Written notification about debt

Debt collection: Other debt

Didn't receive notice of right to dispute
Complaint: I began getting calls regarding debt owed to an apartment complex that I moved out of. The debt collector, Hunter Warfield stated that since I did not do a final walk through at move out, I owe an amount of {$560.00}. I never received anything in writing from them regarding this debt. When I called to try to settle the debt, I asked for an agreement in writing. They refused to put anything in writing and stated that once I pay, I will receive an email with a code to retrieve confirmation of my payment within 24 to 48 hours. Hunter Warfield continues to report the debt to the credit bureaus continuously. They mentioned on the phone that they do not own the debt but are trying to collect on behalf of their client, the apartment complex. I am more than willing to settle this if they can prove that they are legally authorized to collect this debt.

Attempts to collect debt not owed

Debt collection: Other debt

Debt was paid
Complaint: I told them I have paid this debit off before I ever heard from Hunter Warfield. XXXX took my money and I asked them to not contact my company again using robocalls. She told me that the calls will not stop and they will continue to call me as often as they like. I told her I would report them and before I finished my sentence so cut me off and laughing said go right ahead. I own a towing and recovery business and am fully trained in debit collections myself. I have studied and certified in these areas as directly relates to repossessions of assets. She said if I paid my debit after a certain date i still owe them. Which is completely illegal. If XXXX took my money the account was not charged off. Therefore another company can't collect the debit again.

Didn't receive enough information to verify debt
Complaint: Recently, I have received phone calls from a collection agency named Hunter Warfield. They claim that I have an outstanding balance of {$540.00} owed on a previous rental property. They are also telling me that if I do not pay it immediately, they would damage my credit report by reporting it to XXXX, XXXX, and XXXX XXXX. First of all, I have explained to Hunter Warfield, that I resolved my account with my former landlord some time ago, so their collection efforts are unwarranted. Additionally, I have requested that Hunter Warfield provide me with documentation from the previous landlord, which details the charges that constitute the supposed {$540.00} debt. Their representatives refuse to send me anything in writing. They simply state that if I do not pay them {$540.00} right now, they are going to hurt my credit.

Impersonated attorney, law enforcement, or government official
Complaint: This company ( Hunter Warfield ) which I hold No Contract with nor have received services from is a 3rd party agency who has no right to collect anything from the alleged debtor since there is no way they can prove they were on any original contract. 73 Amjur, 2nd, Section 90. You have no right to subrogate ( substitute ) yourself into a contract. Whether it be by purchase, assignment, transfer, or trade. If you bought the debt you did it on your own behalf. Not at the request of any alleged debtor, and therefore are a stranger to the transaction ( voluntary payee ). Reporting of this debt is a violation of the FCRA and the FDCPA. Ive conducted some research on this company and in the state of Missouri this company is not Licensed, Bonded, and does not have a Certificate of Authority to collect in the state of Missouri. This is against the state and federal laws. Refused for a cause without dishonur. I hereby rescind my signature and do not consent to this contract with your corporate office. Once a company charges off the account and sends it to a collection company they are in breach of their own contract. This is against the FCRA.

Incorrect information on your report

Credit reporting, credit repair services, or other personal consumer reports: Credit reporting

Account information incorrect
Complaint: I was living at XXXX XXXX XXXX XXXX on a one year lease that was supposed to end in XX/XX/XXXX. I informed them on XX/XX/XXXX that I would be needing to move out as of XX/XX/XXXX due to personal issues, HOWEVER, there had also been some major issues with maintenance and being blamed for having dog waste that wasnt ours outside of our apartment even though we were picking other peoples dog waste up. We had maintenance issues with our dryer and one of our showers not working that was ongoing from almost the beginning of our lease. I paid my rent until when I moved out and left the apartment in pristine condition. Nothing more was said from the complex after I left. My daughter had even been back a few times to get mail not forwarded and the office said nothing to her ( she was also on the lease ). Imagine my surprise when I just checked my credit report and see that I am being reported as owing {$9800.00} since XX/XX/XXXX to XXXX XXXX XXXX being collected by a Hunter Warfield who I will also be reporting as a collection agency should know better than this. Im assuming that they are trying to make me responsible for the remainder of the lease from when I moved out until XXXX. The problem is, XXXX XXXX contacted me by phone and email ( thankfully ) and let me know that a new tenant had moved into the same apartment I had moved out of ( they took tenancy as of XX/XX/XXXX ) and needed me to release services because some reason services were still hooked up in my name. I have thankfully kept that communication to prove that they are trying to collect for the same apartment twice and only within a month of me vacating which I believe is a violation of the Fair Debt Reporting Act as well as other AZ tenant/landlord laws. I am requesting that this ALL be removed from all credit reporting agencies and stop all collection activities due to this violation and the fact that there was harassment over behaviors displayed by neighbors and not by me ( quite the opposite ) as well as maintenance issues ongoing and never corrected after numerous visits.

Debt collection: Other debt

Attempted to collect wrong amount
Complaint: On or around XX/XX/XXXX, a credit bureau dispute was submitted against this company for an erroneous balance they claim is owed to " XXXX XXXX XXXX ''. On or around XX/XX/XXXX, a written dispute and request for validation was sent directly to collection agency, Hunter Warfield Inc. They were also advised to cease and desist verbal communication. This company failed to provide adequate proof of this alleged debt within a reasonable time frame. They continued to call and harass me repeatedly after receiving notice to cease communication other than a written response to my dispute. They also reported to the credit bureau that this debt was verified as accurate, however after speaking to the original creditor it was found that the balance was in fact erroneous. This debt was taken to court in XX/XX/XXXX through XXXX City Court and was dismissed. I have filed an attorney general complaint against the owner of this debt, XXXX XXXX located in VA as well for failure to address and correct this matter within a timely manner. Hunter Warfield Inc has had many complaints against them for deliberate violations against consumer rights. They run a very unprofessional operation and I believe their name is used as a scare tactic to make people think they are an attorney, which in my opinion is a deceptive practice. I would like to ask that this company be fully investigated by the CFPB.

Sued you without properly notifying you of lawsuit
Complaint: This is a response per my last complaint filed via CFPB. When I was disputing this charge, all of my information provided was not sent to you to update your records. Second, this account seems to be involved in some type of " court '' appearance via XXXX County Clerk of Courts and it is being handled by " XXXX XXXX XXXX XXXX XXXX '' doing business as XXXX XXXX and retained by XXXX, XXXX. I am disputing this account through XXXX because the last payment on this account was given on XX/XX/XXXX in the amount of {$500.00}. Therefore, on XX/XX/XXXX, it will reach the 5 years per statute of limitations. I never came into agreement of validating this debt nor of any agreement on a payment arrangement. If this account is being handled directly via XXXX XXXX XXXX XXXX, then why are you reporting it on my report under XXXX? That is considered DUPLICATE debt. Hunter Warfield is NOT listed on the statement of claim which was filed. On XX/XX/XXXX, I never entered into any agreement and I am requesting proof of this allegation ( signature ). I suggest you contact whoever you are partnered with and find the means to get this resolved because I find it unprofessional that this account is being duplicated and being attempted to being served in addresses that I do not live in.
