Complaint: I initially called on XX/XX/2019 to inquire because I was not allowed to make transfers from the account or pay bills. They told me the account had been closed for over thirty days. I was never notified of this. And beyond that, the account was still accepting and notifying me via emails of accepted deposits indicating that the " funds were successfully deposited and would be available on XX date. '' ( over 6 deposits were accepted ). I have all of these emails from multiple deposits. I was never able to access these funds and it's now been over 18 days since I started this process of getting my funds -- and I still can not access my business funds. They initially told me to file new paperwork to change the business address as they couldn't send my funds to a personal address. I am a single member XXXX so that doesn't seem right, but I obliged. I've sent that same form multiple times ( over four times ). Each time I call about it I get a different reason why it hasn't been viewed, i.e. " we are still reviewing forms from XX date ( usually a date over 2 weeks prior ), and when we get to it -- it will then be 7-10 days until we can process. '' I was told last week that " it wasn't legible '' ( although I could clearly read it from the same email attachment ), and so I sent it again in a PDF form which they requested. Here we are yet again over 7 days later and no response, account still showing open online, and my funds have not been moved from the account. I'm a small business owner and I can not live, can not pay bills, can not pay clients with all my money tied up in Capital One Spark Business site. Right now I've been on hold since XXXX, and it's XXXX now. Still on hold. This is every time you call. And when you do get somebody on the line they have an excuse or another reason that it's going to take an additional 7-10 days to even get something reviewed. I can not wait any longer. I need to pay bills and my other account is now experiencing fees from overdrafts, negative experiences with clients that are not able to be paid, inability to keep trade services on which is how I run my day to day business, etc. So I'm out additional monies on top of the funds they are holding of my business and clients. I filed a complaint with the FDIC and they referred me to you. I'm just hoping someone will help me. I'm in an extremely bad situation and I don't know what recourse I have. Thank you. Sincerely

Complaint: Capital One did not respond to my request to provide competent evidence that bears my signature that I authorized them to review my credit repost nor did they provide proof they contacted me on the number listed on the extended Fraud Alert on my credit report. Capital One claims an auto dealership gave them permission. There were three other financial institution that also checked my credit report at the same time. They have completed their investigation and concluded it was a " fraudulent inquiry. '' The other financial institutions and car dealership have taken steps to remove the inquiry from my report.

Complaint: In XX/XX/2018, Capital One sold my mortgage and my HELOC to two different loan servicing companies. In XXXX, I received 1098 tax forms from both loan servicing companies. However, these only reflect one month 's worth of interest payments. Capital One has not provided XXXX forms for the 11 months that they were my loan service provider. I looked online for my tax forms and they were not available. I called Capital One customer service and they said that " Capital One has chosen to exit the mortgage loan servicing business '' ( yes, I knew that already ). They said that I could write to the former address to which my loan payments were sent but they expressed doubt that they were required to send me any tax forms. I can not seem to find a human at Capital One who thinks it is their job to send me the tax forms that are required..

Complaint: Payment made on XX/XX/2018, in the amount of {$200.00} and payment made on XX/XX/2018, in the amount of {$460.00} were both applied solely to the interest of the loan and not the principal. When I made the payment I asked for the money to be applied to the principal, the teller in the bank said they had no control over what the payment applies to and to call the 800 number. I contacted the 800 number and was advised that I could not pay on the principal and had to apply the payment to the interest. After speaking to multiple people, they all told me the same thing.

Complaint: XXXX XXXX XXXX should be fined for their illegal practices .... I initially contacted them last year asking to validate the judgment from them for capital one. First of all I was never served properly I had no idea about this complaint. I wish to fight the entry of a default judgment obtained based on lack of notice. service of the summons did not result in actual notice in time to defend the lawsuit, the entry of default was the result of " mistake, inadvertance, suprise or excusable neglect ''. I reached out to capital one the original creditor who stated they do NOT have any pending dues from me there was no debts to them from me. I served this notice to XXXX XXXX XXXX who ignored the letter and now went through with judgement and garnished my bank account where I receive my social security income. I contacted XXXX XXXX XXXX to inform them that my income is except from garnishment and that capital one stated in writing that I do not owe them anything .... they AGAIN ignored my request and now froze my accounts. I contacted DAs offices and now preparing my complaint to them will file this week if this is not resolved and lien this false judgement is not released ... XXXX XXXX XXXX also issued a false statement to Capital one in their attemps to renew this debt stating that " LAST PAYMENT WAS RECEIVED ON XX/XX/2017 '' IT IS A LIE, FALSE AND FRAUD. I never made a payment to them this should not be ignored ...

Complaint: Back around XX/XX/2018, I noticed Capital One Credit Cards showing up on my Credit Reports. I promptly sent a request for information from the company, about the alleged debt in a form of a loan. Capital One ultimately took two of these accounts off my report. But left one still remaining on my reports. So I continued to question this alleged account, I did not recognize. Every time I ask them to provide me answers to questions Ive asked, they have answer with generic answers back. Thus not providing important information, that they as business should be able to answer. I literally wanted some with first hand knowledge to answer my question. But time and time again I received generic response, that wasnt even what I was inquiring about. This we back a forth for a while. Recently they have filed a lawsuit. In this law suit they include a affiliate, that supposly is someone of first hand knowledge. That says I owe them money. What is interesting is this person NEVER answers my questions I sent to Capital One. Its not till they filed a lawsuit, this alleged XXXX, comes forth. So I believe she are lying about having firsthand knowledge of this alleged loan. She never contacted me once. Even, when I requested to speak with someone with first hand knowledge. Their action speak million words. They have not been able to prove they made a legal loan and complied with Truth and Leading act. This is why its so suspicious they decide to sue, instead of answering my questions.
