Took or threatened to take negative or legal action

Debt collection: Auto debt

Threatened or suggested your credit would be damaged
Complaint: I received a notice from XXXX XXXX in XXXX, New Jersey stating I could turn in my lease early and owe nothing on the old lease. I went in and made it clear I would not do it unless I would not owe anything. They assured me - both the salesman and the finance manage that it would be an even swap. My lease shows that it is. I have the form I was sent in the mail. About two months later I received a bill from XXXX XXXX XXXX that I owed {$2000.00}. I explained the situation and they said, " We have nothing to do with Hyundai. '' They turned it over to XXXX XXXX, XXXX in XXXX, New Jersey and they are telling me they will take me to court. This started in XX/XX/XXXX. I wrote them a complete explanation and heard nothing until this month ( XX/XX/XXXX ) when they threatened to take me to court. I feel this was a " bait and switch '' by XXXX XXXX and XXXX XXXX XXXX. It was XXXX XXXX XXXX who held the first lease and it was they who the finance administrator called to get my pay off while I was there!

Struggling to pay your loan

Vehicle loan or lease: Lease

Lender trying to repossess or disable the vehicle
Complaint: I made a serious mistake by entering into a lease agreement with XXXX XXXX in XXXX NC. XXXX XXXX XXXX. At the time I went to just look around, my XXXX lease was expiring. I defiantly was pressured into this vichle. I am XXXX and the simply wore me out. The went so far as to drive me back to my home with a salesmen to pick up my puppy, so I wouldn't leave and not come back. The said they did not want anything to happen to the XXXX XXXX I was turning in. I was looking for a payment of about 260 . I finally got out about XXXX XXXX that night, with the car. When they sent me to the financial man he gave me all these papers in small print to read. I stupidly trusted him. There motto is Our customers are always for life. Now I know why. They failed to tell me I would get a bill from XXXX for XXXX because I did not buy from them, plus I was billed for some damages on the XXXX. They did not want me to go with the salesmen as I was supposed to do., to get the pay off. The knew I was going to be billed and that would have stopped me from leasing the XXXX. Instead they turned in themselves and a few days later I received a XXXX $ bill from XXXX. Within two days I receive a bill for over 350.00 + . From Hyundai. When I returned to ask about this they never told me I would have that bill as soon as I left wth the car. In addition to that I find the finance man put two warranties on the car. One for maintenance and one for one for Master tech, whatever that is. I was unaware of that. After much haggling they removed the warrantees and gave me a credit. To make matters worse my daughters company closed and she was without a job. She still does not have a job and now has XXXX and it will be 6 weeks before she can even think about it. She has moved out so I have no help from her. Now the payment was impossible. I am behind and they Want to reclaim the car. I will never catch up. I have pleaded with them as I live on SS. It's a constant battle. I returned to the dealership and asked for help. I tried to turn it in and get an older car from them. No never. They want me to lose the car so they can repo it and then sell it cheap and I would be paying for a car I don't have. I am desperate and have no where to turn to. This's lease is now almost one year old so I have two more years of torture unless I die first. I guess I would be out of the lease.

Problems at the end of the loan or lease

Vehicle loan or lease: Lease

Excess mileage, damage, or wear fees, or other problem after the lease is finish
Complaint: I have completed a 3 year lease with XXXX XXXX and returned car with no damages. I took video and pictures for my own protection in case of something like this on the day of my return to the dealer at XXXX XXXX XXXX in XXXX California. I did have over mileage and I expected that but now I have received a statement for not only the excess mileage but also damages, disposition fee, and taxes for a bill of {$3200.00}. I called yesterday and spoke to XXXX at XXXX XXXX he said they will give me extension until XX/XX/2018 but payment had to be in full and only by checking or ATM debit. No credit card payment at all. I was not disclosed of any disposition fee or damages at the time of my return. There were no damages. I have proof of that. XXXX said I see you turned in your car on XX/XX/2018 and the report was dated on XX/XX/2018 two days later i will send you a kit? to dispute damages? XXXX stated that the report said there are damages to the front bumper and rear? I am asking for your help in this matter because When I was at the dealer I was told that they would take care of all the charges if I purchase or lease with them and I said great, I chose a car and test drove another and when we couldn't come to an agreement I said no thank you, I will go elsewhere and walked out of the dealer. I leased a new car that day with another Dealer. I have worked very hard on making sure I made every payment on time and completed my lease with Hyundai and I feel it's unfair that now I have these charges that are not valid.

Problems at the end of the loan or lease

Vehicle loan or lease: Lease

Problem extending the lease
Complaint: I set up automatic payments in XXXX/XX/XX/XXXX ( after having a perfect payment history with this vehicle AND an XXXX XXXX ), because I was getting married, moving, and became a XXXX ( which I spend 60+ hrs/wk ). It was vital that I had automatic payments set up because I knew I would not have the time to do much else other than work and sleep for ~2 years as I earned my time at work as a XXXX . I thought everything was fine until my wife had me check my credit report last month as we are ( were ) looking to purchase a house. Specifically, I called Hyundai in XXXX/XX/XX/XXXXand spoke with a man by the name of XXXX. He confirmed I had automatic payments set up and that it might take a payment cycle or so for it to get up and running. So I paid over the phone with him there and didn't look back. My job and life are overbearingly busy ( much like anyone who reads this probably experiences too ), and I frankly never checked in with anything or anyone. To my surprise, Hyundai has been reporting my payments late in excess of 120+ days ... which I immediately paid upon learning. I called them and explained, but they did not care and they actually hung up on me. I was respectable and calm on the phone, why would they do that to me unless its such a hot potato they don't want to touch it. And this is why I am filing this with you, they have ruined my credit because of a failure on their part.

Complaint: I was purchasing a car under my XXXX and using a CD which required signatures of at least 2 members of the XXXX. We began the signing for the vehicle on XX/XX/11 after establishing a CD with a local bank on a property I was awarded from my my divorce, and because the car dealership was running behind the papers were not completely signed when I had to go to work. My signatures for the XXXX were collected. After I left for work the other member of the XXXX was there to complete the signing for the vehicle and added his personal name for registration and titling of the vehicle without my consent. As the vehicle was now registered to the XXXX or ... .. I was compromised from my interest. The individual then registered car in his personal name when it was not in his place to do so and I was damaged. After the registration changed no one would give me information.

Improper use of your report

Credit reporting, credit repair services, or other personal consumer reports: Credit reporting

Report provided to employer without your written authorization
Complaint: On Friday XX/XX/18 I went to XXXX XXXX XXXX in XXXX XXXX. I was interested in lowering my current payment, and transitioning into a XXXX vehicle. The salesman was very nice and honest, and then his manager XXXX came out to talk to us. He explained he would have to do a soft pull of my credit in order to give me a roundabout of what he could do for my situation. I told him I didnt want my credit pulled and could he provide me with a roundabout estimate of payment if I provided to him my scores, he stated do you know all three of your scores I stated yes. I provided him my 3 scores and he wrote it down and went in the back. It was around XXXX so my friend and I told him to call us and let us know what he came up with, he stated the payments are looking about {$400.00} with no money down. I walked out assuming he would call tomorrow with final deal. On the morning of XX/XX/18 I checked my score due to receiving an alert that my score had changed and to my surprise my credit had been pulled from XXXX XXXX against my consent. I called the salesman XXXX immediately and he stated he was on his way in. I asked did he have his managers phone number he stated no and that he doesnt come in until about XXXX. He insisted for me to come in and check out the vehicle to purchase, however I was more concerned about my credit drastically dropping in points. I made my way to the dealer and saw the vehicle, I didnt like the vehicle because it was a XXXX vehicle yet it had less perks than my current vehicle. XXXX ( XXXX manager ) came out showing papers claiming he never pulled my credit. XXXX stated to me alone He probably pulled your credit and forgot he did it At that time i was told to sign the credit authorization form in order to proceed. There was no deal they were able to work out for me and a vehicle and my credit suffered, even when originally my credit was not to be pulled. They pulled my credit illegally and I will like my score to go back to my original score of XXXX.

Problem with fees charged
Complaint: We leased a car from XXXXXXXX XXXX of XXXX. At the end of the lease term we turned it in. The lady looked over the car and said we owed nothing. Subsequently, we got a bill from XXXX XXXX XXXX saying we owed {$430.00}. We called the customer " service '' line and asked for documentation showing we owed that amount. They never sent us any documentation. So we looked on XXXX XXXX XXXX website and it showed that THEY owed US {$220.00}. [ This was 3 weeks AFTER they sent us the demand. ] We thought the matter was over. In XX/XX/2017, we received a letter from a debt collector saying we owed {$440.00}. We wrote to them and contested it, asking them to send us documentation showing we owed the amount. They sent us the same invoice that Hyundai had sent us in XX/XX/XXXX, which explained nothing. Subsequently, we find that they placed a negative item on our credit report. This almost cost us financing for a new furnace for our house and caused the state bar of Colorado to ask the co-leasee for an explanation of this negative credit report. Hyundais business practice was outrageous. They refused to show any documentation, other than an alleged invoice, to explain why while Hyundais website system shows they owe us {$220.00}, they still insist that we owe them {$430.00} AND placed a negative item on our credit reports. We do not like to owe anyone money, so we have always make payments on time. However, we also refuse to be the victims of paying any alleged unproven debt that comes out of thin air. All the documents we have are attached with this complaint.

Incorrect information on your report

Vehicle loan or lease: Lease

Account status incorrect
Complaint: On XX/XX/XXXX Vehicle was purchased and the dealership XXXX XXXX dealership. From the start of leasing the vehicle it became an issue. I resided in XXXX explained my residence was in XXXX and instead of giving me the proper documentation. The salesman provided me with XXXX residency ignoring that I had proof of new residence so, when it came to be registering the vehicle I received a very hard time on the way I received sale of purchase. The salesman only wanted to bait me into a car as a lease instead of providing me correct information. I did complain and next thing I know I was being subjected to some sort of XXXX XXXX when turning on the car it was making me sick and it felt like some sort of XXXX XXXX or XXXX. Took the car to the dealer in XXXX several times and the company claim it was nothing they could see wrong. However, I XXXX online and founded other people experiencing similar symptoms when driving the vehicle so, it could have been someone tampering with my gas tank. By XX/XX/XXXX I returned the vehicle back to XXXX XXXX and received a voluntary lease agreement where I no longer was responsible. What they done was claim I had the vehicle until XX/XX/XXXX which is not true and placed derogatory remarks on my credit report I want removed. The company treated me discriminatory from the sale of lease. Had me driving the vehicle without proper documentation before leaving XXXX to XXXX. I contacted the DMV where I put in a complaint due to DMV in XXXX claiming someone treated me wrong due to sales on vehicle with residency in XXXX not XXXX. Now I feel the XXXX XXXX dealership is tarnishing my credit report and the amount owed to them for return voluntarily to bamboozle me out of more money than I should owe due to not having the car for a year and paying {$410.00} plus {$1500.00} from XXXX to XX/XX/XXXX. XXXX to XX/XX/XXXX the car was under the dealership who used my name and credit for 3 months I had no entitlement to vehicle and plates where surrendered back to XXXX. So who was fraudulently using my information for 90 days inside the dealership to gain and I get a derogatory credit report. My solution is the company remove the car off my credit report and solve this issue by stating car was resold and I was no longer responsible from XX/XX/XXXX. There treating me like there was no problem with the company from the beginning when, there was a problem right after lease sale. Where I could of got pulled over by trooper with no proper paper work until after I put in my complaint to receive documentation. It was like the salesman did not care as long as he got a sale and found ways after I surrendered car with no high mileage back to there company. All XXXX and I was the only XXXX being subjected to a bait sale and incorrect paperwork to go forward to register vehicle from the very beginning. Now there hindering my credit report making acts of discrimination me being XXXX XXXX who, came to just purchase not be subjected to such a negative outcome. The company gave me documents to fill out without providing information on there in to show what was happening. There scheme was too obvious and then it became mad day once I spoke up about the treatment. I took pictures to show the missing information before signature I was told it would be added after I sign for lease as policy. I had a discount for vehicle there claiming they gave me a discount no they charged me more monetary to benefit sale.

Billing dispute for services
Complaint: In XX/XX/XXXX, I had a problem with meeting my payment due date. I called in to have the payment extended to avoid a late charge, as well as late payment on my account and credit agencies. In XX/XX/XXXX, The representative with whom I spoke told me all was set. I asked him, am I not suppose to get a letter to sign and he said no, all is set, my next payment will be in XX/XX/XXXX. In XX/XX/XXXX, I started receiving calls as well as letters that I am pass due. I spoke with the agent and explained that this should not be. She read the account history and apparently saw what the first person wrote, then she said will fix the problem and that the calls will stop. She then send me a letter which I fax back to XXXX with my signature attached. On Wednesday XX/XX/XXXX, I went on lone to make my XX/XX/XXXX payment and saw that they charged me {$25.00} for late payment fee, as well recorded late payment to my account history and on my credit report. I called to have these corrected and was told the manager denied to waive the late payment because I already have one waived. I told them, this is the company error and not mine and it should be off my credit history cleared from this error. I then asked to speak with a manager and was told I have to call back and because they are not available. I now have a {$500.00} balance on my account that is 32 days pass due and a fee of {$25.00}, plus late payment report to my credit history. I need these to be corrected - the late be removed, my credit history to clear from this late payment note, and the balance remove to have my account in good standing.

Excess mileage, damage, or wear fees, or other problem after the lease is finish
Complaint: XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX # XXXX XXXX XXXX, TX XXXX XXXX XXXX XXXX XXXX. XXXX XXXX XXXX XXXX, CA XXXX XX/XX/XXXX Re : Account # XXXX VIN # XXXX XXXX XXXX XXXX XXXX XXXX To Whom it may concern, I am writing to you regarding the above referenced account for a leased XXXX XXXX. I am in receipt of a collection notice from XXXX XXXX XXXX XXXX XXXX dated XX/XX/XXXX. This agency has been retained by XXXX to collect on the end of lease fees ( all inclusive ) in the amount of {$1200.00}. I am not only appalled by this action taken by XXXX, but furious at the neglect and lack of competence of the Lease Maturity Servicing Team based in XXXX, TX. Background information as it relates to this lease. 1. On XX/XX/XXXX, I signed a Lease Extension Agreement for the course of 6 additional months from the initial expiration date of XX/XX/XXXX and agreed to make payments in the sum of {$290.00} 2. On XX/XX/XXXX at XXXX XXXX, CST and inspection was conducted by inspector # XXXX under inspection ID XXXX. This was conducted by XXXX ( XXXX XXXX XXXX ) a company retained by XXXX 3. On XX/XX/XXXX, the vehicle was turned in to XXXX XXXX XXXX located on XXXX XXXX XXXX XXXX XXXX, XXXX XXXX, TX XXXX 4. On XX/XX/XXXX, I received a letter from XXXX, seeking a total of {$1200.00} ( {$400.00} Disposition Fee & {$860.00} Excess Wear and Use ) Upon the receipt of this bill, I contacted XXXX to discuss the bill. Here is a synopsis of the conversation ; I had in good faith done a pre-maturity inspection to determine any repairs to avoid such fees. In the inspection report of XX/XX/XXXX, line 2 : ExteriorBumper Cover scratch heavy 3 to 4 in the amount of {$250.00}. Now, I was advised by the inspector that XXXX had a tolerance of less than 2 to avoid any fees assessed. He further went on to say that if the cosmetic scratch was to be touched up by OEM paint, that would be considered acceptable as per the contractual agreement by XXXX. On XX/XX/XXXX, I purchased the original part from XXXX XXXX XXXX ( part # XXXX ) touch-up paint in Anthracite Gray. When the vehicle was surrendered to the dealership, I was advised by XXXX XXXX head of Finance & Lease Returns at XXXX XXXX XXXX that a final inspection would be conducted by XXXX before disposing the vehicle at an auction or selling it via a pre-owned car dealer. XXXX never completed an inspection post Lease Termination to determine the amount owed, but took into account a report which was more than 90 days old. After my conversation with XXXX in XXXX, XXXX. I received a call from the Lease Maturity Servicing Team in mid to late XXXX, XXXX. On XX/XX/XXXX after a conversation with an agent, I was asked to send an email disputing the total charges in the amount of {$860.00}. In that email, I included images in color, specific to the rear right bumper as listed in the Inspection Report of XX/XX/XXXX. In that email, I also included the invoice for the Paint which was purchased at the dealership. These were required by the agent with whom I spoke. On XX/XX/XXXX, I received a follow-up email asking me once again for the account #, which had been provide on 4 previous occasions. I responded to the email on XX/XX/XXXX, with the requested information. After sending this information to the Lease Maturity Servicing Team on XX/XX/XXXX, I heard nothing from XXXX, there were no calls, no follow-up letters and or my original request to send an amended statement for end of lease charges. However, XXXX instead retained a collection agency to collect on their behalf. As of the date of this letter, I have yet to receive any updated documents showing the correction of {$250.00} from the total amount. As a blatant disregard to my communication and sincere efforts to pay the amount due, I am now pursuing this matter with the Commissioner of Consumer Affairs not only in the State of CA but also the State of Texas. In addition, a copy will be sent to the Federal Trade Commission, to highlight Deceptive Business Practices by XXXX XXXX XXXX. I have contacted the collection agency, to advise them to cease any communication as the amount stated in the demand letter is incorrect. In conclusion, I have every intent to resolve this matter amicably and paying the amount duly owed to XXXX XXXX XXXX. In the event XXXX and the retained collection agency do not correct this matter, I will then pursue this matter with CFPB under the violation of The Rosenthal Fair Debt Collection Practices Act California Civil Code 1788 et seq. Please send me an updated bill at your earliest so that I can pay the amount due. Sincerely, XXXX XXXX XXXX XXXX XXXX CC : XXXX XXXX XXXX XXXX XXXX

Problem while selling or giving up the vehicle
Complaint: I had a car accident XX/XX/2018. After the accident I contacted my insurance for car repairs. The insurance sent out a check with the amount of {$8800.00}, my name and XXXX XXXX name were on the check. XXXX XXXX has a complicated process. The body shop where my car is being prepared and held at, has to send XXXX XXXX proof of photos, invoices, and vehicle preparation proof. After the proof is sent through mail, i would have to wait a few days or weeks for XXXX XXXX could sign and send the check to the body shop. The problem was that XXXX XXXX sent the check out to the wrong address! After I waited for about 2 weeks, I decided to call XXXX XXXX and was told that they had made a mistake. Which was that they sent the check out to the wrong address. The check never appeared!! I had to then call the insurance to tell them what had happened. They had canceled the check, that was never found, and send another one to my personal address. After i received the check i was then told to send it back to XXXX XXXX as an overnight shipment. Then once again told me to send out the same documents i sent in the first place : invoice, photos etc. While this process is happening, I am being charged a daily fee for the car being held at the body shop until they receive and clear the check from the car repair. They do not allow me to send any of these proof documents through fax. I was told to send them through overnight shipment to speed up the process. I shouldn't even be paying for these things! I want my money back! This was their fault. Issues like this should be fixed! My car has been in the body shop for over 2 months. I have been having to rent out vehicles so i could be able to work and pay my bills.
