Loan servicing, payments, escrow account

Mortgage: Conventional fixed mortgage

Complaint: The company that is servicing my mortgage is relentless with offers to refinance at shorter terms or for cashout. The ads are on paper, including details ( such as my address, part of my account number, my outstanding mortgage balance, link to a personalized web site ) that makes it imperative that I dispose of the document carefully. It 's a nuisance, and a possible vector for identity theft.

Complaint: In XX/XX/XXXX, my wife 's mortgage loan with XXXX was sold to Caliber Home Loans beginning in XX/XX/XXXX. Our issues with the sale of our mortgage are many beginning with XXXX. Their claim was that our payments were late even though our payments were sent return receipt requested showing payments arrived on time. XXXX began returning our payments and threatening foreclosure even though we had a agreement from one of their representatives to fix so called problems. In any case the loan was sold. My wife has since passed away ( XX/XX/XXXX ) and I as her executor and beneficiary I have beentrying without success to get any reasonable or knowledgeable responses from Caliber Home Loans. They are as follows ; 1 ) We had a modification in XX/XX/XXXX with XXXX and with the contracts mandated for my wife to sign was a life insurance policy for the principle of the loan. With the sale of the loan to Caliber, which we were never given a notice of, this life insurance policy disappeared and were never given the choice of continuing on with the policy. XXXX was the beneficiary of the policy and XXXX paid for the policy through our mortgage. The mortgage was bought by XXXX who has changed the loan with no agreement from us. 2 ) We have tried to get an explanation and accounting of how this mortgage grew from {$200000.00} to XXXX. Enclosed is a copy of the last XXXX statement and the first Caliber statement. 3 ) Enclosed is a copy of the modification that Caliber has given me 15 days to sign even though I have repeatedly requested this information. We are willing to continue to make payments while this issue is being resolved. This could all be resolved if I did not keep getting different answers from everyone I communicate with.

Complaint: Caliber Home Loans is not reporting accurate information to the major credit bureaus in regards to my " monthly '' payments received, monthly payment amount, which is XXXX not XXXX or XXXX and matter has caused a negative impact on my credit, score and job clearance. Per my credit reports On XX/XX/XXXX and XX/XX/2017, Caliber reported that my account was delinquent by 30, 60, 90 days when in fact my account is current and does not reflect reporting for the months of XX/XX/XXXX, XX/XX/XXXX nor XX/XX/2017. I have recently reached out to various Caliber Customer Service employees whom referred my inquiries to their " Credit Department, '' however, the issue still remains unsolved and incorrect. I am fully aware that XXXX 's reporting is the XXXX of each month, however, XX/XX/XXXX 's reporting should reflect XX/XX/XXXX 's payment which has not been reported and the same for XX/XX/XXXX 's reporting. To date, my next scheduled payment is not until XX/XX/2017, which my reporting should reflect on time. Caliber is not adhering to their reporting schedule nor are they reporting accurately, which causes a financial and employment strain on its customers, due to their inability to report accurate information.

Loan servicing, payments, escrow account

Complaint: I paid my property taxes on time until I refinanced my home. My mortgage was refinanced by XXXX in XXXX where I am a resident. I paid prorated taxes to XXXX and I have documentation as proof which also contains that on top of the existing amount I pay per month, I also put the amount of my property taxes into an escrow of the company which is how it gets paid afterwards. A month later ( end of XX/XX/XXXX ) the loan was purchased by Caliber Home Loans , Inc. ( Corporate Office : XXXX XXXX XXXX, XXXX, TX XXXX ). I have been making payments promptly and on top of that I have been submitting additional payments towards my principal. Today, I received a delinquency notice from the XXXX County Treasurer, that I owe property taxes for the current year ( which where Caliber Home Loans Inc. has been the responsible party ). I called their department and I was told that they will do an investigation but WILL NOT call me back about this and basically left me on my own. They have been taking money out of my payments since XX/XX/XXXX and fail paying the property taxes THEY ARE responsible for, leaving me with penalties. Please enforce the applicable laws against such company. Took my money, do n't pay what they are mandated to pay by law and furthermore stated that they will not even keep me posted on this which will essentially allows the county to post the delinquent property address ( and its owner ) in the local newspapers. Thank you and XXXX Bless!

Complaint: This loan is in foreclosure, and the homeowner had successfully completed a HAMP Trial Plan with the servicer XXXX, making her 3rd payment on XX/XX/XXXX. The servicer then changed to Caliber. On XX/XX/XXXX we received the permanent HAMP modification, however, while the trial payments were for {$1400.00} per month, the permanent mod payments in the first version of the modification we received were for {$1900.00} per month. We pointed the discrepancy out to Caliber 's attorney on XX/XX/XXXX. Three weeks later we received the revised modification agreement with the corrected monthly payment, on XX/XX/XXXX. The agreement stated that it was to be returned by XX/XX/XXXX, essentially giving us just one business day, which was the Friday before XXXX. XXXX was out of town for the holidays and we sought clarification regarding an ambiguous instruction on the modification, for which we received clarification on XX/XX/XXXX. We sent the signed, notarized agreement out that same day ( XX/XX/XXXX ) and Caliber acknowledged receipt the next day. Nearly four weeks later, on XX/XX/XXXX, we were notified that the date was missing on the signature page of the agreement, and that we should re-sign and re-send. Four business days later, on XX/XX/XXXX we sought clarification as to where to send the corrected modification. Caliber 's attorney replied that same day and the corrected modification was sent out the next day. Caliber acknowledged receipt of the corrected modification on XX/XX/XXXX, just four days after Caliber 's attorneys provided clarification as to where to send it. On XX/XX/XXXX, we were informed by email from Caliber 's attorney that the modification was cancelled because the homeowner " failed to execute and return the agreement ''. Caliber 's attorneys also stated that HAMP would no longer be available to the homeowner We believe that timeline speaks for itself. The initial delay was primarily caused by Caliber incorrectly calculating the initial final modification, which they then had to revise. Subsequently, it took Caliber nearly a month to inform us of the missing date and the need to re-execute, which we did promptly. Punishing the borrower for this delay by revoking the HAMP modification and taking the position that it is no longer available is completely unfair. Please help us with this matter, the borrower is terrified that she is going to lose her home. Thank you for your time.

Taking out the loan or lease

Consumer Loan: Installment loan

Complaint: To Whom it May Concern : We closed a Mortgage Loan with Caliber Loans on XX/XX/XXXX. Our initial closing date was XX/XX/XXXX. We have written a time line and can provide whatever documents that is needed as well as a Professional Witness to verify our claims. Our loan was F.H.A. We initially were trying to get Down Payment Assistance. Throughout the whole agonizing process, we never dropped the ball on our end with paperwork. We were told per our Loan Officer ( XXXX # XXXX ) that I could start my part time hours the following week since I was notified mid-week about the status change that was needed. So, I continued the week with the schedule. On XX/XX/XXXX, I submitted my check stub to verify employment. I was told at XXXX ( The Day before closing ) that The Underwriter sent our file to an investigating level due to me making more hours. Ultimately the decision was that we were committing Fraud and we can not get Down Payment Assistance PERIOD! ( It 's remarkable that the loan was approved at all if it was truly flagged for fraud ( flagged 3xs per XXXX ) ) When we asked XXXX why she told me I could work the hours, she carelessly said that the underwriter changed her mind ( changing mind sounds personal not professional ) so that 's why this was going on. ( After Closing I was told that The Down Payment assistance is done at the beginning of the process there was no reason my check stub should have prevented us from receiving Down Payment Assistance. This leads me to believe that our application was never submitted and the story about our file being flagged was just a way to prolong the strained situation. ) She gave no explanation or no apology to her misinforming me. She actually boasted " That she does not work for free that we are going to close '' " She also boasted that " She DOES NOT do the numbers, that going over them was a courtesy ''. We were completely misled about what to do during the process. I was verbally scolded by XXXX, apparently, my tone was too dry for her liking which that conversation ended with me hanging up. I was not going to argue with her. XXXX needs to understand that her fast talking is not a good trait to have and her answers are very important if she is unaware of the answer to a question it 's okay to get back with the Future Home Owner. Her misspeaking prevented us from getting down payment assistance, and made us lose my 4.3 % interest rate, and in turn we had to pay approx. XXXX to close. My realtor asked XXXX did we need to make an amendment for us to receive the XXXX that was promised by the Sellers in the contract she said no. The result of that was us only getting XXXX from the sellers, XXXX less than what was LEGALLY PROMISED and XXXX more that we had to pay. Also, the Underwriter supposedly went over my application more than once, it took the Title Company to find the discrepancy in the numbers and at the last minute we were told we had to bring an additional amount to the table. We did not go over any numbers until we sat at the table to close. The Title Company gave us the numbers. XXXX stated that " XXXX ( Realtor ) could go over the numbers she could n't she had to pick up her son ''. My Loan Officer did not give us that " LUXURY ''. We lived out of boxes for almost two weeks, I had utilities on at a home that I did not close on until a week later. My whole family was completely disadvantaged by the whole situation. I know things can change instantly in the real estate market but one thing should stay the same, Customer Service should never change. A potential Home Owner should be able to trust the Loan Officers Judgement and be comfortable with the info that is given we were not able to do either. It seemed like after we was out of contract they felt like we had to tolerate their ABUSE if we did n't want our time and money wasted.

Complaint: Currently, I am XXXX in the military and my place of residence has been foreclosed on. As a result, I have obtained a military stay, however the associated lender and mortgage company has not respected the court and violated Fair Debt Collection Practices. Caliber Home Loans and XXXX as Trustee for XXXX XXXX have violated Fair Debt Collection Practices. They have sent people to my place of residences to to question my family and roommates. They sent a vendor by the name of XXXX ( XXXX ) to harass my wife and threatened to evict her if she did not sign a document. My wife asked that he would not return to the premises and he came back to harass her on XX/XX/2017 at XXXX. XXXX called her and threatned her to evict again on XX/XX/2017. She and XXXX argued for over an hour. She sent XXXX a copy of her lease via email and he continued to harass the other tenants and scared them into signing the documents. As a result the other tenants moved and left my wife and I stuck with all the utility bills. On another occasion, these XXXX companies have sent someone by the name of XXXX on XX/XX/2017 at XXXX to question the contractors that were mowing the lawn at my place of residence. The contractors informed me of the questions that were asked of them. I have documentation of the emails, letters and court notices that were received by XXXX and Caliber Home Loans. They have violated a number of times. I understand that each time constitutes {$1000.00}. I would like them to pay me for each violation. If they do not want to respect my family then I will take them to court.

Complaint: XXXX-loan # XXXX Docket # XXXX Law date : XX/XX/2017 I expected better from our " justice system '' but, I am not surprised at my outcome. There are businesses similar to Caliber Home Loan, Inc., in existence all over. They claim to be customer specialist but they are not. They prey on the short comings/ misfortune and zero finances to fight properly. In my opinion Caliber Home Loan , Inc., is no more that a collection agency that buys loans and services them until people make one mistake. That one mistake has caused me nothing but disappointment, frustration and XXXX. Paper shows that Caliber tried to work with me, but they really did not. I fought long and hard to modify my mortgage loan on my own, and then through Court Mediation. Week after week, month after month, the same exhibits needed to be redated, refaxed or remailed. In Court mediation myself and the Court appointed mediator handed off the paperwork to the Attorneys office representing Caliber Home Loan , Inc. and they saw that it was passed on in a timely manner. This process went on for a year or more and until recently I got defeated. I have every paper I ever sent to Caliber Home Loan, Inc. I was never sent a letter of rejection. They knew my credit worthiness and I feel they misled me. I have lived here 15+ years and am XXXX years of age. I apologize for being laid off but tried to quickly rebound and get back on board. I was told by Attorneys and others that mortgage companies do not have to work with people and I am sure that Caliber did not want to work with me. Now, I will join the homeless because I could have paid the modification ( which was to be through HAMP ) but Senior housing and regular housing are saturated. What do I want?? I just do not want anyone else to suffer this kind of unnecessary XXXX, XXXX, XXXX and XXXX from Caliber Home Loan , Inc. Thank you for your time and consideration.

Complaint: I was marketed by Caliber Home Loans via a letter. I applied for the refinance of my home with Caliber Home Loans, only after they assured me that a prior Chapter & BK and included foreclosure would not be an issue. I was charged for an appraisal an we supplied all of the requested documentation to process the loan. We are then told that they could not approve the loan based on the BK and Foreclosure. When I mentioned the statement from the loan officer XXXX that she had received written permission regarding this, then the issue of disputes on our credit report were brought up. I requested that information so we could correct those inaccuracies on our credit report. I was told that it would be sent and it was not. Now I am told the the Fanny Mae DU system did not accept our loan file. I believe this to not be true and also feel this process of obtaining a XXXX DU finding would have be done in advance of ordering an appraisal. I feel that our loan file was not processed in a manner to protect us from un-necessary charges of the appraisal fee and I do request an immediate refund of this expense. Thank you.
