Complaint: Bayview Loan Servicing LLC, located in XXXX XXXX, FL, is a predatory lender, who has over 1,400 lawsuits against them, as this can be verified through XXXX XXXX. Bayview has over 250 complaints with XXXX, over 190 with XXXX, over 150 with XXXX, and they have a 1 star rating with Consumer Protective Services, as well as over 250 complaints with the Better Business Bureau, which they do not subscribe to.
Bayview conspired with the Chapter XXXX Trustee 's Office to plan on illegally foreclosing on our properties, and split the illegal profits. This is fully documented in the Neystels ' Chapter XXXX Bankruptcy filing.
My Mother and I had to battle for years and go to the Whitehouse 3 times, and after 6 long, angonizing years, the Chapter XXXX Trustee was ordered to back off on the collections of a judgment taken illegally. However, the Federal Judge, took the illegal judgment off of my Mother, yet, in retaliation, left the illegal judgment on me.
Bayview, in XX/XX/XXXX, foreclosed upon our properties, in violation of a Federal Automatic Stay afforded by the Bankruptcy Laws of the United States Code. I finally had to go to a hearing before the judge, and present evidence, with counsel, proving Bayview illegally foreclosed on the properties, while violating an Automatic Stay. Thereafter, the Judge ruled to have the illegal foreclosures rescinded. During this time, Bayview obtained an in rem order, that was taken against me, illegally, as Bayview 's predatory attorney, XXXX XXXX, admitted on court record, that he was aware that I was hospitalized during the time of the hearing. This is on appeal concerning the in rem order. These illegal actions have caused irreparable damage, along with the still lingering approximate {>= $1,000,000} judgment still haunting me.
Bayview has charged fraudulent interest, and charges, on our accounts.
On XX/XX/XXXX, Bayview, again illegally foreclosed on our properties, while violating an Automatic Stay in place with my Bankruptcy Petition, as well as violating an Automatic Stay in place with my Sister 's Bankruptcy Case Filing.
My Sister was protected by the Automatic Stay, when the second illegal foreclosure took place on XX/XX/XXXX.
The law is very clear, yet simple, there was not only one Automatic Stay in place, yet also my Sister 's Automatic Stay was also in full force.
Bayview, the predatory lender 's attorney, XXXX XXXX, took my Sister to a Court hearing around mid XX/XX/XXXX, while my Sister was in the hospital, and a note from the Doctor was filed with the Court, as well as given to the Judge, showing she was hospitalized, and because of all the corruption and drama, as well as the fear of becoming homeless, she XXXX XXXX, and is still to this day hospitalized. Numerous case laws, as well as being supported by the United States Code, clearly says a Court can not rewrite the laws and history, which have established you can not retroactively lift an Automatic Stay that was in place, in this case there were two in place on XX/XX/XXXX.
The Judge in my case, and in my Sister 's case, both had the audacity of making accusations that my Sister is playing games, and I have committed perjury, which is absolute nonsense.
The will was never probated, within the timeframe that the law allows. Therefore, my Sister, XXXX XXXX, as well as my Brother, XXXX XXXX, and I, all retain a 1/3 interest in the Estate. This has created the entire family to be broken apart, and contest the heirships of the properties.
I am currently XXXX XXXX, and due to my financial hardship I am being forced to represent myself. Bayview, the predatory lender, by and through its counsel, continue to schedule hearing after hearing, and in the midst of this kaos, my doctor has provided numerous doctor 's notes stating that I am XXXX XXXX, can not read my pleadings, and am unable to attend any hearings until mid XX/XX/XXXX, providing that my eye procedures have gone as planned.

Complaint: I am a XXXX XXXX working with a client trying to avoid foreclosure. He tried contacting his lender numerous times regarding options for modification. They over and over told him to complete loss mitigation package sent to him. Informed him each time he sent all the documents over that he was missing documents, they never received them or that his documents were expired by the time they got the other documents. This has continued for over 2 years now and the ct is now in the OREGON FORECLOSURE AVOIDANCE PROGRAM. We both have experienced trying to contact the account manager in the case and left a number of voicemail and never received a call back. The client and I have yet to get a finalized review for a loss mitigation options for home retention. They continue to not be responsive and prolong the process it feels like till they client has not other option due to all the fees they 've inquired by the lender prolonging the process. Even Bayviews own attorney is frustrated with Bayview. The attorney informed Bayview several times over the last week - to remove the litigation flags preventing Bayview from speaking with us. Bayview is ignoring their own attorney and is refusing to remove the litigation flags, and therefore speaking to us, XXXX XXXX XXXX, as an authorized third party. There is a foreclosure date coming up very quickly and we simply do not have time to allow Bayview to continue playing these games. XXXX It is apparent that Bayview is ignoring their own attorney in order to force this property into foreclosure.

Complaint: I reapplied for a loan modification in late XXXX and sent all the documents in on XX/XX/XXXX and followed up two days later to make sure they were received, also l called during the month of XXXX to make sure nothing else was needed on the file and i faxed what was requested but towards the week of thanksgiving the customer service rep assigned to the account was out the office so i called and spoke to someone else but was told i could only leave a message, after the holiday i got a email requesting more documents so i faxed those documents on XX/XX/XXXX and again on XX/XX/XXXX, and called to follow up again on them and left messages and emails with the assigned rep but did n't get a reply until two weeks later stating that she did n't get the faxed so i re faxed them again so after all of these things they tell me today my file has been denied, when the fact is that i sent the documents in a whole month ago and they wait until now to tell me they did n't get my documents which an excuse when i called and emailed several times on the status of the file this whole thing is wrong!!

Complaint: I bought the home in XX/XX/XXXX. I always paid on time until The XXXX when my job was destroyed the XXXX XXXX XXXX XXXX. I was given unemployment for a period of time and I still made payments. After that time my daughter moved back home to help us meet our financial obligations.
We sent complete financial packages to XXXX and while in the process of waiting for an answer the loan was transferred to a new Mortgage Servicer. They immediately went for a judgment of foreclosure and set a sale date XX/XX/XXXX, we had to file a Chapter XXXX to stop the sale.
We did everything the new servicing company requested Bayview Loan Servicing.
We are fighting to save our home. Please help us.

Complaint: Loan not in my name, grand deed done XX/XX/XXXX and have power of attorney dated XX/XX/XXXX, know loan not in my name but power of attorney is exclusive for the loan, modification etc. faxed paperwork XX/XX/XXXX, XX/XX/XXXX and XX/XX/XXXX was all complete, have a rep but rarely calls back, always loosing paperwork etc. Called XX/XX/XXXX was on hold for over an hour, per california law loan was never reviewed for modification, rep was on vacation, transferred to 6 different departments, finally loss mitigation rep said would have a manager call me back the XX/XX/XXXX or XX/XX/XXXX, NO CALL! Paperwork was in before sale date, have proof of everything and yet to have a return call WITH MESSAGE LEFT! My cousin has been faxing, calling, faxing, yet no one responds back!

Complaint: This company is the second mortgage lien holder on our home and do not have or will not provide a copy of the mortgage note to the first lien holder at my request. They were contacted in the beginning of XXXX XXXX with a request for a subordination and a copy of the note. The first lien holder paid for the documents on XXXX XXXX XXXX and received the subordination in late XXXX. We are still waiting for them to receive a copy of the actual note. When I call them time and again, I am placed on hold for extended periods of time then told to call another department and get the same results.
If this company does not have a copy of the note, what are our options? I understand that by law, they have to have a copy on file.

Complaint: As a follow-on to my complaint filed Reference Case No. XXXX. For past 2 years I have been working with Bayview on a Short Sale with no end in sight due to Bayview 's broken administrative process. There seriously seems to be something wrong across the board for Mortgage Bank Servicers and I am begging on my hands and knees for regulating agencies to intervene and help them. In numerous instances my loan was transferred to several Asset Managers. I get it and understand that the Loan Modification Department is overwhelmed due to the economic breakdown in our country but does it mean that the integrity of the Homeowner 's file should go away when it is transferred or if there is a lull period during the approval process that documents should go missing or expired. But guess what CFPB it happened to me just like the other hundreds of complaints filed against Mortgage Servicers such as Bayview because either the Code of Federal Regulations needs to ramped up and clauses that reside for Loan Modification and the administrative handling of homeowners files need greater clarity and transparency for homeowners. For example last year my file was still being processed by Bayview under the HAFA program even though that program was no longer effective as of XX/XX/XXXX. This was a huge oversight by Bayview that ultimately cost me a contract because I had to restart the process with underwriting. Just imagine my file got passed their trained and potentially qualified Asset Manager who submitted my package under HAFA when the program did not exist. But it did not stop there during the lull of my file being transferred to another Asset Manager you guessed several of my documents expired or got lost be it the appraisal, forms, bank statements, pay stubs or other mandatory document and it does not take a genius to figure out what happen ... yep my file could not go to underwriting because go figure it takes 72 hours to upload any documents into the system but in the meantime the clock is ticking for the submittal ahh, ah I have to restart the process all over and resubmit another application and do a complete package ... .how many times did this happen to me and other homeowners with Mortgage Bank Servicers let 's pull out a magnifying glass and take a look or maybe someone is willingly to reach out to the Government Accountability Office so homeowners can get this transparency. Somebody needs to do something outside of CFPB and Federal Reserve Board to ensure we are treated fairly and establish realistic, attainable timelines for homeowners. If a case resides with a Mortgage Servicer for a workout option passed a certain time there is no recourse for the homeowner ... has anyone thought about that? What is a fair time period where a file is being reviewed what is a fair time period to get a workout option ... .why does it take an inordinate period of time to get approvals. Why are Servicers in my case working with antiquated systems. I am praying for a kumbaya moment for me and other homeowners that are dealing with mortgage servicers where they are batting zero. I am begging that someone intervenes and help me with my Deed in Lieu of Foreclosure. I am hoping that one day there will be a light shown for me by Bayview at the end of the tunnel I have been hanging in there for 2 years now. So what I learned today on XX/XX/XXXX, Bayview is unable to settle on my Deed in Lieu because XXXX XXXX XXXX can not settle for the XXXX being offered and want XXXX ... did I tell you guys when my application was initially submitted I qualified for HAFA? Since that time, sadly my bag is empty and well this is a no-brainer Bayview wants me to figure out a way to come up with the rest of the XXXX to get from under the property even though I submitted gosh more than 4 ratified contracts to them. I just do n't know. Oh and let 's not forget that I need to clarify even though Bayview approved only one of my contracts on XX/XX/XXXX it took so long to get the file approved I lost the buyer. Since that time you guess it I have been batting zero. Who am I? I am a full-time working single mom of XXXX, a XXXX, a XXXX XXXX XXXX and a customer of Bayview Loan Servicing that is on my hands and knees pleading, begging and wanting a resolution to do the Deed in Lieu so that we can restart our lives and afford the basic necessities in life.

Complaint: I am trying to apply for a modification with Bayview Loan Servicing so that I can save my home. My assigned representative is named XXXX XXXX. My first impression of him was that he is very hard to get ahold of. I have always been told that he is the only person in his department that can discuss my file so I can not simply speak to the next available representative I have to call his number directly. It usually goes directly to voicemail. He picks up and immediately asks me to hold, sometimes for upward of an hour long. I know he has an email address and I asked him if that might be a better way to get in contact with him since he is so busy but he told me know he does n't check that the best way to discuss my loan is to keep continuously calling his phone until he picks up.
The last time I spoke with him was on XX/XX/XXXX at approximately XXXX. There was only one more document being requested -- a document that I had already faxed to him the previous week. I asked if he got the fax and he said he has n't seen it yet and he does n't really trust faxes so I should just email it. The implication was that he was n't even bothering to check his faxes because they 're unreliable so the best way to send documents is email. He told me that I could reply to an email of his and if I replied back it would be uploaded to the account directly. He said the email would be out in about XXXX minutes. The email finally came XXXX -- six hours later. I simply could not wait around that long for him to send the email, and he told me that any documents sent to his email would be automatically uploaded so I had already emailed the necessary document to him at XXXX.
When I spoke to him today, XX/XX/XXXX, he said that he closed my case because the all necessary documents had not been received. He said he had requested the documents on XX/XX/XXXX so he does n't even remember correctly what day we spoke. He kept saying that our correspondence must have " crossed '' which makes no sense because I sent the document within 15 minutes of him asking for them. Even now it 's only 3 business days since he requested the document so how can he close my file so quickly?
I first applied for assistance back in XX/XX/XXXX and I even reapplied on XX/XX/XXXX because it had been closed for the same reason -- package incomplete. However with such poor communication from XXXX XXXX how can I ever figure out if and when they have all the documents they need? I am very concerned because after 4 months we are no closer to reaching a resolution on my loan modification.
