Complaint: On XX/XX/XXXX, XXXX filed a judgement against my homestead property in Texas. We have owned and lived in and claimed this home as our homestead since XXXX. The property address is XXXX XXXX XXXX, XXXX, TX XXXX. The judgement Case # XXXX, Instrument # XXXX. This judgement was for an unpaid credit card debt. I acknowledge the debt, however, the judgement should not have been placed on my homestead property. I have been unable to refinance my home due to this judgement. I've tried to work with XXXX and then Capital One ( judgement was sold from XXXX to Capital One ) since XX/XX/XXXX when I discovered the lien. They prepared a partial release but it was never recorded. When we tried to refinance our home in XX/XX/XXXX, I discovered that the release had not been filed. I've been trying to work with them to re-prepare the release and get it re-filed since XX/XX/XXXX but I've had no luck. I most recently spoke with XXXX, XXXX, XXXX and XXXX at XXXX who have all attempted to assist, however, they've been unable to provide either an original release for me to file or have their legal team send the release to the county for recording. I need to refinance my home as I was recently ( XX/XX/XXXX ) laid-off and had to take a job paying considerably less. Capital One is preventing me from doing so and as a result I may lose my home and ruin my credit because I can not pay my bills at my reduced salary. My account # with Capital One is XXXX. I am happy to file the release myself ; I just need them to prepare it and send me the original so that I may do so. Again, I have been trying to resolve this issue since XX/XX/XXXX.

Complaint: I was using my first credit card with XXXX XXXX XXXX and I was unable to afford the payment on months due to being unemployed and a student. There were 2 missed payments in XX/XX/2016 and there has been nothing since then. I am working diligently to rebuild my credit score so I am able to save up and buy a home in the next couple years. This would be amazing to get off my report.

Complaint: So I have a credit card with XXXX XXXX XXXX XXXX my balance was {$1300.00} I called to say that this was going to be paid in full the middle of XX/XX/XXXX ( i called the begining of XX/XX/XXXX to let them know and they said that would be fine ) and they should have noted my account so I wouldn't get charged a late and have no more charges. I called today XX/XX/18 and they said they couldn't reverse the late fee of {$25.00}, really!!! They got the full amount of {$1300.00} paid in full and they cant reverse a one time late fee??? they are saying that because i had one reversed in XX/XX/XXXX they cant do another one but in this situation the card is paid off and I will be closing account and so they should be able to waive this fee!! Now this wasn't even my fault that it took longer than expected which I had mentioned to person when I called capitol one to get total balance amount.

Complaint: On XX/XX/XXXX I went to look at a XXXX XXXX XXXX used SUV on the lot at XXXX XXXX XXXX Georgia. When I got there I informed the 1st person that talked to me his name was XXXX that I had emailed with XXXX XXXX and XXXX XXXX and that I had my own financing of up to {$14000.00} he joking said {$15000.00}. He got XXXX out to talk to me and I informed him of the financing and he opened the vehicle for us to look at. XXXX comes out and I tell him about my financing and then XXXX comes back and says you do not want this vehicle it takes synthetic oil and premium gas. Ok I was getting ready to leave as I only came in to test drive the XXXX XXXX SUV. XXXX says come in and let me see if XXXX has better interest rates than XXXX. He said it would be maybe a half point on the credit score as he was doing soft inquiry. I also explained to him that I was still shopping and had an appointment to see a vehicle in XXXX XXXX at a dealer I also explained this to XXXX when I saw him, I was only doing preliminary shopping for a used SUV. I also told him if he had a used manual transmission on the lot he needed to get rid of to let me know. He gets my information and disappears for about 30 minutes. When he comes back I specifically asked him are you checking with BANKS on my behalf and he said NO and left again and went back into another office. Another 30 minutes passes and I was getting ready to leave as I did not think it took that long to find out what XXXX interest rates were. He then takes me over to XXXX XXXX desk and XXXX writes on a scrap piece of paper that he can get me a XXXX new XXXX XXXX manual transmission for {$480.00}. a month. I started laughing and was getting up to leave and he said what can I do to get you to buy this vehicle today. I laughed even more I thought this was all rather funny as I had told him now on several occasions that I had my own financing even showing both XXXX and XXXX the email from XXXX and that I was still shopping and had plans to see more used SUV 's in the next several days. He said we can get you the new XXXX XXXX manual transmission for {$11000.00}. and it will be {$480.00} a month. I said no thanks and left. My XXXX year old son was with me and will attest to these facts also. The next day XXXX calls up and says good new we can get you in the XXXX for {$390.00} a month I was like what ... I told him that I had already told him on several occasions I was not ready to buy nor was I shopping for a new vehicle. Then I get notification from my bank that several hard inquiries had been run on my credit. I contacted the 3 lending institutions that I saw and inquired if any were XXXX financing none were. I contacted the manager of the dealership to give him a chance to correct this wrong. He said he was not there that day and he would check for me. He called back and said that XXXX had not informed the assistant manager that was there that day that I had my own financing nor did he tell him that I was shopping for a used vehicle. That XXXX had informed him that I desperately needed a vehicle. I did not give any one permission to try to get me financing nor did anyone ever ascertain from me the terms I would want to obtain a loan or even how much down payment I had as this information was already in my loan application with my bank XXXX and I had been approved for a loan through them for up to {$14000.00}. on a used vehicle of my choice. The manager said he would not contest when I sent my letters to the credit bureau that they ran unauthorized loan applications without permission using my information. But I find this practice very unethical and they lied to me and I am sure running someone's credit information without permission is wrong and should be prosecuted. I have further received a letter from XXXX that says they declined to give me a loan. I called them and told them I did not apply for a loan with them. They were not interested in finding out that XXXX XXXX XXXX Georgia ran this without my permission. It would seem that every bank that XXXX XXXX XXXX Georgia pulled into this scheme of illegal behavior would also be culpable. I am not sure of the number of times they applied for credit for me without my permission or knowing how much I had to put down or any terms that I would want to complete a loan. The manager said XXXX never checked XXXX financing and that would only take a phone call and he did not need my information to ascertain the interest rates from XXXX. This seems to have been deceptive from the beginning nor has anyone informed me the interest rate or any other relevant information that I would need to make a determination. This was deceit from the beginning and these actions have been detrimental to me. These actions have harmed me as now the interest rate of my approved loan will be adversely affected by the deceitful actions of XXXX XXXX XXXX Georgia. Complaint: On XX/XX/2018, I sent a letter to Capital One Auto Finance to dispute information they were reporting on my credit report about an auto loan I had with them. They responded to my letter by sending me a print out of payments they say I made to them. However, according to the Fair Credit Report Act ( FCRA ), they were also supposed to report to the credit reporting agencies that a notice of dispute be placed on my accounts within thirty days, which they failed to do. On XX/XX/2018, I sent them another letter advising them that they did not comply with the FCRA by issuing the notice of dispute. I then checked my credit report on XX/XX/2018, and they still had not put the notice on my accounts.

Complaint: I fell behind on y credit card account, and capital one contacted me, saying that if I made 3 on time payments on my account, they would reinstate the account after 3 third payment was made. After 4 on time payments, the account is still restricted, yet they keep telling me to wait, and wait, and wait. I understand they can conduct business in any way they see fir, I just dont think it is right to blatantly lie to consumers after you have offered them an opportunity to resolve the issue and make good one the agreed upon conditions for reinstatement

After reviewing the fees query on the screen I cancelled the transaction and retrieved my card ( no atm receipt was given since I had cancelled the transaction ). The following transaction occurred on my XXXX statement : ATM Withdrawal XXXX XXXX, XXXX XXXX XXXX XXXX XX/XX/2018 ( {$340.00} ) Since this withdrawal was cancelled by me before completion no cash or receipt was received. I promptly notified my bank and they looked into it but declined to reimbursement and closed my dispute. They did provide a document from the bank but it was in XXXX and provided no resolution. I will attache this document.

Complaint: On XX/XX/XXXX after my mother died I called Capital one and canceled my mothers card. I was contacted by my father who is XXXX and was told that he can't reorder his drugs or buy food since his card was also canceled I spoke with multiple reps and supervisors and they refused to reinstate or send a card without a 10 day investigation. They even claim it was canceled by the automated system which is not true. I called and they didn't ask for a death certificate but only for her card number which is different. She was not the main holder and almost everyone agreed his card should not have been canceled. I spoke with supervisor XXXX and XXXX agent # XXXX. I have e-mailed corporate and everyone refuses to help. My dad is very frail after my Mom 's recent death and twice they called him on the phone and got authorization for me to speak but didn't even note it. I have spent hours on the phone and no one will help. Even contacting corporate was no help. They say they have no other process to help. My father nor I needed this type of uncaring company response.
