Complaint: I believe my home was paid off after XXXX XXXX when ny husband died. No more statements and a broker search found no open mortgages. 2 /3 years later Get statements from Caliber Home Loans, never heard of them and XXXX XXXX served with papers for foreclosure. I wrote NYS DFS and contacted Caliber and Caliber did not have me on for any foreclosure bur I was getting papers from XXXX For XXXX. The week of XXXX my former attorney ( friend in community ) emails me Notice of Sale docs filed with no date but I had a XXXX done Title Analysis which suggests Fraud and said I have case and neither Caliber or XXXX or XXXX are listed anywhere. It lists XXXX XXXX XXXX which is paid off satisfied. It also states {$120000.00} from a closing in XXXX that we were told was an error and looks like it was filed and attached to our refinance. I need to halt court actions while we can prove false, fraudulent documents.

Complaint: This process began the second week of XX/XX/XXXX when my CURRENT mortgage holder contacted me and asked me if I would like to re-finance my loan. I spoke with XXXX XXXX at Caliber Home Loans and he can be reached at XXXX or XXXXXXXXXXXX XXXX turned me over to the loan processor below. Loan processor name : XXXX XXXX at XXXX XXXX XXXX XXXX, XXXX XXXX, XXXX, CA XXXX and she can be reached at XXXX or XXXXXXXXXXXX XXXX XXXX has sent me letter asking me to get statements from my pension plans stating that they are guaranteed for the next 36 months. Apparently the underwriters were unable to understand the language of letter from my first pension plan ( XXXX XXXX XXXX XXXX ) so she contacted them and they sent me a new letter stating that I will receive this pension until myXX/XX/XXXX and I forwarded a copy to XXXX XXXX on XXXX/XXXX/XXXX. However, my second pension, XXXX is a XXXX pension and XXXX XXXX is asking for the same type of letter. XXXX can not guarantee that I will not break their compliance regulations and therefore can not send a letter guaranteeing that I will receive this pension continuously for the next 36 months. XXXX XXXX stated in her letter today that I could get a new letter from XXXX, so I did get that letter but it is the exact same language of a letter that she and the underwriters already have. She also stated that I could forward a copy of the XXXX handbook for the underwriters to read and then they would decide if this is sufficient for my re-finance. Again, this is my CURRENT MORTGAGE holder that I have been making timely payments to since they became my mortgage holder. I ca n't even believe that if I were a working individual ( not retired or XXXX ) that a mortgage company would require that my employer submit a guarantee letter stating that I have guaranteed employment for the next 36 months. No employer would put themselves in a position of guaranteeing employment for anyone for a future period of time. I believe that I was only asked to obtain these letters because I am over the age of XXXX and that I am XXXX. Please help me understand that this is a perfectly legal process for underwriters.

Complaint: My mortgage lender Caliber has failed to apply lump sum payments that were made to cure a delinquency. Caliber has failed to allow me to be considered for ANY type of modification or homeowner assistance plan. As a result I had to file for Chapter XXXX bankruptcy protection and have been making regular payments to Caliber. Then they unexpectedly refused to accept my XXXX and XXXX payment and sent them back and instead have set a foreclosure sale date on XXXX XXXX, XXXX. I am working two jobs and my XXXX XXXX daughters that live with me are XXXX helping out with bills and paying rent. I can afford a fair payment and have paid on this mortgage for close to 17 years, yet Caliber takes advantage of my husband 's XXXX and tries to auction off my home and breaks federal bankruptcy law and also New Jersey law by refusing to offer mediation. We took out this loan in XXXX and my interest rate is 10.45 %. I was earning a good living with my employer that I had been with for 10 years and then he XXXX XXXX. As a result the company was significantly downsized and I was laid off. This put us into a difficult financial situation. Things got worse when my husband XXXX XXXX after a long battle with XXXX. He did not have health insurance at the time and as a result XXXX came after my family and took out $ XXXX from our assets, leaving me flat broke and a XXXX. At that time I began struggling with the mortgage payment and reached out to Caliber to see if there was some type of XXXX forbearance that could be offered. Their agents had no sympathy for my situation and refused to give me any accommodation in my time of need and instead demanded that I reinstate the loan. I was able to find work as a XXXX XXXX XXXX XXXX and continued trying to get Caliber to work with me. Their agents refused to accept a regular payment and continued to demand that I pay back all past due payments as well as late fees and junk fees and legal fees. My mother loaned me $ XXXX and I made a lump sum payment to Caliber in hopes that you would work with me to resolve this matter. However, instead of working with me, Caliber took the payment and did not apply it to my balance, in essence committing mortgage fraud. I demand a full accounting of all payments made on this loan and want to document the application of all payments that have been made to Caliber. Due to their continued refusal to work with me I entered into a Chapter XXXX bankruptcy in order to resume making payments since they would not accept a regular payment. I made the BK payment for a number of months until in XXXX XXXX when Caliber returned my check. This happened again the following month. I tried to contact their agents in order to open a review of my current financial circumstances, but could not gain any traction. Caliber has denied me access to government programs that should be made available to me. I have done EVERYTHING I can to overcome my past financial challenges, but Caliber does not seem to care. I am currently working as a XXXX XXXX XXXX XXXX as well as a second job doing XXXX XXXX XXXX. My XXXX daughters live in the home with me and XXXX help out by paying me monthly rent. If Caliber were to actually take the time to open a review of my current financial situation they would see that I have sufficient income to qualify for government and internal programs. In order to fix this problem I have tried all options -- a lump sum payment, reorganizing my debt through bankruptcy and trying to get Caliber to allow me to be considered for a modification. Throughout all of it Caliber has blocked me every step of the way, and instead of offering mediation as required by New Jersey law they have set a foreclosure sale date. This is wrong.

Complaint: I lost my job in XX/XX/XXXX and was without adequate replacement income until just recently. I originally contacted our lender not long after it became apparent we would not be able to pay our full mortgage amount, and continued to send partial payments as we were able. Submitted loss mitigation application through our lender in early XXXX, and throughout the process submitted all documents as requested. At no time was unemployment forbearance discusses ( did not even hear of this option until this month from another party ), and was not told of Save Your Home California until XXXX, when we were denied assistance by our lender and told we did not qualify for any assistance with our lender. Unfortunately I do not have many documents from along the way, as I was not expecting this outcome and did not take detailed notes about all phone calls, but I have recently informed my lender of our extreme dissatisfaction with their assistance in saving our home, and their lack of information provided about all options that may be available to us. Assistance is currently in review with XXXX, but foreclosure process has been started by our lender.

Complaint: I 've been having a problem with caliber home loans since XX/XX/XXXX. My mortgage did n't have an escrow account on it since I first started it 20yrs ago. The checks kept crossing in the mail when I was trying to pay my property taxes. I finally got it straightened out with the tax commission. They refunded caliber home loans and the escrow was supposed to be taken off my account. This was all cleared within 30 days and caliber told me they would take the escrow off. I got my bill in XXXX and the escrow is still on there. I 've called them every month trying to get it off because they are demanding that I pay more than I owe. I told them I was n't going to pay my bill until they took it off because I never agreed for an escrow to be put on my house. They want me to pay {$31.00} extra a month when my taxes are only {$140.00} a yr. I have begged a pleaded with caliber every month to fix this because I will not pay more than I owe. They refused to do this because I did n't have my account current. This happened to me in XX/XX/XXXXthey put forced insurance on my home because my insurance company did n't inform them that I paid my insurance. They got the notification that I paid the insurance and charged me for the insurance in the total fees charged portion of my statement. I had to bring the account current including the total fees charged. Caliber home loans got a refund from the forced insurance and I had a credit on my account. They told me they would refund me the money once I paid the total charges owed. They whipped out my credit and said that money was theirs. I did n't know I could file a complaint about caliber home loans then. When this started I was not going to let them rip me off again it was over {$800.00} I lost in XX/XX/XXXX. Now because I told them I was n't going to pay anything until they fixed the escrow they put on my account they put my house in foreclosure. I went ahead and made a mortgage payment the middle to the end of XXXX and explained to them I was paying XXXX and as of XXXX XXXX I was paying XXXX and XXXX XXXX XXXX I 'll be paying XXXX and XXXX and XXXX XXXX I 'll pay XXXX and XXXX and XXXX XXXX I 'll pay XXXX and XXXX. After I sent in the check on XXXX XXXX they sent me a refund of the payment I made in XXXX Plus they told me they finally took the escrow off my account XX/XX/XXXX when the filed for foreclosure. They finally did what I 've been fighting them over and put my house in foreclosure and charged me attorney fees for the foreclosure. They could have avoided all of this by taking the escrow off my account when they should have to begin with. Even after they told me they took the escrow off my account XX/XX/XXXX it 's still on my statement. I do n't know why they are sending my payments back trying to make it look like I 'm not making an attempt to pay my mortgage but I 'm not paying for my taxes more than I owe and I 've already sent payment to the tax commission for my taxes myself. I do n't feel my house should be in foreclosure and I do n't think I should have to pay attorney fees for their mistake and trying to charge me more than I owe. They told me to get it out of foreclosure that I would have to pay what I owe in payments plus the escrow and then they would refund me. I 'm XXXX XXXX and I have a mortgage company that is trying to rip me off again and take my home that I 've had for 20yrs now. Please tell me what I can do about this thank you XXXX XXXX

Complaint: Caliber Home Loans mislead me regarding their claims disbursement process regarding property damage loss. This misleading, resulting in me paying for repairs to my home that my homeowner 's insurance company provided funds for, prohibiting me from affording my mortgage payments. Caliber Home Loans has breached their implied covenant of good faith and fair dealing. After suffering damage to my home, my homeowners insurance company paid {$5200.00} to make the repairs. The claim funds was made payable to myself and Caliber Home Loans. The original contractor I was working with was no longer willing to accept payment according to the Caliber Home Loans disbursement process. As a result of this change in contractor, I informed Caliber Home Loans that I would have to pay these contractors using my personal financial resources. After having the 50 % inspection, I received a check in the amount of {$980.00}. Previously a Caliber Home Loans Loss Drafts Department employee told me that after having the 50 % inspection, they would release 50 % of the remaining funds, followed by a 75 % and 90 % inspection and the remaining funds would be released similarly. This was n't the case, they claim that they meant that after the 50 %, they would release another 25 % disbursement so I would have received a total of 50 % disbursement. As a result I had to pay general contractors out of pocket without receiving full reimbursement from Caliber because they released an amount lower than expected. Due to the severity of the property damage, and without the insurance money, I was forced to continue using my own financial resources to repair the property ; preventing me from having the funds to pay my monthly mortgage payment to Caliber Home Loans Despite me submitting letters and receipts showing how much money I had paid out of pocket, and as a result of paying the general contractors out of pocket, I have not been able to make my mortgage payments, and Caliber filed for foreclosure as a result. I have contacted Caliber Home Loans rega rding this matter on the following dates : 1. XX/XX/XXXX ( phone call ) 2. XX/XX/XXXX ( phone call and letter ) 3. XX/XX/XXXX ( letter ) 4. XX/XX/XXXX ( letter ) 5. XX/XX/XXXX ( letter ) 6. XX/XX/XXXX ( letter ) 7. XX/XX/XXXX ( letter ) There attempt at resolution was to have me file for another loan modification. Why should I have to do that because they made a mistake in their communication and I stuck to the loan terms by having the repairs made to the property, despite not receiving the loan proceeds that they are holding XXXX.

They claim the loan is now serviced by Caliber Home Loans but I have still not received an accurate payment history. I wrote the Attorneys the following letter and they have yet to reply. Hello XXXX, My name is XXXX XXXX and I filed a Chapter XXXX BK to protect my home on XXXX XXXX, XXXX, and an automatic stay is pending since it that date. The group of companies you represent filed a Notice of Default ( NOD ) three days later on XXXX XXXX, XXXX. I spoke with them and they said it was an error, that they were sorry, and that they would correct it immediately. It has still not been corrected and expunged from Title as agreed. Also, many of the documents you have filed in the BK are fraudulent, and the Loan Numbers have all been blacked out? I would like to know why? Also, your running totals are totally and absolutely wrong and I have requested a running total balance of payments accounting since the loan was originated in XXXX and am still waiting for it. I would also like to confirm with you that you are debt collectors attempting to collect a debt and therefore subject to the FDCPA. I attach these documents.

Complaint: I have struggled to keep my home for years and during this time I was serviced released to Caliber Home Loans. Working with Caliber Home Loans has been extremly difficult, but I have been persistent and was finally able to receive an approval for a modification to save my home. This was in XXXX, when I attempted to make my first trial payment I was advised that I could only use XXXX XXXX to make my trial payment. This payment was made, but Caliber deemed it late and then refused to honor my modification. I was soon facing another foreclosure sale on my home and proceeded to escalate my frustrations with Caliber by filing a law suit against them in my local superior court. This lawsuit was eventually settled for a loss mitigation review of my options to avoid foreclosure. This was early XXXX and my wife and I eventually seperated and divorced. We decided it would be in our best interest to pursue a short sale so that we could resolve this debt and move on. We do not wish to have a foreclosure on our record. I listed my home, it suffers from deferred maintenance and incomplete repairs from a plumbing problem we encountered several years back. We were unable to fix it with insurance due to being behind on my mortgage-thats another circle of problems. These problems make my home less appealing to a prospective buyer since it is currently not in move in condition and it requires alot of work to make it so. Caliber Home Loans commenced working on the short sale and ordered a Broker Price Opinion on my home. This agent that came out gave modest credits for the repairs needed and my value was set at XXXX. Move in condition homes in my area sell anywhere from 500k-550k. This caused the offer that we accepted to be countered to the XXXX " value '' and the buyer decided that it was not in their best interest to pursue this home. We continued to market the property, received inquiries from different agents but non brought us an offer anywhere near the price Caliber would accept. After several months I finally received an offer from an agent for XXXX. Upon submission of this offer my agent was advised that as of XXXX/XXXX/XXXX Caliber Home Loans would no longer review short sales on any of their private investor loans-which include mine. I was instead offered a Deed in Lieu as a way to avoid foreclosure. This is the nail in the coffin as a Deed in Lieu can not be accommodated for my property, I have a 2nd mortgage, XXXX Arrears and a Judgment that all require contributions from a buyer to release their liens. A Deed in Lieu will not provide that as this process involves me just signing over the property to Caliber free of any other encumbrances that I can not remove unless a buyer pays for them in escrow. Now I am stuck with no other option but to foreclose and Caliber has taken the position to not offer the new buyer a review of the contract we recently accepted. As much as I would like to avoid foreclosure I am unable to do that based off this recent decision. Caliber even offered me an incentive of XXXX to do a Deed in Lieu but I was only offered XXXX with a short sale. Caliber is just holding another carrot on a string in front of me as they are aware of the matters currently affecting the title of my home and have knowingly offered me a program that I could not follow through with. It just seems unfair after all of the efforts I have put into trying to sell this home, we finally found a buyer willing to take this property as-is. I dont know where else to turn to, my searches indicate that I am not the only person facing this problem with Caliber and I foresee many more people falling into an unnecessary foreclosure at Caliber 's hands.
