Complaint: I applied and was approved for a loan modification with Bayview loan servicing. They messed up the first modification and issued me a second as a courtesy, but did n't notify me of the mistakes. I worked with a housing counselor who was the one to first find out about the mistakes. I made payments toward the 1st trial modification but they told me it was the wrong amount because they gave me a second modification and that amount was higher. So the modification is now void and my house is in foreclosure. Also, my house was damaged and the insurance company told me send the check to bayview. I did. Bay view kept telling me the check was sent to loss and found. Long story short they cashed the check ad lied to me for months telling me they did n't know where it was. Even after keeping my XXXX check ( which was more than enough to keep me out of foreclosure, Im scheduled for foreclosure in less than 30 days. Please contact me I fell this is wrong on so many levels and they are trying to steal my home.

Complaint: Bayview Loan Servicing , LLC took over my loan from XXXX XXXX XXXX, after the Federal Government found XXXX XXXX XXXX guilty of improper mortgage modification and I was awarded {$2000.00} dollars and they were to complete trial modification. They did n't, they sold it to Bayview. Bayview has delayed, denied, stalled the loan modification for years now and continues to say they either did n't get requested documents, when I have proof of delivery or they just deny it outright ; telling me they represent the investors not the mortgage holder. This is criminal. They improperly send notices through their attorney prior to even sending decisions trying to foreclose, even during my XXXX and especially on Holidays hoping I was not home. They need to be reprimanded and fined for not following federal guidelines just at XXXX XXXX XXXX was.

Complaint: My loan used to be with XXXX. I really like being able to pay in the branch & know my payment was correctly processed. The loan has Bayview Loan Servicing now for over 2 years. I make my payments online because on the auto-pay features states that if my payment fall on a holiday or weekend & is not process by the XXXX I can be subjected to a late fee. Every month I login & schedule a payment usually around the XXXX or XXXX avoiding weekend/hoildays. I noticed that my payment was n't withdrawn from my account as schedule. I call & they said that my payment cleared & to give it a few more days. I checked again the next day & it was shown late- with a late charge & additional fees. They said that it came back as a bad account number. I asked them what they show & the rep said that they do n't keep that info. I told them that its the same account that I always pay from & that I am never late. After over a 1/2 hour on the phone I was able to get the fees reverse & proceeded to make a payment thru then phone so I can be current. They do n't make it easy to pay them. You are not able to save your payment info & you ca n't see your info after a payment is scheduled to verify if the info is correct. If you make a payment after the XXXX, they charge you extra. You get calls saying your late starting on the XXXX of the month-everyday until the payment clears your account. They do n't even check to see if a payment is schedule. They call all hours of the day. Its the biggest monthly bill I have- I do n't need a daily reminder that it is due. legally I have until the XXXX to make my payment until I incur a late fee. I have great credit but I feel that I am treated like a some kind of low life because I qualified for a loan modification. I feel like I am in some kind of collections program & is subjected to harassments if they do n't pay my mortgage by the XXXX of every month.

Complaint: Due to XXXX, XXXX & loss of jobs we could not make our house payment. We had a loan with XXXX and a XXXX loan with XXXX XXXX ( {$25000.00} ). We talked to our realtor who said to do a shortsale. She listed in XX/XX/XXXX at {$85000.00} ( XXXX shortsales in the neighborhood ). We received {$120000.00} which the buyer agreed to. She waited a month then terminated because she found another house that was not in shortsale. The house went back on the market and we received an offer XX/XX/XXXX for {$120000.00}. On XXXX XXXX notified us that the servicing of our loan was being transferred to Bayview Loan Servicing LLC on XX/XX/XXXX. But then moved it back further to XXXX. So we could not do anything during that time. Since we have been working with Bayview we had XXXX different negotiators in 5 months. We have had a qualified buyer since XXXX who still wants the house. Bayview has had an investor who still to this day has not said yes or no to the loan ( XX/XX/XXXX ). This company has called and harassed us and more important has called and harassed our parents who have nothing to do with our loan. If they needed paperwork XXXX has everything they need. She has been working on this offer for 8 months along with our Realtor. XXXX had been calling our Realtor each week to make sure the house was in pending and still going through. On XXXX our Realtor went to check on the house and found a flyer on the window from XXXX saying they were going to board the house up and change the locks. Our Realtors sign was out front in plain sight and had a sign saying " contract pending '' along with a lockbox for agents to get in. She went to XXXX and tried to find out what was going on. She did have a loan officer call someone to notify them the house was in pending. Bottom line is we have had a qualified buyer for over 5 months and the offer is being sat on! They could have their money and we could sell the house.

Complaint: The original price of the mortgage was to be {$340000.00}. When we got to closing the price had been increased wothout prior warning or explanation by {$60000.00}, which was the exact amount the lender allowed for repairs and other improvements to be made to the property, however, so how the mortgager increased the price by that amount. Due to the drastic nature of price and/or fees change ( increase ) presented at the closing, there is reason to believe that there were violations of both the Truth in Lending Act and RESPA. The price of the residential mortgage was increased by {$60000.00} at the closing, without warning, nor prior discussion, thus increasing the price to {$400000.00} for an older XXXX bedroom home, very predatory pricing for the particular area. It is hoped that the reasoning for this can be uncovered and rectified during the course of this investigation, and any resulting negotiations.

Complaint: I have been working in getting a loan modification for over a year with Bay view. Going back and forth on getting documents to them with no responses from the Specialist they say are designated to my file. Recently, they asked for a documents ( a P & L ) which was provided to them within hours. I called to confirm receipt with the Asset Manager XXXX XXXX and unfortunately he was not available. Another Rude Representative within his department XXXX XXXX, took the call. When i asked whether they had received the document she said i had to speak with XXXX XXXX and rudely and adamantly advised that i was wasting my time and the sale date of XXXX/XXXX/17 would not be stopped. When i asked her why, she just went on to say that because we provided the documents were provide 7 days prior to a sale date.. She even verified in her system that the documents were requested on XXXX/XXXX/17 and they were provided the same day. How can they do such a thing and pull my home from under me in that way? Request documents and then say no we cant help you? I need your help! I have a sale date approaching XXXX/XXXX/17 next week Wednesday.

Complaint: We currently have a loan with Bayview Loan Servicing. Our loan had been sold to Bayview from XXXX bank, which they are in their full right to do. We had requested a loan modification in XXXX 2016. We had provided all the requested documentation and final tax document that they requested. We faxed and emailed to the loan modification person. Then she left and then we were assigned to another loan person. I again was asked for the same information that I had already provided, which I did again. Then I kept getting letters asking for the same information again. I have tried calling and emailing the loan rep numerous times without any return call or response. I even tried to get a hold of the asset manager and left messages, again with no return call. I finally gave up on my loan modification as they refuse to respond to me. Complaint: I have an adjustable rate mortgage loan that has a very high rate of 9.45 % with very little going towards the principle. It also has a balloon payment of {$440000.00} due on XXXX XXXX, XXXX. In XXXX my loan amount was {$620000.00}. Today my loan amount is {$600000.00}. Over the last 10 years I have paid over {$500000.00} in payments with little reduction in the principle. I did not receive an amortization schedule and have not been able to get one from my mortgage servicer. I have complained many times to the mortgage company and my loan is either sold or the loan gets transferred to a new servicer. I have recently had a significant drop in income and could not make the payment. I have requested a loan modification under the HAMP program which was submitted in XXXX of XXXX. I am sure this would qualify as a predatory loan because of the high rate, non amortizing and excessive balloon payment. My monthly payment is {$5700.00}, of which {$4700.00} goes toward interest and only {$280.00} for principle. This is a loan that would not be made today. It only benefits the investors and makes it impossible for the borrower to repay.
