Complaint: I took out a XXXX XXXX loan and afterwards lost my job and accrued serious medical bills from a XXXX XXXX. I 've paid off over half the loan but am unable to pay the rest right now. Advance Financial calls me from different phone numbers upwards of 15-20 times a day starting around XXXX XXXX central time. Also In the process of making automated withdrawals from my account they over drew my account. I did agree to automatic withdrawal but the fact they caused overdraft fees is very upsetting.

Complaint: Sometime around the beginning of XX/XX/XXXX my billing cycle was changed without my permission in regards to my flex-loan with Advance Financial. They also attempted to withdrawl payments from my bank account ( XX/XX/XXXX ) after I had submitted in writing to revoke permission to withdrawl funds from my account ( XX/XX/XXXX ) because of the billing issues. I have had no true resolution on my account even after submitting a BBB complaint ( # XXXX ). I have spoken with both XXXX XXXX ( Customer Resolution ) and XXXX XXXX ( Manager ) and each time I only ask for my account to be updated and a correct statement sent to me so that I can make my payments. Each time I speak to XXXX XXXX he tells me that he is correcting the error and fix my statement. I have made it clear that I will not make further payments until all errors have been corrected and I am sent a correct and accurate statement. I am told that they will only correct the errors after I make a payment. I think this is an unreasonable request when the statement that I am paying is incorrect. I have been told that adjustments will be made and fees removed from my account only after I make a payment. I have also requested no phone contact via writing and am still receiving multiple calls daily and voicemails with no messages left on my cell phone. This is a direct violation of my FDCPA rights in regards to ceasing communication and harassment or abuse by causing a telephone to ring continuously with intent to annoy. I just want resolution and my account corrected. I have included copies of BBB Complaint, email communication, phone calls and request to stop payments.

Didn't receive notice of right to dispute
Complaint: I have already made payments of more than double the amount borrowed. I have had NO contact with or from this company since XXXX or XXXX XXXX , at which time I disputed interest charges & wanted a new settlement of the account & they indicated that they would credit my account & I was considered paid in full as I indicated I was going to consult an attorney or file complaints. On XXXX / XXXX / XXXX a call was made to my employer when I was not there & a message was left that " I 'd better call.. '' I called this unrecognized number & gave out my current address, as I did not want anyone showing up at my workplace. A summons in a sealed envelope was found in a neighbor 's bushes on XXXX . I am being sued for much more than I originally borrowed ( & alre ady paid off ) plus legal fees, court costs & process server costs.There is NO other attached documentation on this summons. Prior to this I have NOT gotten any letter, etc., that would allow me to dispute and/or dem and the customary debt validation, along with the associated waiting period. I suspect that Harpeth d ba/ Advance Financial has sold off this loan & the attorney will have a " flimsy sworn acct. '' as " proof '' from Advance. The address on the summons is where I lived TWO years ago, which bears out my suspicions about Advance selling my account to an atty/ '' XXXX '', as Advance has had my current address the entire time I was their customer.

Complaint: i originally got my loan ( flex loan ) from ADVANCE FINANCIAL IN XX/XX/XXXX. I walked in and got this loan with in an hour from a very friendly guy that was honest and helped me with a great atttitude, i have payed every month with high intrest and no compaints until now, as usual i payed XX/XX/XXXX my monthly intrest and the minumal amount of around 10.00 on the actual principal witch gave me an availible balance XXXX. on XX/XX/XXXX i paid another extra XXXX on the pricipal directly from bank account, bank draft that i had authorized at the begining of the loan given them access to draft from bank and to withdraw payment if i do not so by the XX/XX/XXXX of the month current availible balance = {$25.00} availible credit, on XX/XX/XXXX i posted another draft of {$60.00} principal payment, making an availible credit limit of {$85.00}. i then went in on XX/XX/XXXX to withdrawl the the currednt availible balance of {$85.00} but was told i could not due to the payments i made by bank draft like i have serveral other times as my bank is in the next town and i do not have a debit card its an easy access and they make money. i told her i completly understand that why its processing the {$5.00} and {$60.00} payments that it is not availible just to make sure the money is there but then she told me i could not even with drawl the XXXX from 2 payments earlier the first one over a month ago and she then explained that no open credit is availible while its processing new payments? i never herd of this and been paying for 5 months was always able to withdraw any time as i was told i would be able to but i did not argue as i can understand company policys are not made by agents, she also told me it would be availible by friday. i returned home and i was upset and called there main company line to get another person who repeated what she said as if i had not told her exactly what was said and that my paid {$20.00} should be availible no matter what, i was offered no solutions and no calls back no offeres to talk to suppervisor or even a recomendation of calling regular office hours maybe a solution could be found. no solutions and acted like they did not care and that its just my problem that the money i had in the bank was now tied up waiting to process and now even my open line credit limit was unavailible because i made the mistake of trusting what they told me and what it currently says on line and in my agreement. after the phone call i was very mad and emailed the company the current situation and frustration, on XX/XX/XXXX i received an email accepting no responsabilitys and told me that there agents game me the very best service? then left my numbers so she could contact me by phone. i had to ask what service what solution. on XX/XX/XXXX the XXXX payment had went threw my bank and money was gone with only one pending transaction of $ XXXX.on XX/XX/XXXX the XXXX draft aslo cleared my bank. on XX/XX/XXXX i called up to my local store and they told me that my currentcredit availible was XXXX but i could only withdrawl the XXXX because the remander XXXX was still processing? i went to go withdraw the XXXX and was successfull but mention this to the person who acted like they had never herd of this. when i contacted the agent who talked to on the email on XX/XX/XXXX she did a very good job of understanding why i was so upset and offered me a gift card and told me that it had been processed byboth my bank and there bank and that it still was unavailible to me and she would check in on it. i then received an email a few hours later with an electronical gift card and said that there computers do not update until XXXX XXXX central and that the money should be avilible then on XX/XX/XXXX and then recived an add shortly after saying happy XXXX XXXX your current availible credit line is {$60.00} just in time for the holidays! so i called the store and they confirmed this so i headed down there but when i got there was given the same exact speech that the money is not availible still processing and this is the same agent i had talked to on XX/XX/XXXX that said by friday and i told her about all the issues i have had and then she told me no i did not that i had only spoke to 1 person after her by phone and that my other conversations never took place! she did not call me a liar but denied that anything i had said did not happen! needless to say i was very upset so i went home and called there XXXX number again were i got a male agent who confurmed my information and ask me the issue so i gave him the short version but mainly what had just happened because i was not called a liar but that nothing i said was true! after i said what i had to say, i herd nothing and said hello 2 times when another man with a different voice and a smurk in his voice say ya ya and continued to tell me it would be availible tuesday and took a bite off an apple and started chewing while talking to me, i dont think i have every encountered behavior like this from a company or its employees. the only person who did try to help me was the woman i talked to in the emails who had done a good job until this last person, i choose this loan because on there web page it points out 2 very important things 1. a FLEX Loan gives you the ability to apply once and withdraw cash at any time ( up to your credit limit ). and 2.An Advance Financial FLEX Loan puts you in complete control. word for word. i am anything but in control and the agent that was eating an apple doring my problems and issues should not have a job, my goal in life is not to pay this loan off as fast as i possible can and consider it the worst choice in services i have ever made the mistake of choosing and only wish i could pay off today and not even ask for any more but am trapped as they tied up all my funds and avilible credit for over a week.XX/XX/XXXX i still do not have access to my credit limit.

Complaint: Advance Financial should be taken out of business. I was not aware of the 279 % interest they charge for a flex loan. They took a total of {$450.00} per month out of my checking account since the beginning of XXXX . My payoff balance only keeps getting higher and higher. Their flex loans are set up to XXXX customers over and make them further in debt by not helping them in any way due to the outrageous interest rates. What a scam!!

Complaint: On XXXX XXXX , XXXX , Advance Financial submitted XXXX varying automatic debit from my checking account totaling {$360.00} ( {$120.00}, {$120.00}, and {$110.00 } ). Ta king money that they knew and know is judgment free in an attempt to collect a debt. I currently received XXXX and XXXX XXXX XXXX as my only income which they authorized and received illegally under state of tennessee laws and Fair Debt Collection Protection Act. When I called to inquire about the debits from my account and receiving a refund ; a XXXX and a XXXX first informed me " before they could assist me they would first like to inform me any information given in regards to my account is an attempt to collect a debt. '' Under Tennessee laws once my account is in default they should seek legal remedies to resolve the matter. Instead they continued to seek debiting my account, which violates state laws. They failed to notify me in writing of my account being pursued as a debt as it has been in default since XXXX XXXX , XXXX , violating the FDCPA. The company also breached the contract in which they are to only submit a " single debit entry only in the event of default ''

Complaint: Advanced Financial XXXX, TENNESSEE Issues : 1 - Charged fees or interest I did n't expect 2 - Ca n't stop lender from charging my bank account I 'm just VERY dissatisfied with their business practices with the XXXX and auto taking my payment 's when I 'm not set up for auto pay - customer service rep verified I was NOT set up as Auto Pay When I first got help from customer service due to my financial situation ( unemployed ) I was under the impression they were going to suspend the interest so what money I could pay at the time would take down the principle balance. As well as keep my account out of collections. I made reduced payments and it still went to interest with just a fraction going towards my principle.. My principle has only gone down about {$20.00} and I 've paid hundred 's of dollars over the past few months and I have not and refuse to not take any more money from this line of credit again.
The other day ( XX/XX/XXXX ) They automatically took {$230.00} from my account the other day and as stated above I am verified as not on auto pay. On XX/XX/XXXX they auto pulled {$97.00} XXXX CST then another hour later they auto pulled again {$130.00} at XXXX. I had also just paid {$50.00} online about 2 weeks before.
My account is behind but they know that due to my situation.
They are kind of hard to deal with. I want the money they took from me back as I do n't think they have the right to auto pull payments if I 'm not set up and did n't give them permission to do so.
The XXXX is predatory lending. They do n't explain the process and before you know it you are swimming in debt that does n't go down and they feel they are at liberty to take what they want.
We can only work and make money so fast to keep up, and when they auto take money, it takes from being able to cover basic needs.
VERY upset with this place, regret borrowing from them. I want resolution to my account.

Complaint: I was NOT told that I retest accrues daily, I was not informed that there is no help in catching up should we fall behind, save for deferring a payment and then doubling up on payments he next month. Because of this, my payments have increased to $ XXXX/mo. I only bring home $ XXXX/check, so how am I supposed to pay this off? I have NEVER done business with a company that allows credit to be increased without considering monthly income. If they had limited my credit usage, I would n't be in this situation. They prey vulnerable and the financially unstable and have no means of recovering. This is insane ; I originally borrowed XXXX and now my balance is over XXXX with $ XXXX/mo payments and very little of that going to the principal. This is a trap, and they need to be sued immediately. I inquired about closing the account and paying it off, and I ca n't even do that to try to get this under control.

Complaint: I have filled out a stop payment form with bank and I have also filled out a form that stops them from taking money off my bank card as well. I sent them a certified letter stating that I am revoking my consent to use my bank for any future transactions/eft's/ACH ... etc, etc. I have offered them {$50.00} every 2 weeks but they are going to continue the 7.9 % interest per day on me!!!!! I will never get out of this!!!! Atleast I am trying to pay them and not running off and waiting till they take me to court ... ... .Their EPP ( extended payment plan ) agreement is very unfair!!! Complaint: I took out a flex loan XX/XX/2016 shortly after the loan was taken out my child was XXXX and I became late on all my bills. I contacted Advance Financial XX/XX/XXXX and again XX/XX/XXXX via telephone and I mailed a letter stating that I was aware of my account being behind and wanted to know if I could settle the account by making smaller payments and I received no response. I started receiving mailing from attorneys because I am being sued not only did they not respond they have now attached attorney fees and other fees. This will for sure force me into bankruptcy.

I 'd been with Advance Financial for years as they offered both payday loans and a XXXX cash loan with a total pay off of XXXX. In XXXX XXXX I went in to Advance Financial and was told they had switched to a new flex loan that would " save me money '' but because it was so new the clerk did not no the details. That 's when things got out of control. I was making regular payments with automatic deductions from my banking account and not getting a bill. Three months later I went into the store and was told I only had {$35.00} in credit ; that 's when it hit me! I had made approx. XXXX payments of {$700.00} dollars thinking I was getting close to the end of this loan. I did file a complaint and agreed upon a settlement with the company when I received a tax refund in XXXX XXXX. I spoke to a very nice company rep and we settled on a payment arrangement and was also given a 30 % rebate off their product. Once again, I found myself as a customer of theirs as if I had n't learned my lesson and I am in a worse boat then ever. I do n't believe the 30 % was applied to this loan and out of desperation I went to another pay day loan to take out a new loan to pay off Advance Financial and am now up to XXXX. Yes, I am taking fault as I wanted to make payments but these companies make so you will NEVER got out of debt with them. The additional XXXX companies I used are XXXX XXXX XXXX and Tennessee XXXX. Between the XXXX companies, they 've eaten up XXXX of my paycheck as they automatically take the money from my account. I am behind on all my bills and even two months behind on my mortgage because I am trying to pay them off. What I owe is greater than what I initially borrowed with each of these companies. With XXXX XXXX XXXX, I tried to make a payment over the amount due and was told by the manager " my computer wo n't let me do that. '' These companies are impacting my quality of lie and health. In XXXX I was XXXX and the XXXX and XXXX was way better than dealing with these companies. I make a decent living and they are robbing me blind, but what about the people on a fixed income who use these products. Each of these companies pretend to be transparent with their fees but are not. I 've signed papers with each of these companies and still do n't feel satisfied with their representation.
My main complaint is why are these companies allowed to do business? If I do n't pay them back, is somebody going to come and break my legs as this situation must be worse than dealing with a loan shark. The people that use these products are not rich to begin with and they are really preying on this group. They do n't care about people at all, just their money and are stealing people blind.

Complaint: I was not sure whether " lost or stolen check '' or " fraud or scam '' better fits my situation. I wrote a check for a man who was supposed to provide services for myself and a client. Before I gave the check to the man, my client informed him ( not yet me ) that the project was cancelled and that we no longer needed his services. At the time, no work had begun at all, and none has ever been done, at all. He and I had already scheduled a time to meet for me to hand over the materials to start the job and the check for the project. When we met, he lied and said the project was still " on '' and I handed over all of the materials and the check. Minutes after I handed him the check, the client told me the project was cancelled and that she needed to make sure he was n't prepaid for it ( and that she had already told him this ). I immediately told him that I needed the check back, that the project was cancelled and that I was aware that he was notified of the cancellation before he accepted the payment. I told him there would be a Stop Payment on the check. He would not respond to my texts and phone calls and went immediately to a check cashing store to cash the check that he knew had a stop payment on it. Flat Out Fraud. The check cashing store cashes the check and pays the man. Days later, when the check cashing store tries to deposit that check into their account, it is returned because of the Stop Payment. They first try for several days to contact the man, but of course, he is a criminal. He is not going to do the honest thing, answer them, and right his wrong. After he does not answer them or respond in any way, the check cashing store calls me to " collect a debt ". They call multiple times a day to pressure me to pay them back what they paid to him. I do not have a debt to them. I did not go into their store and take money from them. The man did. I confronted the man about this and told him that I needed the money that he took from the check cashing store. After first trying to deflect and change the subject, he apologized several times and said that he would " get me my money back ''. However, he never has, and has continued to ignore calls from the check cashing store. The check cashing store now harasses me everyday to pay them. I do not believe I should have to. I did not defraud anyone and have never even done business with their establishment at all.
