Complaint: I just received a letter from Bayview Loan Servicing a debt collector who is threatening to foreclose on my home. They acquired the loan from XXXX. The original lender, XXXX failed to transfer the mortgage and the promissory note to XXXX. Because of this, there has been no payment on the loan in six years and eight months prior to Bayview Loan Servicing, a debt collector " acquiring '' the loan. Under Michigan statute the debt is Time Barred. ( Six years is the statute of Limitations on Promissory Notes in Michigan. ) Bayview Loan Servicing , LLC is threatening to collect on a Time-Barred Debt. Please investigate this Debt Collector.

Complaint: I am unable to pay mortgage because of hardship due to over extended expenses and medical problems. I therefore applied for home loan modification to XXXX. While the process was going on, they sold my loan to Bayview Loan Servicing. For two months I keep calling customer service and they report that they are unable to help because the loan has been sold. I recently receive a notice that the house is foreclosed and a sale date is XX/XX/2017. I receive no notice from Bayview of the sale.

Complaint: I submitted a form for a XXXX, a mortgage assistance program, to my mortgage servicer, Bayview XXXX XXXX XXXX. At this time, my mortgage is at XXXX XXXX % and the monthly payment represents more than 65 % of my gross monthly income. I started the process XX/XX/2016 and now after XXXX representatives and sending all the documents needed. It is clear to me that they have not presented my documents to the government program, XXXX. It is clear to me that Bayview XXXX XXXX is catering to the investor who is holding my mortgage, XXXX. With interest rates so low, why would they release my mortgage to be amended under the XXXX program. They did n't submit my application and denied my request to submit it. I tried to refinance but my income is too low so I was denied. I have been paying for 11 years and am current but it is very difficult for me at this time to continue paying such a large portion of my income to stay in my house. The government should be going after the loan servicing companies because they are abusing people like me.

Complaint: I did a re-fi with First Mutual they then sold it to XXXX which went out of business.I was then contacted by XXXX XXXX XXXX Who stated that My FHA mortgage was assigned to them and that my {$900.00} a month mortgage would be {$2300.00}. I immediately contacted them and told them that since I 'm a Veteran that my mortgage could not be assigned to them without a face to face and authorized by the VA. They then filed foreclosure paperwork through the court. Out of fear and lack of knowledge I paid them until I was financially strapped. My Wife had to have a XXXX which caused me to stop paying XXXX completely I saved up enough money to hire a law firm XXXX XXXX XXXX XXXX. The firm placed me in a XXXX XXXX lawsuit against XXXX and they backed off and stated that my mortgage had been securitized and that Bayview Loans Servicing LLC would be my new servicer. Again out of fear of loosing my home I paid Bayview a total of {$9600.00} {$1800.00} a month for 6 months because they threatened foreclosure via the same debt collector lawfirm XXXX XXXX XXXX that XXXX had used. After paying the 6 month trial period for a modification which the results from the XXXX Bayview sent paperwork to file for a modification that they said I had already been approved for. With lawyer fees and false modification payments I 'm out about {$20000.00} and Bayview is threatening to sue for foreclosure again. Like I stated earlier I 'm a Veteran with a sickly Wife and just want to pay fair market value for my home Bayview states that I owe them {$320000.00} and my home was appraised at {$150000.00}.

Complaint: I received a letter from Bayview in XXXX stating that I had successfully completed my loan modification program. It detailed that Bayview would be reviewing my monthly payment, interest, escrow and principle amounts and adjust my account accordingly. Then I would be contacted once this process was completed. I am unsure what happened internally in regards to closing my loan modification. As I have not received any additional notification from Bayview. My account is currently showing 3 months past due and I am receiving letters from Bayview about financial assistance. I recently received a letter stating that I have been assigned to a specialized team to assist in bringing my loan back on track. It stated that I need to contact them for assistance. I have attempted contact 15 or more times. An automated system states that their office is closed. However, I am calling during business hours. My loan is not off track ... My payments have been drafted via EFT from my account each month. I have spoken with several associates and supervisors, in an attempt to remedy this issue. I have been told that tasks and requests have been opened to ensure my outstanding payments are applied. Bayview is currently holding {$2200.00} in suspense. I have notified Bayview by phone, their online portal and email. I have requested a copy of my payment history and note in an attempt to facilitate a review and correction. In addition, I have notified them that I would file this complaint if these issues are n't resolved. In addition to the payment issues. I have requested that my name be updated as I was married in XXXX. I have uploaded the required documents directly to their website as well as emailed them. An associate did confirm that this documentation has been received, my name has still not been corrected. I am unsure how to proceed at this point, as there has been no resolution and all numbers I have tried to call have produced a automated response that the office is closed.

Complaint: Had mortgage that sold and they wanted to refinance at lower rate, They never got around to the refinance and account was caught up, then it was sold again. My payments were not being pasted to my account but was put into an escrow account. My mortgage did not have an escrow account but they refuse to give me credit for my payments. They are trying to force us into refi at a much higher rate and keep increasing my payment .But they keep taking my money but not giving credit. Complaint: My home mortgage was sold without warning by my local bank ( XXXX ), to a national mortgage loan service company, Bayview Loan Servicing LLC in XX/XX/2016. XX/XX/2016 I received notice from the XXXX XXXX 's office indicating that the taxes on my property had not been paid. My mortgage is calculated to include escrow for property taxes and home insurance. After numerous telephone calls, emails and postal mail, I have not gotten a response from Bayview and the taxes remain unpaid. It is the worst customer service I have ever experienced from any company in my lifetime. Each time I call, I get a different person who only gives their first name, and can not sufficiently answer any questions, nor even provide a supervisor 's name to answer any questions or achieve any resolution. I have received no response to my email or postal mail, both of which provided verification documentation of the unpaid taxes and the specific property parcels in question. It is unfair to pay a mortgage that is supposed to include enough to cover the property tax and insurance, only to have taxes go unpaid and accrue late fees. I feel that I must somehow find the money to pay the property taxes until this is resolved and then likely fight a new battle again to get the money back or have it deducted from future mortgage payments. I am current on my mortgage payments and have not been late. XXXX weeks ago I received an escrow analysis statement indicating that I needed to pay {$340.00} in order to account for a shortage. I mailed in a check for that amount on XX/XX/2016 and I have not received any acknowledgement of that payment. I believe this company is customer-unfriendly and unresponsive to questions or concerns. There is no acknowledgement email return, no call back and no response to postal mail.

Complaint: On XX/XX/2016, I, with the help of an advocate from a non-profit organization, contacted Bayview Loan Servicing regarding an increase in my mortgage payment. We spoke to XXXX ( XXXX ) at Bayview, who advised that an escrow analysis had been completed and the shortage of {$560.00} had been divided over a 48 month period to keep my payment affordable at {$370.00}. I was concerned about an additional amount appearing on my statement of {$11.00}. The Bayview representative indicated that the fee was a remaining fee from when my modification was completed and that the {$11.00} did n't have to be repaid right away. XXXX indicated that the fee could be repaid at anytime in the future, that it was n't accruing any finance charges or additional fees. My advocate confirmed with the Bayview representative that as long as I paid {$370.00}, that I was paying my full monthly mortgage payment. XXXX confirmed this and indicated that anything over {$370.00} could be applied towards that {$11.00} outstanding fee as long as I indicated on the payment that any overpayment would be applied to the outstanding fee balance. On XX/XX/2016, I was concerned again about my monthly statement from Bayview. It appeared that nothing had changed with my payment and that another fee was assessed. My non-profit advocate assisted me with a call to Bayview again. We spoke to XXXX. He advised that my monthly payment amount is {$380.00} and that I was assessed a corporate advance fee of {$11.00} because the payment of {$370.00} that I sent to Bayview was not a full payment so instead of causing my loan to fall behind, Bayview advanced the shortage to make the full payment. Although I 'm thankful that my account was paid in full for XXXX and XXXX, I feel that I and my advocate were mislead when we contacted Bayview on XX/XX/2016. I 'm on a fixed income. I had to apply for a mortgage modification to get my loan back on track and avoid losing my home. I have no intentions of falling behind again and never want to be at risk of foreclosure again. I need for the mortgage company representatives to be forthcoming and accurate whenever I call to request information. If my advocate, whom I trust to ask the mortgage company the correct questions, felt mislead by the call to Bayview on XXXX XXXX, 2016, then I feel they could be misleading other consumers.

Complaint: My escrow account was double charged for XX/XX/XXXX and XX/XX/XXXX XXXX and cities taxes by Bayview Loan Servicing , LLC . When they send me XXXX XXXX Report with shortage in XX/XX/XXXX, I called them to correct it, but instead of actual investigation of the problem they tried to make me believe that each payment XXXX XXXX and city from my escrow account was just XXXX of total payment due. I went to XXXX XXXX 's office and got Tax Bills for XX/XX/XXXX and XX/XX/XXXX that proofed that I was right. What is more XXXX XXXX and city taxes were paid by the company which I bought the house from, I guess, by mistake. As I 've been told at the XXXX 's office, checks from Bayview Loan Servicing were rejected and send back to the same address that they came from. I send all docs to Bayview and they finally figure out that they tried to pay taxes for my neighbor 's parcel because of wrong property legal description on XXXX deed. I bought the house in XX/XX/XXXX, and all taxes were correct until XX/XX/XXXX. The corrected legal description was recorded in XX/XX/XXXX. I faxed all proofs of it to Bayview on XX/XX/XXXX. And it is still not corrected as of today date. I spoke with all departments within the company, like customer service, escrow analysts, and customer advocacy team. They neither ca n't find money that they send to XXXX and city in XX/XX/XXXX and were returned back to them or correct my escrow account for 7 months already.
