I asked which was discussed while at the Lendmark location with the loan officer. The Branch Manager XXXX and loan officer XXXX were aware that this loan was solely for XXXX XXXX but needed my my credit to obtain the loan. I have received numerous phone calls, voicemails, and correspondence by mail in reference to late payment. The branch has been kind and helping with a solution to this problem by deferring payments and waving late fees due to XXXXXXXX XXXX being in breach of our verbal contract. It was stated to XXXXXXXX XXXX that I could afford him not making the payments on the loan, because I could not financially afford it. I travel for work up until I start my XXXX XXXX for XXXX XXXX and will no longer be able to work full-time. While between travel assignments I don't get paid and to gain the extra financial strain of this loan payment is overwhelming and unaffordable for me with everything else I'm already burdened with financially is causing me physical and mental distress. XXXXXXXX XXXX has been paying the loan since XXXX up until XXXX XXXX and just stop responding to Lendmark 's phone calls and my phone calls and text and just think that it's ok to just not pay his loan in my name because he used the money not me it was for his expenses not mine and I'm hurt and disgusted because I'm doing my best to maintain my credit so that one day I can be a first time homeowner like many others, but don't feel that the good deed I did that I should bear the burden, because they breached and violated the verbal agreement/contract to pay this loan. I would really love to have resolution from this issue and I'm begging for this loan to be forgiven because I just can't afford it and it's ruining my life with the constant phone calls and crying because I need my credit and digging myself deeper in debt by neglecting my financial responsibilities to address this loan that only belongs to me by name. Complaint: I have been paying my loan off on time for the last 4 years with Lendmark Financial. My balance was {$170.00}. I processed my last payment online today and scheduled it for tomorrow. Due to issues I have heard about pay off practices with this lender, I decided to give them a call and confirm that all my obligations will be satisfied. I was then told that i will till owe money and that the amount listed is not what I actually own.
I tried to speak with the manager and express concerns about irregular practice in which the information online and over the phone are not correct, and I was told that it is all in my loan docs!
I have heard that a lot of other customers had the same issue with this lender and this is why I decided to submit my complaint.

Complaint: I have a loan with Lendmark Financial Services. For at least a year I have been asking for a monthly statement that shows current balance. Each time I am told the " process '' is under construction.
I also expressed on serveal occasions my balance goes up and not down.
They crafted some form of a statement that was very confusing.
Is is not required to get a statement with due date, payment due, and current balance???
Are they not required to show current apr?
