First it was - I could not get any information about my account XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX # XXXX XXXX, CA XXXX Paid then {$10000.00} Second - XXXX XXXX XXXX XXXX ( XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX CA XXXX Paid them {$9500.00} They put a cease and desist on my account. I could not speak to the bank concerning my mortgage at all. The bank would only speak to anyone except an attorney.
After the first fight I had with XXXX XXXX XXXX and I refused to pay anymore money to them I had to get help.
XXXX XXXXXXXX XXXX XXXX and they all promised 100 % that I had all that was necessary for a loan modification or some type of workout because I had income.
It never happened. my home was put in to foreclosure with a sale date.
I finally got into my account and now I submitted documents to be considered for a modification. I get a pension and I have a job. I don't know what went on when I had no communication concerning my account, but I am asking that Carrington will allow me to get everything they need before they put another foreclosure sale date on my home.
Thank You.

Complaint: I purchased an investment home in XXXX from the VA under their VA Vendee Loan program. The {$130000.00} VA mortgage was processed and held by XXXX XXXX XXXX from XXXX until summer XXXX. I routinely overpay each month to accelerate my principal payback and reduce interest costs. During this time I had no problems in dealing with XXXX, prepaying principal, or correctly crediting my payments and pricipal overpayment to Interest and Principal balances.
In XXXX XXXX transferred my mortgage to Carrington Mortgage Services LLC. Since that transfer, Carrington has repeatedly and incorrectly charged my monthly overpayments as future loan coupon payments, meaning they are not reducing my principal owed when I overpay, and charge/collect the future interest payment on the incorrect loan balance. I regularly call Carrington to reverse the future coupon payments, and reapply overpayment to principal owed. This is a nuisance that I've never had to tolerate with any other mortgage holder, but it seemed to address the problem.
However, during my monthly complaint call in early XXXX, Carrington 's customer service rep claimed he can't reverse interest collected in because 'the XXXX books are closed ', with the result that any XXXX excess principal payments I made in XXXX - that they incorrectly reallocated to future XXXX interest payments - are irreversible and non refundable. I do not see any such clause in my XXXX mortgage documents, and I have never had a mortgage servicer fail to correctly and accurately allocated principal overpayments to my loan balance, and recompute interest per the new balance.
One rep asked that I no longer include principal overpayment within the same mortgage payment check, to ensure it is credited separately as principal. I complied the following month, but the second check was also applied to future interest, principal, and escrow. After one of my calls when the rep agreed to reverse my {$8000.00} overpayment to ensure it was credited to principal balance, the next monthly statement shows the correction was also reversed back to future coupon payments.
I am not a financial scholar, but I believe the term 'fraudulent ' accurately describes this firm 's routine policy of failing to correctly allocate principal payments and recompute interest owed, and failing to correct interest collections due to 'closing the books '. In my understanding, any loan is active as long as there is a balance, and erroneous computations are always subject to correction.
After many months of this recurring issue, I recently decided to pay this loan in full to conclude my dealings with this firm. The payoff amount provided by Carrington this week failed to credit my principal overpayments, overstating my amount owed - their figure does not credit unearned future interest payments that were supposed to have reduced principal in the month paid. I can not get a straight answer or correct loan balance from anyone available by phone at this firm, and from a quick search online, my experience is consistent with Carrington 's unearned interest collection practices with other clients.

Complaint: I am a retired XXXXyr old Veteran with XXXX XXXX service in XXXX on a fixed income. I was retired in XXXX and went into a severe financial crisis by the loss of 2/3 of my income. I have been scammed by several Modification outfits and got no results. I have simply been trying to get an affordable monthly payment that I can make without being broke every month. It took me 2yrs to get my full retirement and that is what started this situation. I was an XXXX in XXXX XXXX with the rank of XXXX XXXX and a rating of XXXX in civil service ( 29yrs ). My daughter and myself lived on {$1700.00} per month for over a year, Even after getting full retirement, I only bring home a little over {$3500.00} per month. When retired my monthly mortgage payment was {$1300.00}. It is not hard to see that one can not make that payment on {$1700.00} per month and still live. I have tried many times to get a fair payment that I can make, to no avail. The supposed loan started in XXXX with XXXX XXXX XXXX. We live in a small XXXX Florida town and I have found out that XXXX was not licensed or authorized to work in Florida then. The mortgage has been sold to XXXX XXXX XXXX XXXX XXXX and is currently serviced by Carrington Mortgage Service. We have recently been served with a summons Lawsuit of Foreclosure. I have been here for 27yrs and it is the only real home I have ever had. My daughter had XXXX for 6yrs and it is the only home she has ever known. To the corporations this is a property, but to us it is our home. I feel that at this time, I can make a {$600.00} per month mortgage payment. If only the mortgage company would work with me. I did have a Forensic Investigation done on my mortgage and they found several discrepancies. I am not trying to get something for nothing, I just want my daughter and myself to stay in our home. Oh, something I forgot, I was divorced in XXXX just prior to retirement. That did not help the financial situation either.

Complaint: I sent a previous complaint XXXX ; this is in follow up.
In summary Carrington Mortagage took over my loan from XXXX XXXX in XX/XX/XXXX per the initial letter. I have been making payments to them monthly since XX/XX/XXXX. They sent me an intent to foreclosure letter. My mortgage payment is {$1100.00}. XXXX at 11.2 % interest rate. I was in touch with them and completed loan modification papers. My payments are automatically sent from my account. The XXXX payment was sent on XX/XX/XXXX and it was returned to the account on XXXX. I received a letter on XX/XX/XXXX stating that they approved me a loan modification, but did not state what the new payment would be, and that they wanted me to make payments of {$1400.00} until the final loan modification documents were confirmed ; starting XXXX.
The letter also said my current loan and agreement was still in place. If that this is the case, then why ask me to pay more than my current mortgage. If I was struggling to pay {$1100.00}, then why would they want me to pay {$1400.00} instead. It does not make sense to me. And why are they not stating up front what the new loan modification payment would be. I donot want to accept any new arrangement without knowing upfront what the new payments would be. That just does not sound like good business. I told you at the beginning I felt like they were deliberately trying to take my home ; this behavior from them seems to be confirming that. I donot know what else to do. They decided to take my mortgage from XXXX XXXX, my question is why if they are not going to help.

Complaint: I responded to the XXXX XXXX XXXX to make a XX/XX/XXXX mortgage payment, where I was informed by the teller that my mortgage account was closed, unbeknownst to me.
I received a letter from XXXX XXXX XXXX indicating that they sold my loan to XXXX XXXX XXXX. During that week, I attempted numerous times to contact Carrington Mortgage ( No answered-awful ) so that I could make my mortgage for XX/XX/XXXX, however, the phone continued to ring with no answer the phone. This went on for about 4 days, where I was able to speak with someone.
The teller informed me that their were not a debt collector. I asked her what happen and why was my mortgage transferred to them, when I was never late with my mortgage payments. The teller informed me that XXXX XXXX XXXX was not following the proper procedures with the loan. She informed me not to worry that I would receive a letter from XXXX XXXX XXXX welcoming me to their company with a statement to pay my mortgage for the month of XX/XX/XXXX. In any event, she also informed me that if I wish to pay my mortgage I could it on-line. After several attempts to make my XX/XX/XXXX mortgage payment, I was finally successful in making my mortgage payment.
However, XXXX XXXX XXXX continues to call me requesting my mortgage payment for XX/XX/XXXX. I informed them that I was sending the mortgage payment via mail ( which I prefer ) and asked them why were they calling me. They called me again with the same request, I informed that I sent in my mortgage payment. I explained that maybe due to the XXXX XXXX we just had. Moreover, they continue to harass me with phone calls about paying my mortgage. When their is a 16 day grace period, in which, I have to pay my mortgage.
Since the Loan Modification with XXXX XXXX XXXX in XX/XX/XXXX, I haven't been late or failed to pay my mortgage payment. I don't understand why XXXX XXXX XXXX continues to harass me repeatedly for no reason.
I am not late with my mortgage payment.

Complaint: Carrington Mortgage Services LN XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX CA XXXX On XX/XX/XXXX we started a short sale with Carrington Mortgage Services ( CMS ). On XX/XX/XXXX CMS claimed their XXXX came in at $ XXXX and they countered the buyer to that price. We sent to CMS the Contractors Bid and the Home Inspection Report for them to review for a Value Dispute. CMS responded by countering the buyer even higher at $ XXXX.
Keep in mind that the Contractors Bid called out $ XXXX in damage to the home, and that does not include the severe issues to the foundation ( See Home Inspection Report, attached ) which will require an engineers report and bid. When you provide evidence to a lender that there is $ XXXX in damage to the home, as well as severe foundation issues, ask them if their XXXX agent took that into account which they refuse to answer, and they respond by countering even higher than they did before, it becomes readily apparent that CMS makes up their own values.
It is obvious that Carrington is refusing to review the extensive damage to the property so that they may do a deed-in-lieu ( which by the way is NOT possible as there is a 2nd TD on the property, though CMS claims they negotiate these with the 2nd TDs all the time ) in order to be able to transfer the file to their retail division which will collect money on the real estate side by listing and selling the property themselves. Refusing to give an appropriate value for the property in order to prevent the short sale from taking place is FRAUD. They are doing this in an attempt to defraud their investor and their own client, and the fraud is happening on many levels within CMS.
This is NOT the 1st time this EXACT COMPLAINT has been made against CMS. Not only are there thousands of other people that have filed complaints for these exact reasons, but we too have already filed complaints against CMS for these same reasons. Please see attached CFPB complaints : # XXXX, # XXXX, and # XXXX.
I am sure CMS is going to attempt to lie to you, the CFPB, regarding the fraud they are committing. We are getting sick and tired of lenders telling us that they outright LIE to the CFPB, then laugh at us for thinking the CFPB would help.
1. Carrington forecloses on properties for their own gain, and defrauds their investor out of a valid payoff of their loan 2. Carrington forecloses on properties so they may transfer the file to their retail division which will collect money on the real estate side by listing and selling the property themselves Please read # 2 again CMS HAS THEIR OWN RETAIL DIVISION THAT WILL LIST AND SELL PROPERTIES TO THE BENEFIT OF CMS. THEIR ONLY GOAL IS TO FUNNEL ALL THE LOANS THEY SERVICE INTO THEIR OWN COMPANY FOR THEIR OWN FINANCIAL GAIN.
We know that CMS has no intention of reviewing this property for a short sale. They never did. They instead want to foreclose on this property and send it to their real estate division which will collect money on the real estate side by listing and selling the property themselves and get paid a commission for the sale. THIS HAS BEEN THEIR GOAL FROM THE BEGINNING.
1 ) We are requesting the CFPB fully investigate CMS and their real estate division because we know from past experience that the actions they are taking are widespread in XXXX California. Their goal is to further profit by selling the home themselves within their own real estate division.
2 ) We want a copy of the XXXX done, as per ECOA guidelines see attached.
3 ) We want an appropriate market value accepted for this property and an approval of the short sale at this market price.
4 ) We want Carrington fined the maximum penalty of $ 1XXXX dollars for continually and purposely committing FRAUD against this homeowner, and since they are defrauding borrower, the investor, and the community, and therefore are not fulfilling their servicing obligations.
5 ) This is not the 1st time this exact complaint has been made to the CFPB. Carrington, in fact, has done this exact thing with many other homeowners.
We will be copying this complaint to the Bureau of Real Estate as well as the States Attorney General on this complaint.

Account status incorrect
Complaint: CMS did not address inaccurate credit reporting. I do not have an open mortgage account with Carrington Mortgage Services as of XXXX The account last activity is not XX/XX/XXXX but XX/XX/XXXX. The account does not have a past due amount but has a XXXX balanace. The amount status is not 31-60 days past due but Pays-As-Agreed. The account is not open but is Closed. The account does not have a balance but is PAID OFF. The Account Status should be Pays As Agreed on XX/XX/XXXX, XX/XX/XXXX, and Paid Off/Closed XX/XX/XXXX. However, CMS did not address any of the original complaint listed above and in the original complaint. The company keeps updating Account Comments on the account in my credit reporting without updating Account Status and Account Last Activity. The company has not updated Account information since XX/XX/XXXX and refuses to addresses these issues after I have called and spoken with several CMS representatives on several occasions. One CMS representative said " We show your account as 'Paid Off '. It is strange why we did not send an update to the credit reporting agencies to update your account. '' Hence, the numerous XXXX complaints. I tried to address this with the company before filing complaints with XXXX, XXXX, and XXXX. The company failed to resolve.

Complaint: In XX/XX/XXXX I requested a loan modification from XXXX XXXX XXXXXXXX.
In XX/XX/XXXX, XXXX XXXX XXXXXXXX confirmed my loan was being reviewed for loan modification and they received all the documentation required and would make a decision within 30 days.
In XX/XX/XXXX before my loan was transferred to Carrington Mortgage, I confirmed what the process would be in regards to my loan modification. I was told that the process would continue with the new lender. They would pick up the process where XXXX XXXX XXXXXXXX left off and I would not have to do anything.
On XX/XX/XXXX, my loan transferred to Carrington Mortgage.
In XX/XX/XXXX, I called Carrington Mortgage to check the status of my account and loan modification. I was told that I has to wait 60 days and I would be contacted. I was told that Carrington Mortgage has to wait for XXXX XXXX XXXXXXXX to send them my documents.
In XX/XX/XXXX, after the 60 days I contacted XXXX XXXX check the status of my loan modification and have been giving the run around ever since. I have spoken with several managers and customer service representatives.
They are refusing to process my request for loan modification and have now sent my loan to foreclosure.
I have informed Carrington Mortgage that they are in violation of mortgage regulations that govern how transferred loans that are in the process of a loan modification are suppose to be handled.
It is now XX/XX/XXXX, and Carrington Mortgage has been increasingly difficult to deal with. Representatives hang up in my face and promise to call back and never do.
I have spoken with XXXX ( supervisor ), XXXX XXXX, XXXX ( XXXX 's XXXX ) XXXX XXXX, XXXX ( another manager ) XXXX, XXXX, and a host of other regular customer service representatives to no avail.
This company is aware that they are in violation of the law and they have refused to correct the violation and process my request for modification.

Complaint: We had a Mortgage with XXXX XXXX XXXXXXXX and in XX/XX/XXXX we negotiated a short-sale with them and had a cash buyer for {$130.00}. We had submitted all the hardship letters, bank statement etc to the bank and everything was agreed for the short sale to proceed. XXXX XXXX XXXX in their efforts to close this sale took myself and husband off the Title - we never signed anything with them to do this. There was a problem with the Title and the cash buyer we had walked away from the property after waiting for 6 months to get possession of the property. We were notified via a Court document that we no longer had any legal rights to the property Because of this we were unable to do another short-sale or anything with the property. We spent many frustrating hours on the phone with XXXX XXXX XXXX trying to get this matter rectified. We spoke to every department sent letters and emails to no avail. I spoke to deed in lieu department and they told me I could not do a deed in lieu because we were not on the title.
In XX/XX/XXXX our loan was sold to XXXX XXXX XXXX. They contacted us to find out what was going on with the mortgage. I explained the situation to them. They said they would look into the matter and see if we could do a deed in lieu. I asked the representative that I was working with if there were be any consequences in doing this with them and he said no they would just take the property back and we would be done with it. I heard back from Carrington Mortgage stating that their attorney came back with the title report and advised that myself and my husband were not on the title to the home. There was a court ruling that took our names off the title back in XX/XX/XXXX - as stated above we never signed any court documents with XXXX XXXX XXXX. Carrington Mortgage also states that the previous servicer, however, never released the lien and reported the transfer complete. They stated that we did not have to sign any further documentation with them.
Our credit report were severally affected by all of this and I asked Carrington Mortgage if they could clear our credit reports. Their reply was there may be a way to have the credit reporting fixed so the loan does not show up after you and your husband were taken off the title in XX/XX/XXXX. They asked us to draft a letter giving an overview of the situation starting with our hardship up to dealing with the XXXX XXXX XXXXXXXX and trying to get this sorted out. They said once they received this letter, my supervisor and I will take it to our Vice President and get working on fixing the credit. They did fix our credit. Clearly they could see from the documentation sent to them that we had a case.
I received a XXXX stating that we were personally liable for {$140000.00} which I am now expected to pay taxes on. I sent an email to the person I have been dealing with at Carrington Mortgage on XX/XX/XXXX stating that my understanding was that after talking to you that this debt would be forgiven once you cleaned up the title. I asked him at the time we spoke on the phone what were the repercussions of you taking this property back and itw as stated that there would be none " we will take it back and it will just go away. It was never disclosed to me that we would be personally liable for the debt.
I have left 3 messages for XXXX XXXX to call me back and none of my calls have been returned nor do I have an answer on my email that I sent on XX/XX/XXXX.
I called Carrington 's customer service division today and spent an hour on the phone with various people all stating that they can do nothing about this. How can we be personally liable for a debt when we do not own the house? We had a clear agreement with the XXXX XXXX XXXXXXXX back in XX/XX/XXXX for a short-sale that they messed up - and they took us off the title leaving us with no recourse.
I do not know who owned the house after XXXX XXXX XXXXXXXX took us off the title or why they could not complete the short-sale but I do not believe we are personally liable for anything on a property we did not own.

Complaint: My loan was recently transferred to a new mortgage lender known as Carrington Mortgage. Ever since this transfer Carrington Mortgage has been receiving my regular monthly mortgage payments and has refused to apply the additional funds sent with these mortgage payments to my escrow account. I have sent multiple requests made multiple phone calls and yet the company refuses to apply the funds accurately and correctly. Diring this month alone I currently have {$310.00} sitting in a suspended in a account in which I am unable to have moved over to my escrow account. My payment is due on the XXXX of each month but I have until the XXXX to complete the full payment for the current month. Upon making these requests I had to had to reach out several times to make numerous complaints about these additional funds I sent not being moved to my escrow account. I advised my current lender that I am not late on my mortgage payment and therefore have the right to have the funds in which were submitted to them, applied accurately and correctly. This is been an ongoing battle with our to my mortgage account. I was provided misleading and inaccurate information multiplte time and I believe this company is violating my rights underneath the Real Estate Practices Act. In addition to the mismanaged of funds, when I asked for a comprehensive breakdown of my payments ; a detailed loan history as to where my funds were being applied and where they were being held, along with what my regular monthly mortgage payment was I kept getting misleading and inaccurate information Everytime. I've complained to Carrington Mortgage that my current mortgage statements are not matching the application of my payment throughout the online portal in which they provide as the payment history is showing unclear payments and different amounts than what's being submitted. I am extremely concerned as I believe Carrington Mortgage is inaccurately and illegally misapplying funds with an intent to manipulate these funds to embezzle money. This company should not be allowed to conduct business as a mortgage servicer until they can ensure consumers are provided accurate and complete payment records. Please investigate this issue further as I believe as a homeowner I shouldn't have to fight my mortgage provider for this information.

Each time I called to see when the checks would be sent I was told that I was missing paperwork for the contractors o myself. Each time I sent the same documents. Now we are in the month of XX/XX/XXXX in which I called yet again to see if my modification was complete. I was told yes that I was denied because I have a low interstate. I never received a letter saying I was denied then on Saturday XX/XX/XXXX I received a letter from XXXX XXXX XXXX saying that my house is going to be foreclosed in the next 30 days if I did not make a payment in full.
