Complaint: On XX/XX/XXXX I received a phone call from my Attorney, it was a 3 Way Call with Bayview Loan Servicing VP, XXXX XXXX on the line. Finally, I felt like maybe we can resolve this whole mess they have made with my account. OnXX/XX/XXXX I received a Loan Modification from Bayview Loan Servicing, it was signed notarized and fully executed! On XX/XX/XXXX I received a call from XXXX XXXX claiming Bayview Loan Servicing didnt receive my last trial modification payment. I sent her proof that my last modification payment was made on XX/XX/XXXX, but she continued to lie about receiving it. First, I sent Bayview Loan Servicing a check on XX/XX/XXXX for my XXXX payment, but they were taking forever to post it to my account, so I got worried, thinking maybe the check was lost or maybe Bayview Loan Servicing was just sitting on it. I stopped payment on the check and decided to use my debit card onXX/XX/XXXXto make XXXX payment. The payment went through and I e-mailed XXXX XXXX to let her know XX/XX/XXXX payment was made and gave her the confirmation number. I have been doing a lot of research, trying to understand why would she lie about receiving my payment. My online account is showing my XX/XX/XXXX payment in a Suspense Account with a credit. Its just so STRANGE to me that Bayview Loan cant see this. I was nice enjoy to provide a screenshot to them. Why was my last modification payment put in Suspense Account? After speaking to XXXX XXXX I still feel like I have been mistreated and he was constantly defending XXXX. I honestly believe they train them to lie like this. He is requesting my bank statement now and I have no problem with that. The problem I have is being lied to about receiving my payment on XX/XX/XXXX and if a reversal was done on XX/XX/XXXX after XXXX XXXX called claiming the payment wasnt received, its their fault for telling a lie, but I will still resubmit the payment because I dont believe in taking anything that doesnt belong to me. My loan modification approval should NOT be voided because I did what I was supposed to. The money was with Bayview Loan Servicing when my loan Modification was approved and they need to be honest. I made all 3 payments on time and I should not be penalized if Bayview Loan Servicing lied about not receiving the payment. I made several attempt to get in touch with XXXX XXXX Manager to see what was going on with my account, and if I needed to resubmit payment and no one answered or returned my call during that time. I can not continue sending money to Bayview Loan Servicing and they claim they are not receiving it. After seeing the my last trial modification payment in Suspense Account with a credit, it makes me think they have the money, but it my bank did the reversal on XX/XX/XXXX it was because of the lie XXXX told me. I feel like XXXX XXXX was defending XXXX lie. I told him the bottom line is I did what I supposed to and the Loan Modification was approved on XX/XX/XXXX and my payment was with Bayview Loan Servicing at the time of approval. My bank was investigating the money only because of the lie I was told. I also told XXXX XXXX if the money was reversed because of XXXX claiming they didnt receive it that I would pay again. I dont need all this stress in my life. My account is a MESS, every time I look at it all the numbers are different. Im praying hard XXXX reveals the truth and Im treated fairly. After going through all this chaos with Bayview Loan Servicing it makes me so uncomfortable having them as my mortgage company because I have never been treated so badly by a mortgage company in my life!

Complaint: Bayview Loan Servicing , LLC has stolen my identity they are stating that I have a mortgage loan out with them since XX/XX/XXXX. They have not submitted a collateral accounting as I requested and they have not replied to a QWR that I have submitted to them certified mail XX/XX/XXXX. They are fraudulently trying to debt collect on a purported mortgage loan. They need to remove themselves from my credit report ASAP and they need to STOP sending me fraudulent paperwork. I expect you THE CFPB to handle this as they are still harassing me with fraudulent paperwork. I will be filing a complaint with the SEC .GOV as well! This purported debt was rescinded and closed out by XXXX XXXX XXXX a/k/a XXXX.

Complaint: On XX/XX/XXXXwe signed a modification with XXXX XXXX XXXXXXXX under the program of NV Hardest Hit with the purpose of receiving long term financial relief. The agreement among the Hardest Hit program and the lender was from the program to pay the lender toward the principal {$50000.00} and the lender to match other {$50000.00}, consequently, reducing from the principal balance {$100000.00}. According to the figures drafted by the bank the principal was {$220000.00} which represents an inflated principal from {$210000.00} to {$220000.00}. A total of {$130000.00} of the new principal balance shall be deferred. The total deferred principal balance will be treated as non-interest bearing principal forbearance and I will not pay interests of make monthly payments on this amount. The new principal balance less the total deferred principal was {$90000.00}. The standard contingent forgiveness principal balance total {$38000.00} all of which the lender agreed to permanently reduce and forgive the total deferred balance. XXXX XXXX XXXXXXXX, intentionally and maliciously offered me a second modifications that according to them was for my benefit on XXXX, and without disclosing to me the terms change of the loan offered me a 3.5 % interest a reduction of 1 % of my previous modification interest bearing, with the deceiving trick of taking away my financial long term relief from the modification of XXXX. They took away my benefit of having the {$38.00}, XXXX forgiven. And without disclosing this terms change to me and hidden the paperwork from my review they added this amount to the new principal balance making up to {$120000.00} which makes harder for me to pay the loan. This modification shouldn't be enforced because we signed the papers on XX/XX/XXXX and the bank rep on XX/XX/XXXX which it was not provided on the required date before XX/XX/XXXX. Consequently, this makes this second modification void, the first one of XX/XX/XXXX is active. XX/XX/XXXXXXXX clearly tricked us because we are elderly and minority. The NV Hardest Hit program was a great benefit to give us the opportunity to stay on our house and have a long term financial relief. The behavior of XXXX is clearly of a predatory mortgage lender. After the illegal change of my loan terms they passed the loan to one of their servicers XXXX, and presently to Bayview with the purpose of keeping me on the loop after inflating my mortgage loan and making more difficult for me to pay the entire mortgage loan and for they to repossess, sell, and make more profit. They transfer the loan one month after to XXXX which behavior showed that the purpose all the way from XXXX was to forclose on us by having XXXX to refuse payments until one day that they sent a threatening letter talking about forclosing and imposing more fees.

Complaint: Hello, My husband and I had a mortgage through XXXX ( it was in his name ). After he XXXX XXXX in XX/XX/XXXX, I took over as the executor of the estate. I purchased insurance through XXXX XXXX for the home in XX/XX/XXXX. However, XXXX purchased extra insurance on the home ( forced-placed insurance ) -- at an extremely high rate of {$11000.00} or so per year. They then increased my escrow and my total payment jumped significantly. We tried to resolve the issue with XXXX, but they have since then sold my mortgage to a debt collector, Bayview Loan Servicing LLC ( who currently hold the mortgage ). The loan number at Bayview is XXXX. The home address is XXXX XXXX XXXX, XXXX XXXX, NJ XXXX Their customer service rep advised that if we could provide proof of insurance for the home for the period ( XX/XX/XXXX onwards ), we would receive a full refund for the forced-placed insurance. I have attached the proof of insurance to this email. The proof of insurance lists the my name + the Estate of XXXX XXXX XXXX ( my husband ). It fulfills all of the requirements they have asked for. This has been extremely difficult with Bayview. They have regularly not known Yet now they are refusing to provide the refund, arguing the insurance was not sufficient. Since its a significant amount of money I've been charged, I have been left with no choice but to file this complaint. Sincerely, XXXX XXXX

Complaint: My XXXX home mortgage was sold to a company called Bayview Loan Servicing , LLC in XXXX of XXXX. I was up to date with my mortgage payments and I was advised by Bayview on XX/XX/XXXX that my mortgage was in default because I was paying the incorrect amounts. They stated my mortgage payments were supposed to be {$3700.00}.. My mortgage amounts have always been {$3400.00}. I began paying the new amount of {$3700.00} as directed and now I have been advised that my mortgage in default and that my house would be put into foreclosure. They are not applying payments correctly and it has been extremely difficult trying to get in touch with the representative who was assigned to me. It takes her a full 48 hours to return my call. If you look at my statements it shows unapplied payments. My mortgage is not in default as I have been making the mortgage payments in the new amount that they requested. The representative assigned to me at Bayview can not explain to me why I am in default and is now requesting {$15000.00} and stated if I do not pay this amount my house will be put into foreclosure. I went back to my original mortgage holder, XXXX Bank and they advised me to negotiate with Bayview because there was no mistake on my part in the amount that I was paying the correct amount on the statements that I was receiving.

Complaint: XX/XX/2018, Im still trying to contact Bayview Loan Servicing so they can update my account..No one will answer the phone or return my call. All the lies and scamming, guess they dont want to talk to me. YES, Bayview Loan Servicing Approved and Executed my Loan Modification, but XXXX XXXX continue to send me harassing letters about foreclosure, claiming they didnt receive my last trial modification payment. I have provided proof that Bayview Loan Servicing received the last trial Modification Payment. They are so INCOMPETENT there. Im NOT Sure if the employees there have high school education, especially XXXX, she is so dense. My account need to be updated. When my attorney finishes with these crooks they will be sorry! I have a contract signed, approved and executed by Bayview Loan Servicing saying I didnt need to do anything else. I received instructions where to send the new modification payments. I have already sent XXXX XXXX my 1st Loan Modification Payment so I dont know what XXXX XXXX is talking about. She is a big liar, trying to scam more money out of me!

Complaint: Bayview Loan Servicing is stealing mortgage payments and claiming they never received your payment. During my Trial Loan Modification I made all 3 of my payments on time. XXXX XXXX is a very dishonest person, she lied saying they didnt receive my XX/XX/XXXX payment. Today I decided to go online and look at my statement and I can clearly see where Bayview Loan Servicing received my payment on XX/XX/XXXX in the amount of {$710.00} and it was credit to my account on XX/XX/XXXX, a blind man can see the fraudulent activity going on here. XXXX XXXX sent me a letter yesterday saying my Loan Modification is denied because I didnt make my last payment. Is XXXX really that XXXX, she doesnt see the payment? I have done everything to resolve this issue. I will be going forward with a lawsuit against these CROOKS! My Loan Modification was APPROVED and EXECUTED because I did everything I was supposed to during my Trial Modification Period! Something serious is wrong with XXXX XXXX and she needs to be terminated and locked up for trying to steal and scam people!

Complaint: Bayview Loan Servicing will not answer the phone or return my call. They dont want to talk after trying to scam me out of money! On XX/XX/XXXX I received a call from XXXX at Bayview Loan Servicing congratulating me for completing my Trial Load Modification. She said I would be receiving a package from Bayview Loan Servicing and I would be working with XXXX XXXX going forward. I received the package from Bayview Loan Servicing, signed the documents, had them notorized and returned them. On XX/XX/XXXX XXXX XXXX from Bayview Loan Servicing called and claimed they didnt receive my final trial payment. I sent her proof the payment was debit from my account on XX/XX/XXXX, she continued to argue with me, so I told her I was going to contact my bank. My bank investigated the supposedly missing payment and told me that XXXX lied! The payment went through on XX/XX/XXXX and the bank gave me the transaction number. XXXX did everything to sabotage my loan modification and she is the reason my bank did a reversal payment. She wanted it to look like insufficient funds. When Bayview received my payment on XX/XX/XXXX it should have been applied to my account. I have been calling Bayview Loan Servicing all week trying to submit the payment again that was reversed because of XXXX XXXX lies! No one will answer or return my call!!! This is really ticking me off and I will be contacting my attorney Monday!

Complaint: It is tax time. I need a copy of my XX/XX/XXXX and XX/XX/XXXX Form XXXX Mortgage Interest Statements. I asked and has been asking Bayview Servicing Co, my mortgage lender servicer for copies of the statements but to no avail. I started doing this since XX/XX/XXXX and their response is, they were already mailed. I always check my mail in search of the needed statements however, I don't find any. I am getting desperate. I will travel on XX/XX/XXXX for a month, I am scared I can not file my income tax return before I leave. I remember last year. I requested the XX/XX/XXXX XXXX form. They were not able to give me the form. They just gave me the amounts of interest I paid them enabling me to include the information in the XX/XX/XXXX tax return. I am thinking, what could be the reason why they don't give the form? It is very important for me because it gives me the deduction amount that I can make from the tax computation and it should tell me the balance of my mortgage debt. I am paying a lot for this mortgage and they owe me to give a correct report/statement on time.

Complaint: MY LOAN WAS ORIGINALLY WITH XXXX. THEN XXXX XXXX XXXX. THEN DURING A LAWSUIT AND FORECLOSURE, XXXX XXXX XXXX TRANSFERRED OUR LOAN TO BAYVIEW LOAN SERVICING. WE SETTLED WITH THEM AND THEY FINALLY MODIFIED THE LOAN. BAYVIEW HAD THE LOAN UP UNTIL XX/XX/XXXX AND IT WAS AGAIN TRANSFERRED BACK TO XXXX XXXX XXXX. NEITHER BANK WILL RESPOND TO MY REQUESTS. On XX/XX/XXXX Bayview Loan Servicing cashed a refund check # XXXX in the amount of {$1000.00} from the XXXX County, CA tax assessor, for a property tax appeal that I initiated and won. These funds were due ME and/or were to be put into my ESCROW account for property taxes. Bayview did not allocate these funds to my account and there is no record on my escrow statement where the funds went. There is a second check for the second half of the tax installment of {$1000.00} that has gone " missing '' and has not been cashed. I have requested five times to have Bayview request a STOP payment on check # XXXX in the amount of {$1000.00} and have it re-issued to either me, or now that XXXX XXXX XXXX owns the loan again, to them. I have sent a letter that instructs them to contact XXXX, at the XXXX County Assessors office XXXX. Her # is XXXX. Also to be put in the letter that any future refunds and or correspondence from the XXXX County CA, Assessors office - be transferred to XXXX XXXX XXXX, as if the next property tax appeal results are the same, they will be refunded to Bayview unless this is done in ADVANCE. I have another property tax appeal coming up and any future refunds need to be sent to XXXX XXXX XXXX, not Bayview Loan Servicing. The Mortgage interest statement from Bayview Loan Servicing and XXXX XXXX XXXX statements DO NOT MATCH and have conflicting figures. Both show different deferred interest amounts and loan balances. This needs to be corrected immediately as XXXX XXXX XXXX is requesting a $ 4800+ cushion in my account when I should already have {$2100.00} cushion in the account. This puts our payment in an uncomfortable amount financially and I do not want to default. Both banks will NOT RESPOND TO MY REQUESTS.
