Complaint: My loan was transferred to Bayview Loan Servicing and it has been nothing but a NIGHTMARE! I was doing a Trial Loan Modification and I paid all XXXX payments on time as agreed, XX/XX/XXXX, XX/XX/XXXX and XX/XX/XXXX. On XX/XX/XXXX, I received a phone call from XXXX XXXX XXXX claiming the didnt receive my XX/XX/XXXX payment. I sent proof to XXXX showing it was debit from my account just like XX/XX/XXXX and XX/XX/XXXX payments. She argued with me that it wasnt received. I went to my bank and they thought it was strange also that they claimed they didnt receive my XX/XX/XXXX payment. I called my bank today to asked if they found out what happened and the clearly stated that XXXX XXXX XXXX lied to me! The XX/XX/XXXXpayment was received by XXXX XXXX XXXX and they provided me with the transaction number. XXXX lied to me so that I would file something with my bank and make it look like the funds were returned. XXXX is my witness. I did everything I was supposed to do. They are ripping people off and telling lies about not receiving payments. My Attorney will be handling this because it has STRESSED ME OUT. I HATE A LIAR and I HATE MY LOAN WAS TRANSFERRED TO THESE CROOKS! Please STOP these people from illegally foreclosing on people homes ...

Complaint: Bayview completely ignored laws and is reporting a disputed amount to the credit bureau. Bayview took over my loan and even when I disputed according to the laws that are supposed to protect me, Bayview ignored and reports my account late 60 days which included the disputed payment. Bayview asked me to provide information I did, they reported to credit bureau and had caused me financial damage they are going this, as noted on your site too many many people, when will this company be stopped?

Complaint: We want Bayview to follow the stipulations of settlement agreement ( attached ). Every time we call in to Bayview the SPOC is not available and we get a different answer regarding the settlement. Most recently, we spoke to Bayview and their rep didnt know anything about the settlement agreement and refused to run this file through a loan mod, as required according to the settlement agreement. Bayview is also stating there is not enough time to run it through a settlement agreement, even though we submitted the full package to them on XX/XX/ well over a month ago. How is it that no one at Bayview realizes there is a settlement agreement, when Bayview is the one that refused to speak to us because it WAS in a settlement agreement and was being handled by their attorney?? We just want Bayview to follow the stipulations of the settlement agreement and review this file for a loan mod.

Complaint: a qualified written request was submitted to bayview loan servicing on two separate occasion with no response to the request on XX/XX/XXXX and XX/XX/XXXX as per in sub title E Mortgage Servicing of the Dodd- Frank and Consumer Protection Act Bay View had 5 days to response by mail and must provide a substantive response to the borrower within business 30 days, THIS has not happen but bayview loan servicing is moving forward with the foreclosure and according to a letter date XX/XX/XXXX stating that bayview was still in the process of a resolution of the matter of the loan modification with a proposed resolution date of XX/XX/XXXX, so while bayview was telling me this they still had a sale for XX/XX/XXXX we called everyday this week to get an answer and nobody would tell us anything until today that the sale was still moving forward even with a pending answer on the loan modification and violations of the dodd- frank and the consumer protection act, there intent was to foreclose without any regard whatsoever.

Complaint: This is not the first time that I've contacted you concerning the following. I am a XXXX year old widowed XXXX senior citizen who is a Victim of Predatory Lending since XX/XX/XXXX. My niece who is My Power of Attorney, Attorney-in-Fact who handles all my affairs is writing this for me and has assisted me since XX/XX/XXXX. I've applied for help since XX/XX/XXXX, after being told that if I didn't pay the next full mortgage payment, not to send anything less then what they asked for. It unfortunately turned out to be much more then I could ever afford! I am also responsible to pay the entire Water ( $ XXXX/month ) and Electrical bill ( {$600.00} ) for the 2 family house besides my other bills. In XX/XX/XXXX, I went to The Neigborhood Housing Services of XXXX XXXX for help! I was told after their reviewing of my Mortgage Agreement, that I was in fact a " Victim of Predatory Lending ''. They said, there wasn't a single page in my agreement that provided proof of my financial ability to pay this mortgage in the first place. I have been to Court several times since then and was told by " TWO '' Court appointed Attorney 's ( I have proof in an email from one ) that it was in fact " Predatory Lending ''. I have submitted since then almost 10 Loan Modifications per year and have been consistantly rejected. Just recently, I recieved once again, a Notice of Sale for Judgment of Forclosure dated for XX/XX/XXXX ( this was sent regular mail in late XX/XX/XXXX and there is no date on this paper ). In XX/XX/XXXX, my niece spoke to a XXXX XXXX from Bayview Loan Servicing , LLC and was informed by her that I was to wait until my new Social Security & Pension comes in XX/XX/XXXX so that I would have more money to apply for another Loan Modication. So we waited until the following transpired. During the Month of XX/XX/XXXX my first floor tenant was approached by someone possibly from Bayview Loan Servicing that my home was in Foreclosure. She then decided that she was going to leave and break her Lease Agreement, because of her feeling threatened. While attending the many Court appearances, I was told by the Judge that as long as my tenants ( 2 apartment lessee 's ) had a two year lease, they were safe! But, when people come to my home and speak to my tenant 's they become scared and either decide to leave or not pay rent. This is not fair and has been going on since XX/XX/XXXX. Since that time I have contacted XXXX XXXX who informed me that she is no longer assigned to my case to please contact XXXX, an Assessment Manager @ Bayview. I have left messages consistently since then with no response from her or from Bayview? Please note that CFPB has every single detail of my dilemma on file! Please help me to keep my home!! Your prompt assistance in this matter will be greatly appreciated, because I don't know what to do next! Thank you ... ... ... ... ... ... ..

Complaint: I applied for a loan modification in XXXX i submitted all the documents on XX/XX/XXXX and additional documents on XX/XX/XXXX, i received a email on XX/XX/XXXX stating that 4 items where needed with a due date of XX/XX/XXXX, the letter was address to me and supposedly mailed to me which would have been possible because it had the wrong address on it, also we spoke to XXXX XXXX who is the point of contact for this file and informed XXXX XXXX and my self of the missing documents on XX/XX/XXXX with a due date of XX/XX/XXXX basically giving us one day to get the 4 items in which was on a Thursdays day and we sent the documents in on Friday XX/XX/XXXX, directly to XXXX XXXX XXXX number XXXX which goes to her computer, we followed up with her on XXXX XXXX via email and left messages in her voice mail and called customer service regarding the documents only to be told we could send her a email or leave her a message, we didn't her back from her until XX/XX/XXXX only to told that she didn't get the documents to her efax which is the one we have used all this time, so we resent the 4 items again on XX/XX/XXXX, and of course bayview tells us its after the due date of XX/XX/XXXX and a sale date of XX/XX/XXXX which was more than of enough time to get the loan mod done but they would rather foreclose then to say that XXXX XXXX never responded XXXX XXXX emails or phones calls asking her to confirm that she received the documents that went out two weeks prior on XX/XX/XXXX, we included copy of the dated documents for XX/XX/XXXX a copy of the email from her on XX/XX/XXXX thru her automated dated document system requesting the documents the XXXX items and a copy of the emails asking her to confirm that she received the 4 items.we responded to every phone the same day or the next day from XXXX XXXX but she never responded to any of our emails or phone calls during XXXX XX/XX/XXXX, bayview had plenty of time to process this loan mod from XX/XX/XXXX to XX/XX/XXXX,

Complaint: Bayview Loan Servicing LLC has not responded to a QWR that I sent them certified I asked for all the LEVEL ACCOUNTING and Proof of this PURPORTED DEBT they are trying to collect on. They need to remove themselves off of my credit report at once and they need to Stop Harrassing me. They also need to stop stealing my identity, I am going to press a criminal complaint against them. Complaint: Bayview loan Servicing llc has added XXXX to my Mortgage that was sold to them by XXXX XXXX XXXX who did foreclose on me in XX/XX/XXXX.I filed for modifaction in XX/XX/XXXX and was denied stating I failed to return documents 4 times I needed that modafication my spouse XXXX XXXX do to injury 's from XXXX.I did the modifaction with Bayview with the interest rate the same 7.25 % for 45 years I had already paid for 16 years my balance was XXXX.I Have paid them for 2 years always ahead not behind. I provided a lot of evidence to the credit Company 's as of XX/XX/XXXX the credit Company 's have deleted Bayview Loan Servicing llc from my credit file.I 'm paid up till XX/XX/XXXX.Also they sent me 2 XXXX tax forms one under my info and another one under my name along with my XXXX Spouse under XXXX XXXX XXXX XX/XX/XXXX.If you could please help me I have no funds since Irma.Much respect.I DO NOT OWE XXXX .XXXX SHOWS ON CREDIT REPORT PAID 100 % OF MORTGAGE.

Complaint: BayView Loan Servicing purchased and/or received our loan from XXXX XXXX on XX/XX/XXXX. BayView has been attempting to collect payment from us dating back to XX/XX/XXXX, although the loan was not theirs to service at that time and our payments were made ( which we have documented proof of ) to XXXX XXXX up until we were notified by XXXX XXXX on XX/XX/XXXX that the account would then be serviced by BayView. BayView also violated mortgage law by not informing us of the change of loan servicing until XX/XX/XXXX ( also documented ). According to law, they are required to notify us at a minimum of 30 days before the loan servicing changes hands, which they failed to ever do. The fact that they are : a. attempting to solicit funds for a period of time that they did not have legal right to the servicing of our loan and b. failed to maintain the legal 30 day notice of loan servicing change notification, BayView has violated state of Tennessee and federal mortgage loan laws. BayView has now began threats to foreclose on our home that is, documented, as being up to date on all payments and the error being on their side in this matter.

Complaint: My name is XXXX ( XXXX ) XXXX and Bayview Loan Servicing is the mortgage loan servicer on my mortgage loan ( Loan # XXXX ). It has been a couple of months that this company keep sending me letters about the home insurance certificate for my residence. I have asked my insurance company to send them ( email address is XXXXXXXXXXXX ) a copy of my home insurance certificate. A copy of that certificate has been sent to Bayview on multiple occasions ( On XX/XX/XXXX and again on XX/XX/XXXX ). However, I received another letter dated XX/XX/XXXX from this company claiming that they have illegally purchase insurance on my behalf and they threaten to deduct the exuberance cost of this illegal policy from my escrow account. I filed a complaint with CFPB on XX/XX/XXXX, and Bayview provided a false response to that complaint on XX/XX/XXXX. In its response letter dated XX/XX/XXXX, page 2 of 4, Bayview claims that it was not in the receipt of an updated insurance policy until the policy was received via email on XX/XX/XXXX, and was processed on XX/XX/XXXX. This is a pure lie, as I have an email evidence that the updated insurance policy was emailed to Bayview Insurance department ( i.e., XXXXXXXXXXXX ) on XX/XX/XXXX, and again was forwarded to them on XX/XX/XXXX. I believe Bayview has been caught in a lie to a federal agency now. They received the proof of insurance that they were seeking on XX/XX/XXXX, but they refused to process it until XX/XX/XXXX. That is more that a month, during which time, Bayview was harassing me with threatening and distressful letters about purchasing lender imposed insurance policy. I want CFPB to ask Bayview about their recent lie in their response. I have attached a copy of the email that was sent by my insurance agent to Bayview on XX/XX/XXXX. In that email, the certificate of insurance was sent to Bayview, but now Bayview claims it did not receive the certificate of insurance until XX/XX/XXXX, which is a big lie.
