Complaint: My account was transferred from XXXX to Bayview effective XX/XX/XXXX.At the time I had an excrow excess of {$1900.00}, On XX/XX/XXXX I called Bayview and spoke to XXXX XXXX and his superior regarding the escrow. I was a month behehind in the amount i of {$930.00}. It was agreed that this would be deducted from the escrow excess which would leave a balance of {$1000.00} owed to me, I was instructed to call customer service, which I did a week later. I spoke to XXXX ( he refused to give his last name ). In speaking to him, he gave me incorrect information, regarding my account. I was told the the trasfer had been made, however I have yet to receive the escrow balance. I have spoken to several people at Bayview and in each instance I have had to literally argue to correct misinformation regrding my account.I am frustrated and believe delaying tatics are being used to delay or deney the return of the escrow ( I was told that my escrow balance would take 30-60 days to be returned. Is the the norm?

Complaint: We started a loan modification XX/XX/XXXX. The person helping us is XXXX XXXX from Bayview which I think is a collection agency. First, I have submitted the documents 3 times and have been given 3 different reasons why My documents have not been reviewed and I missed the deadline and had to resubmit. I was never called about missing documents and every time I called XXXX XXXX he would say they were working on it and call back in a week. He also told me I had to be 4 months behind before I could apply which I was not comfortable with. Another collector called me in XX/XX/XXXX asking for a payment and I made a payment. Me XXXX said since I made a payment I had to wait another month which meant a total resubmit of all documents. I told him I was in fear of losing my Home he assured me that would not happen. I wanted to just forget about the modification and ask him how I could catch up. He told me I had to pay {$4500.00} them {$1800.00} a month which is approx {$500.00} more than my payment. I was stuck I had no choice but to resubmit for the 3rd time. I didnt have {$4500.00}. Them today I received a secure email from XXXX XXXX but it was meant for another person with MY documents attached. I can forward this email to you. This may be why I have never received any email, text or phone call that I had missing documents. He has already shared personal financial information to me from another person, I dont feel secure with him or this Company but if I stop now my Home will go into forclosure. I have contacted XXXX XXXX with XXXX and she has submitted my documents for the third time but now because of XXXX XXXX and Bayview I am 4 months in arrears and could lose my home. I feel like he is purposely doing this to get my home because I ha e equity in it or he just does not k ow how to do his job. I am very concerned about losing my Home because of these issues caused by XXXX XXXX. All calls are Recorded so this can all be verified

Complaint: This is my email to Bayview Loan Servicing, Bayview Loan Servicing , LLC Customer Support XXXX XXXXXXXX XXXX XXXXXXXX XXXX, XXXXXXXX XXXX XXXXXXXX XXXX, FL XXXX Customer Relations Department at XXXX. Our hours of operation are Monday Friday XXXX XXXX to XXXX XXXX ET, and Saturday XXXX XXXX to XXXX XXXX ET. Loan Number XXXX Property Address XXXX XXXX XXXXXXXX XXXX, AZ XXXX Mailing Address XXXX XXXX XXXX, XXXX, AZ, XXXX, USA Interest Rate 11.2500 % OK, I have sought legal counsel on several issues. First, The property address is not XXXX XXXX XXXX XXXX, XXXX, Az XXXX. That was an office space I rented from XXXX until XXXX The correct site address is XXXX XXXX XXXX, XXXX, AZ XXXX. Make the necessary changes. Second, I reviewed the form XXXX and found a gross error that the Federal Trade Commission may be interested in. How is it I paid {$200.00} every two weeks, never missed a payment, and now I owe more at the end of XXXX than I did at the beginning of XXXX. I wonder how many mortgage payers are going to blindly pay the balloon you are creating. Thirdly, who is collecting the interest on the {$200.00} payments I am making until it is applied to the loan. That is my money, I expect that money to be applied as I pay it not held in your interest bearing escrow. Thus what are you doung with the extra payment a year I am making. I want to pay this not off not have you embezzle the interest you are earning at my expense. So, I more than request a full accounting of all payments applied when received and the EOY balance adjust downward where it should be. In the meantime, I will be filing a complaint to the FTC concerning your continued egregious inability at mortgage servicing. They sold the note to Bayview and Bayview has sold it twice more since yet maintain servicing provider. I have had nothing but trouble with Bayview. I need to pay biweekly ; it took me three tries before they figured out how to take biweekly payments. Yet, they do not apply the payments to the note when they receive the payments, They hold the payments in escrow until the regular payment is due. That means I am paying 30 days interest on a sustained balance instead of 15 days. I am not being credited the interest they are earning on my money they hold in escrow. Then, they increased the EOY balance by the difference of the interest I paid and the payments I made. They are creating a balloon payment situation that I will never be able to pay when it is due. That is one reason for the biweekly payments to reduce that end of contract balloon. These people took over servicing XX/XX/XXXX and continue to demonstrate their inability to properly service loan accounts. They should be shut down.

Complaint: For more than seventeen months, I been trying to obtain a loan mod with my current service Bayview mortgage, I explained and documented my hardship, however, servicer never works with me to find any reasonable solution. Recently my last submission was denied and servicer stated that was no loan mod possible to reduce my current mortgage payment. My intention since almost the beginning was to obtain assistance to bring my mortgage current, and NOT to reduce my mortgage payment ; I insisted on this particular point several times but looks that never it was considered by my servicer. Complaint: XXXX XXXX XXXX XXXX bought my mortgage loan effective XX/XX/XXXX and sold it effective effective XX/XX/XXXX to XXXX XXXX XXXX. I sent a RESPA QWR to Bayview requesting the production of documents surrounding the change of creditor/ownership and mortgage servicing transfer, on XX/XX/XXXX and again on XX/XX/XXXX. Bayview/XXXX XXXX response was basically they didn't have to answer because XXXX XXXX no longer owns the loan. While the mortgage servicing was somehow cancelled after effective date the loan was with XXXX XXXX XXXX for several days thus I believe XXXX XXXX must answer my outstanding RESPA requests.

Complaint: On XXXX XXXX my feelings were all over the place. I felt angry, deceived, and disrespected. I made an error on Complaint ID # XXXX and Im writing to correct it. My Loan Modification was approved on XX/XX/2018 and not XX/XX/2018, sorry about the error, but these 6 months dealing with XXXX XXXX XXXX has been pure XXXX. It was XX/XX/2018 when I received the call from XXXX XXXX claiming they didnt receive my XXXX payment. My XX/XX/2018 Payment was sitting in a Suspense Account. After praying to XXXX about all the chaos Im going through with XXXX XXXX XXXX, I realize this battle is not mines, its the Lord. I pray for all the people involved in wrongdoing, because I know that no good deed goes unpunished.
