The general manager for the complex in which we lived had a lot of complaints against him for kicking people out because he was upset they complained about him..which is exactly what he did to us! There were people outside smoking weed, and just not a comfortable situation for a single mother of XXXX. I walked right back up to the office, and explained they could cut up the contract because I would not be moving in. Well low and behold this is where we stand now. They never once tried to make contact with me letting me know that they would be charging me for anything, turned around and sold the information to FCO. I spoke with FCO sometime last year 2016 and was so frustrated I told them I would just pay something to have them stop harassing me. I spoke with a manager who in turn did stated to me that they would remove it from my credit due to the situation. I took their words for what they were and noticed this year when I sat and pulled my credit that the account is still there. I contacted the company last week and asked to speak with the supervisor who handled my account and find out why it was not deleted, and was told that they will not transfer me and that what the employee was telling me was all I was going to get.

Complaint: This complaint is based on FCOs multiple violations of the FDCPA, the FCRA and the Massachusetts Debt Collection Regulations ( MDCPA ). However, the CFPB website limited me to choose only one violation, where I chose the most relevant. I discovered a collection account reported by this debt collector after reviewing my credit reports. FCO reported that I owe {$2000.00} to an apartment complex. On XX/XX/XXXX, I sent FCO a demand for relief pursuant to Chapter 93A of the Massachusetts Consumer Protection Act. FCO received my letter via certified mail receipt number XXXX XXXX XXXX XXXX XXXX. My demand was based on FCOs violation of the MDCPA 940 CMR 7.07 ( 21 ) which states that it is an unfair or deceptive practice for a debt collector to report to a consumer reporting agency on its transactions or experiences with a debtor in a name other than that of the creditor. My letter also stated that by doing so, FCO had taken action that can not legally be taken, in violation of the FDCPA 15 USC 1692e ( 5 ) and that they employed false or deceptive means to collect a debt, in violation of the FDCPA 15 USC 1792e ( 10 ). I had demanded that FCO delete the unlawfully reported account from my credit reports. FCO ignored my demand and continued to report the account in their own name, in violation of the MDCPA and the FDCPA. My letter dated XX/XX/XXXX also included a request for validation of debt. On XX/XX/XXXX, FCO responded with insufficient validation of the debt ( and actual evidence that the debt they claimed I owe was in fact inaccurate ). FCO responded with the following : ( 1 ) An illegible copy of the lease agreement. Notwithstanding the indecipherable language on the agreement, it had expired back in XX/XX/XXXX. However, according to FCO, the alleged debt was incurred between XX/XX/XXXX and XX/XX/XXXX. ( 2 ) A document titled Statement of Deposit Detail. This statement reflects that I had moved out of the apartment on XX/XX/XXXX. However, the statement also reflected new rent charges and other fees that had been incurred on XX/XX/XXXX. Rent payments were billed in advance, not in arrears. Based on this document, I was billed for rent during the month after I had moved out of the apartment. ( 3 ) FCO failed to include proof of assignment of the debt that was requested in my letter dated XX/XX/XXXX.
( 4 ) FCO failed to include other documents I had requested that would validate the debt as required by the MDCPA and Massachusetts Residential Occupancy laws. On XX/XX/XXXX, I disputed the inaccurate and unsubstantiated account thru the consumer reporting agencies. My dispute was based on FCOs failure to validate the debt, and because they reported the account in their own name, in violation of the MDCPA 940 CMR 7.07 ( 21 ).
On XX/XX/XXXX, I received notification from the consumer reporting agencies that FCO had falsely verified the account ( even though they failed to adequately validate the debt or report the account solely in the name of the creditor as required by the MDCPA ). By verifying both false and unlawfully reported information thru the consumer reporting agencies, FCO also violated the Fair Credit Reporting Act 15 USC 1681s-2 ( b ).

Also I attached was a copy of a casher 's check and emails verifying the amount was incorrect. I was told they will have to investigate and I will have to pay {$4000.00} but the will have to report the {$10000.00}. and stay on my credit for seven years. Complaint: I called this company on XX/XX/XXXX, XX/XX/XXXX and XX/XX/XXXX. This was allegedly for expenses after I moved out of the apartment at XXXX XXXX. After 4 months of requesting debt validation, I received the contract and the alleged invoice. I called the company and informed them that the invoiced items could not belong to me. According to the lease that was provided to me by the debt collector, the terms began on XX/XX/XXXX through XX/XX/XXXX. The lease was signed on XX/XX/XXXX. The invoice is charging me for items before my lease began and for items that were not done when I was in the apartment. I am being charged for items done on XX/XX/XXXX to XX/XX/XXXX when my lease did not begin!! When I moved in the apartment, it was already painted and cleaned. How can I be charged for painting that allegedly happened when I already moved in? No painting occurred while I was in the property. They are charging me for unit not cleaned on XX/XX/XXXX when I was already in the apartment! They are also charging me for early termination fees of two months and a half when I left the apartment 2 days before my lease ended! I called the debt collector three times and they said they were contacting XXXX XXXX and they never answered my calls. I explained to the debt collectors how is it possible that painting occurred when I was already in the apartment and how can the apartment be cleaned when I was in the apartment? I told them they had the wrong person and they refused to answer my calls and tell me what XXXX XXXX said. This is not my bill and I refuse to pay it. This is damaging my credit report and hurting my chances of purchasing my home! I need this deleted! It is not my bill!!!!

I had in the course of my search, went to XXXX XXXX XXXX XXXX, XXXX where I was shown some apartments. I later applied online for an apartment and my application was successful and I paid the deposit required. I moved from my apartment at XXXX XXXX XXXX, XXXX XXXX in XXXX, XXXX ( where I had lived for XXXX years ) on XX/XX/XXXX to XXXX to take possession of the apartment I had applied and paid for ( the deposit ) at XXXX XXXX XXXX. On my getting to the apartment office, on XX/XX/XXXX to take possession, I WAS MADE TO PAY FOR THE 1ST MONTH XXXX DOLLARS AND MADE TO SIGN THE LEASE BEFORE I WAS SHOWN THE APARTMENT, I immediately rejected it because it was n't what I had seen when I came to visit and what I had paid for, the lady told me to come back on Monday, XX/XX/XXXX to see her boss. I went back on Monday XX/XX/XXXXbut they were unable to provide the one I wanted, so I told them, I WILL NOT BE GOING AHEAD WITH THE LEASE since they do not have what I was promised, they refused, saying I had signed the lease and if I wo n't be going ahead, I had to pay about XXXX DOLLARS plus as cancellation fee and 3 months rents ). I told them I WILL NOT BE DOING THAT considering the fact that they did not fulfill their own end of the bargain. I then went searching and I found my current apartment, applied and got approved same day ( the monthly rent by the way is even way higher than what I would have been paying at XXXX ). XX/XX/XXXX XXXX went ahead to draw XXXX dollars from my XXXX XXXX XXXX account, after I had told them otherwise, I called them and mailed them as well, reiterating my stance that I DO NOT OWE THEM ANYTHING and that they even have to refund my deposit and the money already drawn from my account, I NEVER TOOK POSSESSION OF THIS APARTMENT, I NEVER HAD THE KEYS TO THE APARTMEN, The only time I stepped my foot into the apartment was when I went with one of the staff on the day I had referred to earlier. I reported them to my bank and a dispute was opened, ( see attached 1 ), dispute which was resolved in my favor and my cash was returned to me. After a few months, I started receiving mails from FAIR COLLECTIONS AND OUTSOURCING claiming I was owing XXXX XXXX XXXX, first it was XXXX, then later XXXX dollars, I called them multiple times and sent a mail to them as well ( see attached 2 ) stating my own side of the story, but they went ahead and reported this illegal act to the 3 Credit Bureau. This had adversely affected my Credit Report. I NEVER OWED THIS AMONUT, SINCE XXXX XXXX XXXX NEVER FULFILLED THEIR OWN END OF THE BARGAIN, why would I be made to pay for this. XXXX XXXX XXXX, if not that they are trying to bullying me into paying this should have taken this case to the Courts, where such issues are addressed.

On XX/XX/XXXX Fair Collections & Outsourcing, Inc. mailed information they have on file regarding the account. The information Fair Collections & Outsourcing , Inc. provided contained TWO DIFFERENT SIGNATURES which they are claiming to be mine. It is clear that someone has forged my signature on a document they are using to attempt to validate the debt and collect with. I do not wish to impugn the integrity of any employee at Fair Collections & Outsourcing, Inc or the original creditor but someone has forged my signature on a contract. Complaint: I received my first contact about a debt collection in process in XX/XX/XXXX. I immediately disputed with the collection company and the original debtor in writing. As of XX/XX/XXXX I have not received a response from my letters sent in XX/XX/XXXX. This past week I had applied with a rental property to move into a new apartment and I ca n't because this collection was placed on my credit report in XX/XX/XXXX. I had no knowledge of the debt collection nor was I given the opportunity to dispute it, provided any of my rights to dispute, and my XXXX credit score when from XXXX to XXXX from XX/XX/XXXX to XX/XX/XXXX although I have paid down my personal credit cards and have had no late payments ever since XXXX. I pride myself on my credit and paying all credit card and debt obligations in a timely manner. I was also denied a credit card in XX/XX/XXXX and was n't provided the details of this debt collection except that my credit score was too low. This has extremely impacted me in a negative way and I need to have the collection debt removed from all XXXX of the credit bureaus immediately. I have opened separate disputes with them as well. Complaint: Around on or a bout XX/XX/XXXX , I received a phone call from a collection representative by XXXX XXXX , he advised me he was calling from FCO - Fair Collections & Outsourcing Inc. about a debt with XXXX ( XXXX ) XXXX XXXX . I advised him that I never lived at the residence he was speaking about and stated that this was fraud. After the call, I checked my credit report only to see that a judgment had been entered against me on XX/XX/XXXX in the amount of {$2300.00}, in XXXX District Court. I called back immediately, and spoke with another representative, in which, I provided him with this information as well as the reference number XXXX XXXX . A few days ago, I received a credit alert upon checking, it shows that this company has put this on my credit report with the dollar amount of {$4000.00} and the account was supposedly, opened on XX/XX/XXXX .
I called again on XX/XX/XXXX , and spoke with XXXX XXXX again, once again, I provided him with the same information and asked him why they put this on my credit report and the amount and opening date of this account is wrong. I asked him how can you put an account on a person credit report with wrong information. He said that I need to fill out some paperwork and I did n't so therefore, they had the right to do so. The paperwork is about fraud because, I told him that this account was n't mines. I am still trying to get this matter straightened out. However, I want them to remove this account from my credit report since, it is already showing the account has a judgment. I want to know how, they can change the amount from the judgment entered by the same company. Please investigate this company!
