Complaint: In XXXX I filed for Chapter XXXX Bankruptcy. I successfully completed my chapter XXXX bankruptcy in XXXX XXXX. Shortly after my discharge, I got a notice from Bayview that I was 229 days delinquent on my mortgage and the amount due to bring my loan current is {$16000.00}. I disputed the delinquency amount and I found out that they have my account in suspense. I contacted my lawyer who then wrote to Bayview to remove my account from suspense and credit my payment accordingly, but Bayview did not do that correctly. On the Post-Petition Ledger from Bayview Transaction date, XXXX/XXXX/XXXX amount received {$11000.00} this payment was not applied correctly.
I also told them that if I had missed a payment while I was in bankruptcy, they were by law supposed to call the bankruptcy court as well as my attorney to report me and that they were in violation of the bankruptcy code. Since then, I have been trying to deal with them. They sent me an application to apply for a loan modification, making home affordable to avoid foreclosure. I accepted the offer and I applied for a modification. I submitted all the necessary documents as requested. Three months later Bayview denied the modification stating a Negative NPV- that the owner of my loan did not approve a modification.
They gave me alternatives to pre-foreclosure or Deed-in-Lien. Bayview tactics are unethical and illegal, they are making it very difficult for me so that they will foreclose on my house and make money.This company is just awful, does not record all payments, even though the checks were cashed and I have proof from my bank Attached are my correspondence to Bayview and the Post-Petition Ledger from Bayview showing all my payments.This company is just awful, Bad COMPANY TO DO BUSINESS WITH. A lot of negative complaints about this company, they have destroyed a lot of families. See attached compliant.

Complaint: As a follow-up to Complaint Filed on XX/XX/XXXX ( Reference Complaint # XXXX ) I received an update from XXXX XXXX XXXX Asset Manager assigned to my loan that my request for a Streamline was denied because of prior modifications. He asked that I complete a Loan Modification and stated that it will also be denied as well since I was given modifications in the past.
Sadly, my situation is a unique one with the XXXX XXXX XXXX XXXX to XXXX XXXX, then a divorce that just occurred onXX/XX/XXXX. It has been an uphill battle for me and my XXXX young impressionable children. Here 's my ask if a request will be submitted to XXXX XXXX - the investor for consideration of a repayment then why can not my initial denial suffice why is Bayview requesting for me to complete a loan modification package fully knowing that it would take an inordinate process to go through approval only to be denied anyway and dragging out the inevitable of submitting my hardship directly to the investor XXXX XXXX. I ask that you intervene and help me I need the stability for my children. While I know we all have circumstances these circumstances were unfortunate and out of my control. I would have loved to wave a magic wand and have them go away. I did not want a divorce and more importantly I did not want my young daughter to XXXX either. Complaint: I am writing you now in hopes that a full investigation can be done on Bayview Loan Servicing for almost two years I have been trying to sell my home. With Bayview Loan Servicing each and every Ratified Sales contract fell through due to slow processing. Bayview will continuously request a new appraisal, submittal of new documents, they would assign new Asset Managers of which I had 4 or more. In all instances my entire file did not transfer and the newly assigned Asset Manager would be clueless of my file and documents sent or they would say they are not in receipt of my Hardship Letter, HUD-1 or other documents. By the time they would assign an Appraiser for my property either my documents expired or the buyer would terminate the contract and I would have to restart the entire process. As of last year XX/XX/XXXX under the new administration the Making Home Affordable Program went away XXXX kept referencing and processing my documents under such program once my package went to the underwriter they caught the error and again I lost another contract. Because this has not happened to just me I am pleading that CFPB and all regulating agencies do an entire investigation on Bayview Loan Servicing. Bayview even posted signs on my property which was illegal as if my home was in foreclosure on numerous instances which inhibited my ability to off load the because potential buyers thought the home was going to be put up for auction. Somebody please, please do an investigation and more importantly please help me fast forward the Deed in Lieu my current Asset Manager name is XXXX XXXX comes now because the Making Home Affordable Program went away Bayview is only offering XXXX to the 2nd Lien Holder vs. the XXXX which is stalling the sale of my home. I am at a wits end on what to do my file has been under review since XX/XX/XXXX with Bayview Loan Servicing and Real Time Resolutions with no end in sight. I am a single mother of XXXX children I can no longer sustain this property paying ancillary costs associated with the property and take care of the basic necessities for my children. This is absolutely insane.
What Bayview is doing is unlawful it should not take two years to sell a home nor should it take an inordinate period of time to get a Deed in Lieu processed.

Complaint: I contacted Bayview Loan Servicing who is managing my XXXX XXXX XXXX XXXX Loan in hopes of getting a workout option. In XX/XX/XXXX offered a workout option of a Repayment where my payment would be in excess of XXXX monthly not including the initial down-payment which is something I am unable to afford as a single mom and I quickly alerted my Asset Manager XXXX XXXX. XXXX XXXX stated that there was a new program that was available in XX/XX/XXXX which offered a streamline option so I can get back on track it was perplexing why I was not offered this option. Nonetheless, he submitted my paperwork for this work out option and during that same time stated that my loan was referred to Foreclosure. I am confused if I am being considered for a work out option why was my loan referred to Foreclosure the second week in XX/XX/XXXX. While I strongly believe that XXXX XXXX is doing everything he could there is something wrong with Bayview 's company management of client files. Bayview needs to be investigated for their shoddy practices. I can not sleep at night worried about if my XXXX children and I would be put out on the street. The whole process as me in agony and distress. Please, please help I can not afford to lose my home for my children.

I am back to work full-time and would like to propose an opportunity to get caught up on my late payments with the debt being repaid over the course of one two years or in a late payment paid in lump sum if funds become available. Please consider lengthening my loan term to 32 years so I can pay back the arrearages now that I am back to working fulltime. If thats not an option please consider reducing my principal to current home market values using my current loan rate. I need my home for the stability my children and a foreclosure would not be beneficial to my community, particularly now that I am able to pay and have resumed working full-time.

That is the response we receive on every CFPB complaint we file against Bayview. Well, I have read many other CFPB complaints against Bayview and they all have a common theme FRAUD AND ABUSE. I am sure those complainants also receive the Sorry but you are lying response. That seems to be their standard form letter in response to CFPB Complaints. How could it be possible that all of these unrelated people from all over the country would be lying?? The fraud committed by BAYVIEW does not just happen once in a while. It happens on a very large percentage of short sales across the country. We have witnessed this on a daily basis for the last 10 years. When is the CFPB going to step in and do something about the fraud going on at BAYVIEW? When is the CFPB going to hold BAYVIEW accountable? IF I DID WHAT THEY ARE DOING I WOULD BE IN JAIL FOR A LONG LONG TIME!

WHAT HAPPENED to the revised appraisal?
WHY are we being denied even though our offer does meet their minimum net? ( our offer is actually much higher than their minimum net. ) This is the 2nd Time XXXX XXXX has XXXX up on this file regarding values. Her mistakes are causing significant delays. ( which is harming their investor, our community, and the estate that has taken over this property.. values in XXXX XXXX have been dropping for the last three months. ). It is obvious she is overworked - and that means BAYVIEW does not have appropriate number of staffing to be able to service their files according the servicing guidelines set forth by the CFPB.
I want Bayview held accountable for the lack of staffing needed to do their job-for which they get paid of servicing their files. Bayview has no interest in following the laws and guidelines set forth by the CFPB. They dont care how their files are handled they only want to put forth the least amount of effort into fulfilling their obligations.

Complaint: Bayview loan servicing, not reporting our current mortgage status, we own our home, Bayview showing on our credit bureau history, we lost our home in s chapter XXXX Bankruptcy discharged on XX/XX/XXXX. We have been current with our mortgage, and due to an attorney error, s letter to reaffirm our mortgage debt was not filed withBayview, s letter of intent to keep this debt, as well as s car was filed. This error was not found by Bayview or myself till I pulled s credit report almost s year after Chapter XXXX was discharged. Bayview refuses to report to credit bureaus accurate information, due to the missing reaffirmation letter. We modified our mortgage XX/XX/XXXX We pay on time, but Bayview continues to show we lost our home in a chapter XXXX Bankruptcy! I have since sent them the copy of the reaffirmation of debt letter, my attorney is no longer employed with the law firm we used. I have sent all three credit bureaus, 10 years of payment history on our mortgage, deed, ad well as property tax statements. They will not change info on credit report. Bayview loan servicing, had recieved the documentation and continues to not report to credit bureaus. This is wrong.. they will not work with us due to human error. We pay our mortgage every month, have for years, but on our credit report Bayview shows we are not home owners! This is bad business practice. Our credit report needs to reflect that we are home owners and we pay on time. I have sent the reaffirmation letter to there company, but they will not acknowledge they have recieved it. They are a very disorganized company, and our credit is being destroyed. They need to correct our credit report, we did not lose our home before, during or after Bankruptcy. Our home and vehicle are exempt under BK laws. They new we had no intentions of losing our home. Bayview loan servicing are disorganized and take weeks or even months to handle complaints. I have been fighting to get our home ownership back onto credit file for almost three years.

XXXX XXXX XXXX I applied for mortgage susp for XXXX months to do repairs after Irma. Bayview responded by selling mortgage to XXXX servicing and no suspention of payments. XXXX rep refused susp of payments.
XXXX servicing read the contract to me over the phone and sent a copy. I have never seen or agreed to part two of contract. They are adding {$45000.00} to the loan for late fees and interest that were waived in renegotiation.
Back in XXXX I had a choice between taking a {$30000.00} payment and moving or to renegotiate loan. There is no way I would pay twice the value of the house. That 's why it was reappraised.

Complaint: Our loan was sold to another mortgage company and the balance of our loan raised from XXXX to XXXX. When I called and asked for a pay off on this loan I was told that it would be XXXX. They also say that we are behind on the payments, yet we have been making a payment a month, plus 2 months we made double payments because they said we were behind. I have researched this company and they have a lot of complaints against them. When you call to talk to someone it is automated and if you do get through then you have to leave a message and they never return your calls. This is very up setting because our original loan was for XXXX in 2001 then it went to another company and then another company and now to this company and we still owe almost as much as we did when we first got the loan. Also the interest rate was supposed to be fixed and it has raised. We need help and so does a lot of other people.

Complaint: My mother XXXX XXXX in XX/XX/XXXX, prior to that she was ill from one of those new pharmaceuticals. I did not have power of attorney to pay the mortgage, so it got behind. When I tried to make payments after she XXXX, they still had the mortgage in her name and SOCIAL SECURITY NUMBER, so I coul n't access the account to try and make payments. The company then foreclosed on XX/XX/XXXX. We have been issued an eviction notice, but we 're unsure of when that will be carried out. I have contacted legal aid to get a temporary restraining order on the eviction. The collection agency has been unwilling to help, and I have tried to refinance his loan through HARP. That is along process, though.

Complaint: Bayview Home Loans LLC is trying to collect on a purported debt. Various sevicers, lawyers, and agents for purported lender/beneficiaries XXXX XXXX XXXX, XXXX.
No valid transactions can be documented since the original purchase loan and the purported transfers and or sales of the disputed loan that XXXX XXXX XXXX and XXXX XXXX XXXX XXXX XXXX have not verified or dealt with in good faith. While contesting the foreclosure initiated by XXXX for XXXX under the deceptive and possibly fraudulent identity of XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX as trustee for the benefit of the certificateholders of the alternative loan trust XXXX mortgage pass through certificate, XXXX XXXX and their lawyers from XXXX XXXX XXXX XXXX, including atty XXXX XXXX, Esq, XXXX who may have misled the court as to the claims of XXXX and XXXX in a quiet title action and the current foreclosure action and counterclaim the purported loan was again transferred to Bayview Loan Servicing LLC. XXXX XXXX, Bayview and their agents and lawyers continue to commit unfair, abusive and deceptive practices such as robosigning and probable fraud on me and the courts. While neither XXXX nor XXXX have validated their claims the figure of {$250000.00} does not correspond to the purported amount of debt. On XXXX/XXXX/XXXX I sent a Qualified Written Request by certified mail to Bayview Home Loans LLC I have not recieved a response to either letter in violation of my rights by operation of law as to the validation of debt letter and the Dodd Frank Act as to the QWR. These recent violations and abuses continue a pattern of harm, fraud and denial of basic rights where the court and Judge are ignoring the facts and policy to address the harm done to homeowners and consumers. The accounting and escrow that they keep issuing forced insurance, fees, on my property. This needs to be addressed asap as they are causing me great harm and stress. Complaint: XX/XX/XXXX/XX/XX/XXXX my mortgage payments were being delayed due to a changed of my income and household finance. I notified my mortgage company XXXX XXXX and asked if I could qualify for a hardship help. XXXX XXXX told me that my paperwork was submitted and that he would let me know what the outcome would be. I received a call around the end of XX/XX/XXXX, and I spoke to a XXXX XXXX XXXX, he explain to me that he is the new person on my case that will be helping me in my modification and that somehow XXXX XXXX has misplaced all of my documents. XXXX XXXX stated in order for me to be consider the committee said I must complete the documents over again, and so I did. So XX/XX/XXXX I faxed all the documents that was requested in to XXXX XXXX all that I did not faxed I email to him and was waiting on his response. A week later XX/XX/XXXX, XXXX XXXX stated that the documents were missing and some were expired, he also stated that I had a certain amount of days to get those documents in and I did. XX/XX/XXXX in the first week came and I received a call from XXXX XXXX and again he stated that he not yet to receive the documents that I faxed to him and my filed has been on hold because of this matter. By this time I am upset because I feel as if someone is not being truthful to me because I know I have sent the required documents several times and I am being brushed off. On XX/XX/XXXX, I received a call from XXXX XXXX XXXX and again the documents were not in, and most of them were expired, I were just shocked. So I expressed my concerned about this issue and said that " XXXX XXXX has a history of taking property from people that has problems making payments '', and I stated that I am going to talk to someone and get some help with the Better Business Bureau or the Federal Trade Commissioners office and when I made that statement XXXX XXXX became very upset with me and reassured me that this is not the issue. On XX/XX/XXXX, I received in the mail a notice that my home was being foreclosed and it was filed on XX/XX/XXXX. I felt as if the mortgage company did that because of my threat to report them of their unfair practice. I have enough equity to refinance or take a second loan out but I was not giving that option at all or consider that option at all. I have documents to back up the dates what was sent to each of the representatives that was fax and time, date.
