Complaint: I applied for a loan modification with my lender Bayview. I have since then have been approved for a loan modification. I have made my trial payments on time and have followed all of their instructions. I was sent my final loan modification documents on XXXX XXXX. Since then I have signed and sent the notarized documents back to the lender THREE times, keeping in mind to send it with the return envelope THEY provided for the return. I was recently sent a 3rd packet exactly the same as the previous XXXX to be signed again. I spoke to the lender and the representative told me it was normal for that to happen and to resign and send back. I did just that. Now today I followed up with the lender to confirm they received the fed ex and was informed that my loan modification was in the processes of being denied for failure to return the signed agreement on time. Which is ridiculous since I did so THREE TIMES.

Complaint: XX/XX/XXXX, XXXX transferred my loan service to Bayview Loan Servicing ( BLS ). Since I made my XX/XX/XXXX payment to XXXX, my payments were not starting until XX/XX/XXXX. During this time, I was at the last few months of my bankruptcy, and BLS had to submit a payment history, form XXXX, " Response to Notice of Final Cure Payment ''. This report indicated that I was 2 months behind. After review, I noticed discrepancies in the report. Based on my agreement with the court, I had to make all monthly payments. I submitted a inquiry to BLS along with information pertaining to my account to correct the issue. Over the last 9 months, I have been trying to resolve this issue. XX/XX/XXXX, I was given a point of contact, XXXX XXXX. My understanding was she was familiar with my account. She wanted me to apply for a loan modification. I told her I did n't want that, I just wanted her to review my account. She proceeded to tell me to go through the mod while case is being reviewed. Told her I would n't qualify, because I was working and making a nice income. A month goes by, not approved for the reasons I stated. It just seemed that BLS wanted me to endure more fees and {$750.00} appraisal fee. After all this, XXXX XXXX had none of my inquiries in my file and she could not even give me any information. Continued my inquiries into my account. On XX/XX/XXXX, I received a letter, I had to XX/XX/XXXX to bring my account current or foreclosure will be accelerated. On XX/XX/XXXX, I contacted BLS was given my point of contact for my account. His name XXXX XXXX. I set a phone meeting On Friday, XX/XX/XXXX, I started talking about my account and to discuss my inquiries into my account, to find out he has none of my information in my file. So 9 months of communicating and nothing in my file. I had to email all my documents so he could send to the research department for review. Since then, XXXX had communicated he would set up a payment plan and once the results from the review was complete, he would let me know. On XX/XX/XXXX, I received a response letter concerning my payment history from XX/XX/XXXX to XX/XX/XXXX, as well as, the missing 2 payment months BLS is stating I am missing. BLS could not supply me with any information prior to XX/XX/XXXX because they did n't service the loan. This is inaccurate because the BLS representative had to review my history to submit the form to my court trustee. This tells me that BLS has not thoroughly reviewed my account. My point of contact, XXXX XXXX, is doing the same thing XXXX XXXX did, trying to modify. I will not qualify because I work and my money to expense ratio is fine. It seems BLS just wants to continue to charge me fees rather than try to resolve my issue. I have supplied my bank statements, spread sheets, court docs, etc.. I even communicated to XXXX customer service. The last customer service rep I spoke with, stated that all payments were accounted for when account transferred along with my payment history. The rep did suggest I talk with BLS and have them re-set their bankruptcy system and log information.

Complaint: My parents, XXXX and XXXX XXXX, obtained a loan from XXXX some twenty years ago relating to flood damage to their home in XXXX. They made payments on the loan for years. They are both now deceased. XXXX XXXX passed away on XXXX XXXX, XXXX, and XXXX XXXX passed away on XXXX XXXX, XXXX. Both died intestate, and without assets. No estate proceedings have been, or will be, commenced. Bayview is attempting to collect the loan despite the fact that both parents died without assets. In addition, Bayview is attempting to collect this debt from the decedents ' daughter, XXXX XXXX, who bears no legal responsibility for this debt. They are sending demand and collection letters to XXXX XXXX at her address at XXXX XXXX XXXX, XXXXXXXX. The decedents, XXXX and XXXX XXXX, never resided at XXXX XXXX XXXX. Finally, Bayview is falsely misrepresenting that this is a mortgage debt and that there is a mortgage on XXXX XXXX XXXX, XXXX XXXX 's residence, when that is not, in fact, true. XXXX XXXX is an apartment complex.

Complaint: Bayview Loan Servicing failed to address all our questions and provide all documentation as we requested in the last complaint. Per CFPB guidelines, we are able to file another complaint. First, Bayview stated that the loan originated was with XXXX XXXX ( which is correct ) but also stated that during Bayview 's servicing of the loan the investor was legacy. Bayview failed to provide documentation that XXXX XXXX transferred or sold the Note and Deed of Trust over to XXXX. Also, without documentation, how does Bayview know if XXXX was the investor or not? Without documentation, it is safe to assume that XXXX was still the investor when the Substitution of Trustee and Full Reconveyance was notarized on XXXX XXXX XXXX and recorded with the XXXX XXXX XXXX XXXX Office on XXXX XXXX XXXX, instrument # XXXX. Please answer all our questions and provide documentation as requested! Second, we requested to know what dates, amounts paid and to whom did Bayview send out payments too. These documents will prove if fraud also occurred with this mortgage loan. As you well know, fraud is against the law and it is the responsibility of all Federal and State agencies to prosecute these people or companies that violate our laws! Now, Bayview stated in the response letter dated XXXX XXXX XXXX to the CFPB, in the inquiry XXXX XXXX states the following ; ( item XXXX ) who did Bayview pay the monthly mortgage payments to, for how much and what were the dates when payments were made. Please provide documentation. ( XXXX ) Now, please review my initial complaint with the CFPB. There was no mention of " XXXX '' in our complaint. Also, Bayview provided dates and payments made to Bayview ( copy of the loan history provided ) but failed to provide dates, payment amounts to the investor and who the investor ( s ) were with all their contact information. If Bayview sent our payments to the investor, Bayview would still have the records! So, why did Bayview fail to answer all our questions? Is Bayview aware that XXXX XXXX and all affiliates went chapter XXXX bankruptcy in XXXX, in XXXX Delaware? Is Bayview aware that XXXX XXXX closed the business and was ordered to sell all their assets? Please answer all our questions and provide documentation as we requested! Third, Bayview stated in item XXXX, we are unable to provide an assignment of mortgage as the loan was released directly from the original lender. Now, this statement means that Legacy did not release this loan ( XXXX ) but rather the original lender, XXXX XXXX. Also, with XXXX as the nominee for XXXX XXXX, it is safe to assume that the XXXX that was issued was not signed by XXXX XXXX, our original lender. The XXXX was signed on XXXX XXXX XXXX by XXXX XXXX, which claims to be an Assistant Secretary of XXXX. Per a court order, from the Department of Treasury Comptroller of the Currency ( O.C.C case # XXXX ), this Cease and Desist order clearly reflects that XXXX is an institution related to tracking and registering residential mortgage ownership and servicing, acting as mortgagee or record in the capacity of nominee for lenders. So, why did XXXX have Bayview Loan Servicing, have an employee, XXXX XXXX sign the XXXX when Bayview and XXXX XXXX is fully aware that he does not work for XXXX nor collects a paycheck from XXXX XXXX XXXX mis-represented himself as an assistant secretary of XXXX knowingly that he works for Bayview Loan Servicing! So, did n't XXXX track the assignments as they were supposed to do? Did XXXX collect the payments from Bayview and keep them or did XXXX in fact send all the funds too XXXX XXXX after XXXX went bankrupt? XXXX is only the nominee for the lender to do what the lender wants. XXXX is neither the lender nor the investor which means that they do

Complaint: My wife and I applied for a refinance in early XX/XX/XXXX of our Florida property and we were consequently denied because Bayview Loan Servicing LLC is now claiming that our loan modification was more than 180 days delinquent. This was not on the credit reports when we got the original mortgage loan in XX/XX/XXXX. Our account with Bayview ( XXXX ) has been paid as agreed since the contract started in XX/XX/XXXX. We have diligently been working with Bayview since XX/XX/XXXX and provided them with the necessary documentation to resolve this issue. We have supporting documents including a payment history from Bayview Loan Servicing showing pay as agreed and that our loan is current. We even filed a dispute with XXXX to have this remove from the credit report. XXXX is in agreement that the loan was paid as agreed. We had made several attempts at communications with Bayview 's customer service department only to get the same response that we need to send over the credit report to us to review and we will get back to you. This is has been happening for the past 2 months with no resolve in sight. Can some one please help us to resolve this as it is ruining out credit standing. Thank you!

Moreover, now due to my file being flagged for dual tracking and for Bayview Loan Servicing directing their employees not to provide me with Asset Manager 's contact information, I have no choice but to file with the Consumer Financial Protection Bureau and protect my rights. BAYVIEW LOAN SERVICING EMPLOYEE XXXX RIDICULES XXXX WOMAN AND REFUSES TO GIVE HER ( SINGLE POINT OF CONTACT INFORMATION ) ASSET MANAGER 'S SUPERVISOR 'S SUPERVISOR 'S PHONE NUMBER OR EMAIL. I told XXXX I was trying to reach my Asset Manager or my Asset Manager 's supervisor. I told XXXX I received a letter from Bayview Loan Servicing dated XX/XX/2016, stating I had contacted Bayview Loan Servicing and declined a Permanent Modification. I told Chance THE LETTER WAS WRONG I HAVE NEVER CONTACTED BAYVIEW LOAN SERVICING AND DECLINED A PERMANENT MODIFICATION, because I had never received a Permanent Modification. I also indicated to Chance that I had made all three of my trial modification payments ahead of time and that I was going to continue to make my mortgage payments and that I was now going on the 6th payment in the trial. Complaint: Bayview loan service took over the servicing of loan number - For XXXX DATE XX/XX/XXXX. This company has missed manage this loan the the principal is constantly being manipulated.There seems to be some kind of fraud with the principal balance on the documents. When I called in and asked about the loan customer service told me that the loan was 13 months behind and i said how can that be when you have been getting the payments.She asked if i was in a loan modification i told her we were not in any loan modification. Then my wife called in on XX/XX/XXXX and customer service XXXX tells her that there is {$7800.00} in a suspense account she said to her why do they have it in there she said she would move it over and that it would take 24 hours to show up in the account. Then my wife called in on XX/XX/XXXX and XXXX said there is {$480.00} in the suspense account. The original loan amount -XX/XX/XXXX- {$81000.00} Loan amount on XX/XX/XXXX- {$89000.00} Loan amount on XX/XX/XXXX {$88000.00} Loan amount on XX/XX/XXXX {$88000.00} Loan amount on XX/XX/XXXX {$86000.00} On the XX/XX/XXXX to XX/XX/XXXX. The suspense account had {$1900.00} in it. They applied the money from the suspense account to the loan. The balance was brought to {$86000.00} date XX/XX/XXXX. I want to know why this account has so much inconsistency with it and what happened to the {$1900.00}. Now the balance is back to {$89000.00} after what looks like they did some type of reversely on this account. I have sent documents to show some of the inconsistency on this account. Deliberately creating a technical default or wrongfully declaring a default in order to generate fees and penalties.

Complaint: Bayview Loan Servicing continue to violate consumer financial protection laws of dual tracking foreclosing on our home while we are in an active workout. Bayview Loan Servicing has started a foreclosure or foreclosure sale in violation of loss mitigation rules. Starts a foreclosure or foreclosure sale in violation of the loss mitigation rules. Bayview Loan Servicing is actively foreclosing on our home after we have made XXXX payments on time and continue to make payments. The trial modification plan called for us to make XXXX active payments on time. Although Bayview Loan Servicing has failed to provide a permanent modification package until XX/XX/2016, we will continue to make payments. On XX/XX/2016, Bayview Loan Servicing claims I stated to an Asset XXXX that I declined the Permanent Loan Modification Documents they sent me. Bayview Loan Servicing stated " On that same day XXXX XXXX spoke with the Asset XXXX and stated that she declined the Loan modification offer. '' 1 ) Firstly, after our second Asset XXXX, XXXX XXXX left Bayview Loan Servicing failed to notify me of who my new Asset XXXX was. 2 ) The third XXXX XXXX never answers her phone and therefore I always leave multiple messages and she never returns phone calls to discuss the loan. 3 ) Bayview Loan Servicing continues to harass us and discriminate against us due to our XXXX by blatantly lying and making false accusations to cover up their neglect, unfair practices and. I would like to make this perfectly clear I NEVER DECLINED ANY PERMANENT LOAN MODIFICATION DOCUMENT FROM BAYVIEW LOAN SERVICING ON XX/XX/2016. I did n't receive any documents from Bayview Loan Servicing for a Permanent Modification Documents until approximately XX/XX/2016. Therefore, it would have been impossible for me to have stated to an Asset XXXX at Bayview that I was declining permanent modification documents I DID N'T HAVE. Bayview Loan Servicing claims they called us on multiple occasions and we did n't answer. 1 ) Bayview Loan Servicing NEVER called on the dates they indicated or multiple occasions. On multiple occasions I have sent qualified written request to Bayview Loan Servicing, Bayview Loan Servicing has failed to acknowledge my letter. Although Consumer Financial Protection Laws state Bayview Loan Servicing has failed to fix the error within the XXXX to XXXX days ( excluding XXXX, XXXX and XXXX holidays ). Bayview Loan Servicing has also failed to send us the information we requested or investigate and explain why no error occurred or the information was n't available. Bayview Loan Servicing has failed to state why they think they did n't make an error, and has failed to explain in writing why. Bayview Loan Servicing has also failed to explain why the information is n't available.

Complaint: On XXXX XXXX, 2016, in a previous phone conversation, I spoke with XXXX XXXX of Bayview Loan Servicing regarding a letter I received on XXXX XXXX, 2016, from Bayview Loan Servicing stating " you notified us that you did not want to accept the offer. '' I told XXXX XXXX that I never notified Bayview Loan Servicing that I did n't want to accept the offer because I had never received the offer from them. XXXX XXXX became very combative and angry with me he stated that 's not what the letter said. XXXX XXXX also became extremely combative, angry and aggressive regarding permanent modification documents Bayview Loan Servicing claimed they sent that I never received until XXXX XXXX, 2016, with Permanent Loan Modification documents dated XXXX XXXX, XXXX Although I indicated to him over and over again that I never received the first set of documents and that the second set were water damaged and late and that I had notified Bayview Loan Servicing of this, and that I was back and forth between the hospital dealing with a terminally ill husband and had been checking the porch everyday, XXXX XXXX LITERRALLY ATTACKED ME, BULLIED AND HARRASSED ME AND WAS ANGRY AND AGGRESSIVE BECAUSE AS HE STATED BAYVIEW LOAN SERVICING MANAGEMENT AND SUPERVISORS HAD GAVE HIM PERMISSION TO DO SO, and he is bullying me XXXX XXXX STATED SO WHAT PEOPLE DEAL WITH STUFF EVERYDAY AND SOME PEOPLE LIKE YOU DO N'T WANT ANY HELP AND INSTEAD OF FILING COMPLAINTS WITH THE CONSUMER FINANCIAL PROTECTION BUREAU you should sign the predated XXXX XXXX, 2016, Permanent Loan Modification Documents that Bayview Loan Servicing dated XXXX XXXX, 2016, and put into a XXXX dated XXXX XXXX, 2016, that I did not receive until XXXX XXXX, 2016. Bayview Loan Servicing XXXX XXXX XXXX Manager was very angry, aggressive and combative with me and kept accusing me of not wanting help and not wanting to sign the permanent modification documents. XXXX XXXX told me it was going to be all bad for me if I do n't return permanent modification documents by tomorrow. XXXX XXXX ALSO ATTACKED ME ABOUT THE COMPLAINTS I FILED WITH THE CONSUMER FINANCIAL PROTECTION BUREAU AND CHISTISED ME ABOUT THE {$1.00} COMPLAINT. Complaint: On XXXX XXXX, 2016, XXXX XXXX, made it totally clear that the reason why Bayview Loan Servicing is going to deny me a permanent modification in 37 days unless I signed the permanent modification violating my rights to give up the right to a trial by jury for the past, present and continuous wrong that has been done to our mortgage by Bayview Loan Servicing and XXXX XXXX XXXX. I completed my three trial modification payments in XXXX 2016, and have continued to make the payments ahead of time for 5 months. XXXX XXXX kept accusing me of receiving permanent loan modification packages that I did n't get. I told XXXX XXXX that I called Bayview Loan Servicing on numerous occasions notifying them that I had n't received a permanent modification package. I also told XXXX XXXX that I notified Bayview Loan Servicing when the second package came wet unreadable and late. XXXX XXXX became aggressive and combative stating Bayview Loan Servicing had the right to dual track my loan. He also stated that Hamp ends on XXXX XXXX, 2016, and after that Bayview Loan Servicing was going to foreclose on my home. He made it totally clear Bayview Loan Servicing Management is upset because I exercised my rights and filed complaints with the Consumer Financial Protection Bureau. XXXX XXXX also made it clear that I had no rights concerning the permanent modification no matter if it did violate my rights. XXXX XXXX also indicated Bayview Loan Servicing Management and Supervisors had flagged my mortgage file for these types of aggressive attacks toward my mortgage account.. XXXX XXXX , of Bayview Loan Servicing LITERRALLY ATTACKED ME, BULLIED AND HARRASSED ME AND WAS ANGRY AND AGGRESSIVE BECAUSE AS HE STATED BAYVIEW LOAN SERVICING MANAGEMENT AND SUPERVISORS HAD GAVE HIM PERMISSION TO DO SO, and I would try to get my Attorney to look over documents tomorrow XXXX XXXX STATED SO WHAT PEOPLE DEAL WITH STUFF EVERYDAY AND SOME PEOPLE LIKE YOU DO N'T WANT ANY HELP AND INSTEAD OF FILING COMPLAINTS WITH THE CONSUMER FINANCIAL PROTECTION BUREAU YOU NEED TO SIGN THE PERMANENT MODIFICATION PACKAGE AND FORGET ABOUT YOUR XXXX ILL HUSBAND BECAUSE UNFORTUNATELY WHEN DEALING WITH A PERMANENT BAYVIEW LOAN SERVICING MODIFICATION THEIR IS NO HUMAN ELEMENT TO IT. Basically my interpretation of that statement is XXXX XXXX, Bayview Loan Servicing Supervisors and Management feel as if because they have flagged my account to foreclose anyway that they do n't have to treat me human that my rights, my families rights, the five months that I have been paying ahead of time on my mortgage loan do n't matter because I am not human to them. Bayview Loan Servicing wants to harass me into signing away my basic constitutional right to a trial by Jury so that they can foreclose on my home BECAUSE BAYVIEW LOAN SERVICING AS STATED BY THEIR EMPLOYEE XXXX XXXX DOES NOT SEE MY FAMILY AS BEING HUMAN. Because XXXX XXXX was on speaker my daughter recorded him because as she stated he was so mean to me. Per documentation, we were paying XXXX, and then we started to pay Bayview XXXX XXXX for this loan. On XX/XX/XXXX, Bayview Loan Servicing recorded a Substitution of Trustee and Full Reconveyance with the XXXX This document states ; the undersigned does hereby affirm that this document submitted for recording does not contain personal information about any person. Mortgage Electronic Registration Systems INC as nominee for XXXX XXXX, it 's successors and Assigns is the present Beneficiary of that certain Deed of Trust dated XX/XX/XXXX made by XXXX and XXXX XXXX, husband and wife as joint tenants as XXXX with XXXX as trustee for the benefit of XXXX as original Beneficiary which said Deed of Trust was recorded on XX/XX/XXXX. Complaint: In 2014, our mortgage was sold to Bayview Loan Servicing , LLC . Since the recession of XX/XX/XXXX-XX/XX/XXXX, we have had difficulty paying our bills on time. Regarding our mortgage, the payment is due on the XXXX of the month, and we usually pay by XX/XX/XXXX, before a late fee is charged. There have been months where we were behind by 30 days, but have caught up. The company always calls us after the XXXX of the month, with multiple phone calls, until we pay. Recently, they did not receive our homeowner 's insurance information and set up an escrow account, thereby increasing our monthly payments. The insurance has been resolved and we have paid all of our monthly mortgage payments. Because of the escrow account, they are not applying the amount that we pay to the mortgage, but to the escrow account. When I called to make the XX/XX/XXXX and XX/XX/XXXX mortgage payment, they say that I am delinquent on my account. I have spent numerous hours on the phone trying to resolve this issue. I just sent an overnight letter cancelling the escrow account - even though I never asked them to put it on the account - as they told me that was the only way to resolve it. My main complaint is I want the phone calls to STOP. We feel that Bayview Loan is targeting us because my husband is XXXX.

Complaint: We received a notice of foreclosure from XXXX in XXXX. We attempted to modify the mortgage and have correspondence noting that due to health issues and the disrepair of the property we could not maintain the current mortgage. We hired an attorney to complete Deed in Lieu which required that we put the property up for sale. Followed all directions. No offer. Contacted XXXX to complete deed in lieu, informed that representative could not speak to us. Notified XXXX we could not keep property at current payment. Moved in XXXX XXXX. House in foreclosure. Received notice that Bayview was now mortgage company ( servicer? ) They began sending mortgage statements and asking if we wanted to remain in home. We again made it clear we can not afford current rate and asked about the deed in lieu in which we paid an attorney to handle sale of property. Bayview said all we needed to do was sign a document verifying deed in lieu. Received instead request for new information. Bayview 's correspondence and telephone messgages indicate that they are a debt collector ; however, they have incurred two additional years of debt on a property we have repeatedly told them we can not afford. XXXX sold a mortgage for a foreclosed property with the intent of accumulating additional debt on a property that had already been foreclosed upon. I have XXXX XXXX. My husband has XXXX XXXX. We are unable to afford the cost of emptying out the property. Yet we continue to receive mortgage statements for a property we did everything to avoid foreclosure upon, to no avail.
