Complaint: Filed claim with our Insurance company for wind damage on roof, received Insurance draft.Tried getting insurance draft endorsed thru Dovenmuehle who is servicing our mortgage from XXXX XXXX XXXX XXXX. Unable to reach person assigned XX/XX/XXXX. Spoke to someone who said they were answering XXXX 's phone. Said endorse, send in, they would endorse and send back even though email said over {$10000.00} they would keep 10 %. I overnighted to Dovenmuehle. Attempted to contact XXXX twice XX/XX/XXXX phone just rang, no voice mail option. Tried again XX/XX/XXXX was able to leave voice message. Never received return call. Called XXXX XXXX XXXX directly. XXXX XXXX got XXXX to return my call XX/XX/XXXX XXXX stated they had a 5 day turn around and that they had to wait until our check cleared before they could send us a check for 90 %. This is incorrect as I overnighted them an insurance draft, not a check. Drafts do not clear like checks. The letter I overnighted with the draft explained that our roof was going to be replaced this week. We needed the money to pay the roofer. I included a prepaid return overnight envelope. Time was of the essence.
I emailed Dovenmuehle again XX/XX/XXXX told them if a check was not overnighted to me so that I received it by XX/XX/XXXX I would file this complaint. I also left voice message with XXXX XXXX Monday morning. She had XXXX call me XX/XX/XXXX she said she would print the check, but it would take overnight processing. Seems XXXX should have ordered on Friday and it could have been mailed Monday. I received a call from XXXX XX/XX/XXXX stating she overnighted the check. I received an email with the tracking number, but did not receive the check today nor does the tracking number pull up on the United States Postal site. They have had our Insurance draft since WednesdayXX/XX/XXXX XXXX XXXX. I have postal record to prove it. If they are going to keep our funds for a week and then keep an additional 10 % they owe us interest. They are holding thousands of dollars without paying interest, and consumers have a very hard time contacting them. They use stall tactics to hold the money longer. XX/XX/XXXX I was also told they ordered a home inspection to verify our roof has been replaced and someone would contact us within 48 hours to schedule an appointment. I was not contacted untilXX/XX/XXXXby XXXX XXXX and told someone would contact us in 48 hours to schedule an appointment. Again, not what Dovenmuehle told us. Our shingles were delivered XX/XX/XXXX, and our roof torn off, and completely replaced by XX/XX/XXXX. We have paid thousands of dollars in interest over the life of our mortgage. Why do they not have to pay us interest if they are going to hold our funds? This needs to change.

Complaint: I closed on my mortgage in the amount of {$160000.00} with XXXX XXXX XXXX for the property in XXXX, Mississippi on XX/XX/XXXXat the office of XXXX XXXX XXXX. The monthly mortgage payment for the coming year was set at {$990.00} of which {$750.00} would be for principal and interest and {$230.00} would go into an escrow account to cover the annual tax payments of {$1700.00} and insurance payment of {$970.00}. The escrow cushion set by the loan service was {$470.00}.
I began paying my mortgage as agreed on XX/XX/XXXX in the amount of {$990.00}. On XX/XX/XXXX I was sent a notice by XXXX XXXX XXXX that my monthly loan payment was going to increase from {$990.00} to {$1100.00} due to the results the annual escrow analysis showing a shortfall of {$1400.00}.
My insurance premium was paid in XX/XX/XXXXin the amount of {$970.00}.
I began paying the new mortgage payment of {$1100.00} in XX/XX/XXXX.
My tax payment was for the XX/XX/XXXX tax year was paid on XX/XX/XXXX in the amount of {$2900.00}.
Although my taxes and insurance amount only added up to an amount that would have resulted in a mortgage payment of {$1000.00} every month, in XX/XX/XXXX I began paying {$1100.00} as instructed and have paid it on time every since.
In XX/XX/XXXX I was informed that my loan was being transferred to Dovenmuehle and that I would begin making payments to them in XX/XX/XXXX.
As instructed I began making payments in the amount of {$1100.00} to Dovenmuehle inXX/XX/XXXX.All of my payments were on time so my mortgage was not in default.
On XX/XX/XXXX I received a correspondence from XXXX XXXX XXXX XXXX that I the escrow shortage is {$2500.00} and that my mortgage payment would be increased again beginning in XX/XX/XXXX to {$1200.00} due to an escrow shortage.
My taxes and insurance have already been paid for XX/XX/XXXX. Based on my previous years tax assessment and payment and my insurance premiums the projections for XX/XX/XXXXtaxes and insurance will be around the same amount as I filed my homestead exemption in XX/XX/XXXX. I actually calculate my total payment to be {$1000.00}.
However, I am being charged an amount of {$540.00} over my principal and interest payment that will result in my paying a total of {$6500.00} into an escrow account that will only disburse a projected {$3900.00} for insurance and taxes between XX/XX/XXXXand XX/XX/XXXX SOMETHING IS VERY WRONG. Where is the other money going? THIS IS FRAUDULENT DOUBLE BILLING AND DOUBLE DIPPING.
In light of previous housing and banking scandals I am making this complaint to CFPB, HUD, and the attorney general 's office as this kind of double dipping places a hardship on homeowners and will result in financial devastation and many foreclosures just to line the pockets of unscrupulous lenders and mortgage servicers.

Complaint: In XX/XX/XXXX I filed bankruptcy. In XX/XX/XXXX my mortgage was sold to Dovenmuehle Mortgage Inc. I made my first mortgage payment to Dovenmuehle in XX/XX/XXXX. As of XX/XX/XXXX, I've paid my mortgage for each of the 29 months I was with Dovenmuehle. Each month was paid via check for a total of 29 checks thus far. In XX/XX/XXXX my bankruptcy was discharged from the court system. Shortly after my bankruptcy was discharged in XX/XX/XXXX, Dovenmuehle sent me a letter stating that I was behind on my mortgage payments. After speaking to my bankruptcy lawyer, I was informed that Dovenmuehle did not submit the proper paperwork to the courts during the bankruptcy timeframe. Dovenmuehle states that they increased my mortgage during the bankruptcy process but they did not legally file this with the court, nor with my bankruptcy lawyer or myself. Dovenmuehle has been inaccurately harassing me since XX/XX/XXXX about missed payments and late charges for a mortgage increase that I was never informed of. On XX/XX/XXXX, I received a mortgage statement from Dovenmuehle via mail for the amount of {$2200.00}. That amount includes an overdue payment of {$1300.00}, plus {$200.00} for bankruptcy attorney fees, and a new/higher monthly mortgage of {$680.00}. For 29 months I've paid my mortgage of {$670.00} for every month via check and I have proof of payment from my bank. Dovenmuehle never informed me or the court system about an increase in mortgage nor about any overdue fees/charges. I was never contacted by Dovenmuehle regarding any increases to the mortgage but am now being harassed and threaten to be sent to collections for an unexplained overdue balance. My bankruptcy lawyer reviewed the terms of my bankruptcy case and determined that Dovenmuehle never submitted any documentation of any of these miscellaneous charges or increase in monthly mortgage payments to the courts. I am not responsible for paying for charges that were never legally communicated to me, my lawyer, or the courts and am requesting an investigation of this mortgage company.

The Current STATUS is still reporting a delinquency current STATUS. This reporting is inaccurate as the current STATUS should reflect that this account has been PAID. Please see the Status on the attachment 1. Per the Credit Reporting Resources Guide, current STATUS is clearly defined as a snapshot of the account status as the last reporting and does not reflect any prior historical status. Complaint: ADA/XXXX Violations During the process of submitting a loss mitigation application, I have been asked multiple times about my XXXX. My XXXX status has been scrutinized and I feel my rights as a XXXX person have been disregarded and violated.
I have been asked how long Ive been XXXX. I have been asked how long I expect to receive XXXX. I have been asked to provide a bill or documents that support my illness and diagnosis, explicitly detail my illness and/or directly indicate my XXXX state. I was asked that it detail certain dates or time frames.
Im now being subjected to repeated calls and requests for the same and/or similar information which is not only causing additional and undue stress and a negative impact on my conditions. They are claiming information not received or just the need to clarify or verify information stated.
I was told the mitigation process began on XX/XX/XXXX ; XX/XX/XXXX ; and XX/XX/XXXX ; and was to complete by XX/XX/2018. Now Im told the process did not start and is just beginning and might be a while longer.
I have repeatedly been inquiring about foreclosure information and told different information, now on self recorded calls. I was told I was in foreclosure. Called the attorney and was told no file in hand. They indicated my file was in loss mitigation and foreclosure never initiated. Called foreclosure department at Dovenmuehle and they stated loan Not in foreclosure. It was in loss mitigation.
I told all this to a XXXX XXXX and I also told her several dates I tried to get reinstatement details and was not provided. She cut me off and said shed have to get with management to look into things. She said the foreclosure information was incorrect and said she didnt know why anyone indicated confusion. They likely just havent properly filed everything yet.

Complaint: Late XX/XX/XXXX I was about two payments behind in my mortgage. On XX/XX/XXXX I was told my loan was accelerated in XX/XX/XXXX. At the time of acceleration, I was 81 days delinquent. I was told this was not legal. I later received a letter stating this information. This letter also stated foreclosure was proceeding due to my not curing my account. From this date to now, Ive submitted and resubmitted loss mitigation paperwork. I have been repeatedly told I couldnt make any payments, contrary to the statements in the letters mailed to me. In a letter dated XX/XX/XXXX, I was told I had until XX/XX/XXXX to cure my loan or it would be accelerated. Which was perplexing as I had a letter that said this action had already taken place and had been informed on several calls that it was already accelerated. I received a letter stating a face to face meeting was to be setup with a third-party organization. But upon calling my servicer to clarify and schedule, I was told it was not necessary and to disregard. It was not correctly stated in the letter and that unless I needed help completing my loss mitigation paperwork, there was no need for this meeting. However, on XX/XX/XXXX, a man from this business showed up at my door. I opened to hear a very unpleasant conversation between him and a dovenmuehle collections person. They refused to give him any information and I asked for his phone to try to understand what was going on. He wouldnt really speak to me until I took him off speaker. I dont recall verbatim, but my hope is that it was recorded. But essentially I was told there was knowledge as to why he was there. After disconnecting the call, he apologized and thought he was bringing me a loss mitigation application to complete. When I told him my application was submitted on XX/XX/XXXX, he was further confused.
I was notified on XX/XX/XXXX that my loss mitigation packet was complete and moving to the committee that would review and let me know my options. When I called to follow-up late XX/XX/XXXX/early XX/XX/XXXX, as well as to again broach the payment topic, I was asked if I had spoken to the attorney I asked what attorney and the representative said the foreclosure attorney. It was at this time I learned that while loss mitigation was occurring and I was being barred from payments, they were proceeding with foreclosure. I was further told it was assigned to a foreclosure attorney the day of or after my loss mitigation paperwork was complete and forwarded for review. When I was finally able to speak with the person identified as my primary POC, XXXX, I was told to disregard this info as all foreclosure proceedings are frozen until after the loss mitigation process was complete. And that I would know my options by XX/XX/XXXX. But upon reaching out to HUD and other resources, I was quickly educated on the term dual tracking and the Georgia law against it. In early XX/XX/XXXX, I received a letter that was telling me it was required by law to be sent. It was my default letter making me aware that my loan was late and I was at risk of all the aforementioned actions. I learned that this letter was to have preceded many, if not all, of the others.
This is a summary of what had transpired over the span of roughly 75 or so days. And as a person who has lived it, its been nothing short of a nightmare. I have a rare combination of XXXX XXXX. They are triggered by XXXX ; the more I am subjected to, the worse I react, rendering my medications nearly helpless. And much of what has happened has caused severe reactions. Due to my XXXX, Im unable to type out every detail. I was told that calls are recorded, though when I request transcripts and copies, Im denied or told that particular call was not recorded.

Complaint: My husband and I owned a single family home. He died last XX/XX/XXXX. This house was on XXXX XXXX XXXX in XXXX NC was put on the market, sold and closed on XX/XX/XXXX. " Dovenmuehle '' was the lender, account # XXXX. The mortgage was due at the beginning of the month so the time between XX/XX/XXXX and XX/XX/XXXXshould have been prorated and the remainder paid to me. I never received a check so I started calling to find out why I hadn't.
I called and spoke at length to " XXXX # XXXX who said that a check had been sent to XXXX XXXX instead of my home at XXXX XXXX XXXX, XXXX NC. ( why would they send a check to the address of the home I sold? ). XXXX said she'd put in a request to reissue the check and send it to me at XXXX XXXX XXXX
The check never came.
I called on XX/XX/XXXX and spoke with " XXXX '' who said I needed to send them a death certificate before they could issue the refund. I sent it in. No check.
I called on XX/XX/XXXX and was told I would have to fill out a form formally to change my address. I completed it and sent it back to them.
I called on XX/XX/XXXXand spoke with " XXXX. '' She said they would have to check with the credit bureau to remove my deceased husband from the account before they could issue me a check ( why this didn't apply in XXXX when they sent a check to the old address, I don't know ) I called on XX/XX/XXXX and spoke with " XXXX ''. I asked to speak to a supervisor. I was transferred to " XXXX '' ( XXXX ) who told me that the information wouldn't go out to the credit bureau until the end of XXXX.
Still no check. So I called back on XX/XX/XXXXand spoke with " XXXX '' ( XXXX ). She said she saw all the records about my calls and that " it should have been taken care of. '' Apologies, apologies. She said she had put in a request for a check to be cut and sent to me. Told be I should receive it in 7-10 working days.

Complaint: I have been in the process of trying to repair my home for a month now. With current regulations the mortgage company holds all funds from the insurance company to make the repairs. During this process I have been told daily that the funds would be released to my account so that I can pay the contractors. I am now 3 business days past the original date I was told. The company is unresponsive and gives the same answer but offers no solution and will not follow up on their word. Dovenmuehle has been in possession of the insurance check for two weeks now and has yet to release a dime. I have completed all paper work and they have stated that the funds should have been available to me.
I have called multiple times and I get the same answer that they will be available tomorrow but it never happens. I am beginning to believe the company is fraudulent and I am being scammed out of $ XXXX in home repairs. I am now paying contractors out of pocket and will be negative in all my accounts causing more headache and fee 's all because this company does not care about the consumer/customer and has taken an excessive amount of time in completing the simplest of tasks. The LOSS DRAFT DEPARTMENT should be investigated.

Complaint: We recently sold a home in New Jersey and a previous mortgage showed up for XXXX XXXX. My attorney found out that this mortgage was satisfied almost 20 years ago but a Discharge of Mortgage was never filed with the XXXX County Clerk. The new buyers continued with the purchase of our home but held {$67000.00} in escrow. My attorney has contacted Dovenmuehle and they were supposed to get a Discharge of Mortgage and file it with the Clerk. He has been dealing with the bank since the end of XX/XX/XXXX and has dealt with XXXX XXXX. Numerous calls by my attorney and myself have been to no avail. I need this money to purchase another home and believe that the almost 3 months we have been dealing with this is more than enough time. PLEASE help. The loan number was originally XXXX.

Complaint: I requested an explanation as to how I could release the Private Mortgage Insurance on my loan. The lender sent me a letter and an application for that proceed. The letter stated that, subject to a current value appraisal of 75 % or less LTV, as a result of substantial improvements in the property during the first two years of the loan, an appraisal can be ordered at my expense to see if the PMI is no longer required. However, despite this explanation in the letter, the company keeps insisting I must make a substantial principal payment no matter what to qualify. I asked for a supervisor for further information, and have not received a call back from someone other than the person who interpreted this provision of the loan.

Complaint: My loan was paid in full XXXX I have a letter from the company and a certified check to prove that, I went to the county clerks office XXXX and was told they have not submitted anything they are still listed as a lien holder. I contacted the company they told me there was an error on the paperwork and it was sent back and they would send it to another department to work on it ..i told them if what they were saying was true then why does the clerks office have no record of it and why have they not attempted to contact me, she didn't know and could not tell me what the error was. I told her it's been almost 4 and a half months and they have not removed their name off my deed I should not have to wait for someone to maybe get to it this is well over a 90 day time frame.

Complaint: On XX/XX/2018, I authorized XXXX XXXX to deduct my monthly mortgage payment from my bank account. On XX/XX/18, they deducted two payments from my account causing and overdraft. I contacted them about the error, I was told to provide screen shots of the double payments, which I did. When I advised them that I had non-sufficient fees accessed on my account they stated that they would refund the fees. I sent them screen shots and emails of the total NSF Fees of 58.85.
Now I am being told that this information is not enough they need copies of my bank statements in order to refund my money. I advised them that they didn't need my bank statements to take money out of my account that they were not authorized to take. I am being given the run around, if they are doing this to me then they are doing it to thousands of others. I want them to return the NSF fees refund the same way the fees were caused and provide documentation to my bank and credit bureaus of their error. The are trying to send me a check in 15 days and then I have to try and get it cashed. This is fraud.

I have been paying 6 yrs on this loan, 5 of them with this company. I want to know what my loan balance needs to be to have it taken off and no one seems to know or know who in their company can tell me. This company has very poor customer service and are seldom, if ever, of much help. Seems to me that they make money off our loans, so should be there to help us when we need it. Complaint: Request I am writing to request that the late payments reported by Dovenmuehle be removed from my credit report and to highlight Dovenmuehles poor processes and behavior that ( 1 ) led to the missed payment report and ( 2 ) prevented me from resolving the issue with Dovenmuehle itself.
Summary Dovenmuehle failed to properly notify me that they cancelled my online recurring payments. Instead, I was notified of a payment issue for the first time on XX/XX/18 by XXXX XXXX because Dovenmuehle reported my account as delinquent to the credit bureaus.
Dovenmuehle claims they mailed me a letter stating my accounts were delinquent. I did not receive that letter. Dovenmuehle did not notify me that they ceased recurring payments by phone or email.
I immediately called Dovenmuehle to resolve the payment and credit report issue. I was repeatedly harassed, intimidated, and threatened by Dovenmuehle agents as I tried to do so.
Attempts to Resolve Issues with Dovenmuehle Attempt 1 : Phone Call with Collections Agent, XXXX, Saturday, XX/XX/18, XXXXXXXX XXXX CST, 10 minutes.
During this conversation I was told that I couldnt resolve the missed payment and credit report issue together until Monday. I stated that I would wait until Monday to resolve both issues together. The agent then stated that if I didnt make the payment with him immediately he would report that I made no promise to make the payment in the future.
I believed he was trying to scare me by threatening me with legal action/foreclosure if I did not pay immediately. I subsequently asked him if our conversation was recorded so that I would have proof that I did not say that. After this question the agent stated that he was changing his report.
Attempt 2 : Phone Call with Customer Service Supervisor, XXXX, Monday, XX/XX/18, XXXXXXXX XXXX CST, 25 minutes.
I was told that Dovenmuehle would not resolve my credit report issue unless I mailed them a letter. The representative stated the issue could not be addressed by phone, by email, through the website, or any transparent processes.
Dovenmuehle could give me no guidance on what the letter needed to prove, what the timeline was, who would oversee it, or any information that made me believe the letter would be considered. Instead, their lack of transparency led me to believe this was an attempt to ignore my concerns.

I explained during this conversation that if the company would not make me a promise to address this situation with the credit bureaus that I would dispute the claim with all credit bureaus and file complaints to the XXXX XXXX XXXX and XXXX XXXX XXXX XXXX. The supervisor subsequently told me that my complaint would be forwarded to a senior manager and that I would get a response to the credit bureau situation within 48 hours. No one followed up.

Complaint: To whom it may concern, I am writing you because XXXX XXXX XXXX has giving me a hard time trying to apply for a loan modification. It is more than 6 months trying to get help save my home.
I called XXXX XXXX XXXX who is my lender asking for help because the 3rd income that I had moved out and that cause a big hardship on our income.
Now we are 4 month behind and XXXX XXXX XXXX trying to get a loan modification, XXXX XXXX XXXX keeps telling me that they are not going to help me because the Investor of my loan is out on vacation and returning until XXXX.
This is ridiculous to me since its almost 1 year seeking help and still no results.
Please help.
