Complaint: Our home is in foreclosure. We have retained an attorney. He has assisted to prevent foreclosure via modifications, mediation, etc to no avail. Our original note was owned by XXXX. XXXX has been servicing our loan. The foreclosure was filed by US Bank as Trustee for XXXX. The problem is that there is no clear assignment of our mortgage note, we are being foreclosed on by an unknown entity. They failed to provide ORIGINAL note or original assignments. The alonge is blacked out and blank. After weeks of research we have discovered that a hedge fund, owned by XXXX purchased a Participation Pool of defaulted mortgages from XXXX. There are XXXX complaints by homeowners and attorneys that this entity is engaging in illegal activity, forging signatures, and filing assignments and along after the fact. They are stealing homes. I have filed 8 modifications and NOT received any formal answer to 1. I offered $ XXXX to assist to bring pmts current, they refused. Our attorney has done all his due diligence he can. They fail to provide original notes, they fail to provide any discovery at all. They claim to have the Certificate that states they have the original notes. Well if they have the original notes then produce the original notes. When we had our mediation, even their own attorney states that there is not 1 person he can speak with with regards to mediations, negotiations, or discussions to save our home. They have no standing. They are seeking a NON JURY trial. As the homeowner I have the obligation to defend my title. They want a NON JURY trial because the banks will have to prove everything. I do n't even know who they are. There are multiple cases and lawsuits against XXXX. They do n't even exist, US Bank does n't even exist nor have they stated they have any trust fiduciary responsibilities with my home. This is another housing bubble created by a wealthy hedge fund. No one seems to care. There is no actual assignment to them, They have nothing but photocopies of my notes. Nothing is original. I need STATE and FED assistance ASAP.

Complaint: An offer was submitted for review on a system called XXXX ( very bad and difficult system to navigate ) and the lender informed my authorized 3rd party that they needed to have the Property released from my Bankruptcy. once it was released they asked to submit a new offer and voided the previous offer. I called this morning and asked to speak with someone who then informed me that they required 37 days to review and that the schedule sale date was too close and they would cancel the new increased offer which would have been submitted today. They also said that Bankruptcy should n't be used as a tool to stop the sale. Which i think is a matter of personal opinion as i will fight to keep my credit and avoid a foreclosure altogether.

Complaint: My mortgage was originally held by XXXX. In XX/XX/XXXX they sold my loan to Caliber Home Loans ( CHL ). On XX/XX/XXXX I received a call from a CHL representative XXXX employee ID # XXXX stating at that time my account had a credit of {$820.00} making the amount due for XX/XX/XXXX {$660.00}, which I paid during our conversation. Since that time to present my account has not been correct. I have made my monthly payments via phone each month paying the amount the representative showed owing on my account at the time including occasional late fees. I started receiving Pre-Foreclosure Notices, the first dated XX/XX/XXXX, sometimes multiple copies of the same correspondence on the same date. At one point the representative I was speaking with told me, when I asked to speak to a supervisor, that none were available, however ; I could speak to someone in a lower position than him or " hold for thirteen hours '' to speak with someone with authority enough to correct my account. Being fearful of loosing my home, and unable to get a clear answer from CHL regarding the actual amount due, I started the Loss Mitigation process on the advice of the representative.
After receiving the application I completed all sections, attached the documentation requested, faxed and emailed the packet to CHL on XX/XX/XXXX. This information was requested again numerous times which I both emailed and faxed on XX/XX/XXXX, XX/XX/XXXX and XX/XX/XXXX with additional documents requested sent on XX/XX/XXXX and XX/XX/XXXX. Today, XX/XX/XXXX I received notice that the Loss Mitigation was denied due to the documents requested not being provided. Although on XXXX XXXX, XXXX XXXX, employee ID # XXXX, stated CHL had everything they needed, underwriting had the packet and would have a decision within thirty ( 30 ) days. He also suggested that I phone once a week for a status update.
It has also been brought to my attention that the last half of my XX/XX/XXXX Real Estate taxes due on XX/XX/XXXX were not paid on time and have accrued interest and penalties.

Complaint: I have a mortgage with Caliber Home Loans, which calls itself a collection agency rather than a bank. On two recent occasions, I made my regular monthly mortgage payment to Caliber and they did not deposit the payment, claiming that it was not associated with my bank account properly. They charged a late fee on both occasions. I fought to have the first late fee ( XX/XX/2016 ) reversed, but they have refused to reverse the second fee. The payments were made using my personal checking account, which I have had for many years and which has not changed in any way. Other payments from that checking account were cashed routinely without a problem. I suspect that Caliber is using the claim of " no account '' to add late fees to my, and perhaps other accounts.

Complaint: Caliber Mortgage has decided to create their own Bankruptcy Law, when it comes to short sales. Caliber is demanding an approval from the court ( " Motion to Sell '' ) allowing the short sale to take place, and will not give the court any kind of short sale approval terms whatsoever. The BK court will not review a Motion to Sell until they have all approval conditions from the mortgage lender. Caliber has decided that they are above the BK court and are going to create their own rules as to how a short sale works when the borrower is in bankruptcy. What is Caliber trying to hide from the BK court?

Please cease and desist all foreclosure activity pending resolution of an appeal in accordance with Regulation X, 12 C.F.R. 1024.41 ( g ) .. The lender has stated that they denied the loan mod review due to incomplete package being received for review - The lender did not request a Letter of Explanation for XXXX income and did not send a missing letter document or a denial to the client. If they would have done there due diligence in the review of the file they would have found that XXXX is not employed so there were no pay stubs to provide.

Complaint: Trying to work with our lender on a loss mitigation application. They sent us the application with a letter dated XXXX/XXXX/17 with instructions to return within 30 days. We submitted electronically and sent the original documents in overnight mail, we me the 30 day deadline. The lender can not confirmed that they received it. They now say they need 37 days before the sale date to review ; when I told them the letter gave us 30 days ; they said it would take 5-7 days to upload, but they would review. The sale date is XXXX/XXXX/17. We feel that this is illegally dual tracking to force us into foreclosure when we have submitted an application to try to bring the loan current.

Complaint: My mortgage holder is Caliber Home loans. In 2015 l made mortgage modification. According to my mortgage modification agreement with Caliber Home Loans l have to pay my premium, interest and Home Owners Association fee to Caliber Home loans and they have to pay my HOA fee to XXXX ( my home owners association ), every month. By some reason Caliber do n't pay regularly. As a result of this I have big problem with my HOA. They want to cancel my occupancy agreement. Complaint: Caliber Home Loans : The New XXXX. Lying to customers to force them into financial suicide.
Caliber home loans is guiding people into FHA mortgages and setting them up for financial suicide. This is a report being filed on behalf of more than one person, all close friends and referrals to Caliber, who have experienced XXXX XXXX, ( XXXX # : XXXX / State Lic # XXXX ) misleading customers into mortgages they can not afford. She and her staff, backed by the Corporate Caliber, are setting people up for failure. She and her staff, guided by senior management ; XXXX XXXX, XXXX XXXX ( XXXX 's Husband ), and others at Caliber to push the approvals and final documents off to the last minute before closings to force the hand of the buyer to have to take what has been presented.
In my, and XXXX others cases, XXXX XXXX guided us into FHA mortgages. For various reasons, we were told FHA mortgage was the " ONLY '' option. These FHA fees are stacked on top of the monthly payments and are not able to be written off as tax liability either. Caliber Home Loans said, " Just sign the documents and in six months to a year you can refinance and l lower your payment, $ XXXX- {$500.00} per month. '' On top of this, at the time of my purchase, I was told that I had to go with an FHA mortgage because of student loans. I have perfect credit, lots of income, and I put down over {$150000.00}. This was based on the deferment of the student loans for a year, a {$600.00} per month payment. Caliber Home Loans and XXXX XXXX knew that the payment was pushing my financial limited, but being promised that the payment would be lowered with refinancing in a year, the mentioned amount, the payment would basically be the same.
All this is no longer true. Caliber home loans has truly operated in a manner to be the most predatory of predatory lenders and worse than XXXX who ripped off millions of American and set up the financial failures of XX/XX/XXXX-XX/XX/XXXX. They knowing applied my {$150000.00} to set me up for failure with the hopes of me and those I have mentioned ( XXXX others ) to default on the mortgage to gain my equity and additional profits. These activities can be found in numerous other complaints across the internet.
When XXXX XXXX was called back to " Refinance '' she was completely unavailable and unwilling to even look at the mortgage and lower the payment as promised. She was originally contacted in XX/XX/XXXX, over a year after making all payments on time and still with 100 % perfect credit and she refused to help. She was contacted and then led me on for months on end and beyond the point of rates going up in XX/XX/XXXX. She then become very politically driven to blame " Trump '' for why I could not refinance and why rates went up. This was less than days after his inauguration. Since then, her boss, XXXX XXXX ( XXXX # : XXXX / State Lic # XXXX XXXX got involved. She was the most unprofessional person I have dealt with. XXXX actually emailed me and said, " You need to learn some patience, '' when asked to help move things forward. As the unbelievable arrogance persisted I asked to speak to their boss. I found out that XXXX XXXX is their boss, and XXXX 's husband. I then reached out beyond XXXX to XXXX XXXX, who has chosen to also act untouchable replying to emails asking for help with the response of, " Cute ''. All have failed to help or even discuss refinancing. Quite the latter, their " Customer resolution department '' has been XXXX dialing me with auto dialers and staff who have been even more arrogant in their responses and even more rude. It is apparent that Caliber Home Loans is the most unprofessional group from end to end.
With no end in sight and to have been completely misled has force me to begin search for a resolution. All have refused to help.

Complaint: I called Calliber customer care department XXXX and spoke with XXXX. To my surprise, he said that XXXX XXXX 's modification was denied for missing documents. He also said they had not received documents since XXXX, which is untrue.
The servicer has a complete modification package. I spoke to a rep on XXXX and they requested a Profit and Loss as the last piece of documentation needed to reach a decision. Yet XXXX stated on XXXX the document was never received which was sent via email on XXXX

I do n't feel that the bank has the authority to require that our agent disclose a marketing strategy, disclose all offers, provide feedback, etc. This is asking our agent to provide information we are not comfortable sharing, as our agent is not the bank 's agent, he is the sellers agent. The bank has implied, through the negotiating firm, that any short sale would be denied if this information is not provided to them.

Complaint: After being contacted by Caliber Home Loans in XX/XX/XXXX & XX/XX/XXXX regarding refinancing our existing Caliber 30-year loan, we started the refi process XX/XX/XXXX. We were quoted a 15-year loan, 2.75 %, 0 points, 0 out-of-pocket closing costs. Application & requested docs were provided & {$500.00} was paid for an appraisal. Numerous closing disclosures have been received, none of which had the information we were quoted. A closing was scheduled for XX/XX/XXXX but on XX/XX/XXXX it was postponed by Caliber until the next week. At that point we learned that the property taxes, which were due in XX/XX/XXXX, had not been paid. Therefore, we will not be able to claim them on our XX/XX/XXXX Income Taxes. The closing has not been rescheduled, the 90-day rate lock has expired, and numerous attempts at contacting Caliber have yielded no results or information.
