Complaint: Caliber Home Loans ( CHL ) sent confirmation in XXXX of 2016 indicating that we were approved for a loan modification. Immediately thereafter, and pursuant to CHL 's instructions ; we submitted our signed documents which we Faxed ( verified ) & Mailed. We immediately began paying the agreed upon amount FAITHFULLY/MONTHLY to present day.
In XXXX CHL sent a foreclosure notice and when I called they indicated that they had not received the aforementioned documents before a XXXX deadline and they were therefore going to foreclose on our loan. CHL said they called and sent notifications BUT THAT IS NOT TRUE!!! as we only received a letter in XXXX stating the correct address to send our Bank Checks to as being XXXX not XXXX as I was sending the Bank Checks to the XXXX address as instructed by a representative which I spoke with. That is THE ONLY correspondence we received from CHL - for had they merely indicated that they did not receive said documents we would have immediately remedied the situation.
The Bottom Line is CHL accepted and cashed our checks for several months now which in any court of law is validation of the contract between us.
It should be noted that throughout the process of being completely ignored by the XXXX XXXX XXXX after being transferred from XXXX XXXX Bank - the entire process of dealing with CHL was excruciatingly difficult - and mind you - I 'm a XXXX with an XXXX!!! CHL seemingly/purposefully made Loan Modification Process exceedingly difficult. They would send out the same packets of documentations time after time and oftentimes requesting information that had already long since been sent and verified as being received by follow up phone calls. And please do note that it more often the case that the representatives gave completely different explanations when compared to the documentation they sent out.
Oftentimes it seemed like we were dealing with several different disjointed companies when trying to communicate with CHL. No one had answers to seemingly simple questions concerning their documentation inquiries.
In perusing the online complaints it was readily understood that we were in an uphill battle in dealing with CHL, but nothing prepared us for how incompetent this organization was.
XXXX can only hope and trust that they, like XXXX and other evil establishments, will be levied well-deserved punitive fines and fees for how they have mistreated their clients.
Reiterating : We complied with every request made of us - we were granted a loan modification - faithfully made our payments from XXXX through to XXXX - and then unexpectedly received notification that we were being foreclosed on - without a single phone call/message or registered letter which one would think would be well warranted in a situation like this. CHL sent us NOTHING save for an address correction for payment!
For if we had XXXX iota of an indication that there was a discrepancy we would have moved heaven and earth to remedy the situation.
With all that being said, we want to thank you for your time and efforts on our behalf as we are truly at your mercy against an unmovable object.

Complaint: Caliber Home Loans has screwed up my escrow account twice. First they paid an irrigation assessment they were not supposed to pay and began charging me {$100.00} a month more to cover their mistake. I also paid the assessment and cant get that money back. Now they have failed to pay the second installment of my property taxes and I have been assessed a penalty and late fee which they will have to pay. They are unresponsive in fixing these issues and I can not change mortgage companies. I did not ask for them they bought my loan and now I am stuck with their XXXX service for the next 28 years.

Complaint: My problem began when I was steered and pushed into a negative amortization loan. The problems continued as my mortgage payment and balance increased over the years, eventually going up nearly {$700.00} a month. This coupled with recently having to go on full time XXXX and a mortgage lender Caliber Home Loans that seems to not care or respond to my requests for help has me facing foreclosure. There are XXXX of us living here, including my special needs daughter and losing our home would be devastating. We are contacting you to see if we can get any assistance with our situation and try and get Caliber to engage with us.
When I purchased my home I had solid employment for many years as a locomotive engineer and had a solid credit profile. However, for some reason I was steered into this predatory negative amortization loan that I did not fully understand to buy the house. Despite the fact that my payments and even my balance continued to increase incrementally, I was able to pay as agreed for many years. Due to the huge increase in monthly payments as well as health issues and caring for my XXXX daughter I began struggling a few years ago and applied for a modification with Caliber and after a long review was approved, although the new payment was higher than what I had been paying. Not long after that things took a turn for the worse when my doctor told me that my XXXX was so bad that I could no longer work and had to go onto XXXX. This resulted in a loss of about {$5000.00} a month in income. I am receiving benefits, and my wife is working full time as well, but there is no way we can afford the modified payment that Caliber offered us.
I began reaching out to Caliber to explain the situation and to inform of the drastic change in financial circumstances. I was told that there were programs available for us and that we just needed to apply and send in the paperwork. Well I have done this on numerous occasions and have made no progress and do n't really know where I stand. The problem began because I was pushed into a predatory toxic loan that was destined to fail by XXXX. After the loan was transferred multiple times, it ended up with Caliber. I am sure that they obtained this loan for a significant discount, because they knew it was destined to fail.
I have worked hard my entire life, and this home is all I have. I do not want to fail because I was steered into this predatory loan, and then became XXXX. I want Caliber to work with me to resolve this problem. I know that there are government and in house programs available for struggling homeowners like myself. Why wo n't Caliber give me access to these programs? Instead they are rushing to foreclose on my home so that they can increase their bottom line and put me out on the street. I know that Caliber has government and in house programs available for homeowners such as me. Why are they not allowing me the opportunity to have a review completed for options based on my current and correct financial status? I do not want to lose my home!

Complaint: My mortgage company, Caliber Home Loans , Inc., has given me a difficult time about paying my local fire district taxes even though a portion of my mortgage payment is collected by them to pay those taxes. I 've had to spend considerable time to get these taxes paid XX/XX/XXXX, XX/XX/XXXX, XX/XX/XXXX and XX/XX/XXXX. The taxes are due on XXXX XXXX. In XXXX XXXX, I received a phone call from Caliber informing me that they would pay my taxes. Today, XX/XX/XXXX, I received a letter from the fire district indicating that the taxes have not been paid and that the account would soon be going to a collection agency. Caliber has been collecting money from me under false pretenses and is going to ruin my credit. This company needs to be held accountable for their actions.

Complaint: I was falling behind in my mortgage payment, I received a letter from Caliber Home Loans offering financial compensation for a Deed in Lieu Foreclosure in XX/XX/XXXX. I was hesitant at first because I did not want to lose my home. I received another offer from Caliber for less money that the first one and after reviewing my options, I accepted their second offer ( for less money ) in XX/XX/XXXX. I was told I had until XX/XX/XXXX to leave the property and hand over the keys to a local representative. They offered me an extra week if I needed to to turn in the keys, which I accepted. It was n't until I handed the keys over on XX/XX/XXXX that they told me that they would now have to " investigate '' my personal finances to see if I had other properties and I would have to wait 4-6 weeks. This information was not told to me at the beginning of the process but what could I do, the keys were already turned in. I would call Caliber at least once every week to check on status of the process with little results or information. On XX/XX/XXXX I received a letter form Caliber Home Loans stating that my application was being held up because records showed there was a junior lien on the home by the state of Arizona. After talking to the state tax department, they assured my that there was not a lien on the home. They did tell me that there was at one time a lien on the home for tax purposes back in XX/XX/XXXX but the lien was released once the back taxes were paid in full. According to the letter I recieved from Caliber, I had 30 days from the date of the letter ( XX/XX/XXXX ) to respond and clarify the problem holding up the process. On XX/XX/XXXX, I faxed the necessary paper work from the county recorders office stating that the lien was released in XX/XX/XXXX over to Caliber. Upon faxing the lien release, I called Caliber to verify that the fax was received, I was told that it was and that a manager would call me later that day. There was not any call from anyone from Caliber that day so I called back on XX/XX/XXXX and spoke with the manager about my matter. According to the manager, my application was to be denied even with the lien release being submitted to them way before the 30 days due to the fact that the property foreclosure date was scheduled to be the following Wednesday ( XX/XX/XXXX ). I feel that I did everything asked of me and followed all their directions in a timely manner and before the foreclosure date. There are multiple phone calls that were initiated by myself to see if there was anything that can be done on my side to try to avoid something like this. One of the representatives even advised me to get back the keys and try to negotiate a cash for keys instead of a Deed in Lieu. I feel I was just given the run a round this whole time and I let the manager know. I was told to by the manager to write an email to her boss to see if there is anything that they could do. I have lost faith in the system.

ON XX/XX/XXXX WE HAD TO SUBMIT ANOTHER HAMP APPLICATION TO CALIBER UPLOADED TO THEIR WEBSITE. FROM XX/XX/XXXX WE UPLOADED ALL THE DOCUMENTS REQUESTED FROM ALL THE SPOC REPS.
THEN ON XX/XX/XXXX CALIBER WITHOUT ANY PRIOR NOTICE, CANCELLED AND DE-ACTIVATED OUR ACCESS TO THEIR WEBSITE TO UPLOAD ANY MORE HAMP DOCS. THUS, WE WERE UNABLE TO KNOW WHAT DOCUMENTS WERE ALREADY PROVIDED TO CALIBER AND ON WHAT DATES THEY WERE UPLOADED AS THE WEBSITE HAD ENABLED US TO DO. THIS SLOWED DOWN OUR HAMP APPLICATION SUBMISSIONS TREMENDOUSLY.
AFTER CONFRONTING CALIBER WITH THIS EXTREMELY PREJUDICIAL ACT AGAINST XXXX THE SPOCS FINALLY GAVE US THE EMAIL XXXX TO SUBMIT MORE DOCUMENTS.
UNFORTUNATELY, WE CAN NOT TELL WHAT DOCS. WERE ALREADY PROVIDED AND ON WHAT DATES. THEY CLAIM THEY DE-ACTIVATED US DUE TO A PENDING FORECLOSURE SALE WHICH THEY SCHEDULED FOR XX/XX/XXXX, WHILE OUR HAMP APPLICATION WAS STILL PENDING.
THEN FINALLY ON XXXX, THE SPOC XXXX INFORMED US THAT CALIBER HAD RECEIVED ALL NECESSARY DOCUMENTS AND WOULD SUBMIT THE ENTIRE HAMP APPLICATION AND DOCUMENTS TO THEIR UNDERWRITER. HE THEN STATED THAT WE WOULD HAVE TO WAIT ABOUT 30 DAYS FOR A RESPONSE.
THEN ON XX/XX/XXXX, OUR LAW OFFICE CALLED TO GET AN UPDATE AND CALIBER STATED THAT THEY NEEDED MORE DOCUMENTS AND THAT THEY HAD CLOSED OUR HAMP APPLICATION BACK ON XX/XX/XXXX.
ON XX/XX/XXXX WE EMAILED THOSE DOCUMENTS. XXXX, THE SPOC SAID TO CALL BACK IN 1 WEEK FOR AN UPDATE.
THEN ON XX/XX/XXXX WHEN WE CALLED BACK, XXXX ANOTHER SPOC IN XXXX. STATED WE NEED EVEN MORE DOCUMENTS.
CALIBER HAS NEVER CALLED OR EMAILED OR FAXED OR WRITTEN ANYTIME TO REQUEST MORE DOCUMENTS. WE ONLY KNOW AFTER WE CALL THEM. THIS IS DUE TO THE HARDSHIP CAUSED BY THE ACCESS DE-ACTIVATION OF THE WEBSITE TO UPLOAD AND REVIEW DOCUMENTS.
THUS, WE ARE FILING THIS COMPLAINT TO THE XXXX DFS TO COMMENCE AN INVESTIGATION INTO CALIBER 'S FRAUDULENT AND BAD-FAITH PRACTICES WITH HOME-OWNERS IN XXXX. IM VERY SURE THEY HAVE ACTED FRAUDULENTLY AND IN BAD-FAITH WITH MANY OTHER HOME-OWNERS IN XXXX IN ORDER TO FORECLOSE ON THEIR PROPERTY AND MAKE A PROFIT WHEN SELLING THEIR HOMES. WE ALSO FILED A COMPLAINT WITH THE XXXX DEPT. OF FINANCIAL SERVICES.
PLEASE ACT EXPEDITIOUSLY IN THIS MATTER AS WE ARE ALSO TAKING THIS TO OUR US SENATORS AND REPS. IN CONGRESS FOR AN INVESTIGATION.
