Problems at the end of the loan or lease

Vehicle loan or lease: Lease

Termination fees or other problem when ending the lease early
Complaint: I leased a new XXXX XXXX through Hyundai Motor Finance ( Hyundai Capital America ) from a dealership in Pennsylvania, and am investigating my options to trade in the leased car at another manufacturer 's dealership. Part of the information I need when negotiating is an accurate payoff amount for my lease. I called Hyundai Motor Finance at XXXX to request this number, but was told by a floor supervisor in the Texas call center that they are not licensed in Pennsylvania to sell a lease vehicle to the leasee, only to a dealership. This part I understand. What I do n't understand is that she then told me that it is both Hyundai policy, and they are not allowed by law, to give the payoff amount to the leasee, but can only give that value to a licensed dealership. This puts me at the disadvantage of trusting a dealership that they have given me the correct payoff. I believe that even though I may not be able to buyout the lease myself, I should be able to learn the payoff for my own lease. I was told that if I wanted more legal information I should contact their legal department. I asked to speak to her supervisor but was told that none was available, and that he would call me back within " 72 business hours '' which I understood to be 9 business days. This is apparently happening to everyone in Pennsylvania that leases a XXXX from Hyundai Motor Finance who want 's to know their payoff. Are they correct that I have no right to this information about my own lease?

The XXXX XXXX XXXX XXXX ) confirmation of payment is XXXX I did not recognize my mistake until my Hyundai statement arrived and did not reflect the payment made on XXXX/XXXX/XXXX, in the amount of {$220.00}. The Branch Manager of XXXX, XXXX XXXX ( XXXX ) met with me on XXXX/XXXX/XXXX. She contacted XXXX XXXX ( XXXXXXXXXXXX ) who confirmed payment was made to " XXXX '' but to the Hyundai account and address. She faxed a copy of the check, in which I was shown as the remitter and was deposited into an account shown on the reverse side of the check " cred to payee '' written opposite my account number ( XXXX ). Unable to receive car title or other problem after the loan is paid off
Complaint: I paid off my auto loan from Hyundai Motor Finance and have been enquiring about the title which now lawfully should be turned over to me. I 've received a myriad of responses including they do n't have my title, they wo n't send me the title, they will send in 90+days, I should go get a duplicate from the DMV as they 'll never send me a title, I should get it from the dealership etc. All these calls are recorded by HMF so you can see what they are doing. I believe I complained about their using incorrect credit scoring and over charging me interest so they are now retaliating with holding on to my paid off car title. I just want my title as I 've paid the loan off and HMF is illegally giving me the run around. The DMV sent my licence plates and registration to the dealership who forwarded to me ... And HMF says they have n't even received the title from the DMV ... What a lie!

Problem with additional products or services purchased with the loan
Complaint: On XX/XX/XXXX, my car was reported stolen. A claim was filed with XXXX and the claim process begun. I reported this to Kia Motors and my account was placed on hold until the claim process was completed. I updated Kia Motors when XXXX stated that they would pay out the claim due to total loss. I was sent claim documentation from XXXX on XX/XX/XXXX stating the amount that was being paid. I also had XXXX coverage through XXXX as well. My total loan with Kia was {$29000.00}. XXXX and XXXX insurance ( through XXXX ) paid out {$15000.00}. I called Kia and informed them of the issue. I stayed in contact with Kia multiple times throughout the claim process stating that the car was not going to be paid off and a balance would be left. I let Kia know that I was attempting to be proactive in the matter and find out what could be done. I was transferred to several customer service representatives and Supervisors and was given no assistance due to all of the payments not being received. I was informed by Kia that they were waiting on a refund check for my XXXX XXXX coverage. Kia stated that they could not give me any more information about my case until this payment was received. I called XXXX XXXX Kia on XX/XX/XXXX and spoke to a representative that stated that a check would be mailed when Kia submitted the paperwork. I called Kia back twice a week to inquire about options for my account. Kia informed me that they have yet to receive the payment. I called the dealership back and they stated that a check was mailed in XXXX and they could provide me with the tracking number. I spoke to a representative in XXXX about the options to work on this account due to the balance that was left. I was informed by the representative that Kia only gave one option to the customer. I was informed that the remaining balance of {$12000.00} could be paid in 6 months at a payment of {$2100.00} a month. I was told that due to Kia not making a profit from this account because there was no collateral ( the car ) involved, it would not be beneficial to keep the account open. I informed the representative that there was no way that I could make a payment of {$2100.00} a month, continue to maintain housing, care for my children and continue to work at both places of employment. I was then told that if I could not agree to the terms an pay this balance off in 6 months, the account would be charged off and reflect negatively on my credit. On XX/XX/XXXX Kia closed the account and charged the balance off as bad debit. This had a tremendous impact on my credit. I had this account with Kia for over 2 years and was never late on a payment. I was not given reasonable efforts to settle this account so that my credit would not be negatively impacted. I 'm almost certain that Kia has sold this debt to a collection agency and will be able to write this off as a loss at the end of the year. This is unfair to be treated in this manner, especially when I had no control over my car being stolen. I paid faithfully every month and maintained by account with Kia. I feel that I have been violated all over again. Once by the thief that stole my vehicle and twice by the company that financed my car loan.

Billing problem
Complaint: This is a complaint that I want to be published as well. I have been continuously trying to resolve this issue with Hyundai Motor Finance directly ( from 1-800 customer service number to CEO ) ; however, this company acts in unreasonable manner. Additionally, it does not shows signs of the company that cares and wants to maintain the relationship with loyal customer. -Upon end of lease ( XX/XX/XXXXXX/XX/XXXX) received few bills with {$0.00} balance ( see attached ) - this is miscommunication. -Then found out about " lease end fee '' - sent USPS coupon with payment ( never published due to USPS or other mishandling ). -Out of country until XX/XX/XXXXdue to family emergency. No calls were received. Under assumption that payment was posted. -Upon return realized that no payment was received by Hyundai . Attempted to make electronically - see attached. Payment bounced as per Hyundai due to account being " closed ''. This is another of my many attempts to make a payment. -Finally was able to make a payment onXX/XX/XXXX Although the payment was late, it was not due to my inability to make the payment, but instead was due to you not being aware of it being due ( family emergency ) and due to companies inability to communicate and handle correspondence in the efficient manner. As a result of this, Hyundai responded with not being able to assist. Instead, they reported me to all 3 bureaus with 120 days late and ruined my excellent FICO score from XXXX to XXXX. Totally unprofessional and unreasonable company.

Their investigation did not fix an error on your report
Complaint: On XXXX XXXX, XXXX, we turned in our leased XXXX XXXX XXXX, which we originally leased on XXXX XXXX, XXXX. Not long after turning in the vehicle, sometime around XXXX XXXX, my husband and I had late notices appear on our credit reports showing that we had been late on payments in XXXX XXXX and XXXX XXXX. Knowing this was n't the case, especially since late payments show up right away on a credit report, I immediately filed disputes with the credit agencies reporting the error, as did my husband. In addition, I called XXXX to investigate the matter. According to the representative I spoke to, there were no late payments on my account. So XXXX also contacted the credit bureaus to notify them that no late payments had been made. Then, in XXXX, the errors popped back up again. I called XXXX and explained the situation and they said that I should contact the credit bureaus and give them an Audit Control number, which is written on the letter I will be attaching, and have the credit bureaus contact XXXX directly. I was n't able to do my XXXX dispute online so I do have a copy of that letter that I mailed on XXXX XXXX, XXXX. Once again, the error was corrected on all reports. Then, just a week or so ago, the error popped back up on my XXXX report. Rather than doing the exact same things I have been doing, I am trying this route to see if the results are different. So far, XXXX and XXXX are n't showing the error but in the past they have not all occurred at the exact same time.

Problem with fees charged
Complaint: On XX/XX/XXXX, I went into the Hyundai Motor Finance website and noticed that I had two late fees charged that I did not notice before. When I called the company that day, they said my payments were late so there was nothing I could do about this. After getting off the phone with the representative, I did some more research and found that my statements for the months I was charged a late fee had an amount due of {$0.00}, which is why I did not make a payment. In XXXX I had paid {$700.00}, over twice my payment amount, so I thought that is why I had a XXXX balance due in XXXX, but I was still charged a late fee. For XXXX, I am unsure why I did not have a balance due, but I have had issues with this loan from the beginning with the dealership and had to call the dealership in XXXX because I had not received a statement to make any payments after my XXXX purchase. They had never sent in the updated paperwork to the finance company for my vehicle. So I am unclear how Hyundai Motor Finance credited my payments at the beginning of the loan, but I was relying on my statements to tell me if I owed money. I called Hyundai Motor Finance on XX/XX/XXXX to address this and the representative was able to reverse one of the late fees for {$22.00}, but she said she had to send the other one ( for {$22.00} ) for management approval. The late charge for XXXX is still on my account. These are small amounts, but my concern is that I do n't want this to keep happening because those charges can add up.

Billing problem
Complaint: On XX/XX/XXXX I made an outbound call to the collections department of XXXX XXXX XXXX to advise that I would be sending over an insurance check in the amount of {$2.00}, XXXX i was asked by the representative if this was to catch up my past due payments. I advised the representative that is was and hopefully any future payments. I also asked the representative if I should sign the back of the check, she responded to be on the safe side yes. That same day I sent the check with my account number listed to the mailing address confirmed with the same representative, XXXX. XXXX XXXX, XXXX, TX XXXX. I confirmed via my finance app that the payment was received and applied 6 days later XX/XX/XXXX. My app at that time showed that I had no payment due for my normal date of payment XX/XX/XXXX or XX/XX/XXXX. I receive monthly emails and paper statements to advise the next payment due and I received an email showing that a payment was now due for XX/XX/XXXX when it previously showed that there was no payment due. I then reached out to a representative in the customer service department at XXXX XXXX XXXX approximately Wednesday XX/XX/XXXX. I spoke to a representative and asked why there was no longer a positive balance on my account. The response form the representative was that the payment sent covered the entire past due balance. I informed them that my amount to become current was {$1100.00} so there should have actually been an over payment. I then requested to speak to a supervisor. Once the supervisor got on the phone I explained my situation again and she advised there was a simple process to have the over payment moved back to payments. She advised that when there is a payment over {$2500.00} received then the overage would go to principal. She advised to allow 3 business days for payment to be corrected. I then checked my account on Tuesday XX/XX/XXXX and saw that it showed me to be 80 days past due and owing a balance of {$1500.00}. i then reached out to another customer service representative and was advised that she showed my account to be current but a payment is due XX/XX/XXXX. I asked about the amount I saw online and she stated that it appeared the transfer of funds from principal was declined and the entire amount was reversed. I was then placed on hold but the call disconnected. I called back on XX/XX/XXXX and spoke to a collections representative, as of now my account is showing 82 days past due, and explained my situation and she advised she would get her supervisor to assist me. I spoke with the supervisor and explained my situation. I was then informed that she apologized but they originally applied the payment in error and they caught their mistake so they are not able to put the payment back to make my account positive. I was then informed that my car is eligible for repossession since the days past due and a payment of {$450.00} had to be made by XX/XX/XXXX and I could call back Monday XX/XX/XXXX to request a 2 month extension for the rest. I advised I did not agree with their decision to take the full payment back. i advised as a customer I rely on them to tell me there business practices and I was misled by at least 3 representatives. I asked for the payment to be reversed as they previously had it but was turned down. i ended up making a payment for {$450.00} to try to prevent repossession of my vehicle but i do n't think I should have had to pay anything.

Problem with the interest rate
Complaint: My XXXX XXXX credit score with all 3 major credit agencies on XX/XX/XXXX was around 810. I understand companies can use different models and the score can differ slightly - slightly being the key word. When I financed my application for loan with Hyundai Motor Finance on XX/XX/XXXX, they used a score of around 769 for me. That score of almost 50 points lower is ridiculous and would have caused me to get a significantly higher APR. Such unethical practices must harm so many customers who trust Hyundai 's name. Such a big score difference for a person with an otherwise excellent credit history can be damaging financially, but for someone with moderately good credit, it could result in predatory terms of loan or rejection of credit altogether, which could be a fair lending concern for persons of XXXX like me.

Credit reporting, credit repair services, or other personal consumer reports: Credit reporting

Account status incorrect
Complaint: I started 72 month auto loan with XXXX XXXX XXXX in XX/XX/XXXX. I made 100 % on time and in full payments ( confirmed by all three credit reporting agencies and Hyundai themselves on over 10 occasions ). I had made the last payment on my auto loan on XX/XX/XXXX in the amount of {$310.00}, which generated a refund of {$1.00} as well as the issuance of my Title and pay off notice ( which were printed on XX/XX/XXXX and mailed to me ). There was another payment made on XX/XX/XXXX in the amount of {$310.00} ( my account was set up direct withdrawls ), which was also refunded to me due to over payment in late XX/XX/XXXX. There was another payment made on XX/XX/XXXX ( again, automatically taken from my account ) in the amount of {$20.00}, which was also refunded to me due to overpayment. On XX/XX/XXXX, Hyundai advised all credit reporting agencies that though my account was fully paid, and title issued, I was placed in delinquent status with {$0.00} due. After over 20 calls to Hyundai, no one can tell me why I was listed as delinquent as my balance was paid off, title issued and they advised I was NEVER late on a payment. This has caused my credit score to drop over 60 points. On XX/XX/XXXX, I sent XXXX, XXXX, XXXX AND Huyndai all the materials I have ( payment history, title, pay off letter, etc .... ) to dispute this delinquate status. On XX/XX/XXXX, all three agencies corrected my credit report to show that my account was closed/paid on time/never late as it should be. On XX/XX/XXXX, Hyundai, once again, reported my account to all three credit reporting agencies as delinquent with a XXXX balance on this closed account. As a result, my credit dropped another 62 points. I have made, again, in excess of over 5 calls to XXXX and Hyundai trying to get my report corrected and to get Hyundai to correct whatever system issue keeps incorrectly reporting my account as delenquate to the reporting agencies. They advised me that the only way to do this is to dispute it again. They can not tell me if this will ever rectify the issue or if I need to dispute the same issue every single month because Hyundai wont correct their system. I am trying to purchase a home and this 62 point drop in my credit is preventing this from happening. Hyundai is not helping me with this matter in ANY way other than telling me to keep disputing it.

Communication tactics

Debt collection: Auto debt

You told them to stop contacting you, but they keep trying
Complaint: For a little over 6 months now, I have been receiving calls from XXXX financial in order to collect a debt for a leased car that I turned in over 3 years ago. They say that I owed money for wear and tear on the car. I initially was in contact with XXXX at XXXX XXXX, and was very happy to pay the debt. After giving all my information to her, I received a call several weeks later saying that they were unable to process my request. I checked by bank and noticed that it never went through. So again I gave her the information and waited a couple days and they still did n't take the money out. After that I contacted them and they said that my credit union could not find my account even though I pay literally every bill with the same information with no problems. Although I was annoyed because XXXX and her XXXX both were extremely pushy and rude, insinuating that I did n't have the money to pay them, when from the beginning I 've been giving all of information to collect this debt. But okay I gave them information to an alternate bank account at a whole different institution. Weeks went by and they still did not take the money out. I called both of my banks and they said there is no record of XXXX financial ever trying to collect the debt from my account. So this caused a red flag for me. And then early today I received a call at my desk, after the last time I spoke with them, I specifically told them never contact me again regarding this because I will not be abused like this anymore. The man who called was even ruder then XXXX and stated that I needed to now send them a money gram to pay for this. He then proceeded to say ' you obviously do n't have the money to pay your debt ' He knows nothing and I have given my bank information many many times. They are harassing me and my mother at this point because they cant get it together. It seems as though this was their plan from the beginning, a kind of sham to get people to send money directly to them. Insanely rude and abusive company

Excess mileage, damage, or wear fees, or other problem after the lease is finish
Complaint: I leased a XXXX XXXX XXXX in CA in XXXX XXXX. My turn in date was XXXX XXXX. I turned it in at the Kia Dealer in XXXX XXXX, VA on XXXX XXXX, XXXX. They looked at the car said there would not be problems. They also explained that Kia sends a Company out to inspect the car and I would hear from them is there were problems. I got a letter from Kia dated XX/XX/XXXX stating that there was {$1000.00}. dollars in mis-use or excess Wear and Tear. I immediately called Kia. They sent me an e-mail with pictures of a scratch on a door and some bumper damage. There was also some dents from something falling on the car on the roof. I told them the car had no door scratch and no bumper damage and I did not know about the roof and that it was always parked out side so I would agree to pay for the roof damage but not the other damage. They said if I do not pay the entire amount by XX/XX/XXXX they would report me to the credit bureau. I do not want this to happen. I can not even be sure this was my car. They should have inspected it in front of me. I had no door scratch and no bumper damage when I turned in the car. I think they are running some kind of scam, it could just be the inpection company because I am sure they are paid on what they bill. Please help me straighten this out. Thank you.
