Attempts to collect debt not owed

Debt collection: I do not know

Debt was result of identity theft
Complaint: Back in XX/XX/XXXX, in need of a new car, I visited the dealership to see if I could get some sort of financing. The sales rep came back with a twisted face and a horrible credit report in his hands saying that my score was XXXX!!!!! The last time I had checked my score it was in the mid 600s and I didnt recognize alot of the information that was in my credit report like collection accounts, credit cards, addresses, and over 80 inquiries! I immediately knew someone had gotten my information and I called all 3 credit bureaus and had a fraud alert placed. I tried disputing with the credit bureaus about all the misinformation, some things were removed. HUNTER WARFIELD refused to move these three collection accounts ( XXXX XXXX XXXX - ACCT # XXXX ) & ( XXXX XXXX - XXXX ) & ( XXXX AT XXXX XXXX - ACCT # XXXX ) and these accounts are almost {$8000.00} and {$9000.00} debt that does not belong to me and is extremely affecting my credit. After advising the credit bureaus that these collections are identity theft and I myself did not enter any contract with anyone to owe these amounts. By XX/XX/XXXX all credit bureaus had contacted me back saying HUNTER WARFIELD had verified the information as accurate! I contacted them immediately asking to provide them a police report and identity theft report and they refused saying I could only add a statement because they have already verified. I ask them to provide me with them information they used to verify the account belonged to me and they told me to contact the company who is requesting the debt! HUNTER WARFIELD IS REPORTING FALSE INFORMATION TO MY CREDIT REPORT AND REFUSES TO PROVE THESE ACCOUNTS BELONG TO ME! I believe their actions are unlawful, shameful, vile and without merit. With that being said, it is distasteful for them to throw a curb ball of this magnitude, especially when they continuously REFUSE to Validate the Debt which would prove that they have proper ownership of the debt. Therefore, I believe the possible violations are as follow ( s ) but not limited to : 1. The Fair Credit Reporting Act ( FCRA ) 15 U.S.C. 1681b ( c ) : Transactions Not initiated by Consumer. 2. 607. Compliance procedures : ( b ) Accuracy of report ( 15 U.S. Code 1681e ) 3. 616. Civil liability for willful noncompliance ( 15 U.S.C. 1681n ) 4. 616. Civil liability for negligent noncompliance ( 15 U.S.C. 1681o ) 5. Continued to attempt to collect a disputed debt is a FDCPA violation according to FDCPA-Validation of Debts 15 U.S.C. 1692g ( b ) 6. 15 U.S.C. 1692e False or misleading representations 7. 15 U.S.C. 1692f Unfair practices 8. FDCPA-Validation of Debts 15 U.S.C. 1692g 9. Extortion 10. FRAUD by knowingly attempting to execute, any trickery scheme with the intent to defraud a consumer/ debtor. 11. 15 U.S. Code 1681i ( B ) ( i ) ( ii ) and ( iii ) Requirements relating to reinsertion of previously deleted material 12. FCDPA-Communicating false credit information-807 ( 8 ) 13. FCDPA-Falsely obtaining information about me-807 ( 10 ) 14. FCDPA-Creditor Misrepresentation of Identity-807 ( 14 ) 15. The debt collector shall cease all collection once the item has been disputed according to FDCPA-Validation of Debts 15 U.S.C. 1692g ( b ) 16.

Attempts to collect debt not owed

Debt collection: Other debt

Debt is not yours
Complaint: Started receiving harassing calls at my office regarding breaking a lease with XXXX XXXX XXXX in XXXX, KY in XX/XX/2019 from Hunter Warfield representatives. Received calls daily for several weeks until I learned I could send a written notice telling them to cease and also request proof of debt. I was not under a valid lease agreement and have provided the collection company proof of such but they continued to claim I owe the debt. What they sent me is exactly what shows that I was not living under a valid lease agreement. They had provided a copy of a lease that expired 6 months prior to me vacating the property. Called Hunter Warfield on XX/XX/2019 to try again to show them I was not living under a valid lease agreement and ended up talking to someone named XXXX that identified himself as a senior manager. All he did was talk over me, threaten to ruin my credit score and argue that the lease agreement was valid when it clearly isn't. The apartments ' management company, XXXX XXXX, turned this over to Hunter Warfield without ever contacting me which makes me wonder if they knew they didn't have a leg to stand on so they'd see if an aggressive collection company could scare me into paying something I wasn't responsible for. My rent was current and paid in full prior to my moving out. I had given them more than 30 days notice and even told them they could keep my {$200.00} deposit.

Attempts to collect debt not owed

Debt collection: Other debt

Debt was paid
Complaint: Hello, I accrued a debt from an apartment complex judgement in XX/XX/XXXX. As specifically directed by the complex, I paid the debt to Hunter Warfield in XX/XX/XXXX. Debt remained on my credit report after repeatedly notifying ALL parties involved from XX/XX/XXXX-XX/XX/XXXX. I was unable to rent an apartment in my name for YEARS ( XX/XX/XXXX/XX/XX/XXXX to be exact ). I believe the collection agency committedseveral violations ( FDCPA and others ) Including but not limited to : 807. False or misleading representations 808. Unfair practices ( 1 ) 809. Validation of debts 812. Furnishing certain deceptive forms 813. Civil liability ( Specifically B-1 ) -the frequency and persistence of noncompliance by the debt collector, the nature of such noncompliance, and the extent to which such noncompliance was intentional I have every single receipt, email correspondence, credit report, direct dispute to the credit bureaus, complaint #, Attorney/Firm of record information, rental application, adverse action letter, video, audio etc ... to validate my beliefs. The collection agency is also aware of our interactions over the years. The collection agency is not only blatantly rude and egregiouslydeceptive at every turn, they are also extremely reliant on the statute of limitations. However, I recently discoveredthe court and law firm of record was never paid nor notified the debt was satisfied. Credit reports no longer report judgments butto this day ( XX/XX/XXXX ) I have an unpaid judgement in my name until XX/XX/XXXX. The statute of limitations on a civil judgement is 10 years. Legally I am still subject to garnishment if anyone ever tried to pursue action. It is my belief, that they acted fully as creditor and in doing so violatedTennessee Code Title 26. Execution 26-2-217 : ( 2 ) The judgment creditor shall notify the court clerk of the balance due upon a judgment whenever the creditor causes the issuance or revival of a garnishment thereon. Furthermore, the judgment creditor shall notify the court clerk when the judgment has been satisfied. Tenn. Code 26-2-217 Please note, there is NO DISPUTE from either party that the debt was paid in XX/XX/XXXX. The issue, as I believe, is that they want to separate the judgement from the debt and deny responsibility forall related items that appeared on my credit report ; yet, they acted fully on their client 's behalf when they accepted the payment ( and approved it's deletion in XX/XX/XXXX ). I can also prove that even if it is two separate issues, even their client was unaware of this arrangement. This issueis from my very first apartment. As a regular adult, I could not simply give up my attempt to provide shelter. IHAD to keep all of my documentation in order to embarrassingly explain this situation repeatedly to rental properties. I literally made life decisions based on this. This has been continuously stressful but with family, I make it through. It is my sincerest hope that they are unable to do this to anyone else. Most importantly, Thank You for this service. Like many others subjected to predatory business practices, I do not have counsel. I only have my voice. Iam grateful for theefforts of those who tireless work to increase our tone. Best Regards, XXXX XXXX XXXX XXXX XXXX XXXX

Attempts to collect debt not owed

Debt collection: Other debt

Debt was result of identity theft
Complaint: I have been trying to resolve a debt generated by identity theft with debt collector Hunter Warfield. They contacted me XX/XX/XXXX regarding a defaulted rental agreement to the amount of {$1500.00}. This is not by debt and the result of someone forging my name using docusign on the rental agreement. I have spent several frustrating phone calls, written letters stating this wasn't me and was a forgery generated in docusign. I have taken the CFPB 's recommendation and have contacted my local police department to report this identity theft. I have also run a credit report and see that Hunter Warfield ran a credit check on me last year XX/XX/XXXX. The local police dept. recommended Hunter Warfield contact them with the case # if they want to see the report. Hunter Warfield told me over the phone they don't do that and will not close out this debt. This does not sound legit and I am afraid Hunter Warfield is trying to use this fraudulent debt to ruin my credit report if I don't pay them.

Complaint: On XX/XX/XXXX my husband and I signed a lease agreement with XXXX XXXX XXXX and put an {$800.00} refundable security deposit down. We were due to move in XX/XX/XXXX. On XX/XX/XXXX we put in 36 days notice that we would not be moving in and were told by XXXX XXXX that we would receive our deposit back as we provided over 30 days notice. On XX/XX/XXXX XXXX confirmed that the unit was re-rented. XXXX not only held our deposit, but also sent us to collections for {$1600.00}. XXXX XXXX charged the current renters, the new renters and us for the one unit. It is against California state law to charge more than one party rent for the same property. XXXX XXXX also included a 30 day move-out guarantee within the lease agreement that included that the security deposit would be refunded if we provided 30 days written notice that we were vacating the property within the first 30 days of the lease. We provided this notice 36 days before the lease was even due to begin. Hunter Warfield Inc, XXXX XXXX XXXX XXXX, XXXX, FL XXXX now holds the debt and every two to four months is entering the debt as a new uncollected debt. For four years and one month they have been entering the erroneous debt as a new charge off. Not only was the debt fallacious to begin with, but they have falsely resubmitted the debt over and over for four years. This is not only harassment but is also falsifying documentation.

Attempts to collect debt not owed

Debt collection: Other debt

Debt was paid
Complaint: The purpose of this communication is to advise the collector Hunter Warfield that the debt you are trying to collect do not, and should not exist, because I notified XXXX the manager at XXXX XXXX XXXX that, I could no longer reside in the community, because of the fact that I was the victim of a car burglary, and I no longer felt safe, as a senior citizen living in XXXX. XXXX told me that I could live out my deposit if I cleaned the apartment, and this was done. I also told her was that I had came into contact with a criminal that I knew from my previous employment, at the XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX, and he had made a verbal threat on my life. XXXX told me, and I understood that she could not evict a person because of the fact that they had previous involvement in a criminal life style. Therefore, I told her that I would have to move, because I feared for my safety, and on the day that I moved I went to the office, along with one of two of my former co-workers and turned in my key. Several years later, I started getting calls from Hunter Warfield about a debt I owed to XXXX. This debt should not exist because I made sure that I took a witness with me for this specific reason, and he is willing, and available to testify in court if needed. As far as the criminal I did not take the time to find out if he was a resident at, or if he was visiting a resident in the community. I know that at my age, I was prepared, and had would have had to use deadly force to protect, against him, and I did not want a public trial, because this would have led to even more scrutiny, and me having to move again. Therefore, I would like the CFPB to publish this description of my response to Hunter Warfield claims, because I feel that, if there was a problem with my actions, XXXX should have stated them to me when I turned in my key. if they continue with their unwarranted contact I am prepared to go to court with a witness to provide direct evidence of my lst contact with XXXX.

Indicated you were committing crime by not paying debt
Complaint: I have multiple complaints against this company. Hunter Warfield, I received calls daily from many different phone numbers after repeatedly asking them to stop harassing me. I have been threatened and cursed and hung up on. They are now charging me monthly interest on a debt which does not by contract allow, the amount being collected on is incorrect as well. This is in reference to a lease agreement, property which was infested with rodents and pests, windows and doors which were not able to be secured, 90 plus days with no air conditioning, holes in the ceiling, all in violation of the lease agreement and safety and of my health. I submitted all documents to them in proof. I do NOT owe the amount, they also sent me a settlement offer with a deadline which also is in violation of the fdcpa. I have called the property management and they no longer own the property and take no responsibility for the uninhabitable conditions. Hunter Warfield is violating all of my rights
