Complaint: Hello, my name is XXXX XXXX and I have owned my home in XXXX, New Jersey for 33 years. I am facing a foreclosure auction next month because the company that owns my mortgage Caliber Loan Servicing is refusing to consider any options or giving us a chance to save our home. We know that Caliber could work with us and do something to lower our interest rate ( currently at XXXX % ) or even change the term of our loan ( only 10 years left in the term ) to make the payment more affordable but they refuse. This problem began when the loan was with XXXX ( part of XXXX ). You see I had worked for 40 years as a XXXX but during the financial crash in XX/XX/XXXX I lost my job. I could not find work and survived on unemployment and drained the XXXX that was supposed to be my retirement in order to keep the lights on. We began reaching out to get some help for the mortgage at that time but were told the only option was a repayment plan which was temporary and raised our monthly payment. XXXX claimed that since they were not a United States bank and did not take bailout funds that they did not have to help us or work with us. This was heartbreaking and seemed extremely callous. I was not surprised when I found that they were fined XXXX dollars by the government for their unethical foreclosure and business practices. I finally went back to work in early XX/XX/XXXX. I resumed making my mortgage payments until I was laid off of my job about a year ago. During this time period the loan was transferred to Caliber. I once again fell behind on the mortgage and have not been able to find any full time employment ( working doing XXXX work and receiving some unemployment ) that would allow me to resume making my full mortgage payment. When that happened I began trying to engage with the agents at Caliber but have made no progress and feel that they are purposely obstructing me from available options in order to push me into foreclosure. I want Caliber to review my current financial circumstances in order to qualify me for any government or internal programs that they have. I am certain that they have the ability to modify this loan by extending the term or lowering the interest rate from XXXX % in order to make this affordable, yet they continually turn your back on us. I also believe they have the option to forgive delinquent interest or to wrap it back into the balance of the loan or even defer it till the note comes due. Why wo n't Caliber even consider these options or give us the time of day? Now they have set a sale date for XXXX XXXX. I know we are behind on the loan, but we expect that Caliber at least provide options for saving our home and to communicate with us regarding these options.

Complaint: I am working with Caliber mortgage to rescind the property foreclosure sale on my home. They did make me a offer to reinstate the mortgage if I paid XXXX XX/XX/2017. I requested a mortgage modification though the making Home Affordable Act and they are refusing to modify my mortgage loan I do want to keep my home. I had a previous mortgage modification and Caliber mortgage did n't honor the modification agreement.

Complaint: I became XXXX unable to make the full amount of my mortgage payment ton XXXX I was not assisted with any loss mitigation application.The mortgage went into foreclosure XX/XX/XXXX. The attorney said, I was served a Notice of Foreclosure Intervention. I was not severed a notice. I applied for a short sale and sent all requested information. I was not denied or accepted. The mortgage was sold while in the process of evaluation for the short sale. The mortgage was brought on XX/XX/XXXX by Caliber Homes as server XXXX as owner. They failed to assist me with a loss mitigation program until XX/XX/XXXX when the mortgage went into final foreclosure. Now they have added {$9000.00} in interest {$45000.00} in attorney 's fees to total {$250000.00}. They want me to pay that as a loss mitigation. I know I am unable to qualify for this loan. The Judge have approved these figures. I have until XX/XX/XXXX to pay.

Complaint: I filed for Bankruptcy XXXX XXXX, in CA. My Loan was with Caliber Home Loans. They sold my home for {$4800.00} over what was owed against the loan. I never got a check, but received a XXXX showing that they wrote off {$5500.00} in interest. Called the IRS who told me I would have to go after the lender for fraud, but I would have to file as per the XXXX Called them twice at an hour the first time. They could not give me an answers or accounting of the figures. Called them again they left me on hold. Gave up after nearly 40 min. This company had over XXXX complaints here and Ill be securing another attourney and going after them for all expenses as well as fraud.

Complaint: My home is currently under a foreclosure process, but I 've been taken advantage and been treated unfairly as I 've been assessed unfair fees, and was a homeowner subject to both unfair debt collection practices and predatory lending practices of my original lender XXXX ( Appendix B ). My state of Illinois and XXXX County attorney general filed former suits against XXXX, and subsequently they 've quietly attempted to transfer ownership and obligation to another entity- XXXX Master Participation Trust. Without my knowledge or consent, my home was transferred to a private entity, XXXX Master Participation Trust, from a private sale for homes under distress. My servicer is now owned by XXXX XXXX XXXX, a global private equity fund, and is owned by a billionaire named XXXX XXXX. So XXXX has bought my mortgage in a bulk auctioned deal, at a substantial discounted rate and has even been paid a big chunk of money that came out of my mortgage insurance. By not discounting the principal of my loan, the rich investors behind the XXXX make a windfall off of me. In addition, XXXX has continued the lawsuit under the representation that it is the owner of the loan without notifying the court the ownership has changed. This can be confirmed and is on record from XXXX financial records website ( Appendix D ). This entity has even represented themselves as being with XXXX as Trust for XXXX, however my lender and servicer are still listed as XXXX and Caliber respectively. I 'm advised that under UCC, my mortgage could be considered a non-negotiable instrument. This practice is very unfair - how is it allowed that the private equity bigwigs get to buy my loans at a subsidy ( HUD ), but as a homeowner with a home under water, I do n't get a subsidy when trying to save my own home. They 're profiting off of my distress. I 've tried to work my old and new lender/servicer over the last year plus, but have n't gotten any resolve or assistance. I have worked with my servicer and lender directly, HUD, XXXX County Foreclosure Mediation ( Honorable Judge XXXX XXXX ), and private consultation with an attorney. I was consequently advised to contact my local Congressman, XXXX XXXX XXXX XXXX XXXX, and now the Consumer Financial Protection Bureau on this matter. I 'm a previously unemployed, divorced father with XXXX children : XXXX years old, XXXX in college at XXXX, and XXXX XXXX parent ( Mom, XXXX ) who I support and live in the home. My last few correspondences have only resulted in being told to do a short sale or deed in lieu - transactions that would only benefit the lender/servicer. I was recently even told that a modification would n't be considered due to the fact that it 's severely under water. I want to keep my home and previously paid a 3 trial monthly installments in good faith. After I sent the payments, they claimed additional paperwork was n't received and attempted foreclosure proceedings for a 2nd time. In summary : I 'm a subject of both unfair debt collection practices and predatory lending from XXXX. Based on my County 's ( XXXX ) assessment and from my servicer/lender 's own valuation, my home is only worth about $ XXXX, not including $ XXXX in repairs. Since XX/XX/2008, my previous lender XXXX stopped doing refinancing of all loans. My loan is not backed by XXXX XXXX so I can/could not take advantage of home affordable programs. I 'm severely underwater, and ca n't get my loan refinanced or modified with anyone. I have several supporting documents. Thank you.

Complaint: I have a loan with Caliber Home Loans. I had a payment that was not processed due to insufficient funds in XXXX. The mortgage company processed the XX/XX/XXXX, XX/XX/XXXX, XX/XX/XXXX payments after the fact and never credited my loan for XX/XX/XXXX. I was unaware of the situation and then paid my XX/XX/XXXX on time and early XXXX payment in the Mail. Still unaware. The bank returned those two payments in the mail to me un-cashed and when I called to ask why I was told that my home had a scheduled trustee sales date of XX/XX/XXXX and that they returned those tow payments because my house was selling. I have owned my home for 17 years I have never had any negative history. I have a substantial amount of equity in my home also. After many phone calls my only recourse to stop the foreclosure was to do a repayment agreement. That amount changed from originally $ XXXX to {$19.00} with no breakdown or explanation of what the monies would go toward. I was told that it would stop the proceeding and I had to give them a cashiers check for {$9400.00} up front and then {$1100.00} above my mortgage payment balances per month of {$2300.00} over the balance. I paid the {$9400.00} and never receive any proof that the foreclosure was cancelled or any account of funds and why. I immediately called numerous times and the supervisor I worked with was no longer there an any commitment he made verbally they could not honor. Now my foreclosure was on hold and they still could not tell me what the XXXX was for. My mortgage payments due for XX/XX/XXXX, XX/XX/XXXX, XX/XX/XXXX and XXXX added up to only the {$9400.00}. I continued to call and talk to supervisors I paid the agreed amounts in XXXX on the XXXX, XXXX on XX/XX/XXXX and XX/XX/XXXX on the XXXX of the month. When i went to make the payment in XXXX I was told that I breached the agreement and now my house was foreclosing again. Apparently there was no grace period for days in the month and it was due only on the XXXX or it was null and void. I talked numerous supervisors and representatives again and even had a copy of the XX/XX/XXXX agreement and there is no verbiage on the no grace period. A supervisor named XXXX finally apologized for his representative talking the XXXX payment and not saying anything or alerting me that the 9 days created a problem. he said he would reinstate the agreement and to wait 24 hours and call him back to make my payment which I did. Again I did not know of any problem. In XXXX 5x months early I called to make a lump sum payment to get the loan current. I was told that I owed {$7800.00} and additional fees of $ XXXX but i could dispute that amount after I paid the {$7800.00} separately and it would make the loan current and that the foreclosure would be cancelled. I did this on XX/XX/XXXX. The representative committed to me I would get a letter stating then that my loan was current and that she would guide me to dispute the separate incorrect charges. I never recieved anything and no one can help me to dispute and no one can tell me where {$24000.00} over my mortgage payment went. why I would owe still {$3500.00} in fees and why the do not owe me back the difference in over payment over aprox {$4500.00} went. and why the original amount was XXXX over what was due?? why they were foreclosing to begin with since they could have applied the XX/XX/XXXX, XX/XX/XXXX, XX/XX/XXXX payments proceeded to XX/XX/XXXX which I believe is against the law or the XX/XX/XXXX and XX/XX/XXXX payments that they returned to me. I never had any phone conversations with them ever end they were mailing to the home address and not my XXXX so i was completely uniformed. I have no hardship. I want my credit repaid I want the XXXX paid back to me above the mortgage due, i want my {$4500.00} overage paid back and all fees reversed and proof that I am current and that the foreclosure is cancelled.

Complaint: I purchased an FHA loan through Caliber Home Loans which comes with Mortgage Insurance ( PMI ). With PMI I know you are able to get rid of it after you pay down a certain amount. Typically when 20 % of the original principal is paid off or when 80 % principal remains. I called XXXX to find out how I can remove my PMI and they repeatedly told me that the PMI can not be removed and is for the life of the loan. I spoke first with XXXX who stated that they call it MIP but it is the same thing. I was then transferred to his supervisor XXXX ( employee # XXXX ) who stated the same thing. My PMI can not be removed and is for the life of the loan. I asked her to send me a document from their company stating that the PMI can not be removed and she would not, informing me that nobody in the company can email or mail documents to a client. She then asked her area vice president XXXX and he apparently confirmed that again, XXXX will not remove PMI regardless of how much of the loan is paid off and that it will remain for the life of the loan.

Complaint: My mortgage was transferred from XXXX to Caliber Home Loans. The first payment due on my account was XX/XX/2016. I made three payments via online banking ( XX/XX/XXXX, XX/XX/XXXX & XX/XX/XXXX ) prior to the transfer. The second payment was applied as a principal reduction so it did not advance my due date according to the statement I received which was fine since we intend to make XXXX payments a month. The third payment to XXXX sent on XX/XX/XXXX was returned to me by my bank and credited back to my bank account on XX/XX/XXXX because their was no active account for the money to be applied to. I " resent '' the third payment to the new company, Caliber on XX/XX/XXXX and have continued to make payments to them XX/XX/XXXX, XX/XX/XXXX, XX/XX/XXXX, XX/XX/XXXX, XX/XX/XXXX, XX/XX/XXXX, XX/XX/XXXX, XX/XX/XXXX XX/XX/XXXX & XX/XX/XXXX. Problem # 1 ... According to my statement, the payment sent XX/XX/XXXX was applied to my account but reversed and entered into unapplied funds, then there was an escrow disbursement for it. I called Caliber to question it and was told they received an invoice from XXXX that they were owed a payment, so Caliber sent them a check. So, my account received no credit for that payment. Problem # 2 ... The balance on my mortgage with XXXX at the time of the transfer was a certain amount, but when I received my first statement with the new company the balance increased by {$460.00}. The due date on the account also varied by XXXX month. With XXXX I was due XX/XX/XXXX, but Caliber was showing me due XX/XX/XXXX. The due date is not a concern to me since we are paid ahead, but I believe this is part of the problem. Problem # 3 ... I 've been in contact with Caliber to discuss my account and the issues with the unapplied payment and balance difference. I 've sent them a bank statement that included all my {$1100.00} payments made for my mortgage account that was requested. I 've requested from Caliber a life of loan history three times. They said it would include my pay history with Caliber & XXXX. I 've requested my account be credited for the unapplied payment, the balance difference from the transfer and a credit for interest I 've overpaid since they reversed my payment. I have n't received the complete payment history. I have n't been getting call backs nor have I seen a credit on my account. I do not know what I can do now to get this resolved and would appreciate any assistance you can provide.
