Complaint: We purchased a home via a VA Loan ( XXXX ) XX/XX/XXXX. When we closed on the home we paid for XX/XX/XXXX home owners insurance in 1 lump sum payment, paid 75 % of the upcoming estimated county taxes, and then requested/set up a separate a prepaid escrow account that would cover the taxes for the year. We ( us/lender ) agreed my husband and I would cover the principle and the remainder of the payment would be drawn from the escrow account. We set this up specifically due to XXXX of XXXX of our children to ensure we would be able to afford both medical expenses and not have to worry about falling behind. Our mortgage was sold soon after, and we continued to pay what we initially agreed to for the next 3 months, assuming the agreement would carry over. XX/XX/XXXX, our payment was deny ( bill pay ) stating the reason as 'no such account '. The payment was setup after closing and never change. All previous payments were sent and received on that account without issue. I called XXXX and no one was able to tell me what the problem was for 4 days. When I called back to see what was going on. I was told that XXXX would no longer honor the agreed upon payment amount ( even after I sent them the emailed discussion with the lender stating the agreement ) and I needed to make the full payment this month and every month going forward. I made the full payment for XX/XX/XXXX and then requested ( by phone, email, and letter ) that our escrow account be closed and sent back ; since the agreement would not be honored and we could use those funds to help with the payment. XX/XX/XXXX ( full ) payment was received and held by XXXX, but never applied to our loan. XX/XX/XXXX we were notified of the XX/XX/XXXX payment return, stating we owned XX/XX/XXXX-XX/XX/XXXX missing payment amount ( {$500.00} per month x3 = ~ {$1500.00} ) before they would accept any further payments. Well, we have a terminally ill child and had nothing extra due to his medications/expenses. I asked them about the escrow account and if they would draw from there. I was told no and then I was told they never received my escrow account request. Yet, I have the email read receipt. XX/XX/XXXX, XX/XX/XXXX, and XX/XX/XXXX payments were also held for a time and then returned. The problem concatenated before we realized what was happening. XXXX was unwilling to work with us, unwilling to tell me who our lien holder was when asked on 3 separate occasions and when XXXX XXXX taxes came due, they held off on paying them until XX/XX/XXXX. They were due XX/XX/XXXX. I have XXXX delinquent notices with late fees. Payment for the late fees wan never made by XXXX. XXXX enacted Bayview Loan Servicing to assist with collecting payment or hardship assistance. In XXXX, we applied for a loan modification through Bayview as outlined in their letter. XX/XX/XXXX, we received a request for add'l information ( due by XXXX/XXXX/XXXX ). The information requested was sent back by the due date ( emailed using the submittal instructions and email listed on their website ). Yet, today is XX/XX/XXXX, and I have yet hear any response or status update ( no call, no email, no letter ... ). I have n't been able to speak to our correspond with a single person in regards to this matter since applying XX/XX/XXXX. When I call, my name/number are taken. When transferred to voicemail, Im asked for a mailbox number to retrieve my messages. My emails go unanswered. Today, I returned home from my sons XXXX to a foreclosure notice.

Complaint: My son and family wanted the property but they were not able to keep up payments I helped for years but XXXX XXXX I could no longer assist. My loan was originally with XXXX where they allowed me to try a short ale sale to avoid forclosure. After 18 months on market a bid came in and at the that time loan was sold to Bayview Loan Servicing Loan # XXXX and they rejected it so at that time I requested a deed in lieu. On XXXX/XXXX/XXXX I have sent application and since then repeatedly sent documents including the application package twice XXXX XXXX, XXXX then on XXXX they request final document which was sent now on XXXX/XXXX/XXXX the same documents are being requested. over again they were sent either to their document email, processors email or XXXX. And still have issues they have n't received them. Today I again emailed them. It is difficult to get someone on phone. I held 15 min when I asked for a manager then gave up. I would like to be approved for deed in lieu or they can advise me they will move forward with forclosure.

Complaint: I keep receiving mail and all correspondence from this agency claim that he purchase my mortgage from XXXX XXXX along with my United States XXXX on XXXX XXXX, 2017 XXXX XXXX left a letter envelope outside my door in this letter was advertising from Bayveiw Loan Service offering me to Cash for my Key to my house that withdrawal {$50000.00} from my pension to put the downpayment down stating that I Get cash to help you move to a new home accept this offer today. My pension was without and paid for me to move here why would this agency ask me to release my title of my home and all contents in the home to them for {$2000.00} is this legal please investigate this agency ensure that it legal to offer a home owner and all misconduct and mismanagement found all individual involved be convicted according to United States Federal Regulations

Complaint: submitted my file for loan modification review in XX/XX/2016 with Bayview Loan Servicing. I have sent my documents and have contacted my Relationship Manager and have received no response. I am working with a XXXX company XXXX who also contacted Bayview on my behalf only to be advised they have not received a Third Party Authorization which has been sent on numerous occasions. Complaint: My home mortgage originated with XXXX Mortgage and was transferred to servicing by Bayview Mortgage a couple of years ago. At that time, within a couple of months, my XXXX ARM ( with XXXX remaining years on it ) was modified to interest only payments based on 40 year payout without my permission or consent. When the 10 years was up and my mortgage was set to adjust ( downward due to lower interest rates ) I sent Bayview a qualified Respa complaint insisting that they adhere to the terms of my loan and give me notice 60 days before adjustment to XXXX XXXX XXXX 1 year rate + 2.25 % margin rounded to nearest 0.125 %. The interest was I was informed changed from 6.625 % to 4.625 % based on 20 years remaining ( not XXXX or XXXX ) because it " could n't change more than 2 % on any single adjustment ''. I had made payments of principal in advance and for a month they moved my money around in and out of different categories from escrow, to interest, to payments and it took them over a month and several phone calls for them to finally get it right. Then, all of a sudden my interest rate went down to 3.375 % with no explanation. I paid XXXX, XXXX and XXXX payments. I went to pay my XXXX payment ( in advance as I do when able ) and all of a sudden my interest rate is 3.875 %. It seems Bayview changes the terms of my mortgage and interest rates willy-nilly with no consent, notification or explanation. I am worried the next adjustment ( s ) will be detrimental, as they do not follow what is written in my " note ''.

Complaint: Dear Bayview I am continuing modification process from prior servicer XXXX I am concerned as to if there is a sale date or not, as conflicting information is being received. The trustees confirmed the sale date is suspended on the record. I received different information from Bayview. I want to keep my home. If you would assist me in making sure all parties have the same information Bayview XXXX XXXX Company Bayview stating I must sign a new assistance form with Bayview before modification can be complete- I received form XXXX/XXXX/2017. Bayview letter stated if there was a modification in review with prior servicer - the modification would continue. Has Bayview received mortgage records from XXXX XXXX XXXX. I am confused on the process at this time receiving conflicting information. Would you confirm if prior servicer has forwarded a complete file I appreciate your time greatly
