Complaint: I took out a mortgage for $ XXXX with XXXX in XXXX. I have made all my payments on time but they have been misapplied by all the alleged servicers since then. In XXXX a fake straw software company called the XXXX XXXX XXXX XXXX , XXXX tried to assign my deed of trust. ( Exhibit C ) Then in XXXX another fake XXXX and XXXX XXXX XXXX again tried to assign my deed of trust ( Exhibit D ). Then at the beginning of this year XXXX, another fake servicer called XXXX XXXX XXXX attempted to assign my deed of trust. ( Exhibit B ). They allegedly made XXXX XXXX XXXX, XXXX. the " Trustee '' but there is a clear conflict of interest and XXXX XXXX XXXX, XXXX. has denied any involvement in my loan. My deed of trust on p. 24 ( attached ) specifically states that only the LENDER can substitute the Trustee. To date I do not have any evidence who the " LENDER '' really is. In fact, none of these private debt collector companies are the LENDER.These companies including the Trustee XXXX XXXX XXXX, XXXX. have not sent my Attorney the requested documentation. ( See letter dated XXXX/XXXX/XXXX attached ). They have not given me an updated running balance of all payments made to date, which leads me to believe all this is fraud and would like for the CFPB to intervene.

Complaint: I 'm currently in chapter XXXX bankruptcy. My mortgage was serviced by XXXX Transferred to Caliber Home loans.On XX/XX/XXXX I received a notice from XXXX that I missed 16 mortgage payments for my first mortgage.I called and spoke with a customer service and he explained to me my payments for the first mortgage we 're incorrectly applied to the second and they would transfer the payments back to the first and all would be current. Three years later at the end of my Bankruptcy Caliber home loans my new servicer answered the final cure payment stating that I 'm not current on my mortgage and I 'm {$16000.00} behind on payments. I called explained to Caliber on two occasions and in a email for payment history from XX/XX/XXXX until XX/XX/XXXX and was told they could n't provide that for me.I also emailed them which they answered and once again in a email stated they could n't provide info for me to call them.I proceeded to call them and they stated for me to ask my trustee for any info owed I explained in detail that 's not what I 'm requesting I need the info for the Second mortgage and they refused.My lawyer also asked their lawyer and they stated they could n't get me the info requested.This is why I 'm looking for information by submitting this form.

Complaint: On XX/XX/XXXX my Attorneys sent CALIBER HOME LOANS, XXXX XXXX XXXX XXXX. and the XXXX XXXX XXXX XXXX C/O: XXXX XXXX, at XXXX XXXX XXXX, XXXX, XXXX, TX XXXX, along with a copy to the Attorney General of Texas, and the Department of Justice of the U.S., FBI, Fraud Investigation Department, along with XXXX XXXX XXXX, XXXX, ( Servicer ), the attached letters requesting TILA documentation under Regulation X and to date, they have still not replied. On my Deed of Trust signed on XX/XX/XXXX ( attached ), specifically on page 13 of 16, number 24, it clearly states that only the LENDER can substitute the alleged TRUSTEE. Yet on or about XX/XX/XXXX, XXXX XXXX XXXX, acting as Vice President of/obo Attorney in Fact for Caliber Home Loans, Inc., the SERVICER, allegedly assigned my Deed of Trust to XXXX XXXX XXXX XXXX, ACTING AS TRUSTEE FOR THE XXXX XXXX XXXX XXXX at the same address as Caliber Home Loans, XXXX XXXX XXXX, XXXX XXXX OK XXXX, which we believe to be a fraudulent document recorded on Public title which is a felony. Also, there is no mention of the assignment of the Note which violates the FCPA, 15 USC 1641(f)(g).

Complaint: Step 1. The complaint is about 2 issues. Issue number 1. Delinquent taxes that Caliber had not paid from XX/XX/XXXX through XX/XX/XXXX that carried over through XX/XX/XXXX. Issue number 2. Since I could no longer refi my house using the VA streamline with the company I initiated the process, I tried to refi with Caliber Home Loans my existing lender. The problem was Caliber took so long at least 37 days to send my delinquent taxes to XXXX County Tax office, the rate that was offered to me was no longer available. I could not afford to bring the {$4000.00} to the closing table and pay my own taxes, so my refi did not go through.
During all this time I received several calls from Caliber Customer service telling me they received a payoff request and they wanted to see what they can offer. I told one lady I was offered 3.25 % and we were waiting to close. So one department does not consult with the other knowing my taxes were delinquent.
Step 2. It took almost 37 days for Caliber to pay my back due taxes. On XX/XX/XXXX I called Caliber tax Department ask them to send in my taxes to XXXX County Tax office in an overnight package. This did not occur, they sent the checks via U.S. Mail when I asked for the checks to be overnighted. On XX/XX/XXXX I was notified that there were late fees and penalties that had been accrued and were not my fault but will be paid for by Caliber. After a week of contacting XXXX County I called Caliber back and discovered that the checks werent actually sent until XX/XX/XXXX. It took Caliber 10 business days to make a decision about paying penalty fees, and then the checks were sent U.S. Mail. I was told that by their customer service in the tax office that the checks would arrive in plenty of time before XX/XX/XXXX and be posted to XXXX County Tax office. I do n't know who made this idiotic decision, because it cost me my refi and having my payment increase.
Step 3. It took Caliber 10 days to approve the penalties and fees before they actually sent the check for taxes and fees with no tracking number, no registered mail, or no way to located the package. By XX/XX/XXXX still no checks have arrived. By now half of my day is spent on the Phone on hold with the XXXX County Tax office or on hold with the Caliber tax office waiting to speak with a supervisor after being transferred several times and having to first identify myself and property address, then explain the whole failed attempt of having my taxes paid. Each time being reassured that checks would post on time.
By now my refinance is on hold because the past dues taxes have not been cleared. This would mean I would have to bring {$4000.00} to the closing table and pay for my own taxes in order to move forward on a VA loan. My loan could not be locked because of this tax delay and rates kept getting worse. On XX/XX/XXXX I spoke to another supervisor who agreed that the checks should have been overnighted from the beginning. By this time the checks could not be located and there was no way to track their location. The taxes with fees were due in full for XX/XX/XXXX and XX/XX/XXXX this time both showing as delinquent.
A new set of checks had to be reissued and sent overnight to XXXX County Tax office. Again I was reassured by XXXX XXXX that the checks would be sent to the county and the fees would be applied on time. The checks did finally arrive at the XXXX County tax office. However, the taxes were still showing delinquent as of XX/XX/XXXX. It was then brought to my attention that on XX/XX/XXXX, the late fees and penalties were being rejected by the county. So I then had to call the county and ask why? Then I had to call Caliber again to ask about the fees being rejected which took place on or about the XX/XX/XXXX. During this time, a supervisor had the audacity to say that another check was made out for the late fees and was sent by U.S. Mail again. So even though this was a time sensitive issue and the Caliber tax department knew of my situation trying to refi my home and needing the taxes cleared, they sent the penalty check by US mail with no tracking number again.
Step 4. Caliber Home loans is the Company involved.
Step 5. Any names of Supervisors that I spoke to are logged in their system at the tax department. THey can not lie about any of the incidents that took place because every call was recorded, and phone call logged with notes. I do recall speaking to 3. XXXX XXXX from the tax department. XXXX XXXX from the Refi department. Clints immediate Supervisor, and finally XXXX XXXX from Customer service at Caliber.
In conclusion, Caliber Home loans has shown complete disregard for me as a customer and for my basic requests of having my delinquent taxes overnighted or matching or beating the rate that was offered to me when I was in the middle of my refinance. There were several requests to have the taxes overnighted to avoid further delays in closing my loan and accruing any more late fees for my delinquent taxes. To add further insult to injury the late fees were sent again on XX/XX/XXXX via U.S. mail without any notification from Caliber nor phone call. At this time my taxes were already showing over due again for XX/XX/XXXX and XX/XX/XXXX. Only with the threat of a complaint filed to the CFPB by me did they cancel the checks already sent out and Overnight them to XXXX County Tax office.
Caliber exhibited very poor communication throughout this entire ordeal. It has been 1 week and XXXX XXXX has still not called me back to tell me what she discovered in her investigation of the situation.
The only time someone from Caliber called me about my Delinquent taxes was on XX/XX/XXXX. When the 2nd set of checks was finally overnighted to XXXX County Tax office. This was 3 days prior to the delinquency date of XX/XX/XXXX. Even though the checks were sent, they were late and the penalty check was rejected and my taxes could not be cleared. This is when a decision was made to have another check sent to clear the penalties but again it too was sent U.S. mail. The other calls I received were from the Collections department asking me when am I going to make my payment? I also received a call from client retention telling me there was a payoff requested on my account and asked me what could they do to offer, even though I had spoken to XXXX XXXX on XXXXX XXXXXXXXXXXXXXXXX/XX/XXXXX/span> they still tried to offer a refi even though I was told they could not do this.
Damages done to the Consumer, 1. My payment is going to increase due to insufficient escrow that Caliber home loans caused and placed the cost on me the consumer. This will affect my loan throughout the life of the loan over 30 years.
2. My refinance into a lower rate did not occur due to Calibers mishandling of my delinquent taxes. I could not afford to bring {$4000.00}. To the closing table and make my regular payment of my refi. I lost my rate of 3.25 %.
3. When I contacted Caliber with and sent them my Loan coast estimate which I started in XX/XX/XXXXXXXX in order to close by XX/XX/XXXX. I was told It was too old at that time. My rate cold not be locked with {$4000.00}. Being brought to closing. Caliber would not offer to Match my rate at 3.25 % nor beat it even though they held my Escrow account and the closing costs would be very low since they are servicing my loan. They could have easily matched the rate and made up for the lost time and emotional stress they put me through for he last 2 and half months in dealing with them while still making my payments.

Complaint: after hurricane Irma I was given 3 months no payment to be added at end of mortgage. due to state of emergency. when I went to pay my XXXX mortgage it stated I was three months late. I contacted company to ask why. They stated they were told they did not have to honor that agreement and I had to pay 4 months now all at once.my job relocated after hurricane & house was for sale. closing XXXX/XXXX/18. they have ruined my credit and lied. we were in a disaster and company never notified me that they were not going to honor the agreement to thousand of people not just me. I want credit fixed and them to honor agreement and let me pay my XXXX and XXXX payment. & restore my credit so I may buy in area I work in now

Complaint: I have a Mortgage Loan serviced by " Caliber Home Loans ''. I trust, " XXXX '' is the Investor, as they sued me for Foreclosure.
My mother XXXX XXXX sometime back and we could not afford the Mortgage payments. Hence we became delinquent and are trying to do a Short sale, for the last 8 months or so, to avoid a Foreclosure on our Credit Report.
My 3rd party submitted several ALL CASH Offers, the last of which was about {$500000.00}. This Buyer is willing to close in 15 Days and take care of all the extensive repairs amounting to around $ 300K ( Inspection Report by a Licensed Inspector and a Repairs Estimate by a Contractor attached ), as also deal with the delinquent tenant. He is Ok with a Short Sale or a Note Sale, whichever is OK with Caliber.
But unfortunately, Caliber is stone walling all the Offers, saying that short sale/Note Sale is not an option at all now. They are not even giving any counter-offer, but only saying that I have only 2 options, namely : 1 ) Deed-in-Lieu ( DIL ) 2. ) Bringing the Loan Current by paying around $ 380K.
I have told them several times already that both the options are not at all feasible, because : 1. ) There is a delinquent ( XXXX ) tenant, who has not paid rent for about a year now and I have started eviction proceedings against him ( copy attached ). I am told, as he is a XXXX person, the Courts would be much more lenient towards him and the case can go on for a year or more. So DIL is not an option at all.
2. ) Secondly, to expect me to pay about $ 380K and bring the Loan current is also a far cry, as I am bankrupt now. In the first place I was not able to even maintain my monthly mortgage payments, which is why, I am in this situation. So the 2nd option of bringing the Loan current, is also not at all feasible.

Complaint: On or about XX/XX/XXXX we applied for a loan modification. Caliber home loans asked me for a lease for my rental property which I submitted via-email. Caliber has not sent me a approval letter or denial letter explaining the reasons for a denial. They have scheduled a sale date for XX/XX/XXXXwhen I feel based on our income and hardship, we should be able to qualify for a loan modification.
We talked to Caliber Home Loans about a short sale. XXXX XXXX, a non-profit agency was willing to purchase our home. An offer was submitted, but on XX/XX/XXXX, Caliber denied the offer saying it was too low. A higher offer was submitted that was near the appraised value. Caliber did not approve or deny the offer. Additionally, we feel the denial was premature because the they acknowledgment letter was not sent until XX/XX/XXXX, but we were denied on XX/XX/XXXX.

Complaint: had a mortgage with XXXX starting in XX/XX/XXXX mortgage was an ajustable rate that was sold transferred and according to mortgage scam of XX/XX/XXXX XXXX along several other mortgage lenders were bailed out and were to help borrowers out but never offered borrowers anything except sell from one mortgage company to another .imy mortgage fell under what was called predatory lending .after 9 years of foreclosure threats. my property went up for sale XX/XX/XXXX by caliber home mortgage and was sold for me to stop sale i had to file a chapter XXXX bankruptcy. this case should have never gone to superior court as it was scheduled to be heard again in clerk of court but as usual attorneys for mortgage lender did not appear for hearing 2 days later i recieve notice from attorney for mortgage company case would be heard in superior court under judge XXXX XXXX in that court it was ruled that the sale be allowed .i feel that this was a case where improper illegal situation happened being that every time for the pass 8 yrs clerk of court always stated that attorney for mortgage lender did not have all paper work needed .this is why i am filing this complaint i have documentation that show false information and the documents were forged .so this is why i am asking cfpb to help me stop any action for sale of my property.i would like to be heard in a court of law with a jury how the mortgage lender an attorney and judge worked together to forge documents cheat and swindle home owners out of there property .i also know that these individuals have very powerful connections threw out the world so going forth with this action could possibly put my life and families life in jeopardy so i am asking for help please i need help .yours truly XXXX XXXX

Complaint: Unfortunately, none of the boxes on the previous page matched my particular situation. Here it is : In XXXX of XXXX I bought my first home. I did my due diligence during the home purchase and hired all of the required " professionals '' throughout the process including an inspector, appraiser, and title company. I also looked up the home on the county tax assessor website to ensure that the local government had the home listed in its current state. Nonetheless, shortly after purchasing the home I received a violation from the city stating that my house was in violation as there was an " illegal unit. '' Now the city is telling me that a large portion of my home was built without permits and is therefore illegal. Furthermore, that I must bring it up to code or tear it down which would turn my 5 bedroom 2 bath home into a 2/1 and would financially ruin me.
I have been working to resolve this situation but simply can not afford to do so. What 's more, I find it difficult to comprehend how a consumer like myself can be legally responsible despite having gone through all of the appropriate steps in the home buying process including going through an FHA approved lender and utilizing an FHA approved appraiser.
I am a public school teacher and this situation has the potential to financially devastate me due to no fault of my own as a consumer.

Complaint: I was affected by Hurricane Harvey and was approved for a forebearance plan on XXXX-XXXX-17 with Caliber Home Loans that would allow me to skip my mortgage of XXXX for months of XX/XX/XXXX, XX/XX/XXXX and XX/XX/XXXX. The forebearnace plan was offered to me, and since I needed to make home repairs, I took advantage of it since I was told my balance would be added to back of the loan and that my payments would resume as normal in XX/XX/XXXX. Today, I fear Ive been scammed. Ive received bills and a certified letter stating Im at risk of foreclosure and the total amount is due. Yesterday I spoke with XXXX in customer service and was told that I could avoid foreclosure my remodifyinh My loan and that it was already going through that automatic process which could result in higher interest rate ( my current rate is 3.625 and he stated it may go up to 4 percent or more. Caliber has taken advantage of hurricane Harvey victims by promoting payment plans via get help hooks on their website and yet developing a scheme that is only benefiting them, and will only hurt their clients. Please help.

Complaint: I have 2 problems with Caliber Home Loans 1. I sold my condo and bought a house in XX/XX/XXXX. In XX/XX/XXXX I received a letter from Caliber telling me I have not had home owners insurance since XX/XX/XXXX. They said they were unaware, they did not know. I called my insurance company and they told me my contract with them was cancelled in XX/XX/XXXX, because I have a chimney coming out of my garage that is unattached. They told me the garage would not be covered but the house was fine. I was unaware that the whole coverage was cancelled. I called XXXX XXXX and got a policy right away. In the meantime Caliber told me they are going to back date a high risk policy from XX/XX/XXXX to XX/XX/XXXX. They sent me a bill for {$810.00} I need to know if this is legal. I would never of gone without insurance if I had know. I thought the mortgage company is suppose to monitor this and let the home owner know. I do not know why after the fact I need to pay {$810.00}.
2.I believe they have red flagged me are now harassing me. They have told me for the last 2 months my mortgage is late. I know it 's not. I have never paid my bills late. I pride myself on this. I paid the first late fee but when it happened. I called and was told they received it on the XX/XX/XXXX or XX/XX/XXXX. In XX/XX/XXXX. I called and they researched and said they received my check on the XX/XX/XXXX but did not post until the XX/XX/XXXX. They said it would be corrected. I received harassing letter and was told to pay the late fee and they will apply it to my principal. I do not have all this extra money for their mistakes. Why are they treating me this way?. They are very incompetent. I would like to be reimbursed for the first late fee because I promise you they are holding the checks and posting them late. Like they admitted to when I called on XX/XX/XXXX.
